    Prefazione al Volume 4, Numero 1

    Over the last few weeks, one event in particular has struck the community of the Trento Student Law Review: the passing of Professor Rodolfo Sacco, a sad loss that will leave a deep void in the academic community. In its essence, to be a maestro del diritto (i.e., a teacher, a mentor in the field of law) means to influence legal thought through ideas that are equipped to survive the test of time and cross-examination, to provide an interpretative prism that affects the understanding of law, having an impact on entire generations of jurists. As proof of how much the keen thinking of the distinguished Piedmontese jurist affects the essence of legal studies in Trento, the very first approach to law by first year students is made by learning about the theory of formants, a pillar of legal comparison that he developed[1], from the pages of a book that bears his signature[2]. An early supporter of this publishing project, in the introductory note to issue 0, Professor Sacco wanted to emphasize the potential of stimulating the development of legal science by means of a dialogative method that was not only horizontal but also vertical between students and teachers. On the other hand, the formative value of the activities of this editorial office did not escape him, together with the ability to stimulate a critical sense in the student, no longer a mere learner of notions but an active contributor to the process of creation of legal science. To Professor Rodolfo Sacco, who - in the face of many sceptics – unmistakably pointed out the potential of a student-run law journal, we wish to dedicate this Volume 4, Number 1. This volume - in continuity with its predecessors - demonstrates how this publishing reality, by its very nature and structure, can be a forum to share ideas. This is the ideal that lies at the heart of the Trento Student Law Review: a scientific article, an essay that has its merits and meets the requirements of scientificity can and must be brought to the attention of the academic community, regardless of the author’s titles. Because only in this way can legal science not be reduced to an oligopolistic top-down structure: “Of course, the teacher knows; and we all want him to pass on his knowledge. But this does not mean that the pupil should always keep silent. Why should he not propose issues? Why shouldn’t he ask questions? Why shouldn’t he make objections?”[3]. The publication of this volume calls for reflection on the work of the Board of editors, as it is the ideal moment to take stock of the path that led to the creation of this editorial product. Some very important improvements have affected the way the Trento Student Law Review reaches its audience. Through continued collaboration with the Ufficio Editoria Scientifica d’Ateneo (i.e., the University’s Scientific Publishing Office), we have completed the transition to the new Open Journal Systems (OJS) platform, https://teseo.unitn.it/tslr. The transition has brought us to a new webpage, through which we can offer our readers renewed and updated content through a fresher, more modern and accessible graphical interface. A special mention of gratitude goes to our Faculty of Law of the University of Trento, whose collaboration is demonstrating how the desire to involve students in the legal debate can be commonly perceived as an educational tool aimed at developing transversal skills, and critical thinking. In conclusion, I would like to thank the Vice Editor-in-Chief, Emma Castellin first and foremost for the important work of final revision and proofreading, and for the constant exchange of views, support, and input to the supervision of the editorial work. Nella sua essenza, essere maestro del diritto significa contribuire al pensiero giuridico attraverso idee che sappiano sopravvivere alla prova del tempo e del contraddittorio, fornire un prisma di lettura che incida sulla comprensione del giuridico, avendo un impatto su intere generazioni di giuristi. A testimonianza di quanto il pensiero dell\u27insigne giurista piemontese sia alle radici degli studi giuridici in Trento, ecco che al primo anno il primissimo approccio con il diritto avviene proprio conoscendo della teoria dei formanti da lui elaborata[1], dalle pagine di un volume che porta la sua firma[2]. Sostenitore della prima ora della Trento Student Law Review, scrivendo la nota introduttiva al nostro primo volume – il numero 0, il prof. Sacco volle sottolineare l\u27attitudine di questo progetto editoriale a sollecitare lo sviluppo della scienza giuridica con metodo dialogico non soltanto orizzontale, ma anche verticale: tra studenti e docenti. D\u27altro canto non gli sfuggì il valore formativo delle attività di questa redazione, assieme alla capacità di stimolare un senso critico nello studente, non più solo spettatore ma contributore attivo al processo di creazione della scienza giuridica. Al professor Rodolfo Sacco che, avverso molti scettici, seppe indicare a chiare lettere le potenzialità di una rivista a gestione studentesca, desideriamo dedicare questo Volume 4, Numero 1. Questo volume – in continuità con i precedenti – sta a dimostrare come questa realtà editoriale, per la sua stessa natura e struttura, sappia essere un foro di condivisione di idee. Questo è l\u27ideale che sta al cuore della Trento Student Law Review: l\u27articolo scientifico, il saggio che ne abbia i meriti e che soddisfi i requisiti di scientificità può e deve essere portato all\u27attenzione della comunità accademica, quali che siano i titoli dell\u27autore. Perché solo così facendo la scienza giuridica non si riduce a struttura verticistica di tipo oligopolistico: "Certo, il docente sa; e tutti vogliamo ch\u27egli trasmetta il suo sapere. Ma ciò non significa che lo scolaro debba sempre tacere. Perché mai non dovrebbe proporre temi? Perché non dovrebbe fare domande? Perché non dovrebbe fare obiezioni?" [3]. L\u27avvenuta pubblicazione richiama al dovere di riflettere sul lavoro della Redazione, in quanto momento ideale per tirare le somme del percorso che ha portato alla realizzazione di questo prodotto editoriale. Alcune novità di grande importanza hanno inciso sul modo in cui la Trento Student Law Review raggiunge il suo pubblico. Attraverso la costante collaborazione con l\u27Ufficio Editoria Scientifica d\u27Ateneo, abbiamo completato la transizione sulla nuova piattaforma Open Journal Systems (OJS), https://teseo.unitn.it/tslr. La transizione ci ha portati a un nuovo sito con la possibilità di proporre al nostro pubblico contenuti rinnovati e aggiornati, per mezzo di un\u27interfaccia grafica più fresca, moderna e accessibile. Una particolare menzione di gratitudine va rivolta alla nostra Facoltà di Giurisprudenza dell\u27Università degli Studi di Trento, la collaborazione con la quale sta dimostrando come il desiderio di coinvolgimento della popolazione studentesca nel dibattito giuridico possa essere inteso come strumento formativo volto allo sviluppo di competenze trasversali e del senso critico.     Questo testo ripercorre l\u27attività di Maria Lai (Ulassai, 1919 – Cardedu, 2013) individuandone specificità e contraddizioni interne, anche in relazione al sistema artistico da cui Lai ha volutamente cercato di prendere le distanze nel corso della sua vita. Attraverso un lavoro indiziale – poiché di indizi e non di storia spesso è fatta la storia delle donne – si analizzerà un percorso di ricerca intessuto di piccoli tentativi, a volte timidi, a volte volutamente appartati, diessere artista. Lo studio prende come punto di partenza e di riflessione un particolare biografico della sua infanzia su cui la critica non si è ancora soffermata: il suo essere "figlia d\u27anima" una particolare forma di affido familiare.     The aim of the present article is to analyse a constitutive trait of modern economic science in the light of Rosmini’s Principles of Moral Science. The meant trait is described with the formula «loss of reality» and is assumed to reveal structural criticalities of modern economic science which affects its relation to reality and thus implies the risk to compromise its research findings.     The Encryption Paradox: Fostering Security by Threatening Security

    The debate on encryption has become more and more heated in the last few years. The resurgence is mainly linked to the recent advent of two factors: on the one hand, endpoint encryption is increasingly becoming the default setting on every device. While, on the other, Internet Service Providers have started to broadly offer end-to-end encryption services. So, if data is now strongly encrypted and protected both in transit and at rest, it is law enforcement and intelligence agencies that pay the price by being unable to access the content of numerous communications. This problem has been named by the US government "going dark" as it compromises investigations and surveillance activities by creating sudden "black holes" of pivotal information. Although the proliferation of encryption can often represent a major hurdle for law enforcement, it is justified on the Internet by its inherent insecurity as a dense network of nodes where packets of information are transmitted uninterruptedly. Indeed, the Internet infrastructure rests the foundation of its success on the possibility of encrypting information so that it cannot be accessed by malicious actors. Hence, encryption "weakened" by the presence of backdoors (required by the government) to access data in cases of national security protection would alter an otherwise ironclad mechanism. And so, it will undermine the security of global cyber trafficking and, consequently, of (digital) human rights such as freedom of expression and information, the protection of personal data, and even the smooth functioning of the online market. This article aims to seek a solution that can reconcile the - seemingly - opposing demands at stake: the national and collective security as opposed to the security of Internet architecture - and the entire ecosystem of rights exercised within it. In conclusion, it will be argued that it is not feasible to reduce the overall level of communication privacy to protect collective security, as a further erosion of communication privacy would result in a substantial violation of individual freedomThe debate on encryption has become more and more heated in the last few years.     Tra la fine degli anni settanta e i primi ottanta, l’Italia è stata centro propulsore di una serie di attività artistiche ibride, interdisciplinari e intermediali, spesso di natura collettiva, la cui portata innovativa, seppure immediatamente avvertita da alcuni, comincia solo oggi ad essere riconosciuta come propriamente avanguardistica. Osservate da questo inquieto inizio del terzo decennio del XXI secolo, queste inclassificabili esperienze di convergenza sembrano non solo avere anticipato metodologie espressive e produttive interdisciplinari oggi consolidate, ma anche prefigurato scenari antropologici futuribili che sono diventati, di fatto, il nostro presente, con tutta la carica distopica che comportano.

    La militanza neo-femminista ha coinvolto negli anni settanta un numero molto alto di artiste, critiche e storiche dell’arte. Come in tutte le vicende storiche in cui le relazioni tra arte e impegno politico si stringono, e il rapporto tra attività e produzione artistica da una parte e società dall’altra viene in qualche misura ridefinito, si moltiplicano le questioni di metodo. Nelle pagine che seguono cercherò di ricostruire alcuni aspetti della stagione neo-femminista romana, senza eludere i nodi problematici che emergono via via che dal quadro generale si cerca di giungere a una visione di dettaglio e a una comprensione dei percorsi e delle opere delle singole artiste

    «He [the Oriental] is as we are»: Gertrude Bell\u27s Geography of Arabic Culture in "The Desert and the Sown"

     The Desert and the Sown, an early Twentieth Century English travel account written by Gertrude Bell (1868-1926), writer and archaeologist, has long been esteemed as a source of inspiration for scholars who were working on travels and travellers in the Mediterranean. Bell was a multifaceted figure «she wrote extensively on the ancient cultures of the region, and documented the daily experience of her travels as a prolific letter writer». She began The Desert and the Sown in the early 1900s and published it after she returned to Great Britain in 1907. Her greatest wish was «to write not so much a book of travel as an account of the people whom [she] met or who accompanied [her] on [her] way, and to show what the world is like in which they live and how it appears to them». In the Preface, Bell delineates both the content and the scope of the book. The work appears as a largely narrated commentary, although it almost gives the idea of moments of being of a prose which combines real experience and emotions. It is noticeable both for the author’s view, and for its being the result of evidences of other social realities — while showing due respect for otherness and cultural differences. One of the most striking features of The Desert and the Sown is its tendency to emphasize ideas, customs and social behaviours of different peoples. It appears as really one of the texts written in Great Britain to accurately investigate the organization of Arabic communities the author met. While The Desert and the Sown has been effectively studied from a variety of standpoints — in terms of feminist approach or interaction between cultures— little notice has been given to the emotional quality of the work. This is a characteristic which progressively emerges from the words and situations the author accurately accentuates to make readers comprehend the depth of peoples’ soul. Furthermore, the author’s account highlights her own perception of the world she knew. Although, she herself recognises that emotions affect judgements and, consequently, her own criticism and/or appreciation of people’s values and beliefs. With her «seeing eyes» Bell’s work is full of empathy and sharing, «she learned to speak the languages of the people she loved with a feeling for all the nuances and subtleties, and her Arabs loved her». In other words «she has developed a new art of travel» and of perceiving Arabic culture «mixing the archaeological with the human in perfect proportion». This essay explores the emotional quality of The Desert and the Sown, in terms of cultural comparison and empathic relationships. It is, perhaps, in this dialectic that lies one of the most significant keys for Bell’s work. It seems to follow a careful method according to which the author conceptualizes her own experience as a form of ritualization of travel based, primarily, on three fundamental actions: traveling, sharing, participating. These aspects may be thought altogether as a single process which contributes to a redefinition of the author’s self and emotive participation in that experience, it shows what Antonio R. Damasio would define as «the connection between emotion and consciousness». By virtues of these properties, moving to the East becomes a means through which Bell aspires to reach significant reactions as forms of response to the Arabic world as it is narrated. Therefore, by providing concrete and cogent personal experiences of the naturalness of the peoples she met, she suggests that the meaning shaping her travels lies beyond her own inventiveness and of those involved in the account. Her written project aims at raising the awareness and knowledge of  traditions and customs of a country «parts of [which] have been visited but seldom, and described only in works that are costly and often difficult to obtain» (Preface p. x). Bell’s expands her portrayal and provides a definition: virtues and hospitality characterize most of the people she met and, specifically, they offered her «a clue to their relations with one another» (Ivi, p. xi). It is mostly a human dimension she aspires to delineate together with a detailed representation of daily life, customs, law and traditions. She links her activity as an archaeologist — whose evidences are useful to the investigation on the evolution of populations —to that of the writer who attempts to profoundly penetrate the soul of those people so distant and, likewise, so close to us. Bell directly constructs the physiognomy of micro-collectivities (in Ortega y Gasset’s canonized expression) —castes, sects and tribes —which reflect the attitudes of the people (in Palestine and  Syria) within a defined form of social and political organization and that may ensure equality and the respect of «the law of its own» (Ivi, p. x). In other words, her written record is a representation, she delineates a reliable map of men, places and facts, enriched by «photographic materials» and impressions. And by employing different linguistic hues, that we might consider halfway between scientific and poetic language, Bell succeeded in captivating her reader by telling a story instead of overwhelming him with information

    Published in 1697, Charles Perrault’s fairy-tale Le Petit Chaperon rouge has been the subject of numerous versions and adaptations. This study focuses on four Italian translations published between the 18th and 21st centuries, chosen for their significance. Through the analysis of tex- tual and paratextual elements, an attempt will be made to bring out the operational ‘regime’ of translation (P. Burke), with reference to the rendering of the formulaic language that strongly characterises this fairy-tale. The perspective of Descriptive Translation Studies will allow us to appre- ciate the project behind each translation, while showing the different versions of the fairy-tale as a precious mirror of their time.Pubblicata nel 1697 dal libraio-stampa- tore Barbin, la fiaba Le Petit Chaperon rouge di Charles Perrault è stata oggetto di numerose versioni e adattamenti.     «Cannibale»\u27s Translations and the Reception of US Underground Comix in Italy: A Semiotic Analysis

    By relying on the tools provided by semiotics (in particular, isotopic and thymic analysis) and multimodality, this paper presents a contrastive analysis of the Italian translations of a selection of works belonging to the US underground comix phenomenon, which were published in the ninth and last issue of the radical comics magazine «Cannibale» entitled «USA Only» (July 1979). This represents a critical publication since it includes works by US underground cartoonists which were selected and translated by Italian underground cartoonists during the Years of Lead, thus establishing a bridge between the two experiences. The aim of the study is to investigate the hermeneutic frames adopted and the signifying processes triggered by the transfer into the Italian language and underground milieu of the controversial production which characterised the turbulent years of the US Counterculture (mid 1960s-mid 1970s). In particular, the paper discusses the translation of two works by cartoonist Greg Irons and writer Tom Veitch, originally published in the second and last issue of «Deviant Slice Funnies» (1973): a 14-page untitled story opening «Cannibale»’s issue and the 10-page story entitled You got a point there, pop! (translated as Gran perdita di punti, amico!), ending the publication with an emblematic scene of cannibalism.Questo articolo presenta un’analisi contrastiva delle traduzioni dall’inglese all’italiano di un corpus di tavole appartenenti alla scena fumettistica underground statunitense (underground comix), pubblicate nel nono e ultimo numero della rivista a fumetti di stampo radicale «Cannibale», intitolato «USA Only» (Luglio 1979). Lo studio poggia sugli strumenti metodologici forniti dalla semiotica (analisi isotopica e timica) e dalle teorie sulla multimodalità. «Cannibale USA Only» rappresenta un ponte tra due esperienze, raccogliendo le opere dei fumettisti underground statunitensi selezionate e tradotte da fumettisti appartenente alla scena underground italiana durante gli Anni di Piombo. L’obiettivo dello studio è dunque investigare i frame ermeneutici adottati e i processi di significazione attivati nel trasferimento in italiano e nel milieu underground italiano di una produzione controversa, figlia dei turbolenti anni della Controcultura statunitense, a cavallo tra gli anni Sessanta e Settanta. Due casi di studio sono discussi in particolare, entrambi nati dalla penna di Greg Irons e Tom Veitch e pubblicati nel secondo (e conclusivo) numero della rivista «Deviant Slice» (1973): un racconto senza titolo che apre il volume di «Cannibale» e You got a point there, pop! (translated as Gran perdita di punti, amico!), opera che chiude l’antologia con un’emblematica scena di cannibalismo
