Italy as an unsafe place? The protection of migrants’ fundamental rights as a systemic issue in the dialogue between Courts: some recent developments
No full textThe purpose of this contribution is to develop a reflection on judicial
dialogue within the framework of migrants’ rights, moving from two recent
judgments adopted by the ECtHR and by the Dutch Council of State, both relating to
the violation of fundamental rights in Italy. While the former ruling held Italy
responsible for the violation of Article 3 and 5 of the ECHR by reason of the harsh
living conditions in the hotspot of Lampedusa, the second established that these and
other systemic deficiencies afflicting reception infrastructures preclude the transfer
to Italy of an individual requesting international protection. Following an
introduction and analysis of the two rulings, this article will delve into the
interconnection between them, with a particular emphasis on the potential emergence
of a "slippery slope" mechanism. In this context, the disruption of inter-state trust that
underlies the Dublin system tends to solidify the exclusion of a state (in this instance,
Italy) from the category of nations where the rights of migrants are considered
adequately protected

Get PDF2021 - 2022In our fast-changing world, management and marketing acquire a strategic relevance. They
become an important reference and support when it comes to making healthcare more effective,
efficient, and sustainable. A key contribution in achieving these goals is played by a systems
governance and management of healthcare (Pollard, 2016); hence, by the adoption of a systems
approach (Golinelli, 2000, 2010; Barile 2000, 2009).
Due to an ageing population and the growing number of patients with comorbidity, the
number of patients with chronical illnesses (for which there may not be a cure) is growing.
This situation highlights the need to define governance policies capable of ensuring the
sustainable development of the economic and social system through appropriate forms of
organization.
In this problematic context, a need to understand and interpret the complexity of service
systems and social phenomena using general schemes of interpretation, arises. Essentially, the
complex goal is to balance the effectiveness, efficiency and sustainability of service in the
governance of the healthcare system (Saviano, Bassano, & Calabrese, 2010). Accordingly, this
study aims to investigate the evolutionary trend of change that the Italian Healthcare System is
facing now in order to make healthcare service more effective, efficient and sustainable using
the lens of systems thinking as a valid interpretative support of complex phenomena.
On the basis of this premise and considering the widely agreed need of increasing
community care, especially experienced during the COVID-19 pandemic, more specifically,
this work aims to investigate the conditions of the effectiveness, efficiency, sustainability, and
also safety, of healthcare services while shifting from the hospital setting to community and
home care.
This shift is rich of implications and, although hospital care is in actual fact the highest level
of assistance in both structural and organizational terms, it may result much more complex to
effectively, efficiently and sustainably organize care at a community and home care, given the

quest’assunto, si tenta di mostrare che essa fu
determinata anche da ragioni politiche ed
editoriali. Vittorini, probabilmente, non comprese
subito le implicazioni profonde della polemica in
corso e la interpretò come un’opportunità per
rilanciare «Il Politecnico» e per segnalare a
Togliatti alcuni problemi interni alla cultura
comunista; lo scopo del Migliore, invece, era
quello di richiamare all’ordine lo scrittore
siciliano e i suoi collaboratori, troppo aperti a
nuove sperimentazioni culturali e troppo poco
attenti alle priorità del PCIThe controversy between Elio Vittorini and the

assumption, we try to demonstrate that it was
also determined by political and editorial
reasons. Vittorini probably did not immediately
understand the profound implications of the

point out to Togliatti some internal problems of
communist culture; the aim of the “Migliore”, on
the other hand, was to call the Sicilian writer and

Un’indagine intorno alla negazione nelle opere di Giovanni Duns Scoto
Get PDF2021 - 2022Lo scopo di questo lavoro è proporre una prima panoramica generale dedicata al tema della
negazione nel contesto delle opere di Giovanni Duns Scoto. La ricerca è stata impostata
tenendo conto tanto di esigenze storico-critiche quanto di linee di indagine teoretiche. Il
lavoro è strutturato in due sezioni, la prima delle quali presenta un’ampia analisi del tema
nel contesto dei Parva Logicalia, ricostruendone le vicende storiografiche, testuali nonché la
cornice logico-epistemologica da essi presentata (cap. I); si procede dunque a sviluppare
una mappatura della sintassi e della semantica delle espressioni negative (cap. II) ed
un’indagine circa la negazione come istanza di relazione (cap. III). Nella seconda sezione, la
ricerca viene estesa ad un insieme di testi seriori rispetto ai precedenti (commenti alla
Metafisica di Aristotele ed ai Libri Sententiarum di Pier Lombardo etc.). Essa risulta inoltre
orientata in funzione del concetto metateorico di ‘asimmetricalismo’ e coinvolge due
specifici casi di indagine, uno di natura teologica ed epistemologica (cap. IV), l’altro di
natura eminentemente ontologica (V), trattando rispettivamente i temi della conoscenza
negativa e della classe degli enti fittizi. Le conclusioni raggiunte evidenziano alcune criticità
interne al sistema presentato da Duns Scoto, quali ad esempio la tematica della restrizione
semantica in riferimento alla negazione infinitante, e permettono soprattutto di identificare
il ruolo cruciale giocato dal concetto di repugnantia, ad un tempo imprescindibile e
problematico. [a cura dell'Autore]This work aims at developing a first in-depth analysis about the topic of negation within the
philosophical and theological production of John Duns Scotus. This research has been
carried out resorting to two different approaches: (i) keeping a rigorous historical and
critical analysis of the writings while (ii) deploying recent conceptual tools, unbound to the
medieval speculation. The thesis is structured in two sections and five chapters according
to a chronological and thematic criterion, hence the first section is devoted to Scotus’ Parva
logicalia. (I) The first chapter displays both the historiographical and conceptual frame which
upholds the following analyses. (II) The topics of syntax and semantics of negative
expressions are then explored, endorsing a compositional approach over the complexity of
the linguistic items involved; (III) the understanding of negation as an instance of relation
is then addressed, specifically dealing with the concept of ‘opposition’. The second section
is instead concerned with some latter writings, such as the commentaries on the Metaphysics
and on the Libri Sententiarum, and pivots around the metatheoretical criterion of
‘asimmetricalism’. The specific instances of (IV) negative knowledge and (V) fictitious
beings are in fact developed in the last chapters, showing both the limits and the power of
Scotus’ asymmetricalistic claims. In conclusion, the work shows how negation is involved
in several crucial aspects of Scotus’ philosophical and theological system, sometimes
leading to inconsistencies. The concept of repugnantia, in particular, plays a fundamental
