    ZAŠTITA ŽIRANATA U FEDERACIJI BOSNE I HERCEGOVINE

    U FBiH je 2013. godine usvojen Zakon o zaštiti žiranata koji je stupio na snagu 18.12.2013. godine. Radi se o lex specialis zakonu kojim se reguliše pravna zaštita žiranata kao posebne katergorije lica kod ugovora o kreditu. Međutim, ovaj zakon predviđa brojna rješenja koja značajno odstupaju od opštih pravila obligacionog prava, a naročito odredbama ZOO kojima se uređuju ugovor o kreditu i ugovor o jemstvu. U ovom radu razmatraju se pojedina rješenja iz Zakona o zaštiti žiranata i analizira njihova neusaglašenost sa opštim pravilima obligacionog prava, jer je evidentno da se postojećim rješenjima u Zakonu o zaštiti žiranata, u stvari, potencijalno vrši dekonstrukcija određenih obligacionopravnih instituta. Definicija ugovora o kreditu, kako je utvrđena u pomenutom zakonu, odnosno posebno uređenje odnosa između povjerioca i jemca u značajnoj mjeri odstupaju od opštih pravila obligacionog prava i u tom smislu predstavljaju rješenja koja nisu kompatibilna institutu jemstva – njegovim opštim pravilima, strukturi i vrstama jemstva. Pored toga, predviđena su posebna ograničenja slobode ugovaranja za lice koje namjerava da jemči za obavezu glavnog dužnika iz ugovora o kreditu. Autori u ovom radu upravo preispituju opravdanost i prihvatljivost ovih rješenja, kako sa stanovišta ostalih zakonskih propisa kojima se uređuje ova materija pravnih odnosa, tako i sa stanovišta domaće pravne tradicije, a u cilju pronalaženja odgovora da li su razmatrana rješenja harmonizovana sa ostalim pozitivnim zakonskim propisima i da li su u funkciji pravne sigurnosti.     Formation of the International Sales Contract under the Vienna Convention and the other Sources of Sales Law of Croatia

    Abstract: The development of international trade led to the necessity of equalizing the legal mechanisms for regulating legal relations, arising from international trade transactions. Increasingly important role of international trade questions national trade laws because they often do not meet the needs of international trade, and the problems particularly arise when a dispute arises with an international element. As the needs of trade are changing, the trade practice changes as well. Increased overseas trade highlights problems arising from the diversity of national legislative even more. By concluding the contract, parties reveal that they were led by different legal standards and practices. In this sense, there have been attempts to equalize mentioned legislation in order to create legal certainty and to reduce unnecessary costs related with the conclusion of contracts by an unknown law and the crown of these efforts is United Nations Convention on Contracts for the International Sale of Goods Act 1980. Writers domestic law that regulate this matter have a number of advantages over writers of conventions. Namely, they operate in developed legal system, with a rich jurisprudence, and if they want to integrate new legal institutes from foreign legislation, it may easier to do than when it comes to international document.     Transposition of the Directive 2011/83/EU on consumer rights - A challenge to national legislators

    Abstract: In the area of European contract law legal area most affected by the process of harmonization, and consequently the process of revision is the area of consumer protection. Because in the last few decades most intense legislative activity is manifested in the adoption of consumer directives. Transposing consumer directives member states have recognized the opportunity of their own economic development, since the improvement of trade is only possible if consumers enjoy the same rights no matter where in the territory of the European Union conclude contracts . This paper is focused on new horizontal instrument of European consumer law, Directive 2011/83/EU on consumer rights. Directive 2011/83/EU is a pioneering step towards building a coherent European consumer protection law, and in this light will be indicated the problem questions that arise in the process of harmonization of regulation Member States with Directive 2011/83/EU, keeping in mind the maximum harmonization clause. Also critically will be considered the process of harmonization of positive legislation with the Acquis in the field of consumer protection

    ARGUMENTATION AND POLITENESS STRATEGIES FOR ENHANCING CRITICAL LITERACY COMPETENCE IN C1/C2 STUDENTS OF SPANISH AS A FOREIGN LANGUAGE

    This work, proceeding from Ivanovic (2015), focuses on the linguistic manifestations of argumentation and politeness in expressing different points of view and how they can be applied in teaching Spanish as a FL to advanced level students according to the CEFR (2001) which suggests the critical interpretation of texts in levels B2/C. For proving this proposal, columns published in two Spanish newspapers with different political orientation: progressive, El País (Carlos Boyero and Maruja Torres), and conservative, ABC (Antonio Burgos and Ignacio Camacho) were analyzed. Both the content and the strategies used by columnists have a persuasive goal and are considered materials that encourage students to think about social issues and trigger meaningful discussions. Previous studies have shown that, on the one hand, argumentation is a way of being polite because it justifies communicative goals and is a way of collaborating with the speaker, and, on the other hand, politeness can be considered as a tool for argumentation (Fuentes, 2009: 117, 125). It is supposed that (im)politeness is an argumentative technique that can add value and convince the speaker of something (Alcoba and Poch: 2006, 2010). Therefore, the aim of this paper is to approach Critical Literacy studies and develop critical literacy competence in C1/C2 students of Spanish as a FL focusing on argumentation and politeness strategies. In order to achieve that, as proposed in Goethals (2011), it is essential to enable students to identify different components of each text (text organization), to interpret its functional exponents and functions of certain strategies. In that sense, to adopt critical approach towards media discourse and to be able to interpret the underlying messages it is necessary to emphasize the importance of the following aspects to the B2/C students of Spanish as a FL: argumentation and politeness strategies used in columns and its significant exponents because it can allow us to show whether these manifestations of argumentation and politeness depend on ideology or rather on the personal style of each author

    THE EFFECTS OF INTEGRATED FFI AND ISOLATED FFI ON THE ACQUISITION OF THE ENGLISH PAST TENSE

    This paper presents the results of a classroom-based study which I conducted for my PhD thesis. It is an experimental study on the comparative benefits of Isolated and Integrated FFI in primary EFL education. Greek 5th year primary learners aged 10-11 were exposed to Integrated FFI (n= 75) on the English Past Tense and their learning gains were compared to the gains of their peers who were exposed to Isolated FFI (n = 73), as these were first defined by Spada and Lightbown (2008). Integrated FFI was operationalised as the provision of comprehension and production structure-based communicative tasks; that is, tasks that were especially crafted to provide meaningful contexts for the practice of the English Past tense and its progressive aspect. In completing those tasks, learners focused on comprehension and the expression of meaning while they produced the target structures and received corrective feedback on their errors. Isolated FFI was operationalised as the explicit presentation and meta-linguistic explanations of the rules that govern the formation and use of the same target structures, coupled with grammatical consciousness-raising tasks, structural grammar exercises and controlled oral and written production activities. I taught the groups myself as a teacher researcher throughout the intervention, which lasted for 12 hours. The two groups were tested four times; each test was given after completing six hours of treatment and two months after the end of the intervention. The tests included grammaticality judgments, multiple-choice tests, tense formation tests, an open cloze, a question formation task, picture description, sentence matching and text completion tests. I will present the results of the statistical analyses from the comparisons of these groups. One suggestion is that, planned Integrated FFI targeting specific structures in context, if applied consistently for some time, produces equivalent learning gains to Isolated FFI even for elementary-level EFL learners whose opportunities for productive use of the language are generally limited within the classroom context

    The difference between modernism and postmodernism is difficult to make, but we take as a reference the hypotheses of well-known literary theorists and critics like Terry Eagleton, Pavao Pavliçiç, Roland Barthes, Michel Foucault, Jacques Lacan, Gerard Genette, TzvetanTodorov, JurijLotman Julia Kristeva, MiekeBaletc, a hypothesis of the canadian theorist Linda Hachion, as far as my opinion is concerned is very straightfoward and rational, as far as the definition of postmodern art is concerned, where she sees it as a field where the presence of the past in context of the critical reflex over it, dominates. The poetics of postmodernism is the result of the concept of the domination of irony, the contraverse role, great aesthetic, ideological, substantial paradoxes, the post-modern work of art as such represents a subversive and contraversial phenomenon, that builds and ruines the same phenomena it provokes and raises. Unlike previous currents of art, in postmodernism we have the elements of idelogical and gender movements. Postmodernist writers are: Borges, Marquez, Buzzati, Umberto Eco etc. And it is Umberto Eco’s “The name of the Rose” (Ilnomedellarosa) that is the subject of my study, with a new substantial, ethical, aesthetic, ideological, religious form. In the epilogue of the novel Eco uses the phrase “revisiting tradition” because the past, according to the author cannot be undone but it rather needs to be revisited with irony and not innocence, to highlight the dissension within the head of the church, that in the name of triumph of an idea crimes are commited in an abbey and the epicenter of the occurences is the library rich in ancient and modern texts. The references of our study were libraries, interviews, newspapers, raports and studies published in the internet as well as scientific journals

    HEMINGWAY AND KADARE - A COMPARATIVE OUTLINE

    In this article I tried give a comparative view between two great novel writers, who belong to different nations, cultures and periods, Ernest Hemingway and Ismail Kadare. Both of them are the greatest representatives of their own national literature, and both are part of the world elite literature, translated in more than 40 languages, and internationally awarded. Similarity between Hemingway and Kadare can be noticed not only in their literary works, but in their political ideology as well. I analyzed some of their novels, and in this paper I pointed out some similarities and differences in themes, characters, style, narration etc. Hemingway’s novels that I cover in this paper are Farewell to Arms, For Whom the Bell Tolls, Islands in the Stream, Moveable Feast and Old Man and the Sea, as long as Kadare’s novels are: Chronicle in Stone, General of the Dead Army and November of a Capital City. As a result, I noticed that these two authors have many things in common, their relation to Paris, their political ideology, and in their novels we can notice similar characteristics in their characters - their heroes represent moral values; themes - both of them write about war, love, social issues, etc; naration, style, etc. So, no matter Hemingway and Kadare distant in time and place, there are some touching points between them

    TERMINI OZNAČAVANJA "BASME /BAJALICE" U SAVREMENOM GRČKOM JEZIKU

    Βajanje, basma, bajalica are the serbian words that belong to the circle of magical terminology. Interesting is the comparative approach that compare the Serbs and the Greeks at the linguistic aspect. Βajanje is seen as a magical behavior which aims to make a change in the desired direction. As a rule, the basis of this behavior makes a voice part - specific language formula, shorter or longer, which is usually called by Serbs basma. In the literature the Serbs use the word bajalica as a synonym for the basma , term that in Serbian is used as a common name for a person who is engaged in chanting, and it is usually a woman. Greek for bajanje use the term καταδέσμος, while for the basma they have more terms: κατάδεσμος, μαγεία, μαγγανεία, γητειά / γήτεμα, ξόρκι, and επωδή. Based on these findings, we see that the Greeks „bajanje“ use the above terms and that as a marker for the same action and as a result of these actions they have “ basme, bajalice”. In the case of the Greek’s terms we can make a classification on the basis of objective magic spells that act on the content and those can be as follows: 1. positive or negative for achieving any goal, whether good or bad - κατάδεσμος, μαγεία, μαγγανεία. We must draw attention to just κατάδεσμος and μαγγανεία are basme with negative content and operation. 2. those that are used for the treatment and reject evil ξόρκι, επωδή while γητειά / γήτεμα may be to invoke the rejection of evil, so for healing and for love

    An Empirical Analysis of Real Deposits in Nigeria

    Abstract: The difference between estimated parameters of money supply and currency-deposit ratio is used to examine the behaviour of real deposits in Nigeria between 1960 and 2012. This is done using unrestricted error correction modelling within the bounds testing approach to cointegration proposed by Pesaran et al. (2001). Our findings revealed that inflation, real income and interest rates remain major factors influencing real deposit dynamics in Nigeria. Interestingly, financial innovation measured by the ratio of credit to the private sector and GDP was found to increase real deposits by 0.014% while the shadow economy accounted for the 0.96% fall in real deposits recorded. While interest rate and inflation remain quantitatively important in explaining long-run real deposit behaviour in Nigeria, our finding further underscores the need for monetary authorities to mainstream the informal sector into the financial system given the significant negative influence the shadow economy exerted on real deposi
