Christian sermons and the law of defamation in Cameroon: A common Law approachChristian sermons and the law of defamation in Cameroon: A common Law approach

    No full text
The statutory guarantee of the right to worship and practice any religion in Cameroon entails the freedom to make utterances within Christian sermons and an obligation not to attack the reputation of individuals. Christian sermons have served as a medium for defamation, especially with revivalist or Pentecostal churches as they are commonly known. These institutions establish strong links with their worshipers causing them not to see any defects in their practices even if an injury to their reputation might lead to ostracism. Thus, persons whose reputations are injured hardly lay claims, as they fear being termed evil. This paper has been accomplished through visits to some churches, informal interviews, analysis of legal instruments, and content analysis of relevant literature. It establishes that even though Christian sermons have an impact on building good morals, they may also take advantage of the obedience of worshipers, ruining the lives of some individuals by injuring their reputations through false statements in sermons. This paper, therefore, demonstrates the possibility of laying claims for defamation in Christian sermons and proposes that massive sensitization on the existence of civil and criminal liabilities for defamation should be done to create awareness among aggrieved persons and to reduce the negative effect of fanaticismThe statutory guarantee of the right to worship and practice any religion in Cameroon entails the freedom to make utterances within Christian sermons and an obligation not to attack the reputation of individuals. Within the frame of Posthuman Studies, blue humanities emphasize the role of under-water perspectives in literary criticism. Here the strategy is applied to different poems by Jorie Graham, Laura Accerboni and Marwa Helal, in order to establish the sea as a major allegory of the Digital Era in terms of hardware, network and user-generated content.

One characteristic of the Italian DNA database derives from the legislative choice to create a specific subset of genetic profiles, with the purpose of identifying missing persons, corpses and unidentified human remains kept for some time in forensic institutes without being associated with a name. In this case the technology enables the identification of unknown corpses and human remains, allowing relatives to give homage to their loved ones. One characteristic of the Italian DNA database derives from the legislative choice to create a specific subset of genetic profiles, with the purpose of identifying missing persons, corpses and unidentified human remains kept for some time in forensic institutes without being associated with a name.

    No full text
By explicitly recognizing an «interest of future generations», the recent reform to the article 9 of Italian Constitution gives rise to a renewed discussion of the main conceptual and institutional predicaments in view of realizing true and proper avenues for intergenerational justice. In this paper, I will sketch the major ethical, as well as political and legal problems regarding this matter, while also depicting – by means of a legal-phenomenological investigation – an apt model of representation and recognition, such that future-oriented claims may find a genuine space for their acknowledgment and expression.

    No full text
The Italian Constitution was recently amended to include «animal protection» as a subject over which the State has exclusive legislative power (see art. 9, par. 3). The aim of this paper is to explore the possible ramifications and long-term impact of this apparently small modification, specifically on animal law and policy. Will animal personhood and rights become a reality? And would such a change be in line with the constitutional order? Finally, could the animal-robot analogy prove useful, when problematizing the legal thinghood of animals and exploring the feasibility of animal (and robot) rights?

From the UK Abortion Act 1967 to the present: the woman’s decision-making journey

The aim of this paper is to analyse the relationship between women’s empowerment on the issue of abortion and their need for a supportive and informed deliberative process in the UK scenario. The UK Abortion Act 1967 and current proposals to change the law on abortion, though starting from different places, seem not to properly tackle the complexity behind the woman’s decision-making process. The paper focuses on the two most relevant factors, timing and reasons, involved in the woman’s deliberative process concerning termination of pregnancy, pointing out the strengths and weaknesses in the law and medical guidelines when it comes to safeguarding this process. From the 1960s to the present the British Medical Association (BMA) and the Royal College of Obstetricians and Gynaecologists (RCOG) – two of the main stakeholders – have shown a clear shift in their approach to the law on abortion and related policies from a more medical approach to a wider focus on women’s personal choice. Nonetheless this shift – which has been reflected in new legislative proposals to amend the Abortion Act 1967 – should not compromise recognition of women’s need to receive the social and medical support they deserve during a challenging and possibly life changing process.  &nbsp

Creative AI: The Complex Relationship between Human Inventiveness and Intellectual Property

    No full text
In the development of patent law, inventive step has traditionally been viewed as something essentially human. This paradigm is now being challenged by the possibility of using creative AI systems capable of independently generating new inventions: The so-called creative — physical or virtual — programs and robots have therefore triggered a series of considerations that are not easily resolved within the current framework of patent law. Indeed, there is no consensus that machines can be called inventors. In this paper, we will attempt to explore the complex relationship between creation, protection, human inventiveness, and intelligent, creative and interactive robots and AI systems. In particular, we will clarify whether inventions brought about by AI require a complete reassessment of key concepts in patent matters. &nbsp

Stato di detenzione e libertà di cura

    No full text
The essay analyzes the relation between state of detention and constitutional rights linked to health, focusing on the ones that can be recognized as rights of freedom: the claim that no one could prejudice other’s health, but also freedom of therapy, that includes either freedom from obligatory treatments either the possibility to choose between different possible therapies, doctors and treatment centers. Each of these aspects shows, for persons restricted in their personal freedom, many problematics profiles that are examined. To cope with these, sector operators are called to particular and special efforts, in order to made real and concrete the recognition of constitutional rights to restricted persons.
