    Recovery of Fiscal State Aid in Tax Ruling Cases and Principles of Legitimate Expectations and Legal Certainty

    This paper will shed a light on the application of legitimate expectations and legal certainty principles against recovery orders in tax ruling cases. Between 2014 and 2022, the European Commission\u27s investigations and the decisions following these investigations in some member states\u27 tax ruling practices caused a massive boom in European Union State Aid law literature. Apple, Fiat, and Starbucks cases are among the main scenarios in that storyline. Recoveries of fiscal state aid were ordered as unpaid taxes for up to ten years in the past in these cases. To illustrate, the recovery order was 13 billion euros for Apple and around 20-30 million euros for Fiat and Starbucks decisions. Most interestingly, pleading general principles of European Union law such as legitimate expectations and legal certainty principles against recovery orders did not succeed in opposing the estimations. Therefore, this paper will try to address the application of legitimate expectations and legal certainty principles against recovery orders. The main focus will be how these principles should be applied when it deals with the novel and unpredictable interpretations of European Union State Aid rules. To this end, the clear examples from the Apple, Fiat, and Starbucks tax ruling cases will be drawn.     This study examines the nuances of the regulation of Islamic banking and finance in Nigeria, the UK, and Indonesian jurisdictions, addressing the challenges and prospects for these legal systems and/or economies. The research adopts a qualitative methodology, drawing theory from a vast trove of literature from authors on the African, Asian, and European continents. The basis for bringing this topic into discussion revolves around the undeniable significance that Islamic finance now has in certain parts of the world. Islamic banking dominates the worldwide Islamic finance industry, representing 80% of Islamic finance assets. There is growing concern for the subpar usage of the practice in certain jurisdictions. Most literature does not question this need, perhaps due to the general acceptance of the conventional banking system worldwide. Previous research works are yet to undertake a comparative assessment of the usage of Islamic banking and finance practices among jurisdictions, spanning representative nations from diverse regions and continents, thus occasioning a gap in the literature. This article discusses the legal and regulatory provisions earmarking the practice of Islamic banking and finance in the jurisdictions using available literature. While each jurisdiction recognizes the practice of Islamic finance, those in Indonesia and, to a good extent, the UK, have richer provisions for its development. Thus, while taking cognizance of the social-cultural contexts, a critical assessment of the regulatory mechanisms in Nigeria is carried out against the background provided by the Indonesian and English legal systems. It is found that for there to be a robust appropriation of the practice in the jurisdictions, especially Nigeria, a forward-looking system must be adopted

    Non è facile ricostruire, né tanto meno giudicare gli sviluppi dell’estetica italiana nella seconda metà del novecento e, in particolare, tra gli anni settanta e gli anni ottanta. Tra le diverse discipline filosofiche, l’estetica è probabilmente quella che ha conosciuto la maggior apertura dei suoi margini epistemologici e il più ampio coinvolgimento di oggetti e di ambiti investigati.     È il 20 settembre 1980 quando Giulio Einaudi fa uscire al numero 283 della collana Nuovi Coralli L’opera, secondo romanzo scritto da Emilio Tadini. Scritto su commissione, per un\u27altra collana di gialli, il romanzo cambiò di destinazione editoriale, restando ancorato all\u27idea di trattare del mondo dell\u27arte. Pur vestendo i panni del romanziere, Tadini svolse qui un ruolo ancora critico, specie nei confronti di alcuni fenomeni dell\u27arte coeva; intento che si spiega alla luce delle riflessioni vergate dall’artista stesso a introduzione di alcune sue mostre personali tenutesi fra 1976 e 1978, oltre a una serie di grandi quadri “a tesi”, che inevitabilmente fanno corto circuito con il racconto intessuto nel romanzo L’opera

    This contribution offers the first Italian translation of Les champignons de Paris, an Amélie Nothomb\u27s short story published on Charlie Hebdo in 2007. Observing the structure and the style of the original, this translation, accompanied by an introduction and by a set of explanatory notes, aims to show how Nothomb\u27s poetic is the same used in long form, emphasized by an open irony. Also, we can read the text as a proof of the author\u27s engagement, related to the history of the French satirical weekly magazine.Nel 2007, Amélie Nothomb pubblica una novella dal titolo Les Champignons de Paris sul giornale satirico francese Charlie Hebdo. Questo contributo ne propone la traduzione inedita, tesa a rispettare e sottolineare lo stile dell\u27originale, preceduta da un commento. Si vuole mostrare come il testo sia prova di un certo engagement dell’autrice e come la poetica di Nothomb si sia mantenuta intatta anche in una forma diversa da quella del romanzo e che anzi, alcuni aspetti, come l’ironia, ne risultino esaltati

    The aim of this article is to study the main lines of the diffusion of Hispano-American Modernist poetry in Italy, through the definition of a corpus of translations of the main authors of that literary current in our country. The analysis will focus on the translations that appeared in single volumes and in the numerous anthologies of Hispano-American poetry between the 1960s and 1980s. The analysis of this corpus will show how little Modernism has been known in Italy, and in a way that is often conditioned by the critical views of the various moments in which its diffusion took place. The history of his diffusion will then pass through the analysis of the volumes of individual authors and their presence in anthologies of Hispanic-American poetry. My attention will focus in particular on the poetic production, which is largely in the majority in the volumes examined, with particular attention to those paratextual apparatuses – introductions, biographical notes, translators\u27 notes – that aim to situate the authors in a precise historical period and in a literary current that is little known in Italy.In questo articolo si intendono tracciare le linee principali della diffusione della poesia modernista ispanoamericana in Italia, attraverso la definizione del corpus delle traduzioni dei principali autori di quella corrente letteraria nel nostro paese. L’analisi si concentrerà sulle traduzioni apparse in volumi singoli e nelle numerose antologie di poesia ispanoamericana tra gli anni Cinquanta e Ottanta. L’analisi di questo corpus mostrerà come il Modernismo sia poco conosciuto in Italia, e in modo spesso condizionato dalle visioni critiche dei vari momenti in cui ha avuto luogo la sua diffusione. La storia della sua diffusione passerà allora attraverso l’analisi dei volumi dei singoli autori e la presenza nelle antologie di poesia ispanoamericana. La mia attenzione si concentrerà in particolare sulla produzione poetica, ampiamente maggioritaria nei volumi presi in esame, con una particolare attenzione verso quegli apparati paratestuali – introduzioni, note biografiche, note dei traduttori – che hanno come scopo quello di situare gli autori in una precisa epoca storica e in una corrente letteraria poco conosciuta in Italia

    This contribution analyses Sergio Solmi\u27s five translations from Stephen Spender in a contrastive manner to highlight the emblematic features of his translation practice and to underline some licences. Starting from a remark by Mengaldo about Solmi\u27s versions as an «acclimatazione alla libertà regolata vigente nella contemporanea poesia italiana», the main features of the formal «appaesamento» realised by the translator, his «projet de traduction» as Berman would say, were highlighted through a precise metric-stylistic analysis.Il contributo analizza in modo contrastivo cinque versioni di Sergio Solmi da Stephen Spender per mettere in luce le caratteristiche emblematiche della sua pratica traduttoria e sottolinearne alcune licenze. Riprendendo un’osservazione di Mengaldo sulle versioni solmiane come «acclimatazione alla libertà regolata vigente nella contemporanea poesia italiana», si sono evidenziati i caratteri salienti dell’«appaesamento» formale realizzato da Solmi, il suo «projet de traduction» per dirla con Berman, attraverso una puntuale analisi metrico-stilistica

    On Fenoglio\u27s La paga del sabato: The Partisan as Veteran

    In this article I explore three aspects of Beppe Fenoglio’s La Paga del Sabato that are crucial for the understanding of the author’s immediate post-war treatment of the Resistenza. Through a close reading of selected passages and taking into consideration the early criticism posed by the editor of “I Gettoni” Elio Vittorini (and Fenoglio’s response to it), I investigate the cinematic writing style of the novel, the literary model offered by the Italian translation of Hemingway’s short story Soldier’s Home, and the author’s rejection of the official memorialization of the Resistance. I argue that in this text Fenoglio draws a self-representing portrayal of the “imperfect” partisan - a survivor who has not fulfilled the experience of war. The main character Ettore, suffering from PTSD, is incapable of reintegrating into civilian society after the existential rift of wartime. He and his fellow partisan Palmo are not given the honor of a valorous death in battle, and therefore never enter the realm of what Saccone called the “perfect” partisan, rather emerging as unique literary examples of partisan-veteran figures.  In questo articolo si esplorano tre prospettive critiche su La Paga del Sabato di Beppe Fenoglio al fine di comprendere il trattamento narrativo che l’autore fa della materia resistenziale. Attraverso la lettura attenta di specifici passaggi del testo, e prendendo in considerazione le critiche mosse all’autore dal curatore de “I Gettoni” Elio Vittorini (nonché la risposta a tali critiche da parte di Fenoglio), se ne esplorano gli stilemi cinematici, il modello letterario offerto dalla traduzione del racconto breve Soldier’s Home di Ernest Hemingway e il rifiuto della commemorazione ufficiale della Resistenza. Da tale analisi emerge un autoritratto del partigiano “imperfetto” – un reduce che non ha portato a compimento l’esperienza bellica fino alle estreme conseguenze. Il protagonista Ettore, vittima di stress post-traumatico, è incapace di reinserirsi nella società civile in seguito all’esperienza vissuta in guerra. Ettore e il suo compagno partigiano Palmo non ricevono l’onore di una valorosa morte in battaglia, non riuscendo a entrare nella dimensione del partigiano “perfetto” come definito da Saccone. Ne emergono dunque come figure originali nella letteratura della Resistenza, ovvero come reduci-partigiani

    Brevitas Americana: Stephen Crane, traduzione poetica e visibilità modernista

    With the unfolding of the new millennium, Stephen Crane’s first volume of poetry, The Black Riders and Other Lines (1895), has been reassessed as one of the four works that «defined the shape of American poetry» in the nineteenth century as well as «the first American book printed with a clear Modernist design» (McGann). In a similar vein, its young author has been granted the status of «first American modernist» (Auster). Following such bold reappraisals, this essay explores some of Crane’s shorter poems with a focus on different aspects of translation. Characterized by conciseness and projections of linguistically contracted and expressively dense imagery, Crane’s lines share a common ground of visualization across a range of signifying systems. These lines generate powerful interactions between verbal and nonverbal arts; solicit intralingual and intrasemiotic transmutations; foreground intertextual and semantic complexities at the crossroads where intersemiotic and interlingual translation meet and join in the challenge that turns the literary translator’s task into an even more daunting one.In questi primi decenni del Duemila, The Black Riders and Other Lines (1895) di Stephen Crane è stato rivalutato non solo come «uno dei quattro libri» che «hanno dato forma alla poesia americana» dell’Ottocento, ma anche come «il primo libro americano stampato con un evidente design modernista» (McGann). Parimenti, il suo autore è stato eletto al ruolo di «primo modernista americano» (Auster). Sulla scia di tali audaci affermazioni, questo saggio esplora alcune liriche di Crane in relazione a diversi aspetti della traduzione. Caratterizzate da brevitas e proiezioni immaginative ad alta compressione linguistica e densità espressiva, le poesie del giovane americano si collocano all’interno di un terreno condiviso di visualizzazione, a cavallo di diversi sistemi di segni. I suoi versi generano potenti interazioni tra arte verbale e non verbale; sollecitano trasmutazioni endolinguistiche e intrasemiotiche; mettono in rilievo complessità intertestuali e semantiche a un crocevia in cui traduzione intersemiotica e traduzione interlinguistica convergono e si affiancano a sfidare ancor più il compito del traduttore letterario
