    Starting from an indication by Deleuze, according to whom even transcendental philosophy fails to arrive at an adequate concept of immanence, the essay sets out to test this assumption by studying the way in which, in the history of idealism, thought has been understood as \u27transcendent\u27 with respect to individual thinking selves. This feature emerges particularly clearly in the parable from Hegel to the father of British Idealism Thomas Hill Green, whose theory of eternal consciousness was criticised by another idealist philosopher, Andrew Seth Pringle-Pattison, as a modern form of averroism.Starting from an indication by Deleuze, according to which even transcendental philosophy would not arrive to an adequate concept of immanence, the paper tests this assumption by studying the way in which, in the history of idealism, thought was understood as “transcendent” with respect to individual thinking selves.     The article proposes an analysis of Schleiermach\u27s discussion of the question of miracles, a discussion which lasted for more than thirty years - from the first edition of On Religion: Speeches to Its Cultured Despisers in 1799 to the last edition of the Glaubenslehre in 1830/31. This discussion places itself on the one hand at the conclusion of the long process of hermeneutic accommodation of religious contents with respect to post-Copernican science and, on the other hand, at the beginning of a further season of religionistic research: the problem of the miracle either as accommodation, or as a contrast between science and religion is, in fact, transcended towards a properly religious understanding of it

    Even if critics have rarely paid due attention to it, the theme of the miracle is particularly present in Blaise Pascal’s thought. This paper aims to render Pascal’s entire discussion of the miracle issue, considering his whole production and not only fundamental works such as Pensées [Thoughts] or Lettres provinciales [The provincial letters]. This approach highlights a very rich and articulated theory, which exceeds the apologetic logic alone. As the experimental thinker he was, Pascal started from a concrete miracle-event (the miracle of the Holy Thorn), of which he was a direct witness and of which he sought confirmation. His entire analysis of the miracle as an object of faith is based on this, a faith that however, in this singular way, offers the ‘proofs’ of itself. Believers will not believe thanks to miracles; however, miracles speak to that ‘reason of the heart’ which feels, intuits, grasps, and sees what is usually not visible

    Dobbs, the pronouncement that upended 50 years of abortion rights in the United States, has been generally perceived as a totally unexpected decision. Yet, it is since longtime that its germs have been growing underneath. The essay aims to locate where and when the seeds for the overturning of the right to abortion in the United States have been sowed. It, moreover, highlights the future dangers arising from Dobbs on two levels: its possible outreach in terms of further heinous constraints upon women’s reproductive autonomy on one hand, and – on the other hand – the decline of the Supreme Court’s legitimacy to assert its judicial review power looming from it.La sentenza Dobbs, che è sembrata giungere come un fulmine a ciel sereno, rappresenta in verità l’epilogo di un lungo cammino di svuotamento del diritto di abortire costituzionalmente garantito alle donne statunitensi nel 1973. Il saggio indaga le differenti vie attraverso cui, sotto la superficie dell’attribuzione di un’ampia libertà decisionale alle donne, la forte resistenza nei confronti di un loro diritto a effettuare scelte relative alla propria capacità riproduttiva non ha mai cessato di lavorare a pieno ritmo negli Stati Uniti. Si interroga, infine, sui possibili e dirompenti effetti di Dobbs, tanto sul piano dell’autonomia riproduttiva della donna, quanto su quello della perdita di legittimazione di una Corte Suprema apparsa eccessivamente politicizzata

    The protection of the mental health of detained persons continues to be a forgotten (or deliberately ignored) issue by our legislator. None of the reform proposals, including those of government initiative, relating to this aspect has in fact been included in the regulatory measures to amend the penitentiary system, which – amidst reluctance and timidity – have been approved in recent years. In the paper, an attempt is made to outline the possible contribution of substantial criminal law to the urgent redesign of the model of treatment and care of mental distress in prison and of supervening insanity. The limited adjustments made through the work of the jurisprudence, including constitutional ones, are not in fact sufficient to deal with a situation whose dramatic nature is made evident by the shocking number of suicides in prison (84 last year).La tutela della salute mentale delle persone detenute continua ad essere una questione dimenticata (o volutamente ignorata) dal nostro legislatore. Nessuna delle proposte di riforma, comprese quelle di iniziativa governativa, relative a questo aspetto è stata infatti inserita nei provvedimenti normativi di modifica dell’ordinamento penitenziario, che – tra reticenze e timidezze – sono stati approvati in questi anni. Nello scritto si prova a delineare il possibile contributo del diritto penale sostanziale alla urgente riprogettazione del modello di trattamento e cura del disagio psichico in carcere e della infermità mentale successiva alla condanna. I limitati adeguamenti realizzati attraverso il lavoro della giurisprudenza, anche costituzionale, non sono infatti sufficienti a fronteggiare una situazione la cui drammaticità è resa evidente dall’impressionante numero di suicidi in carcere (84 nel corso dello scorso anno)

    The Courts and effective judicial protection during the Covid-19 pandemic. A comparative analysis

    What role have the courts played during the pandemic? How different has this role been across the globe? Can lessons for a better response to health crises and emergencies be learned from litigation? Starting from these questions, the authors present the main findings of an international project on Covid-19 litigation aimed at collecting and comparing caselaw, within an openly accessible database, from more than 80 countries on all continents, concerning the impact of public health measures upon fundamental rights and freedoms of citizens during the pandemic. This comparative analysis, based on a set of around 2000 decisions from 2020-2022, shows that, although courts have faced very similar challenges, distinct legal traditions have led judges to use different balancing techniques with different outcomes in terms of the control of public powers and available remedies. Actions and omissions have been differently addressed and the evolution of science has significantly impacted judicial review. Areas of litigation have changed overtime, mirroring the evolution of the pandemic and the modifications of governmental strategies. More recently, liability claims are emerging and will probably grow in the near future, offering courts from all over the world a further opportunity to learn from each other. Based on the experience of governments, revisited through the lenses of Covid-19 litigation, scholars, scientists, and policy makers have the opportunity to build on this heritage with the objective of building a better response to future health emergencies that fully respect fundamental rights and the rule of law.What role have the courts played during the pandemic?     The article starts from the examination of two recent rulings of the Constitutional Court concerning the system of Residences for the execution of security measures (order n. 131/2021 and sentence n. 22/2022). At the outcome of the preliminary investigation and of the unconstitutionality, detected but not declared, it emerges that the evolution path of the system of detention security measures, which has gone from hospitalization in judicial psychiatric hospitals to placement in exclusively healthcare management structures, it is still in progress. In fact, interventions are necessary to overcome the main criticalities of this system (including waiting lists), which, in order to be effective, require a serious political and financial commitment.Il contributo parte dalla disamina di due recenti pronunce della Corte costituzionale concernenti il sistema delle Residenze per l’esecuzione delle misure di sicurezza (ordinanza n. 131/2021 e sentenza n. 22/2022). All’esito dell’istruttoria e dell’incostituzionalità, rilevata ma non dichiarata, emerge che il percorso di evoluzione del sistema delle misure di sicurezza detentive, il quale è passato dal ricovero presso gli ospedali psichiatrici giudiziari alla collocazione presso delle strutture a gestione esclusivamente sanitaria, è ancora in divenire. Sono, infatti, necessari interventi volti a superare le principali criticità di tale sistema (tra cui le liste d’attesa), i quali, per poter essere efficaci, richiedono un serio impegno politico e finanziario
