Cambiamento climatico e sicurezza alimentare: dall’approccio One Health ai modelli olistici del Global South
No full textThe article analyzes the impact of climate change on food security and the right to food, exploring different regulatory models deemed to address the challenges produced by climate change in food systems, within the framework of recommendations from international institutions. The essay identifies certain integrated regulatory approaches applicable to agrifood regulation on which a widespread consensus in the scientific community and among international institutions may be appreciated. Among these are the One Health approach, the ecosystem approach, the models inspired by agroecology, and the so-called human rights-based approach (HRB). The paper discusses their effectiveness in promoting food security and climate resilience, attempting to verify the presence of regulatory provisions inspired by such approaches in existing food legislation. In such respect, the article examines the recent European "From farm to fork" strategy and certain approaches in the context of the Global South.L\u27articolo analizza l\u27impatto dei cambiamenti climatici sulla sicurezza alimentare e il diritto al cibo, esplorando diversi modelli normativi per affrontare le sfide prodotte dal cambiamento climatico nei sistemi alimentari, nel quadro delle raccomandazioni provenienti dalle istituzioni internazionali. Vengono identificati alcuni approcci normativi integrati applicabili alla regolazione agroalimentare sui quali si registra un diffuso consenso nella comunità scientifica e tra le istituzioni internazionali. Si tratta dell’approccio One Health, di quello ecosistemico, dei modelli ispirati all’agroecologia e dell’approccio c.d. human rights-based (HRB). Il contributo esamina la loro efficacia nel promuovere la sicurezza alimentare e la resilienza climatica, tentando di riscontrare previsioni ad essi ispirati nella recente strategia europea “From farm to fork” e nell’impostazione di fondo di alcuni dei modi di intendere le risposte del diritto alle sfide prodotte dal cambiamento climatico nel contesto del Global South

No full textThe Jehovah’s Witnesses’ refusal of blood transfusions has traversed legal and scientific culture for several decades, leaving an indelible mark. The analysis starts from the religious motivations for such a choice, and examines the propulsive stimulus offered to the judiciary to cover the regulatory gap with its decisions, to the legislature to pass the law on informed consent, and to physicians driven to develop new techniques and to apply bloodless medicine more and more widely. The article focuses on the particular use of advance directives in a pro-life sense, the important results achieved and the difficulties that still exist in the application of the patient’s right.Il rifiuto dei Testimoni di Geova di sottoporsi alle trasfusioni di sangue ha attraversato la cultura giuridica e scientifica per diversi decenni, lasciando un segno indelebile. La presente analisi parte dalle motivazioni religiose di tale scelta ed esamina lo stimolo propulsivo offerto alla magistratura per coprire il vuoto normativo con le sue decisioni, al legislatore per approvare la legge sul consenso informato, e ai medici motivati a sviluppare nuove tecniche e ad applicare sempre più diffusamente la “medicina senza sangue”. L\u27articolo si concentra sull\u27uso particolare delle direttive anticipate di trattamento in senso pro-vita, sugli importanti risultati raggiunti e sulle difficoltà che ancora esistono nell\u27applicazione del diritto del paziente

No full textIn Iran, the complex relation between science and law in the field of filiation is mainly in the hands of the ʿulamāʾ who are called to solve questions related to the legitimacy of children born from heterologous insemination or to discuss the concept of motherhood and surrogacy; at the same time the legislator seems unable to solve some of the doubts raised by the new technologies. While science in procreation is assisted by innovative doctrinal approaches, old questions like abortion are still accompanied by conservative solutions. The doctrine debates, whereas the statute law more often than not leaves room for doubts and uncertainty.In Iran, il complesso rapporto tra scienza e diritto nel campo della filiazione è principalmente nelle mani degli ʿulamāʾ che sono chiamati a risolvere questioni legate alla legittimità dei bambini nati da inseminazione eterologa o a discutere dei concetti di maternità e maternità surrogata; allo stesso tempo il legislatore sembra incapace di risolvere alcuni dei dubbi sollevati dalle nuove tecnologie. Get PDFThis article offers a study of Luigi Meneghello\u27s unpublished transposition into vicentine dialect of John Donne\u27s The Extasie. This is one of those linguistic torments that were eventually excluded from the volume Trapianti (Rizzoli, 2002) and that remained at the stage of manuscript drafts, preserved at the Meneghello Fund of the Centre for Studies on the Manuscript Tradition of Modern and Contemporary Authors at the University of Pavia. Within the article, the text of the translation is published and a first analysis of it is carried out, highlighting the various stages of development and focusing on the free manner in which Meneghello adapts the language, semantics and metre of the original text to the vicentine cultural and linguistic system, broadening also – in a bidirectional movement – the expressive potential of dialect, which is renewed in the interaction with Donne\u27s poetic language and enriched with neologisms and casts from English.Questo articolo propone uno studio dell’inedita trasposizione vicentina di The Extasie di John Donne realizzata da Luigi Meneghello. Si tratta di uno di quei tormenti linguistici che sono infine stati esclusi dal volume Trapianti (Rizzoli, 2002) e rimasti allo stadio di stesure manoscritte, conservate presso il Fondo Meneghello del Centro per gli studi sulla tradizione manoscritta di autori moderni e contemporanei dell’Università di Pavia. All’interno dell’articolo viene pubblicato il testo della traduzione e viene condotta una sua prima analisi, mettendone in luce le varie fasi di elaborazione e soffermandosi sulle modalità libere attraverso le quali Meneghello adatta la lingua, la semantica e il metro del testo originale al sistema culturale e linguistico vicentino, ampliando anche – in un movimento bidirezionale – le potenzialità espressive del dialetto, che si rinnova nell’interazione con il linguaggio poetico di Donne e si arricchisce di neologismi e calchi dall’inglese

No full textGustavo Bontadini (1903-1990) interpreted idealism as the completed realisation of modern philosophy. Idealism, understood in an \u27essential\u27 and not \u27rhetorical\u27 sense, is the thesis that thought is the manifestation of being. Experienced reality is the immediate realisation of thought. If experienced reality is considered in a strictly phenomenological sense, it becomes the starting point of an inference that leads thought to recognise a transcendent reality, which turns out to be freely creative of experienced reality itself.Gustavo Bontadini (1903-1990) interpreted idealism as the fulfillment of modern philosophy. Idealism, understood in an "essential" and not "rhetorical" sense, is the thesis according to which thought is the manifestation of being. Experience is the immediate realization of thought. If we consider experience in a strictly phenomenological sense, it becomes the starting point of an inference that leads thought to recognize a transcendent reality, which turns out to be freely creative of the experience itself
