    With Constitutional Law 1 of 2022, the constitutional lexicon was enriched with new locutions (“biodiversity,” “ecosystems,” “future generations”) that embody more than just a legal dimension. From the perspective of constitutional law, by hierarchizing environmental value, Article 9 Const. has placed it in a balancing condition with other fundamental public interests. From a constitutional policy perspective, the “new words” chart the path for a different form of progress, which law alone cannot fully reflect, based on the preeminent value of intergenerational solidarity and which requires, for its full realization, a transformation of social ethics.Con la legge cost. 1 del 2022, il lessico costituzionale si è arricchito di nuove locuzioni (“biodiversità”, “ecosistemi”, “future generazioni”) che incarnano una dimensione non soltanto giuridica. Sotto il profilo del diritto costituzionale, gerarchizzando il valore ambientale, l’art. 9 Cost. lo ha posto in una condizione di bilanciamento con gli altri interessi pubblici fondamentali. In una prospettiva di politica costituzionale, le “nuove parole” tracciano il percorso per una diversa forma di progresso, che il solo diritto non è in grado di riflettere compiutamente, basata sul valore preminente della solidarietà intergenerazionale e che richiede, per la sua piena realizzazione, una trasformazione dell’etica sociale

    The contribution analyzes the main trends of climate change litigation, against both public entities and private parties, in Italy and abroad, highlighting the most relevant procedural issues. Starting from the famous "Giudizio universale", the first Italian climate litigation case brought before the civil court in Rome (with elements of originality compared to previous European litigation experiences), the contribution will address the legal foundation of the actions (or causa petendi), the locus standi, even in collective forms, the most appropriate fora (court or arbitration) and their reciprocal relationship, the effectiveness of protection, the causation link and the the applicable law.Il contributo analizza i principali trends del cd. “contenzioso climatico”, nei confronti sia di entità pubbliche che di soggetti privati, in Italia e all’estero, evidenziando le più rilevanti problematiche processuali. Prendendo spunto dal celebre “Giudizio universale”, il primo contenzioso climatico italiano radicato presso il Tribunale civile di Roma (con elementi di originalità rispetto alle precedenti esperienze contenziose europee), si affronteranno temi quali il fondamento giuridico delle azioni (o causa petendi), la legittimazione attiva, anche in forme collettive, i fora (giudiziali o arbitrali) più adeguati e il reciproco rapporto, l’effettività della tutela, il nesso di causalità, la legge applicabile

    Climate change and food security in the One Health perspective

    In the age of the Anthropocene, climate change has become a problematic issue full of undelayable challenges, both for the food system governance and their effects on public health. The main aim of this paper is to define terms and conceptualise the dual connection between climate and food; secondly, its purpose is to intercept the potential climate change effects on food security four dimensions: availability, accessibility, utilization and stability of food resources; furthermore, it aims to highlight the functional relevance of the holistic One Health approach in order to assess its opportunities for transformation and improvement of food sustainability. The final goal is to unhide that this perspective represents a prolific path for the preparation of effective regulatory and policy strategies, in line with the emerging mitigation paradigm. &nbsp

    Unlocking the Synergy: Artificial Intelligence and (old and new) Human Rights

    Artificial intelligence (AI) deeply and pervasively impacts our lives. In this short paper, I propose two lines of thoughts aimed at updating the catalog of human rights in light of the potential and risks of AI (mainly Machine Learning). The first considers the adaptation of certain traditional principles (informed consent and non-discrimination) to the challenges posed by AI. The second covers four new rights, built upon the specific characteristics of AI systems, with the aim of effectively addressing AI pros and cons.Artificial intelligence (AI) deeply and pervasively impacts our lives.     Il ruolo di mediazione all’interno del Comitato Nazionale per la Bioetica

    Ethics committees (ECs) constitute a galaxy of organisms for which different functions and compositions are provided. This contribution focuses on some aspects related to the configuration of the Italian National Bioethics Committee, analysing its functions of mediation-representation and mediation-conciliation. To this end, emphasis will be placed on the criteria chosen for the composition of an organism aimed at reflecting as much as possible the cultural and religious pluralism present in the country. Finally, some reflections will be advanced regarding how the role of a member of the National Bioethics Committee can be interpreted and the delicacy of acting within a public body that aims to seek mediation to achieve the maximum possible consensus. The search for the ideal solution must therefore be reconciled with that of a common, realistic, and practicable position, taking into account the context in which the opinions of a committee like the CNB are read and received.I comitati etici costituiscono una galassia di organismi per cui sono previste funzioni e composizioni differenti. Il presente contributo si concentra su alcuni aspetti relativi alla configurazione del Comitato Nazionale per la Bioetica, analizzandone la funzione di mediazione-rappresentanza e quella di mediazione-conciliazione del CNB. A tale fine si darà rilievo ai criteri scelti per la composizione di un organismo volto a riflettere il più possibile il pluralismo culturale e religioso presente nel Paese. Infine, si avanzeranno alcune riflessioni relative al modo in cui possa essere interpretato il ruolo di componente del CNB e della delicatezza dell’agire all’interno di un organismo pubblico che mira a cercare una mediazione per raggiungere il massimo consenso possibile. La ricerca della soluzione ideale deve dunque conciliarsi con quella di una posizione comune, realistica e praticabile, che tenga conto del contesto entro cui i pareri di un Comitato come il CNB vengono letti e recepiti

    This article analyses the right to health care in Spain from a multilevel perspective. The right to health is guaranteed by the Spanish Constitution, but it has not been interpreted by the Constitutional Court that there is a constitutional obligation to provide free health care to everyone in all cases, which, in the past, led to a situation in which the right to free health care was eliminated, with some exceptions, for some migrants. Spain also has international obligations regarding the right to health, derived from international treaties. The right to free health care is an essential right for the protection of the right to physical integrity and to life and health is a basic need for the lives of peoples without which it is difficult to live and exercise other rights.This article analyses the right to health care in Spain from a multilevel perspective.     The article explores some of the issues that arise regarding the use of organoids in clinical and research settings. After introducing the theme of using democratic participation tools in biotechnological contexts, the text addresses some of the main bioethical and biojuridical issues related to organoids through the discussion of the results of a Deliberative Workshop conducted within the Hybrida project – Embedding a comprehensive ethical dimension in organoid-based research and resulting technologies.L’articolo esplora alcune delle questioni che emergono rispetto all’utilizzo degli organoidi in ambito clinico e di ricerca. Dopo aver introdotto il tema dell’utilizzo di strumenti di partecipazione democratica in ambito biotecnologico, il testo affronta alcune delle principali questioni bioetiche e biogiuridiche che riguardano gli organoidi attraverso la discussione dei risultati di un Deliberative Workshop svolto nell’ambito del progetto Hybrida – Embedding a comprehensive ethical dimension in organoid-based research and resulting technologies

    The aim of this paper is to consider the ways and intentions of Milo de Angelis’ translation experience of Lucretius’ De rerum natura. The first part of the article will provide a comparison between the translation of a Lucretian passage, operated by the editorial board of Niebo, quarterly journal of poetry led by De Angelis himself for three years, and a later version of the same passage operated by De Angelis alone. This will highlight the shift between a translation that remains completely faithful to the ancient author and one that operates more freely. In the second part, the paper will consider the progression of De Angelis’ lecture of De rerum natura, by analyzing some passages from the Lucretius’ anthological collection, Sotto la scure silenziosa (SE 2005), and by showing the evolution of translation toward a proper ‘rewriting’.In questo lavoro sono indagate le modalità e le intenzioni dell’esperienza traduttiva di Milo De Angelis intorno al De rerum natura di Lucrezio. Nella prima parte della ricerca si proporrà il confronto tra un brano lucreziano tradotto dalla redazione di Niebo, rivista quadrimestrale di poesia, diretta per tre anni da De Angelis, con una traduzione successiva ad opera del solo De Angelis, mettendo in luce l’evoluzione da una resa complessivamente fedele all’autore antico ad una resa più libera. Nella seconda parte, il lavoro considererà lo sviluppo della lettura deangelisiana del De rerum natura, analizzando alcuni brani tratti dalla raccolta antologica lucreziana Sotto la scure silenziosa (SE 2005) e mostrando l’approdo ad una traduzione che si presenta nella forma di una riscrittura vera e propria

    Gustav Meyrink’s Der Golem (1915), translated into Italian in 1926, was a fantastic novel with a huge publishing success. Its fast reception in Italy is not only justified by the interest in esoteric or horror literature, but also by the modernist writing that characterises it. Translator and editor Enrico Rocca reads it as a “surrealistic composition”, in which new and significant trends in the literature and arts of the 1910s and 1920s converge, amalgamate and transform, and in which the title figure of the novel is deliberately rendered “invisible”.Il Golem di Gustav Meyrink (1915), tradotto in italiano nel 1926, fu un romanzo fantastico dal grandissimo successo editoriale. La sua veloce ricezione in Italia non si giustifica solo con l’interesse per la letteratura esoterica o dell’orrore, ma va ricondotta alla scrittura modernista che lo caratterizza. Il traduttore e curatore Enrico Rocca lo legge come una “composizione surrealista”, nella quale confluiscono, si amalgamano e si trasformano nuove e significative tendenze delle letterature e delle arti degli anni Dieci e Venti del Novecento e nella quale la figura che dà il titolo al romanzo è resa volutamente “invisibile”

    The article deals with summarizing the birth and development of systemdigtning - systemic poetry - in Denmark and then deals with the parable of Inger Christensen, who was its most famous exponent, then moving on to analyze the possibilities and obstacles in translation when the system maintained by the writer in the poetic composition is extralinguistic and when instead it represents a traditional but extremely impervious poetic form.  L’articolo si occupa di riassumere la nascita e lo sviluppo della systemdigtning – poesia sistemica - in Danimarca e affronta poi la parabola di Inger Christensen, che ne è stata l’esponente più nota, passando poi ad analizzare le possibilità e gli ostacoli nella traduzione quando il sistema affiancato dall’autrice alla composizione poetica è extralinguistico e quando invece rappresenta una forma poetica tradizionale ma estremamente impervia. &nbsp
