The constitutionality control in the Greek legal order: a European country which follows the American system!
Although geographically it belongs to Europe, as far as the constitutionality control of the statutory provisions is concerned, Greece follows the American system. That means that there is no Constitutional Court and, on the contrary, every court (even those of first instance) are entitled, and indeed obliged, to control the constitutionality of the laws (Articles 87 par. 2 and 93 par. 4 of the Greek Constitution). The Greek Courts examine only the substantial and not the formal constitutionality of the statutory provisions. If a court comes to the result of the unconstitutionality, then the statutory provision is not annulled and removed from the legal order, but it is not applied by the court in the relevant court procedure. The only – rather rare – case where a statutory provision is erga omnes annulled is when this is ordered by a decision of the Highest Special Court (Article 100 of the Greek Constitution), following a disagreement between two of the three highest Courts, namely between Symvoulio tis Epikrateias (highest Administrative Court), Areios Pagos (Cassations Court in Civil and Criminal procedures) and Elegtiko Synedrio (Court of Audit).
The presentation is going to examine the origins of the Greek system of the constitutionality control. It will also focus on the advantages and disadvantages of the Greek system and on the scientific and political discussion. Last but not least, the presentation will examine the role of the Council of State, which, although formally not a Constitutional Court, in practice issues the vast majority of the court decisions which accept the unconstitutionality of statutory provisions

Die vorliegende Arbeit geht von der These aus, dass die Zeitthematik in ihren unterschiedlichen Aspekten eine konstitutive Rolle in Strauß" bis dato erschienenem Werk spielt und dass Strauß frühzeitig beginnt, einen eigenständigen Zugang zu dieser Problematik zu erkunden, der, ausgehend von der Alltagserfahrung, vor allem die Bereiche der Naturwissenschaften und Ästhetik einschließt. Die Kernphase dieser Aneignung wird dabei in einer über zehnjährigen Schaffensperiode in Strauß" früherem Werk verortet, in der Begrifflichkeiten aus diesem Komplex stark gehäuft auftreten. Sie lässt sich anhand von vier zentralen Werken umreißen: "Paare, Passanten", "Der junge Mann", "Die Zeit und das Zimmer" und "Beginnlosigkeit". Dabei liegt ein Hauptaugenmerk darauf, den oft tastenden, experimentellen Charakter der oft fragmentarischen Texte in einen Gesamtzusammenhang zu stellen und der chronologischen Entwicklung von Strauß" Zeitbegriff zu folgen. Als Ausgangspunkt wird ein fundamentales Ungenügen identifiziert, das der Autor in "Paare, Passanten" schrittweise anhand von Alltagsbeobachtungen konkretisiert. Strauß zeichnet hier das Bild des "Gegenwartsnarren", der in seiner beschleunigten, medial dominierten Umgebung zunehmend in die Rolle des passiven Konsument eines Informationsüberangebotes gedrängt wird. Er zieht den flüchtigen Reiz der wechselnden Bilder dem Ergründen von Sinnzusammenhängen vor und verliert dabei letztlich seinen Bezug zur Geschichte. Sowohl zu seiner eigenen, individuellen Herkunft als auch zum gemeinschaftlichen Narrativ, das zwischen den Schrecken von Holocaust und drohender atomarer Vernichtung eh bereits einen großen Teil seines sinnstiftenden Potenzials eingebüßt hat. "Der junge Mann" baut auf diesen Befund auf und verschreibt sich der Erkundung eines "neuen Zeitempfindens", das es ermöglichen soll, unsere moderne Lebenswelt in ihrer Beschleunigung und oberflächlichen Divergenz wieder als sinnerfüllt wahrzunehmen. Die Analyse der Einleitung und ersten Romankapitel zeigt, wie Strauß dazu zunächst tradierte Zeitbegriffe radikal hinterfragt und letztlich in Auseinandersetzung mit den Naturwissenschaften ein eigenes Konzept entwickelt, das er in der Folge erprobt. Anknüpfend an die Syntheseansätze von Arthur Eddington verbindet Strauß Erkenntnisse aus der Relativitätstheorie, der Thermodynamik, der Komplexitätstheorie und Kybernetik zu einem Ganzen, das der als zu eng empfundenen linearen Progression ein vielschichtiges Modell entgegensetzt, das auch Stillstand, zyklische Wiederkehr sowie zeitweilige Verjüngung und Rückläufigkeit als Konstituenten zeitlicher Abläufe begreift. Die spezielle Relativitätstheorie räumt dabei mit der Vorstellung einer absoluten physikalischen Zeit auf, die gleich einem universellen, transzendenten Uhrwerk der Welt ihren Takt und ihre Richtung aufzwänge. Sie begreift Zeit und Raum als Verhältnisse, in denen die Ereignisse zueinander stehen und die letztendlich den Dingen selbst entwachsen. Einen kontinuierlichen, gerichteten Fluss der Zeit kann die Relativitätstheorie nicht verbürgen; diese Lücke versuchen Physiker in Anschluss an Eddington mit dem Hinweis auf die Thermodynamik zu schließen. Nach deren zweiten Hauptsatz müsste das Universum als geschlossenes System einer stetigen Entropiezunahme unterliegen, die letztlich den Strom der Zeit konstituiere. In diesem globalen Fluss, und hier beruft Strauß sich auf die Komplexitätstheorie, gibt es jedoch immer wieder lokale Abweichungen und gegenläufige Entwicklungen. Strauß baut auf diesen Überlegungen auf und integriert sie tief in seine eigene Ästhetik. So greift der "Junge Mann" in seinen Erzählstimmen und in der Figurenrede nicht nur häufig Gedanken und Bilder aus der wissenschaftlichen Debatte auf, die ganze Struktur des Romans lässt sich als ein solcher Wechsel zwischen linear-gerichteten Rahmenstrukturen und divergenten Binnenelementen verstehen. Dieses Verfahren, naturwissenschaftliche Aspekte der Zeitthematik in der künstlerischen Form aufgehen zu lassen, baut Strauß in den nächsten Jahren weiter aus, wie die Arbeit exemplarisch an zwei weiteren Werken zeigt. "Die Zeit und das Zimmer" etwa zeugt in seiner ganzen Anlage von einer Auseinandersetzung mit der Quantentheorie und dem "Viele-Welten-Modell". Hier wird im fiktionalen Raum eine Welt erforscht, in der die Entscheidung zwischen mehreren Möglichkeiten keinen ausschließlichen Charakter mehr hat, sondern mehrere Alternativversionen eines Lebenswegs parallel zueinander koexistieren. "Beginnlosigkeit" schließlich entwirft analog zur "Steady-State-Theorie" eine Ästhetik, die ohne Anfang und Ende auskommt und deren "Botschaft" letztlich in die Textgestalt eingeschrieben ist. An Stelle einer linear-diskursiv aufgebauten Erzählung tritt ein Verbund von fragmentarischen Textblöcken, der zunächst inkohärent wirkt, aber durch lose thematische Bezüge, vor allem aber auch durch assoziative Anklänge und leitmotivisch wiederkehrende Bilder immer wieder auf sich selbst vor- und rückverweist. Dem Leser, der sich auf diese Textbewegung einlässt, offenbart sich im Vor- und Zurückblättern die gewünschte Leseerfahrung: Sinnkonstitution erschöpft sich nicht in einer linear-progressiven Verkettung von Vorher und Nachher, von Ursache und Wirkung. Erst wenn die "Linie" durch den "Fleck" ergänzt wird, d.h. durch Elemente des Richtungslos-Assoziativen, des Zyklus und selbst der Stase, ist eine Erkenntnishaltung erreicht, die der Vielschichtigkeit unserer Lebenswelt gerecht wird. Strauß" Projekt eines "neuen Zeitempfindens" ist damit zu einem vorläufigen Abschluss gekommen. Die Naturwissenschaften dienten dabei als zentrale Inspirationsquelle und gaben einen Erkenntnisstand vor, hinter den der Autor nicht zurückfallen wollte; letztlich gehen sie jedoch weitestgehend in ästhetischer Form auf.The present dissertation is based on the thesis that the subject of time in its various aspects plays a constitutive role in Botho Strauß' work as published so far, and that Strauß early on begins to explore his own independent access to this problem, starting from everyday experience and reaching out to the domains of natural sciences and aesthetics. The core phase of this appropriation spans more than ten years within Strauß" earlier period of creation in which terms from this range of topics occur particularly frequently. It is demarcated by four central works: "Paare, Passanten", "Der junge Mann", "Die Zeit und das Zimmer" and "Beginnlosigkeit". The main focus here lies in putting the often tentative, experimental character of the individual work into an overall context and to follow the chronological development of Strauß" concept of time. As a starting point, a fundamental dissatisfaciton is identified, which the author gradually substantiates in "Paare, Passanten" on the basis of everyday expercience. Here, Strauß paints the picture of the "Gegenwartsnarr", who is increasingly being pushed into the role of a passive consumer of an informational overabundance in his accelerated, media-dominated environment. This "fool" chooses the fleeting charm of the changing images over the exploration of meaningful connections and ultimately loses his connection with history " both with his own individual origin as well as with the collective narrative, which, stuck between the horrors of the Holocaust and the threat of atomic destruction, has already lost a great deal of its potential to provide orientation. "Der junge Mann" builds upon these findings and devotes itself to the exploration of a "new sense of time", which is to enable us to find meaning in all the acceleration and superficial divergence shaping our daily life. The analysis of the introduction and the first chapter of the novel shows how Strauß radically questions traditional concepts of time, and ultimately develops a concept of his own, which he then tests for its suitability. Drawing on the synthetic approaches of Arthur Eddington, Strauß merges insights from the theory of relativity, thermodynamics, complexity theory and cybernetics. He thus creates a complex model of temporal processes which counteracts the all too restrictive concept of linear progression, and gives room to phenomena such as standstill, cyclical recurrence as well as temporary rejuvenation and retrogression. The special theory of relativity does away with the idea of an absolute physical time which, like a universal, transcendental clockwork, imposes its pace and direction on the world. It comprehends time and space as relationships describing how events interconnect, as categories which ultimately emerge from the objective world itself. The theory of relativity cannot vouch for a continuous, directed flow of time; a gap physicists since Eddington have been trying to close with reference to thermodynamics. According to the second law of thermodynamics, the universe, as a closed system, would have to undergo a constant increase of entropy, which ultimately constitutes the current of time. In this global flow, however, there are always local deviations and contradictory developments, as Strauß has learned from complexity theory. Strauß builds upon these considerations and integrates them deeply into his own aesthetics. Thus, "Der junge Mann" not only frequently picks up thoughts and images from the scientific debate through its narrative voices and characters" discourse. More importantly, the whole structure of the novel can be understood as an oscillation between elements of the linear, progressive narrative framework and divergent embedded narrations. Over next few years, Strauß will continue to explore this technique of transforming scientific aspects of the concept of time into his own artistic form, as my thesis exemplifies by way of two further works. "Die Zeit und das Zimmer", for instance, testifies by its whole structure to the author- intense pursuit of the quantum theory and its "many-worlds interpretation". Here, a world is being explored in the sphere of fictionality, in which a decision between several possibilities no longer has an exclusive character, but several alternative versions of a life path coexist. "Beginnlosigkeit", in analogy to the "steady state theory", finally creates an aesthetic that manages without beginning and end and whose "message" is ultimately inscribed in the textual form. Instead of a linear-discursive narrative, the text presents itself as an interweaving of fragmentary segments. Seemingly incoherent at first, these sections prove to be tightly interconnected, constantly referring back and forth by means of thematic references, and even more so by associative connections and images recurring as leitmotifs. Thus, whilst scrolling to and fro, the desired reading experience comes to pass for those who allow themselves to fall in with this textual movement: constitution of meaning does not exhaust itself in a linear-progressive chaining of "before" and "after", of cause and effect. Only if and when the "line" is completed by the "spot", that is, through elements of the directionless and the associative, of the cycle and even of the stasis, an attitude of awareness is reached that is suited to the complexity of our life-world. Strauß' project of a "new sense of time" has thus come to a provisional conclusion. The natural sciences served as a central source of inspiration and presented a state of knowledge beyond which the author did not wish to fall back; but ultimately they have completely merged into aesthetic form
Climate change impact on thunderstorms: Analysis of thunderstorm indices using high-resolution regional climate simulations
It is generally assumed that the temperature increase associated with global climate change will lead to increased thunderstorm intensity and associated heavy precipitation events. In the present study it is investigated whether the frequency of thunderstorm occurrences will in- or decrease and how the spatial distribution will change for the A1B scenario. The region of interest is Central Europe with a special focus on the Saar-Lor-Lux region (Saarland, Lorraine, Luxembourg) and Rhineland-Palatinate.Daily model data of the COSMO-CLM with a horizontal resolution of 4.5 km is used. The simulations were carried out for two different time slices: 1971"2000 (C20), and 2071"2100 (A1B). Thunderstorm indices are applied to detect thunderstorm-prone conditions and differences in their frequency of occurrence in the two thirty years timespans. The indices used are CAPE (Convective Available Potential Energy), SLI (Surface Lifted Index), and TSP (Thunderstorm Severity Potential).The investigation of the present and future thunderstorm conducive conditions show a significant increase of non-thunderstorm conditions. The regional averaged thunderstorm frequencies will decrease in general, but only in the Alps a potential increase in thunderstorm occurrences and intensity is found. The comparison between time slices of 10 and 30 years length show that the number of gridpoints with significant signals increases only slightly. In order to get a robust signal for severe thunderstorm, an extension to more than 75 years would be necessary

Randomized controlled trial to evaluate the effects of personalized prediction and adaptation tools on treatment outcome in outpatient psychotherapy: study protocol
Background: Psychotherapy is successful for the majority of patients , but not for every patient. Hence, further knowledge is needed on how treatments should be adapted for those who do not profit or deteriorate. In the last years prediction tools as well as feedback interventions were part of a trend to more personalized approaches in psychotherapy. Research on psychometric prediction and feedback into ongoing treatment has the potential to enhance treatment outcomes, especially for patients with an increased risk of treatment failure or drop-out.rnMethods/design: The research project investigates in a randomized controlled trial the effectiveness as well as moderating and mediating factors of psychometric feedback to therapists. In the intended study a total of 423 patients, who applied for a cognitive-behavioral therapy at the psychotherapy clinic of the University Trier and suffer from a depressive and/or an anxietyrndisorder (SCID interviews), will be included. The patients will be randomly assigned either to one therapist as well as to one of two intervention groups (CG, IG2). An additional intervention group (IG1) will be generated from an existing archival data set via propensity score matching. Patients of the control group (CG; n = 85) will be monitored concerning psychological impairment but therapists will not be provided with any feedback about the patients assessments. In both intervention groups (IG1: n = 169; IG2: n = 169) the therapists are provided with feedback about the patients self-evaluation in a computerized feedback portal. Therapists of the IG2 will additionally be provided with clinical support tools, which will be developed in thisrnproject, on the basis of existing systems. Therapists will also be provided with a personalized treatment recommendation based on similar patients (Nearest Neighbors) at the beginning of treatment. Besides the general effectiveness of feedback and the clinical support tools for negatively developing patients, further mediating and moderating variables on this feedback effectrnshould be examined: treatment length, frequency of feedback use, therapist effects, therapist- experience, attitude towards feedback as well as congruence of therapist-andpatient- evaluation concerning the progress. Additional procedures will be implemented to assess treatment adherence as well as the reliability of diagnosis and to include it into the analyses.rnDiscussion: The current trial tests a comprehensive feedback system which combines precision mental health predictions with routine outcome monitoring and feedback tools in routine outpatient psychotherapy. It also adds to previous feedback research a stricter design by investigating another repeated measurement CG as well as a stricter control of treatment integrity. It also includes a structured clinical interview (SCID) and controls for comorbidity (within depression and anxiety). This study also investigates moderators (attitudes towards, use of the feedback system, diagnoses) and mediators (therapists" awareness of negative change and treatment length) in one study
Biologische Kontrolle pflanzenpathogener Pilze und ihrer Mykotoxine als ökologische Dienstleistung der Bodenfauna in Agrarökosystemen unter konservierender Bodenbearbeitung zur Erhaltung der Bodengesundheit
In verschiedenen Labor-und Feldversuchen sollte geklärt werden, ob Schlüsselorganismen der Bodenfauna (Regenwürmer: Lumbricus terrestris; Collembolen: Folsomia candida und Nematoden: Aphelenchoides saprophilus) einen signifikanten Beitrag zum Abbau von phytopathogenen Schadpilzen der Gattung Fusarium und deren Mykotoxin deoxynivalenol (DON) in Ernterückständen leisten. Folgende Hypothesen sollten geprüft werden: (1) Fusarium-infiziertes und DON-kontaminiertes Pflanzenmaterial stellt für die eingesetzten Bodentiere ein attraktiveres Nahrungssubstrat dar, als nicht künstlich infiziertes Kontrollstroh; (2) Die eingesetzten Bodentiere fördern den Abbau von Fusarium-Biomasse und DON-Konzentration im Stroh; (3) Die Interaktion zwischen den Vertretern der Makrofauna, Mesofauna und Mikrofauna verstärkt die Reduzierung der Fusarium-Biomasse und der DON-Konzentration; (4) Die Bodentextur hat Auswirkungen auf die Abbauleistung der Tiere. Nach jeweiligem Versuchsende wurden in Stroh und Boden die Fusarium-Biomasse in Form von Fusarium-Protein-Äquivalenten (FPE) und die DON-Konzentrationen mittels der ELISA (Enzyme-linked immunosorbent assay)-Methodik quantitativ bestimmt. Außerdem wurde die Biomasse der Regenwürmer sowie die Individuenzahlen von Collembolen und Nematoden erfasst. Die eingesetzten Bodentiere fördern den Abbau von Fusarium-Biomasse und DON-Konzentration in Ernterückständen. Insbesondere Regenwürmer leisten einen wichtigen Beitrag zur biologischen Schädlingsbekämpfung. Die Interaktion zwischen Collembolen und Nematoden erwies sich unter Laborbedingungen als entscheidend für die Reduzierung der DON-Konzentration in Weizenstroh. Außerdem konnte unter standardisierten Laborbedingungen ein signifikanter Einfluss der Bodentextur auf die Abnahme von Fusarium-Biomasse und DON-Konzentration nachgewiesen werden. Im Freiland spielte die Interaktion zwischen Collembolen und Nematoden im Hinblick auf den Abbau von Fusarium-Biomasse und DON-Konzentration keine Rolle. Entscheidend für die Reduzierung war der alleinige Einfluss von F. candida oder A. saprophilus. Auch in Anwesenheit von Regenwürmern stellte sich der Einfluss von Collembolen und Nematoden auf den Abbau von Fusarium-Biomasse und DON-Konzentration als vernachlässigbar heraus. Die Interaktion führte nicht zu einem verstärkten Rückgang der Konzentrationen von Fusarium-Biomasse und DON. Hier war der Einfluss von L. terrestris in seiner Funktion als Primärzersetzer von entscheidender Bedeutung.Besides well-known positive aspects of conservation tillage combined with mulching, a drawback may be the survival of phytopathogenic fungi like Fusarium species on plant residues. This may endanger the health of the following crop by increasing the infection risk for specific plant diseases. In infected plant organs, these pathogens are able to produce mycotoxins like deoxynivalenol (DON). Mycotoxins like DON persist during storage, are heat resistant and of major concern for human and animal health after consumption of contaminated food and feed, respectively. Among fungivorous soil organisms, there are representatives of the soil fauna which are obviously antagonistic to a Fusarium infection and the contamination with mycotoxins. Earthworms (Lumbricus terrestris), collembolans (Folsomia candida) and nematodes (Aphelenchoides saprophilus) provide a wide range of ecosystem services including the stimulation of decomposition processes which may result in the regulation of plant pathogens and the degradation of environmental contaminants. Several investigations under laboratory conditions and in the field were conducted to test the following hypotheses: (1) Fusarium-infected and DON-contaminated wheat straw provides a more attractive food substrate than non-infected control straw (2) the introduced soil fauna reduce the biomass of F. culmorum and the content of DON in infected wheat straw under laboratory and field conditions (3) the species interaction of the introduced soil fauna enhances the degradation of Fusarium biomass and DON concentration in wheat straw; (4) the degradation efficiency of soil fauna is affected by soil texture. The results of the present thesis pointed out that the degradation performance of the introduced soil fauna must be considered as an important contribution to the biological control of plant diseases and environmental pollutants. As in particular L. terrestris revealed to be the driver of the degradation process, earthworms contribute to a sustainable control of fungal pathogens like Fusarium and its mycotoxins in wheat straw, thus reducing the risk of plant diseases and environmental pollution as ecosystem services
The Trial of the Jews in Trent: Preconditions - Proceedings - Consequences (1475-1588)
Die Ritualmordbeschuldigung ist eine von mehreren Anklagen, die in Westeuropa seit dem hohen Mittelalter immer wieder gegen Juden erhoben wurden. Da sie die am weitesten verbreitete unter ihnen war, wirkte sie in besonderem Maße prägend auf das Bild, das in der christlichen Mehrheit von der jüdischen Minderheit in Umlauf war. Der Trienter Fall spielt in diesem Kontext aus vielen Gründen eine herausgehobene Rolle. Die vorliegende Arbeit berücksichtigt alle wesentlichen Elemente des Prozesses, seine Entstehungsbedingungen sowie die Faktoren, die seinen Verlauf beeinflussten und seine weitreichenden Auswirkungen verursachten. Die Ursache für die große Resonanz des Prozesses liegt vor allem im Zusammentreffen der beiden sehr unterschiedlichen Entwicklungen der Judenfeindschaft im deutschen und im italienischen Raum. Die geographische und politische Lage des Fürstbistums Trient im Grenzgebiet zwischen venezianischem und habsburgischem, italienischem und deutschem Einflussbereich führte zu einer Reihe von einmaligen Umständen, die verantwortlich für den Verlauf des Prozesses selbst und auch für seinen ungeheuren Widerhall waren. Hinzu treten andere Faktoren im personellen und institutionellen Bereich und nicht zuletzt die Tatsache, daß mit dem Buchdruck ein völlig neues Medium der Verbreitung und Propaganda zur Verfügung stand, das hier erstmals in großem Umfang eingesetzt wurde. Im Rahmen der Rezeption des Prozesses spielte auch die Entstehung eines Märtyrerkultes für das angebliche Ritualmordopfer, den "seligen Simon von Trient", eine zwar begrenzte, aber keinesfalls zu vernachlässigende Rolle. Langfristig gesehen war es weniger der Kult, der die Bedeutung der Trienter Ereignisse ausmachte, als die Tatsache, daß die Geschichte Simons von Trient wegen ihrer großen Bekanntheit immer wieder als Bestätigung für die Existenz jüdischer Ritualmorde herangezogen wurde und als Vorbild für andere "Ritualmordmärtyrer" fungierte - bis ins 20. Jahrhundert hinein.The ritual murder libel is one of the charges repeatedly raised against Jews in Latin Europe since the high middle ages. As the most widespread among them, it had a particularly high influence on the images current among the Christian majority concerning the Jewish minority. The case of Trent plays a prominent role in this context. The present study considers all the elements of the trial, its preconditons and the factors at work in its course and its aftermath. The wide echo the judicial proceedings found can be explained by the particular meeting of German and Italian traditions of anti-Jewish sentiment. The geographical and political setting of Trent at the crossroads of Venetian and Habsburgian, Italian and German influences, produced those unique conditions which caused and influenced the trial and were responsible for its enormous echo. Other factors, too, are here considered, be they personal or institutional, as well as the fact that the invention of printing hat provided a new means of communication and propaganda, which was first used on a large scale in connection with the trial. The trial's reception was also supported to some extent by the rising cult of the "blessed Simon of Trent". In the long run, however, it was above all the widespread knowledge of Simon's story, which was taken time and again as "proof" of the veracity of Jewish ritual murders and as a model for other "ritual murder martyrs" - with a lasting impact, down to the early twentieth century
