    Data protection and AI compliance in health research: a relevant resource for institutions and companies against algorithmic vulnerability

    Artificial intelligence (AI) is becoming integral to health research, with applications in diagnosis, prognosis, and imaging segmentation across several medical fields. However, integrating health, biometric, and genetic data into AI systems raises ethical, legal, and practical challenges, particularly concerning discrimination and bias. Studies highlight the presence of bias, hindering AI model development in healthcare. Compliance with current legislation (e.g., GDPR), international frameworks (e.g., ISO), and forthcoming European AI regulation is pivotal. This paper emphasizes integrating these requirements into public entities and private organizations to ensure fair AI development and utilization in the health sector.L\u27intelligenza artificiale (AI) sta diventando parte integrante della ricerca sanitaria, con applicazioni nella diagnosi, nella prognosi e nella segmentazione delle immagini in diversi campi medici. Tuttavia, l\u27integrazione di dati sanitari, biometrici e genetici nei sistemi di IA solleva sfide etiche e giuridiche, in particolare per quanto riguarda bias e discriminazione. Diversi studi evidenziano la presenza di bias, che ostacolano lo sviluppo e l’impiego di modelli di IA nel settore sanitario. La conformità alla legislazione vigente (ad esempio, GDPR), agli standard internazionali (ad esempio, ISO) e alla normativa europea sull\u27IA è fondamentale. Questo articolo vuole sottolineare la necessità di una corretta implementazione di questi requisiti negli enti pubblici e nelle organizzazioni private per garantire uno sviluppo e un utilizzo corretto dell\u27IA nel settore sanitario

    Gender bias represent a source of vulnerability in current clinical practice as they can harm patients, especially those identified as gender minorities. This risk is increased in the age of AI-powered healthcare, which calls for redefining vulnerability and strategies to prevent algorithms from exacerbating already existing inequalities. To this end, we analyse the solutions proposed by the European Union\u27s recent AI Act.     The article addresses the complex issue of protecting minors in the digital age, highlighting its constitutional implications. It examines how the Digital Services Act (DSA) has revitalized the issue of safeguarding children’s rights online and how proceedings have been initiated against some digital giants for allegedly being harmful to minors. The discussion includes the historical context of digital maturity laws, comparing the Children’s Online Privacy Protection Act (COPPA) with the European General Data Protection Regulation (GDPR). It concludes by invoking the doctrine of “constitutional precaution”, which argues that the protection of minors’ fundamental rights should be guaranteed in the design of new technologies, emphasizing the need to balance protection measures with the safeguarding of young users’ rights.L\u27articolo affronta la complessa questione della protezione dei minori nell\u27era digitale, sottolineandone le implicazioni costituzionali. Esamina come il Digital Services Act (DSA) abbia dato nuova linfa al tema della salvaguardia dei diritti dei bambini online e come siano stati avviati procedimenti contro i alcuni colossi del digitale proprio con l’accusa di essere dannosi per i minori. Viene inoltre delineato il contesto storico delle leggi sulla maturità digitale, confrontando il Children\u27s Online Privacy Protection Act (COPPA) con il Regolamento Generale sulla Protezione dei Dati (GDPR) europeo. Si conclude facendo appello alla dottrina della “precauzione costituzionale”, affinché la protezione dei diritti fondamentali dei minori possa essere garantita nella progettazione di nuove tecnologie, sottolineando la necessità di operare un bilanciamento tra istanze di tutela e garanzia dei diritti dei giovani utenti

    This paper examines the connection between Michel Foucault and antipsychiatry, taking his 1973–1974 lectures Psychiatric Power as a starting point. Our analysis begins by observing how the problem of madness reemerges in Foucault’s work both because of its affinity to the currents critical of psychiatry and the transformations of the French intellectual field at the time. From this situated perspective, Psychiatric Power becomes particularly relevant because it allows us to connect the three fundamental problems of all Foucauldian work—knowledge, power, subjectivity—around the critical analysis of the modern political technologies.This paper examines the connection between Michel Foucault and antipsychiatry, taking his 1973–1974 lectures Psychiatric Power as a starting point.     The essay analyzes the topic of psychosocial risks in light of evolving technologies that increasingly permeate the spaces and times of life and work, blurring their boundaries and harming the intangible dimensions of the individual. In response to the significant changes taking place in techno-capitalist society, the essay advocates for a rethinking of the relationships between individuals, work and health, emphasizing a person-centered approach. This perspective recognizes the essential and driving value of human resources for the development of businesses and the entire production system.Il saggio analizza il tema dei rischi psicosociali alla luce dell’evoluzione delle tecnologie che sempre più pervadono spazi e tempi di vita e di lavoro fino a farne smarrire i confini, con ricadute lesive dei profili immateriali della persona. A fronte dei significativi cambiamenti che si registrano nella società tecno-capitalista si suggerisce un ripensamento dei rapporti tra persona, lavoro e salute, in una direzione volta a porre la persona al centro, tenendo conto del valore determinante e propulsivo che la risorsa umana riveste, pure per lo sviluppo dell’impresa e dell’intero sistema produttivo

    This study addresses the right to health information in the Spanish legal system from a constitutional point of view, with special attention to the field of psychiatry. Firstly, it analyses the constitutional basis of the information provided in the doctor–patient relationship and the legal regime provided for in the Spanish Law on Patient Autonomy. Finally, it studies more specifically the information of psychiatric patients at the state level and the only specific law that exists at the autonomous level, in the Community of La Rioja.Questo studio affronta il diritto all’informazione sanitaria nell’ordinamento spagnolo da un punto di vista costituzionale, con particolare attenzione al campo della psichiatria. In primo luogo, si analizza la base costituzionale delle informazioni fornite nella relazione medico – paziente e il regime giuridico previsto dalla Legge spagnola sull’autonomia del paziente. In seguito, vengono studiate in modo più specifico le informazioni sui pazienti psichiatrici a livello statale e l’unica legge specifica esistente a livello regionale, nella Comunità di La Rioja

    The article is an introductory overview of the relationship between Rosmini and Second Scholasticism. Rosmini considers the XIIIth century as the Golden Age of Scholasticism, but he also observes a decline of Scholasticism from the XIVth up to the Enlightenment. However, he notes some positive aspects of the XVIIth century Scholasticism in several philosophical and theological fields. Furthermore, he also pays attention to the XVIIIth century Scholasticism, a hybrid form of scholastic thought deeply influenced by early modern philosophy. Finally, the article suggest a working hypothesis in order to study the early modern scholastic background of Rosmini’s thought.The article is a brief introduction aimed to give impulse to a broader research project on Rosmini and Second Scholasticism. Rosmini considers the 13th century as the Golden Age of Scholasticism, but he also observes a decline of Scholasticism which began roughly with the 14th century and ended with the Enlightenment. However, he stresses some positive aspects of the 17th century Scholasticism in several areas of philosophy and theology. Furthermore, he also pays attention to the 18th century Scholasticism, a hybrid form of scholastic thought deeply influenced by early modern philosophers. Finally, the article suggests a working hypothesis to investigate the early modern scholastic sources of Rosmini’s thought

    This article studies the reception in seventeenth-century Scholasticism of Henry of Ghent’s reflection on the existence of God. It analyses authors who explicitly declare themselves to be followers of Henry. This attests the existence of a seventeenth-century Henrician Scholasticism. The history of the reception of Henry’s reflection in this Henrician Scholasticis is, however, also the history of a non-reception of the a priori proof of God’s existence formulated by Henry himself.This article studies the reception by seventeenth-century Scholasticism of Henry of Ghent’s reflection on the existence of God.     Qualche riflessione sugli sviluppi del nostro regionalismo, a partire dal modello regionale di Gaspare Ambrosini

    The essay recognizes the fundamental role of Gaspare Ambrosini in the adoption of the regional model by the Italian Constitution of 1948. The author points out, however, that it is not certain that it was the weakness of this model itself, or the Constitutional reform of 2001, with its inclusion of "federal-inspired" characters, that caused the lackluster results of the regional experience as a whole, due rather to the way in which "Italian-style federalism" was implemented. A solution could be represented by the definitive transition of our system into a cooperative regionalism, which, however, is now threatened by the process of differentiated autonomy inspired by a model of asymmetric regionalism that the 2001 reform opened up also to ordinary regions, but which risks, if not implemented in a balanced way, to increase inequalities.Il saggio riconosce a Gaspare Ambrosini un contributo fondamentale all’adozione del modello regionale da parte della Costituzione italiana del 1948. L’autore rileva, tuttavia, come non è certo che sia stata la debolezza intrinseca di questo modello, o la riforma Costituzionale del 2001, con l’inserimento di caratteri ed istituti “a ispirazione federale”, ad essere causa degli esiti non brillanti dell’esperienza regionale nel suo complesso, dovuti piuttosto al modo in cui il “federalismo all’italiana” è stato attuato. Una soluzione potrebbe essere rappresentata dal definitivo passaggio del nostro sistema ad un regionalismo di tipo cooperativo, che però ora è minacciato dal processo di autonomia differenziata ispirato ad un modello di regionalismo asimmetrico che la riforma del 2001 ha voluto aprire anche alle regioni a statuto ordinario, ma che rischia, se non attuato in modo equilibrato, di aumentare le disuguaglianze
