    Islamic law granted the biological father the right to recognize his illegitimate child, who was not born within marriage, and he has the right to include him in his lineage and inheritance. However, Malaysian Family Law prohibits the illegitimate child from being attached to his biological father, even if he acknowledged him. Here lies the problem of the research, as this prohibition resulted in the lack of recognition of their lineage and the forfeiture of their right to inherit from his father and his family as well. Aims and Objectives:  This study aimed to define the illegitimate child of adultery from the Sharia and law. This demonstrates the practice of Maqasid Shari’a in preserving the progeny and the benefit of Sharia by incorporating this category of society. Consequently, reducing the spread of adultery, by prosecuting the perpetrators through genetic fingerprint analysis. Methodology: This study has taken the inductive approach by following the opinions and evidence of the jurists regarding the inheritance and lineage of the illegitimate child, and the cause of the dispute between them It also relied on the analytical approach by discussing the opinions and evidence of jurists and analyzing these rulings from the legal and Malaysian family law perspectives. Results and Findings: The important results of this study concluded that the biological father has the right to inherit his illegitimate son in his lineage according to the conditions set by Islamic law, and he inherits from him and his father\u27s family as well.  The society general interest requires us to compel the biological father to recognize his son if the mother testifies to the paternity of her son from him and the genetic fingerprint confirmed her claim. Thus, preserving his full right to lineage, alimony, and inheritance, and integrating as a legitimate child into the society

    An Empirical Investigation on Annual Reporting Practices of Malaysian State Islamic Religious Councils: Issues and Challenges

    This paper aims to evaluate the extent and quality of disclosure of annual report and to investigate in-depth explanation on the obtained evaluation. Specifically, semi-structured interviews are conducted to address the reasons/constraints of such disclosure/non-disclosure and for not preparing an annual report. This study found that there are external and internal problems in preparing annual reports; where it was inferred that the internal problems are more serious. The former consists of lack of enforcement and reporting guidelines, whereas the latter includes attitudes of top management, lack of staff, difficulties in preparing annual reports and transformation of SIRC organisations. However, such a lack of enforcement is the main reason for the inconsistency of the annual report disclosure of some SIRC and its total absence from others. This was highlighted by majority of the interviewees. Despite of those problems, most of the SIRC’s accountants claim that they are becoming more active in issuing annual reports. It seems advantageous to address those issues and challenges and SIRC should consider producing a comprehensive annual report for the discharge of their accountability and thus, encourage more funding. They should be more transparent to enhance accessibility, concerning the extent and quality of the disclosure.Consequently, this study was able to make empirical contributions to the literature, and particularly to the practice and knowledge of this type of institutional accounting

    Best Practice for the Care and Use of Animals in Experimentation: A Malaysian Perspective

    Passing federal laws and national guidelines is one of the best revenues to protect animals used in experimentation. The laws can establish standards of care for animals in scientific research such as housing standards and treatment for the animals. At international level, animal ethics and law for the care and use of animal in experimentation have been widely discussed for decades ago. There are several well-known international documents and guidelines that have been referred by many countries when constructing their own federal laws governing the subject matter. They are Terrestrial Code, European Directives, and International Guiding Principles for Biomedical Research Involving Animals. In Malaysia, the Animal Welfare Act 2015 finally has been enforced on 18th July 2017 where the Act among others will regulate the use of animal for scientific purposes in the country. Besides, it will validate the practice of Institutional Animal Care and Use Committee (IACUC) which was based on self-regulation before the enactment of the Act and the Act is significant of having legal enforcement in order to give better protection to the animals subjected to experimentation. Thus, the law has taken its role in enhancing the animal ethics for the care and use of animal in science in Malaysia. This paper aims to analyses the provisions of law in several international documents governing the subject matter that reflect the international practice. Then it will look into the practice of research institutions in Malaysia, applying the existing animal ethics and law in the subject matter. This paper adopts doctrinal approach considering primary and secondary sources of law. Relevant to this, Animal Welfare Act 2015 (AWA) and Malaysian Code of Practice for the Care and Use of Animals for Scientific Purposes (My Code) are analysed. Besides, it also employed empirical study by way of interviews and observation. This paper is significant to inform the practice of animal ethics at international level to be learned by Malaysia as the country is still at an early stage of having the new Act

    The Educational Philosophy of Boko-haram; Analysis from Islamic Perspective

    Abstract The Nigerian armed forces are doing their utmost to crush the Boko-haram insurgency. However, killing and dislodging members of the group does not indicate the total elimination of its ideology. The arguments of the movement against conventional education remain in circulation among people awaiting another generation to champion the course in a new identity. To eradicate the ideology and its influence, there is a need for thorough intellectual and logical responses to those arguments. It is against this background that this paper sought to analyse the movement’s arguments that conventional education should be prohibited on the ground that it originated from the West and was introduced in the country to promote Christianity. The paper realized that this argument is unfounded because conventional education is not a western property, rather a global heritage comprising the remarkable contributions of the Muslim world. Moreover, Islam does not forbid Muslims to benefit from any useful knowledge irrespective of where it originates from as long as it does not contravene Islamic teachings. It also found that using schools for promoting Christianity is not more applicable to many public and private schools in Nigeria today.     Regenerating Muslim Inventors: The Present Future

    Much discussion has been done about the golden era of Muslim civilization and its decline over the past centuries. Recent downturn of events in the Middle East has given birth to the Muslim refugee crisis, coupled with terrorist attacks have fueled the growth. Now more than ever, Muslim need inspirational role models, to survive this crisis and backlash. This paper intends to highlight the achievements of Muslim scientists, engineers and innovators, dating from the early 9th century to the more recent 21st century. Some of the works discussed in this paper are not so commonly discussed, such as the work of Banu Musa on control theory and mechanical pumps by Al-Jazari. Next special highlight is done on the works of Muslim Nobel Prize winners as well as their attempts to encourage other Muslims to be involved in science and technology. Finally, we discuss the successful Muslim inventors of the 21st century, both who created modern devices for communications and lasers. The paper concludes with a critical discussion on what are the qualities that these Muslim technologists had to succeed and how the modern generation can emulate them

    Penilaian Bahasa Isyarat Baharu untuk Pengajaran dan Pembelajaran Solat bagi Orang Pekak: [Evaluation of New Sign Language for Teaching and Learning of Prayers for Deaf People]

    The sign language is the main language used in the teaching and learning approach (TnL) of solat (prayer) for deaf people. However, there have been sign language confusions in terms of form and the true meaning of the term. This is because the signs are developed based on the custom and understanding of the deaf. Hence, this study evaluates new sign language developed to ensure the TnL process of solat (prayer) for the deaf can be carried out more effectively. This study utilises Cohen Kappa for analysis of the evaluation of five experts from the field of religion and six from the field of sign language. In addition, a qualitative approach through group interviews is also conducted to enrich the findings. Based on the findings of the study, this evaluation has achieved the Cohen Kappa Coefficient Index at 0.87 level, which is at an excellent scale level for the whole new sign language developed. In terms of implication, this evaluation can provide a sign language parallel to the religious meaning and understanding of the deaf in Malaysia in TnL of solat. Walaubagaimanapun, terdapat bahasa isyarat yang mempunyai kekeliruan dari segi bentuk dan makna sebenar istilah tersebut kerana dibangunkan berdasarkan cara hidup dan kefahaman orang pekak. Justeru, kajian ini menilai bahasa isyarat baharu yang dibangunkan untuk memastikan proses (PdP) solat bagi orang pekak dapat dijalankan dengan lebih berkesan. Kajian ini mengunakan Cohen Kappa untuk analisis penilaian kesepakatan lima orang pakar daripada bidang agama dan enam orang daripada bidang bahasa isyarat. Selain daripada itu, pendekatan kualitatif melalui temu bual berkumpulan juga turut dijalankan bagi memperkayakan dapatan kajian. Berdasarkan dapatan kajian, penilaian ini telah mencapai Indeks pekali Cohen Kappa pada tahap 0.87, iaitu pada tahap skala sangat baik bagi keseluruhan bahasa isyarat baharu yang dibangunkan. Implikasinya, penilaian ini dapat menyediakan bahasa isyarat yang selari dengan makna agama dan kefahaman orang pekak di Malaysia dalam (PdP) solat

    Exploring Factor Structures Of A Thinking Questionnaire

    The purpose of this study was to investigate the construct validity of a thinking questionnaire through Factor Analysis over a Malaysian university students’ sample. The questionnaire is a 5 point Likert scale survey ranging from Strongly Agree, Agree, Neutral, Disagree and Strongly Disagree, intended to measure students’ self-reflection on their thinking upon their Invention Project. A total of 350 undergraduate students from various faculties participated in this study. Principal Component Analysis was used because the primary purpose was to identify and compute composite thinking scores for the factors underlying the Thinking questionnaire. The five factor solution, which explained 52.4% of the variance was chosen because of the ‘levelling off’ of eigenvalues on the scree plot after five factors, and was also confirmed by the Monte Carlo Parallel Analysis which indicated smaller values of the 5 factors compared to the eigenvalues displayed in the SPSS

    Kredibiliti Komunikator Berasaskan Manhaj Rabbānīyyah

    Communicators refer to Muslims who send Islamic messages to be shared. All Muslimsbear the responsibility as Islamic communicator and thus, need to equip themselves with themethod of da\u27wah called manhãj rabbãniyyah in order for the communication process to beeffective. Manhãj rabbãniyyah encompasses three principles highlighted in Qur\u27an, namelyhikmah, mau’izah and al-mujãdalah. Furthermore, Islam also emphasizes somecharacteristics of a quality communicator such as trusted, fair, reliable, able to employ goodcommunication method and, true and responsible so that the communicator be seen as acredible person. Therefore, this study aims to analyze the elements of manhãj rabbãniyyahand its relationship with communicator’s credibility. The results of this study found that allthree elements of manhãj rabbãniyyah and communicator’s credibility factors have a highCronbach\u27s Alpha value; above α> 0.7. In addition, analysis of Pearson correlation betweenmanhãj rabbãniyyah and credibility recorded a strong relationship; α> 0.6. The mauʿizahelement shows a higher value of the correlation coefficient than the other elements. Itconcludes that the mauʿizah element is most significant than the other two elements. Thefact that the respondents are among the public citizens may contribute to this result.Therefore, it meets the views of scholars who claimed that the public at mass is more suitableto be preached through the method of mauʿizah. Abstrak Komunikator merujuk kepada orang Islam yang menyampaikan pesan-pesan Islam untuk dijadikan milik bersama. Setiap individu Muslim menggalas tanggung jawab sebagai seorang komunikator Islam serta perlu melengkapkan diri dengan metode dakwah yang disebut manhaj rabbãniyyah agar proses komunikasi menjadi efektif. Manhaj rabbãniyyah merangkumi tiga asas pendakwahan yang digariskan melalui al-Quran iaitu hikmah, mau’izah dan al-mujãdalah. Tambahan pula, Islam turut  menekankan beberapa ciri komunikator yang berkualiti seperti amanah, adil, boleh dipercayai, mengguna pakai kaedah yang baik, benar dan bertanggung jawab agar komunikator dilihat sebagai seorang berkredibiliti. Lantaran itu, kajian ini bertujuan menganalisis elemen manhaj rabbãniyyah dan hubungannya dengan kredibiliti komunikator. Hasil kajian mendapati ketiga-tiga elemen manhaj rabbãniyyah dan faktor-faktor kredibiliti komunikator mempunyai nilai Alpha Cronbach yang tinggi melebihi α > 0.7.Selain itu, hubungan korelasi Pearson di antara manhaj rabbãniyyah dengan kredibiliti turut mencatatkan hubungan yang kukuh α >0.6. Elemen mauʿizah memperlihat nilai pekali korelasi yang lebih tinggi berbanding elemen lain lantas disimpulkan elemen mauʿizah lebih signifikan berbanding dua elemen lain
