الوقف المؤقت: دراسـة تأصيلية فقهية: [Temporary Endowment: A Juristic Ta\u27sili Study]
The majority of Muslim jurists agreed on the legality of waqf, but they differed in the declaration of waqf (sighah); whether endowment can be temporary or it is limited to perpetuity. The objective of this paper is to discuss the concept of Temporary Waqf, to analyze the views of scholars and to discuss their evidences, to discuss the interest (maslahah) of contemporary application, as well as to analyze the implementation of temporary waqf in Kuwat. A qualitative methodology was used to analyze the data through inductive and deductive methods. The findings shows that contemporary 122 Vol.20 (April) 2017 experiences of Muslim societies and communities indicate that temporality by will of the founder and by nature of objectives is part of social life as all societies need it as much as they need perpetuity. It can be implied that fatwas that were issued by the Fatwa Committee in regard of Endowment are required to be reassessed from time to time and not limited to single sectarian especially in the field of waqf.
الملخص
اتفــق جمهــور الفقهــاء علــى مشــروعية الوقــف، ولكنهــم اختلفــوا فــي صيغــة الوقــف، هــل يقبــل تأقيتــه بمــدة معينــة أو أنــه ال يجــوز إال مؤبــدا. تهــدف هــذه الورقــة إلــى بحــث مفهــوم الوقــف المؤقــت، وآراء الفقهــاء القائليــن بالتأبيــد والقائليــن بالتأقيــت، ومناقشــة األدلــة التــي اعتمــد عليهــا كل مذهــب، ثــم تنظــر فــي مصلحــة تطبيقاتهــا المعاصــرة، وكذلــك بيــان عــن تجربــة الوقــف المؤقــت فــي دولــة الكويــت. يعتمــد الباحثــان فــي هــذه الدراســة علــى منهجيــن؛ المنهــج االســتقرائي والمنهــج التحليلــي. ومــن النتائــج المتوقعــة مــن البحــث أن الوقــف المؤقــت يحقــق المصلحـة للواقـف والموقـوف عليـه والمجتمـع فـي عصرنـا الحديـث، ألنـه يناسـب الظـروف التـي يعيشـها النـاس، ويناسـب فئـات األغنيـاء فـي العصـور الحديثـة، ويالحـظ أن الغنـى فـي معظمـه ال يتمثـل فـي العقـار، وإنمـا يتمثـل فـي مصـادر أخـرى كثيـرة تـدر الدخـل وتكسـب الغنـى. وتقتـرح هـذه الورقـة تشـجيع لجنـة اإلفتـاء وهيئـات األوقـاف علـى أال تقيـد بالمذهـب المعيـن فحسـب فـي اســتنباط الحكــم الشــرعي خصوصــا فــي مجــال الوقــف
Keterbatasan Fahaman Fungsi Huruf Ya’ Dalam Nahu Arab: [The Limitations of the Understanding of the Letter Ya’ In the Arabic Syntax]
The letter Yā’ (ي)is one of the basic letters in the Arabic language that possesses multiple functions. However, majority of the students’ understanding is more focused on only one of its functions, that is as a ضمير (pronoun) attributing it to أنا ) which means I. Thus, the objective of this study is to determine the level of the students’ skills in distinguishing the various functions of Yā’, to identify the appropriate usage of Yā’ in a sentence structure as well as to analyse the students’ ability to relate Yā’s function to i’rab. The results of this research can help the teachers to draft, diversify and to improve the teachings of the Arabic Language specifically in the Arabic Syntax. By using the qualitative method consisting of written tests and interviews on eight respondents from Alsagoff Arab School, ranging from primary five to secondary three, this study was conducted based on the revised Bloom’s Taxonomy Theory. The outcome of the study showed that the understanding of ضمير (pronoun) attributing it to أنا ) which means I, was more dominant than the others. The limitations occurred because the students’ cognitive skills were only at the level of remembering and understanding. In conclusion, the students’ limitations in understanding the usage of letter Yā’ were due to their incompetence in applying and analyzing previous learnt information. As a result they were unable to assess the differences of the multiple functions of the letter Yā’.
Abstrak
Huruf Yā’ merupakan salah satu huruf hijaiyyah yang mempunyai pelbagai fungsi dalam nahu Arab. Namun, pemahaman majoriti pelajar lebih tertumpu pada satu fungsi iaitu sebagai ضمير (kata ganti nama) أنا yang bermaksud ‘saya’. Justeru, Objektif kajian ini dilakukan adalah untuk mengenal pasti tahap kemahiran pelajar dalam membezakan fungsi Yā’, mengenal pasti ketepatan penggunaan Yā’ dalam struktur ayat, serta menganalisis kemampuan pelajar menghubungjalin fungsi huruf Yā’ dengan i’rab. Hasil dari kajian ini boleh membantu para pengajar merangka, mempelbagaikan dan menambahbaik pengajaran bahasa Arab khususnya bagi subjek nahu. Dengan menggunakan metode kualitatif berdasarkan ujian bertulis dan temu bual terhadap lapan orang responden bermula dari darjah enam hingga tingkatan tiga di Madrasah Alsagoff Al-Arabiah, kajian ini dijalankan dengan berpandukan kerangka teori revisi Taksonomi Bloom. Hasilnya, dapatan kajian menunjukkan pemahaman ضمير (kata ganti nama) kepada أنا yang bermaksud ‘saya’ lebih dominan dari yang lain. Keterbatasan ini berlaku kerana pelajar menggunakan aspek kognitif mereka pada tahap mengingat dan memahami. Kesimpulannya, keterbatasan pelajar dalam fahaman fungsi huruf Ya’ berpunca pada kelemahan mereka yang tidak mengaplikasi dan menganalisis sesuatu maklumat yang diterima terlebih dahulu. Akibatnya mereka tidak mampu menilai perbezaan fungsi kepelbagaian huruf Yā’ dalam nahu Arab
Pembangunan Industri Halal: Konsep Halalan-Toyyiban dan Pengurusan Keselamatan Industri dalam Kerangka Maqasid al-Shariah: Halal Industry Development: The Concept of Halalan-Toyyiban and Industrial Safety Management within the Framework of Maqasid al-Shariah
Komitmen serta kesungguhan yang telah ditunjukkan Malaysia dalam membangunkan industri halal adalah selaras dengan aspirasi negara untuk menjadi juara hub halal global. Pembangunan industri halal bukan sahaja berkait rapat dengan tuntutan menghasilkan produk halal bagi kegunaan masyarakat Islam tetapi juga perlu mempamerkan nilai-nilai Islam yang menyeluruh. Selain itu, pembangunan dan aktiviti industri halal memerlukan corak dan kaedah pengurusan termasuk pengurusan keselamatan industri yang menjadikan nilai-nilai Islam sebagai acuannya. Oleh yang demikian, penulisan ini akan membincangkan tuntutan pelaksanaan pengurusan keselamatan industri dan konsep halalan-toyyiban dalam kerangka maqasid al-shariah. Selain itu, pendekatan kooperatif dalam pengurusan keselamatan juga akan dibincangkan. Pendekatan kooperatif merupakan suatu inisiatif yang berpotensi untuk dilaksanakan kerana ianya adalah salah satu daripada tujuan maqasid al-shariah. Jaringan kerjasama kejiranan dalam isu-isu pengurusan keselamatan industri juga menampakkan kesyumulan Islam dalam hal-hal yang melibatkan keselamatan pekerja, masyarakat dan alam sekitar. Kesimpulannya, pelaksanaan pengurusan keselamatan industri khususnya oleh pengusaha industri halal adalah sesuatu yang menjadi tuntutan. Ianya bukan sahaja tuntutan sejagat tetapi juga tuntutan Islam itu sendiri. Ini bertepatan dengan kerangka maqasid al-shariah dan secara langsung dapat membuka luas pemahaman terhadap konsep halalantoyyiban itu sendiri.The commitment and efforts shown by Malaysia in developing halal industry are in line with the country’s aspirations to become a champion of global halal hub. However, halal industry’s development is not only about fulfilling the market demands for Muslim community but it should also exhibit the values of Islam in a comprehensive manner. Moreover, the development and activity in halal industry should apply an effective management tool including industrial safety that makes the values of Islam as its anchor. Therefore, this paper will discuss the need for safety management’s implementation and the concept of halalan-toyyiban within the framework of maqasid al-shariah. In addition, safety management which is based on cooperative approach will also be discussed. Cooperative approach is an initiative that has the potential to be implemented as it is one of the purposes of the maqasid alshariah itself. Neighborhood network for industrial safety management also exhibits comprehensiveness of Islamic teachings in matters pertaining to the safety of employees, community and the environment. In conclusion, the implementation of industrial safety management, especially by halal players is not optional. It is not only a universal requirement but also a part of the teachings of Islam. This is consistent with the framework of maqasid al-shariah and it directly providesa wider understanding of the concept of halalan-toyyiban
The Historical Impact on the Valuation of Dowry (Mahr) Rate: Pre and Post-Colonial Eras in Johor
In Malaysia, the amounts of dowry “mahr” are decided by respective state of Islamic authorities accordingly based on the provision by the Federal Constitution of Malaysia. Study has identified that Johor is among the states with the lowest rate of mahr fixed upon marriage. Hence, the objective of this study is to examine the history and transformation of mahr’s rate in Johor from pre-colonial, colonial and post-colonial era. This study employs a qualitative method by using content analysis, historical study, survey study and archival study. This study has also relied upon documents and interview to gain related information. The result of this study has found that the mahr’s rate in Johor was introduced and has not changed since almost a century ago. In fact, there have been some transitional periods of world currencies since that particular rate of mahr was introduced until today. Thus, this study found that the mahr’s rate which was based on the value of gold and silver previously was more beneficial for the people at that particular time as compared to the same rate used under today’s floating fiat currency. Current Mahr’s value of in today’s world is irrelevant as what Islam ruled and aimed from the regulation of mahr. The study suggests that the existing rate of mahr to be revalued in congruity with the current value of a catty of silver which is around RM 1392 as maximum rate and RM 70 as minimum rate according to previous opinion of mahr calculation that has been set in Johor
Pengaruh Efikasi Guru Terhadap Stail Disiplin Guru: [The Effect of Teacher’s Efficay on Teacher’s Discipline Style]
Appropriate discipline style should be used by the teachers to discipline the students.Teacher are unsured and confused when handling student discipline and show the absence of a strong teacher efficacy.Thus, the objective of this study was to examine the influence of the teacher efficacy towards the Teacher Discipline Style, i.e: Supporter, Abdicator, Enforcer, Negotiator and Compromiser (Tomal,1999). Appropriate discipline style is determined by the highest rate of the teachers’ efficacy. The survey method used a cross sectional design that was carried out among 320 teachers who are the Disciplinary Committee members in national primary schools in Kedah and Perlis. Two instruments are used, Teachers’ Sense of Efficacy Scale (TSES) and The Teacher Discipline Five Style Inventory. Descriptive data are analyzed using SPSS version 19. Inferential statistics are analyzed by using Partial Least Squares Structural Equation Modelling 3(PLS-SEM 3). The findings show that the teacher efficacy has a great influence on Negotiator discipline style but has no influence on the Abdicator discipline style. The findings of this study can contribute to the Ministry Of Education (MOE) as a guide to the selection of a discipline teacher in school and also identify teachers that use the disciplinary style that has lower influence of teacher efficacy to take preventive action.

Stail disiplin yang sesuai perlu digunakan oleh guru untuk mendisiplinkan pelajar. Guru tidak pasti pasti dan keliru semasa mengendalikan disiplin pelajar dan menunjukkan ketiadaan efikasi guru yang mantap. Justeru, objektif kajian ini adalah mengkaji Pengaruh Efikasi Guru Terhadap lima Stail Disiplin Guru iaitu Penyokong, Penyerahan, Penguatkuasaan, Kompromi dan Penguatkuasaan (Tomal, 1999). Stail disiplin yang sesuai ditentukan melalui kadar efikasi guru yang paling tinggi. Kajian tinjauan menggunakan reka bentuk keratan rentas telah dijalankan terhadap 320 orang guru jawatankuasa disiplin daripada sekolah kebangsaan di Kedah dan Perlis. Dua instrumen digunakan iaitu Teachers’ Sense of Efficacy Scale – TSES), dan The Teacher Discipline Five-Style Inventory. Penganalisisan data deskriptif menggunakan SPSS versi 19. Statistik inferensi menggunakan Partial Least Squares Structural Equation Modelling (PLS-SEM 3). Dapatan kajian menunjukkan efikasi guru mempunyai pengaruh yang tinggi terhadap stail disiplin Perundingan Namun tidak mempunyai pengaruh terhadap stail disiplin Penyerahan. Dapatan kajian ini dapat memberikan sumbangan kepada Kementerian Pendidikan Malaysia (KPM) sebagai panduan pemilihan guru disiplin di sekolah serta mengenalpasti guru yang menggunakan stail disiplin yang mempunyai pengaruh efikasi yang rendah untuk dilakukan tindakan pencegahan. 
Benefit in Kind: Should It Be Exempted From Zakat?

However, based on the practice of zakat institutions in Malaysia, not all that is received in relation to employment is liable for mandatory zakat, including all forms of benefit in kind (BIK). On the other hand, in terms of taxation practice, all benefits in kind received by an employee are taxable by Inland Revenue Board of Malaysia (LHDN), except for benefits listed in Paragraph 9. BIK refers to benefits given to employees, which cannot be convertible into money, such as motorcar and household furnishings, apparatus and appliances. It is worth noting that the discussion on the imposition of zakat on benefits in kind has not been given enough thought and justifiably raises questions. Therefore, in this study, three central questions have been raised with regards to BIK and zakat in Malaysia. Should BIK be considered under the category of “whatever received related to employment”? Why BIK should be subjected to employment income zakat? How BIK can be charged under the context of employment zakat? Based on the content analysis method, this paper presented a brief review to answer these questions. In general, this study is of the opinion that BIK is zakatable and LHDN’s income tax assessment method could be adopted for employment income zakat accounting
Interaksi Sosial Dan Peraturan Islam Dalam Surat Undang-Undang: [Social Interaction and Islamic Rulings in Surat Undang-Undang]
Abstract
The object of this research is about the social interaction and the Islamic law in the Surat Undang-Undang. Islamic law is the core which is the core of the personality of the Malay community Malays consisting of rulers, kings, rulers, and people. Surat Undang-Undang is kept in the Special Collection, Leiden University Library. Surat Undang-Undang contained twenty-four clauses that describe the customs and rules that should be guide in Malay traditional societies. However, this writing is focuses to the regulations and laws into the context of Islamic rules. This study was conducted to prove that the Surat Undang-Undang are full of Islamic values, social ethics, culture and rules. Through social interaction, Surat Undang-Undang is the intermediary for conveying religious values and policies among the Malay community who at that time had just embraced Islamic values, ethics, culture and religion. Thus, social interaction between society, the ruler, the people and the people will be refined through the content analysis method by applying the Islamic approach as the basis of this researcg. This research has two objectives, firstly is to identify the rules and Islamic law contained in the Surat Undang-Undang. Secondly, to analyze the Islamic rules and laws in the Surat Undang-Undang based on the concept of social interaction. Thus, this study were able to demonstrate the process of social interaction among the Malay traditional society, the harmonization of the relationship between the ruling class, the ruler and the rulership of the nation\u27s integration regarding to the al-Quran and Hadith.

Objek penelitian ini mengenai interaksi sosial dan peraturan Islam dalam Surat Undang-Undang. Undang-undang Islam merupakan teras keperibadian masyarakat Melayu yang terdiri daripada golongan pemerintah (raja), para pembesar, dan rakyat. Surat Undang-Undang merupakan manuskrip Melayu yang tersimpan di Koleksi Istimewa, perpustakaan Universiti Leiden. Manuskrip ini memuatkan dua puluh empat fasal yang menggambarkan adat dan peraturan yang perlu menjadi panduan dalam kalangan masyarakat Melayu tradisional. Justeru, penulisan ini berfokus kepada hal-hal yang bersangkutan dengan peraturan dan undang-undang untuk disuai padankan dengan konteks syariah dan ajaran Islam. Kajian ini dilakukan untuk membuktikan bahawa Surat Undang-undang sarat dengan nilai, etika sosial, budaya dan peraturan yang berlandaskan Islam. Menerusi interaksi sosial, Surat Undang-undang merupakan perantara untuk menyampaikan nilai-nilai dan dasar keagamaan dalam kalangan masyarakat Melayu yang pada ketika itu baharu sahaja menganuti nilai, etika sosial, budaya dan agama Islam.Golongan pemerintah dalam komuniti minoriti berusaha membangun harmonisasi hubungan sosial kemasyarakatan dengan golongan rakyat sebagai komuniti majoriti. Justeru, interaksi sosial antara lapisan masyarakat iaitu golongan pemerintah, pembesar dan rakyat akan diperhalusi menerusi kaedah analisis kandungan dengan menggunapakai pendekatan Islam. Kajian ini mempunyai dua objektif iaitu mengenal pasti peraturan dan undang-undang Islam yang termuat dalam Surat Undang-Undang. Keduanya, menganalisis peraturan dan undang-undang Islam dalam Surat Undang-Undang berlandaskan konsep interaksi sosial. Falsafah Pemikiran Hatta Azad Khan dalam Kumpulan Drama Dunia Belum Kiamat: Philosophical Thought by Hatta Azad Khan in Kumpulan Drama Dunia Belum Kiamat
Makalah ini adalah untuk melihat falsafah pemikiran Hatta Azad Khan dalam Kumpulan Drama Dunia Belum Kiamat (2013). Fokus kajian ini ialah untuk mengenal pasti dan membincangkan falsafah dan pemikiran yang ingin diketengahkan oleh pengarang dalam kumpulan drama tersebut. Kumpulan Drama Dunia Belum Kiamat (2013) beraliran realisme dan mengandungi lima buah drama iaitu drama Awang, Anak Korporat, Dunia Belum Kiamat, Cermin Tipu Daya dan Puteri Gunung Ledang. Kaedah kajian yang digunakan ialah kaedah kepustakaan dan analisis kandungan. Kajian ini menggunapakai teori Sosiologi oleh J. Duvidnaud (1972) untuk mencapai dua objektif kajian. Pertama, untuk mengenal pasti falsafah dan pemikiran dalam Kumpulan Drama Dunia Belum Kiamat (2013) karya Hatta Azad Khan. Kedua, membincangkan falsafah dan pemikiran dalam Kumpulan Drama Dunia Belum Kiamat (2013) dari aspek sosial, politik dan ekonomi. Kajian ini menghasilkan dapatan kajian iaitu Kumpulan Drama Dunia Belum Kiamat (2013) karya Hatta Azad Khan merupakan sebuah kumpulan drama yang sarat dengan falsafah dan pemikiran. Falsafah dan pemikiran tersebut terdiri daripada pemikiran sosial, ekonomi dan politik.
This research is intended to view the philosophical thoughts of Hatta Azad Khan in Kumpulan Drama Dunia Belum Kiamat (2013). This research is focusing on identifying and discussing the philosophy and the thoughts which had been highlighted by the author of the above mentioned drama’s group. The drama’s group is based on realism and it is comprised of five dramas which are Awang, Anak Korporat, Dunia Belum Kiamat, Cermin Tipu Daya dan Puteri Gunung Ledang.. The method used in this research was literature analysis and content analysis method. This study applied the Sociological Theory by J. Duvidnaud (1972) to achieve two objectives which were to identify and to discuss the philosophy and the perspectives in Kumpulan Drama Dunia Belum Kiamat (2013) by Hatta Azad Khan specifically in terms of social, economic and political aspect. Hence, the research findings showed that this group of drama was loaded philosophy perspectives that consist of social, economic and political thinking
Investigation on the Awareness and Perception, Attitude, and Implementation of the Concept of Islamization of Knowledge among University Educators
This paper attempts to shed some light on the extent to which university educators who are Muslim by religion familiarize themselves with the concept of Islamization of knowledge in their teaching. It is generally argued that knowledge is free from any intrinsic values that may render it biased toward a culture or religious tradition (Bashir, 2000). However, Muslim scholars such as Ismail Al-Faruqi and Syed Naquib Al-Attas refuted such claim as they believe such perception would put Muslim students at risk of being helpless against the onslaught of scientifc truth. Survey research design was employed to execute this investigation in which a number of educators from various felds offered in UiTM Melaka were selected to answer 11 questions related to their awareness and perception, attitude, and implementation of Islamization of knowledge. General overview from the results revealed a rather promising outlook to the prior assumption that educators are oblivious towards the concept of Islamization of knowledge
