No full textDie Bereitstellung der Energieversorgungssicherheit wandelte sich von einer staatlichen Auf-gabe über die Liberalisierung zu einer Aufgabe im Wettbewerbsmarkt, unterliegt aber weiter-hin der Daseinsvorsorge. Der Wettbewerb innerhalb der EU, die Kapazitätsmechanismen so-wie staatliche Beihilfen stehen im engen Kontext zueinander. Die Gewährleistung der Versor-gungssicherheit bedarf der Regulierung des Energiesektors als Ausdruck der Pflicht zur Da-seinsvorsorge des Staates ohne gleichzeitig den Wettbewerb auszuhebeln. Schwerpunkt-mäßig werden die vorhandenen Instrumente sowie die Kapazitätsmechanismen in Deutsch-land und in Mitgliedstaaten der EU vor dem Hintergrund einer CO2-neutralen Energieerzeu-gung unter verwaltungswissenschaftlichen, wirtschaftspolitischen und rechtlichen Aspekten erörtert. Dairy cattle welfare – the relative effect of legislation, industry standards and labelled niche production in five European countries
No full textThe only common European Union (EU) legislation set up specifically to ensure the welfare of dairy cattle is for calves. As a consequence, there is wide diversity in how dairy cattle welfare is ensured in EU countries. A few countries have legal requirements for dairy cattle welfare, while in others, it is left to industry standards or niche production requirements, typically linked to various premium labels. In this paper, we compared animal welfare provisions in dairy cattle production across five countries with different combinations of legislative and other approaches: Denmark, Germany, the Netherlands, Sweden, and the United Kingdom. Firstly, we aimed to map the diversity of animal welfare initiatives. Secondly, we used the Benchmark method of expert valuations and weightings of the relative importance of indivi-dual welfare provisions. We found that Denmark and Sweden have the highest level of dairy cattle welfare provisions as measured by the Benchmark method, partly due to high legisla-tive welfare requirements, followed by the United Kingdom, which has an extensive industry standard with very high uptake. Germany and the Netherlands, on the other hand, have lower levels of documented welfare provisions, and correspondingly a Benchmark score closer to a baseline defined by legal requirements at EU level. We also found differences in what elements of animal welfare were focussed on. Some initiatives emphasised fulfilling the social needs of cattle, while others focused more on space and freedom to move. Also, the countries with the highest Benchmark score had a relatively high level of production of orga-nic and other specialty dairy products. We found the effect of national legislation or ambi-tious industry standards on dairy cattle welfare to be much larger than previous studies have found in either pigs or poultry. At a time when the EU is considering stepping up its efforts to improve animal welfare in terms of common minimum standards, the results of this study could have important policy implications. The diversity in the level of dairy cattle welfare standards found across countries may speak in favour of having shared minimum standards, both at EU level and globally. However, even among countries with a similar Benchmark score, we found a difference in the kinds of welfare provisions at work, which may make full harmonisation of standards more challenging
Poder judicial nacional y primacía del Derecho de la Unión: A propósito de la sentencia del Tribunal Constitucional de Polonia K 3/21
No full textOn 7 October 2020, the Constitutional Tribunal of Poland declared the unconstitutionality of essential provisions of the Treaty on European Union, calling into question the principle of the primacy of EU law (judgment K 3/21). This decision is closely related to the Polish judicial reform that has been severely criticised by the CJEU for violating standards of judicial inde-pendence. This study first explains the process of political capture of the Polish Constitu-tional Court and then looks at the content of the K 3/21 judgment: the Polish Constitutional Tribunal attempt to reject the aforementioned case law of the CJEU on the grounds that the EU institutions have exceeded their competences. Secondly, this study aims to determine the extent of the Union’s competences in the area of the national judiciary, to explain the me-thods of resolving potential conflicts between national and EU laws and to analyse the conse-quences of the primacy principle. The key argument of this part of the article is that national judges have the faculty to examine, ex officio, the compatibility of a given national provision with EU law. This power cannot be limited by any national act, nor by the fact that there is a prior declaration of its constitutionality

liche Kosten-Nutzen-Analyse der Effekte. Vielmehr wurden vorwiegend die direkten Effekte beleuchtet. Diese Analysen stellen damit einen ersten Schritt in Richtung einer ausbalancier-teren und breiteren Diskussion über Kosten und Nutzen von Umweltregelungen dar
