    Relocation: Expression of Solidarity or State-Centric Cherry-Picking Process?

    This article deals with the relocation of international protection-seekers between EU Member States, an instrument originally intended as an expression of solidarity and protection of the most vulnerable claimants. It evaluates three relocation exercises (2009-2013, 2015, 2020), the Commission’s proposal for a regulation on asylum and migration management (RAMM), which amends the nature and functions of relocation, and the Declaration of a Voluntary Solidarity Mechanism signed by a group of Member States in June 2022. The paper concludes that, so far, relocation has been implemented in a way which is hardly compliant with the principle of non-discrimination or fair to international protection-seekers, in contrast with the principle of solidarity. This inevitably affects the efficacy of relocation as a tool of interstate solidarity for managing (potential) migration flows from conflict- torn countries, such as those concerning Afghanistan, Syria or Ukrain

    Building upon one of the latest examples of "hybrid tribunals", the Kosovo specialist court (Kosovo Specialist Chambers e Specialist Prosecutor’s Office), this paper aims to reflect on the effectiveness of the various forms of criminal internationalized justice for the protection of fundamental values of the international community safeguarding the human person, even when such instruments are established with an undeniable delay and meet the hostility of the same community they would help to reconcile. The investigation will lead to some considerations on the role that the creation of an internationalized court could have on the restoration of peace in Ukraine.Partendo da quello che rappresenta uno degli esempi più recenti di “tribunali ibridi”, la Corte specialistica del Kosovo (Kosovo Specialist Chambers e Specialist Prosecutor’s Office), il presente lavoro intende riflettere sull’efficacia di forme di giustizia penale internazionalizzate per la difesa dei valori fondamentali della comunità internazionale a tutela della persona umana, anche quando tali strumenti vengano costituiti con un innegabile ritardo ed incontrino l’ostilità della stessa comunità che vorrebbero contribuire a riappacificare.     Nel lavoro del collettivo di Priorità alla Scuola (PaS) e, nello specifico, del Tavolo Pedagogia e Didattica sono affrontati in chiave diacronica i grandi tempi dell’istruzione a partire dall’esperienza della piena crisi pandemica. Nel saggio si è voluta esplorare la dimensione dei valori educativo-pedagogici e quella degli strumenti, dei mezzi della didattica. Si è trattato di chiedere a un gruppo di insegnanti di ragionare sulle criticità della scuola a partire da quello che alunni, famiglie e docenti hanno vissuto nelle molteplici esperienze didattiche tenendo sempre in mente il faticoso percorso di inclusione scolastica di migliaia di generazioni.In the work of the Priorities to School (PaS) collective and of the Pedagogy and Didactics Table, the great times of education are addressed diachronically, starting from the experience of the full pandemic crisis. The essay sought to explore the dimension of educational-pedagogical values and that of the tools, means of didactics. It involved asking a group of teachers to reason about the critical issues of schooling from what pupils, families and teachers have experienced in the multiple educational experiences always keeping in mind the arduous journey of school inclusion of thousands of generations

    On the regularity of solutions of free boundary problems

    2021 - 2022Optimal design problems have aroused particular interest in the scientific com- munity over the past thirty years. In physics, for example, they find application in the investigation of the minimal energy configurations of a mixture of two materials in a bounded and connected open set. The fascination of such problems derives from their variational formula- tion, which involves not only the state function of a system, but also a shape, that is a set. If a penalizing contribution of perimeter form, due to a surface energy, is added to the integral mass energy, dependent on the configuration state-shape, the problem becomes even more intriguing and inspiring. It is not straightforward to investigate the regularity of minimizing pairs because the two energies have different dimensions under commong scalings: once a homothety of factor r is applied, the first energy “behaves” as a vol- ume (rescaling with factor r n ), the second as a perimeter (rescaling with factor r n1 ). The coexistence of the two types of energies is managed using techniques and tools of both the Calculus of Variations and the Geometric Measure The- ory. In the first part of this thesis we deal with two optimal design problems, in which the integral functions that constitute the mass energy have different growths. If their growth is at most quadratic, we prove the C 1,μ regularity of the interface of the shape that constitutes the optimal pair, up to a singular set of Hausdorff dimension less than n 1. The technique used combines the regu- larity theories of the Λ-minimizers of the perimeter and the minimizers of the Mumford-Shah functional. If the integrands have at most a polynomial growth of degree p, the anal- ysis becomes more involved. The C 1,μ regularity of the interface remains an open problem. However, it is proved that the optimal shape of the problem is equivalent to an open set with a topological boundary that differs from its reduced boundary for a set of Hausdorff dimension less than or equal to n 1. In the second part of the thesis we address to a completely different varia- tional problem, involving a frustrated spin system on a (one-dimensional and two-dimensional) lattice confined in two magnetic anisotropy circles. This topic is of significant scientific interest, as it is useful for understand- ing the behavior of low-dimensional magnetic structures existing in nature. The frustration parameter α ¡ 0 of the system averages the ferromagnetic and antiferromagnetic interactions that coexist in the energy. The minimal energy state of the system, for α ¤ 4, consists of a spin that “lives” within only one of the two magnetic anisotropy circles and has a positive or negative chirality. We find the correct rescaling of the functional and prove the energy needed to detect the two phenomena that break the rigid minimal symmetry described.     Utilizzando le categorie di Gert Biesta, gli autori fanno notare come l’opposizione fra «tradizionale» e «innovativo», così come quella tra «lezione» ed «esperienza» sia già di per sé stantia. Inoltre questa critica sembra avere poco mordente, perché anche laddove gli insegnanti parlino e gli studenti siedano in silenzio, in realtà, questi ultimi stanno comunque compiendo numerose azioni. L’approccio per «competenze», al contrario, dà per scontata la realtà e impedisce qualunque scoperta, visto che non si propone di sottoporla a una lettura critica e tanto meno di cambiarla. Quale dei due approcci è realmente conservatore?Using Gert Biesta’s categories, the authors point out that the opposition between «traditional» and «innovative» as well as that between «lecture» and «experience» is already stale. Moreover, this critique seems to have little bite, because even where teachers talk and students sit in silence, in reality, the latter are still performing numerous actions. The «competence» approach, on the other hand, takes reality for granted and prevents any discovery, since it does not propose to subject it to critical reading, much less change it.     The Indian performative space is a diverse and varied one. Historically and culturally, there have coexisted various forms of performances, be it the Sanskrit classical plays or the traditional performances emerging from the local or the community. Central to the aesthetics of Indian theatre and performance laid the 2000- year-old Nāṭyaśāstra, often compared to Aristotle’s Poetics. This paper will examine one such traditional performance, Rāmavijaya, belonging to the tradition of Ankiyabhaonas in medieval Assam and will locate it within the context of the Nāṭyaśāstra, the canonical guidebook to Indian dramaturgy

    2020 - 2021L’elaborato affronta il tema della partecipazione giovanile online attraverso l’analisi dell’incidenza della pandemia da Covi-19. Il tema della partecipazione giovanile è un tema trasversale che intreccia differenti prospettive teoriche e differenti ambiti della Sociologia: dalla sociologia dei gruppi, alla scienza politica, alla sociologia dei media. Le teorie sulla partecipazione hanno origini molto antiche. Le prime considerazioni sul tema si incontrano già nell’antica Grecia attraverso le opere di Aristotele e Platone, e il loro sviluppo giunge alle riflessioni di Marx e Tocqueville che si concentrano sulla partecipazione sia in termini di partecipazione civile che associazionismo, ma anche di associazionismo di settore. In questa parte dell’ elaborato si è deciso di adottare il punto di vista teorico di Gallino (1978) in riferimento alla sua definizione di partecipazione. Si è operata poi l’identificazione delle differenti tipologie partecipative, facendo riferimento ai dati pubblicati dall’ISTAT. Il concetto di partecipazione giovanile è stato così riletto attraverso differenti ambiti che pongono l’attenzione alla partecipazione civile e quella politica, all’associazionismo di settore, a quello ludico culturale. Dopo aver sviluppato un quadro generale delle differenti modalità partecipative, il lavoro si sofferma sull’analisi delle nuove generazioni e della loro partecipazione digitale. In questa sezione ci si è concentrati sulle dinamiche partecipative online attraverso alcune specifiche piattaforme di social network, portando all’attenzione su principali movimenti che hanno preso forma negli ultimi anni, come il movimento delle sardine. Quest’ultimo, è un chiaro esempio di come i movimenti dal basso, che si basano sulla partecipazione della società civile e diffusi sulle piattaforme digitali, siano le modalità partecipative che le nuove generazioni prediligono. Si è fatto riferimento all’e-governance e all’e-partecipation, ma anche alla disamina di J.Van Dajik (2020) sulla network society. Attraverso gli articoli di Sorice (2020), si è valutata la relazione fra le trasformazioni della sfera pubblica alla luce del processo sociale che viene definito «piattaformizzazione». Si è fatto, inoltre, riferimento a Castells (2006) e a Leone et al. (2016/2019) per quanto concerne la dieta mediatica dei giovani e soprattutto per gli aggiornamenti delle ultime ricerche in tema di partecipazione giovanile. Successivamente ci si è concentrati sulle modalità partecipative online delle associazione, degli enti del terzo settore e della società civile nel periodo più difficile della pandemia. Le dinamiche relazionali, a causa del covid e delle sue restrizioni, sono drasticamente cambiate. Aspetti della relazionalità che, precedentemente erano considerati normali, risultano attualmente essere un rilevante motivo di pericolo. A tal proposito, attraverso i riferimenti alle pubblicazioni di Fotino e Corposanto (2020), si è cercato di analizzare gli elementi che hanno caratterizzato il periodo della pandemia: il concetto di salute, quello di restrizione e il lockdown. Nel IV capitolo di questo elaborato si è presentata la ricerca svolta. Si è adottato il questionario elaborato per l’analisi della partecipazione del coordinamento provinciale di Salerno, ed è stato somministrato a gruppi di giovani della regione Campania. Successivamente si è proceduto con delle interviste, composte da adattamenti di item del questionario, somministrate a un campione ragionato di presidenti dei forum della regione Campania, e si è fatta successivamente l’analisi dei tre casi studio di progettualità portate avanti da ONG, per evidenziare tre ulteriori modalità partecipative. .. [a cura dell'Autore]The paper addresses the issue of online youth participation through the analysis of the incidence of the Covi-19 pandemic. The theme of youth participation is a transversal theme that intertwines different theoretical perspectives and different fields of sociology: from the sociology of groups, to political science, to the sociology of the media. Participation theories have very ancient origins. The first considerations on the subject are already encountered in ancient Greece through the works of Aristotle and Plato, and their development reaches the reflections of Marx and Tocqueville which focus on participation both in terms of civil participation and associations, but also of associations of sector. In this part of the paper it was decided to adopt the theoretical point of view of Gallino (1978) with reference to his definition of participation. The identification of the different types of equity investments was then made, referring to the data published by ISTAT. The concept of youth participation was thus reinterpreted through different areas that focus attention on civil and political participation, sector associations, and cultural play. After developing a general framework of the different kind of participation, the work focuses on the analysis of the new generations and their digital participation. In this section, we focused on online participatory dynamics through some specific social network platforms, bringing attention to the main movements that have taken shape in recent years, such as the sardine movement. The latter is a clear example of how grassroots movements, which are based on the participation of civil society and disseminated on digital platforms, are the forms of participation that the new generations prefer. Reference was made to e-governance and e-participation, but also to J.Van Dajik's (2020) discussion of the network society. Through the articles of Sorice (2020), the relationship between the transformations of the public sphere has been assessed in the light of the social process that is defined as "platforming". Reference was also made to Castells (2006) and Leone et al. (2016/2019) with regard to the way of use of young people and above all for the updates of the latest research on the subject of youth participation. Subsequently, we focused on the online participation methods of associations, third sector bodies and civil society in the most difficult period of the pandemic. The relational dynamics, due to covid and its restrictions, have drastically changed. Aspects of relationality that were previously considered normal, are currently a significant cause of danger. In this regard, through the references to the publications of Fotino and Corposanto (2020), an attempt was made to analyze the elements that characterized the period of the pandemic: the concept of health, that of restriction and the lockdown. The research carried out is presented in the fourth chapter of this paper. The questionnaire developed for the analysis of the participation of the provincial coordination of Salerno was adopted, and it was subjected to groups of young people in the Campania region. Subsequently, interviews were carried out, consisting of adaptations of items from the questionnaire, subjected to a reasoned sample of presidents of the forums in the Campania region and the analysis of the three project case studies carried out by NGOs was subsequently carried out, to highlight three further participatory methods. ..
