قاعدة "العبرة في المعاملات بما في نفس الأمر لا بما في ظن المكلف" بيانها وتأصيلها وتطبيقاتها الفقهية
No full textيتناول هذا البحث دراسة قاعدة: "العبرة في المعاملات بما في نفس الأمر لا بما في ظن المكلف"، وهي قاعدة حظيت باهتمام المذاهب الفقهية الأربعة على اختلاف بينها في صياغتها، وهي إحدى القواعد المهمة التي تشمل مسائل كثيرة وتطبيقات واسعة أظهرت من خلالها رحمة الشريعة وسهولتها ورفقها بالمكلفين، وهي من دعائم الفتوى والقضاء، كما لها الأثر البالغ في تجلية الحكم الشرعي لبعض النوازل الفقهية التي لم تنص النصوص الشرعية على أحكامها، ما يدل على تناسق الشريعة الإسلامية في أحكامها ووضوح مآخذها وأصالتها. وقد ترتب على إعمال القاعدة أن تجمعت المسائل الفقهية مع نظائرها، وضمت الجزئيات على إثرها إلى مثيلاتها، فلم يفرق بين المتماثلات ولم يجمع بين المختلفات المتناقضات. وتهدف هذه الدراسة إلى بيان علاقة هذه القاعدة بغيرها من القواعد المشابهة لها في الظاهر، والتي هي بمثابة تخصيص لعمومها أو تقييد لمطلقها، وكذا هدفت الدراسة إلى كشف مواطن المفارقة بينها وبين قاعدتنا، وبذلك يصان الباحث من التناقض في الفهم، ومن الاضطراب في الحكم.Cette recherche examine la base: "Accreditation Dans Les Transactions Realite N’a Pas L’intention" Cette base a pris la bénédiction des quartes écoles doctrinales religieuses malgré leurs différences en sa formule, c’est l’une des bases qui comprend plusieurs questions et de larges classifications dans divers aspects religieux. Et même elle a un grand impact sur les manifestations des décisions légitimes islamiques dans les fléaux et les calamités religieuses dont les textes ne leur fournissent pas. Cela démontre la compatibilité de la "LOI islamique" dans ses décisions et la clarté des ses approches et même son originalité. Cette base fait rassembler les questions doctrinales avec ses homologues et l’annexer à ses particules et ses contreparties. Donc on n’a pas à différencier entre les homologues ou bien rassembler les contradictions. Cette recherche a pour but de clarifier la relation de cette base avec d’autres qui la ressemble en apparence et qui est soit une répartition de la totalité ou bien une restriction de l’absolu. Cette recherche cible la découverte de la différence entre notre base par rapport aux autres, ainsi le chercheur ne tombe pas dans des contradictions à en compréhension ou des troubles dans des jugements

No full textتهدف هذه الدراسة الى كيفية تصميم دورات اللغة الإنجليزية للأغراض الأكاديمية في كلية العلوم الإسلامية بجامعة باتنة 1 – الجزائر. في الواقع، إن تحليل احتياجات الطلبة في كلية العلوم الإسلامية هو واحد من متطلباتها الجوهرية، لأنه لم يتم تقديم أي أبحاث تجريبية في السابق لتحديد مواضيع مواد اللغة الانجليزية كلغة اجنبية في هذه الكلية. ويفترض أن النشاطات المقدمة لتدريس اللغة الإنجليزية غير كافية، لأنها لم تعد الطلاب بشكل كاف للاستفادة من قدراتهم لتحقيق النجاح في وسطهم الأكاديمي أو المهني. من ناحية أخرى فان احتياجات الطلبة التعليمية وتطلعاتهم لم تؤخذ بعين الاعتبار كما انهم لا يدركون الأهداف الحقيقية للدورة المقدمة لهم. و بالتالي تحليل الاحتياجات اللغوية للطلبة مع ما يترتب على ذلك من معلومات ومبادئ توجيهية لتخطيط دورات تدريس اللغة الانجليزية سيساعد اساتدة اللغة على اتخاذ القرارات الصحيحة فيما يتعلق بتدريس اللغة الإنجليزية للمتعلمين الذين يتخصصون في الدراسات الإسلامية.ولتحقيق هذا الهدف، فان هدا البحث يحاول تسليط الضوء على مفاهيم تحليل الاحتياجات والعديد من القضايا الأخرى ذات الصلة ككيفية اكتشاف الاحتياجات الخاصة للطلبة.و يحاول الاجابة على اسئلة مثل ما هي الاحتياجات وكيف يمكن تحليلها ؟ أي نوع من النظريات و ما هي المناهج التي تستخدم لمعالجة هذه المسألة ؟The scope of study of the present research is the design of English language courses for academic purposes in the faculty of Islamic studies at Batna1 University, in Algeria. As a matter of fact, needs analysis in the faculty of Islamic Studies is one of its substantial requirements, since no empirical research has previously been provided to determine the thematic of ELT/EFL material at this faculty. Materials offered in English teaching is thought to be insufficient, for it did not adequately prepare the students to virtually make use of their language capabilities to succeed in their academic or professional milieu. Moreover, neither their learning needs, wants and interests are taken into account nor they are aware of the genuine objectives of the course. Subsequently, the analysis of the learners’ language needs would be created with a consequent information and guidelines for the planning of ELT courses for teachers and language course designers; and would help them to make the right decisions with respect to teaching English to learners majoring in Islamic Studies.Therefore, to achieve this objective certain issues need to be investigated. The current research attempts to shed light on the concepts of needs analysis and many other relevant issues. It will consider how to discover the particular needs of learners requiring English for Academic purposes. What are needs and how can they be analyzed? What kind of theories; or what approaches have been used to handle this issue
The Cultural Script Approach: A Praxis Of An Intercultural Pragmatic Oriented Pedagogy
No full text use of the language system in “social encounters between human beings who have different first languages but communicate in a common language, and, usually, represent different cultures” (Kecskes, 2010). Many foreign language researchers have recently been trying to find out ways to implementing the concept in foreign language pedagogy. Yet, in the lack of longitudinal studies, little is known about how learners can upgrade their intercultural pragmatic competence in instructional settings. Latterly, some researchers (Wierzbicka, Goddard and Ameka, to name only few) theorized that one way to attain such an objective is the instruction using the cultural scripts, an approach for “articulating cultural norms, values, and practices” (Wierzbicka and Goddard, 2007) by dint of the Natural Semantic Metalanguage technique. Through a one group pre-test post-test design, a discourse completion test, targeting specifically the speech act of requesting, is administered (prior then subsequent to introducing the Anglo-script of personal autonomy) to fifteen master’s students, department of English, University of Khenchela. The findings demonstrate that a cultural scripts-based instruction can qualitatively promote the respondents’ Intercultural requesting strategies, and so, provide a practical groundwork for Intercultural pragmatics pedagogy

No full textتولى البحث إماطة اللثام عن فكر العلامة محمد بن الحسن الحجوي في مقاصد الشريعة من خلال كتابه الشهير: (الفكر السامي في تاريخ الفقه الإسلامي). حيث نجده يخوض في قضايا كثيرة مقاصدية، على غرار المتقدمين. ويحرر مجموعة من قواعد هذا الفن، من شأنها أن تبوئه مكانة مرموقة ضمن علماء مقاصد الشريعة المعاصرين؛ كمحمد الطاهر بن عاشور وعلال الفاسي وغيرهما. كما سعى البحث إلى إيراد طائفة من تعليلاته لبعض الأحكام الشرعية؛ يظهر منها تمكن الرجل من الغوص على أسرار الشريعة، واكتناه حكمهاThe study aims to divulge the thought of the scholar Mohamed Ben Al-Hasan Al-Hajouiconcerning the purposes of jurisprudence, based on his well-known book (Noble Thought in the History of Islamic Jurisprudence). In this treatise we find him delving in multiple purpose-related issues, following his predecessors. He elaborated a set of rules for this art. Rules that promise to give it a prestigious status among contemporary scholars that specialize in this field, such as Ibn Ashour and Allal Al-Fassi and others. The paper also aims to discuss a range of his justifications for jurisprudence provisions that show his competence in Islamic laws and a command of its rules

No full textلا شك أن معرفة اصطلاحات العلماء من الأهمية بمكان لإدراك مرادهم من إطلاقاتهم، وفهم قصدهم من كلامهم، حتى لا يقع اللبس والشك، أو يفسر اصطلاحهم على غير مرادهم، فيقع الخطأ والزلل، كما أنه ينبغي لمن يتكلم في فن من الفنون، وعلم من العلوم أن يورد المصطلحات المتعارف عليها فيه، ويستعملها في معانيها المعروفة عند أهلها، فإن للعلم لغة محكمة ينبغي التزامها، ومخالف ذلك إما جاهل بمقتضى المقام أو قاصد للإبهام أو الإيهام، ويأتي هذا البحث الذي وسمته بـ: "الفصول المنتخبة في الأحاديث الملقبة" في هذا الإطار والمضمار لبيان بعض اصطلاحات العلماء في تلقيبهم للأحاديث النبوية بألقاب معيّنة، متعارف عليها بينهم، متفق عليها في الجملة، مع بيان مسالكهم في ذلكUndoubtedly, knowing the terms used by scholars is extremely important for grasping the meaning of their sentences in order to avoid misconception and doubt, and so that their words would not be interpreted contrarily to what they mean, which may lead to mistake and error. Certainly, he who wants to deal with a discipline or a science has to take its proper terms and use them in the right way as admitted by the specialists because science has its accurate language that we should conform to, and any user who violates that rule is either ignoring context or willing to confuse or deceive. It is in that context that this paper entitled “Selected Chapters on the Entitled Hadiths” is written.
