    A Hybrid Artificial Intelligence Methodology for Legal Analysis

    The following study introduces “Hybrid Artificial Intelligence Methodology for Legal Analysis” (HAIMLA). It consists of a six-step method to design, develop, validate and deploy artificial intelligence (AI) systems for legal analyses that are built on asynchronous unsupervised and supervised techniques applied to legal texts serialised in the Akoma Ntoso XML standard. HAIMLA methodology is drawn upon the existing literature and case studies in AI & Law and it is grounded on consolidated philosophical approaches. Taken together, this background inspires design requirements that constitute the essential pillars of HAIMLA and new directions for future refinements and implementations.   This study has been conducted with the support of the European Commission funds within ERC HyperModeLex (Grant agreement ID: 101055185).     The Many Meanings of Vulnerability in the AI Act and the One Missing

    This paper reviews the different meanings of vulnerability in the AI Act (AIA). We show that the AIA follows a rather established tradition of looking at vulnerability as a trait or a state of certain individuals and groups. It also includes a promising account of vulnerability as a relation but does not clarify if and how AI changes this relation. We spot the missing piece of the AIA: the lack of recognition that vulnerability is an inherent feature of all human-AI interactions, varying in degree based on design choices and modes of interaction. Finally, we show how such a meaning of vulnerability may be incorporated into the AIA by interpreting the concept of “specific social situation” in Article 5 (b).This paper reviews the different meanings of vulnerability in the AI Act (AIA).     Studi clinici, discriminazioni razziali e intelligenza artificiale: diversity and inclusion nel contesto statunitense

    The use of biased artificial intelligence systems in the healthcare field involves the risk to crystallize and exacerbate existing health inequalities. The discriminatory functioning of the algorithm arises, in part, because of the use of an inadequate dataset. The study aims to explore the correlation between the low participation of ethno-racial minorities in clinical trials and the inability of these subjects - already in a condition of subalternity - to benefit from data-driven innovation developed, also, with data from such clinical trial. Moving from the analysis of US context, the paper will highlight the importance of a diversity and inclusion approach in the selection of the sample and in the conduction of the clinical trial, in order to promote equal access to healthcare even - and especially - when this is provided through the use of AI systems.L’utilizzo, all’interno dell’ambito medico-sanitario, di sistemi di intelligenza artificiale affetti da bias porta con sé il rischio di cristallizzare le già presenti diseguaglianze nell’ambito della salute. Il funzionamento discriminatorio dell’algoritmo può essere ricondotto, seppur non esclusivamente, all’utilizzo di un set di dati non adeguato. Il contributo mira a mettere in luce la correlazione tra la scarsa partecipazione delle minoranze etno-razziali ai trial clinici e l’impossibilità da parte di tali soggetti - già di per sé in una condizione di subalternità - di beneficiare delle innovazioni tecnologiche sviluppate anche con i dati provenienti da tali attività di ricerca. Si evidenzierà, impiegando come ambito di analisi il contesto statunitense, la necessità di un approccio di diversity and inclusion nella scelta del campione e nella conduzione del trial clinico, al fine di promuovere l’equo accesso all’assistenza sanitaria anche – e soprattutto – quando questa viene veicolata tramite l’utilizzo di sistemi di IA

    This article examines Gianni Celati and Lino Gabellone\u27s translation of Entretiens avec le professeur Y, a pamphlet written by Louis-Ferdinand Céline and published by Gallimard in 1955. After an initial contextualisation of Céline\u27s work within the modernist movement and a reconstruction of the main peculiarities of Céline\u27s writing, the contribution presents a series of examples of the trans-ductive strategies adopted by the two Italian translators. These analysis will show how, both on the lexical level (thanks to the translators\u27 adoption of a septentrional koiné) and on the level of dialogical rendering (thanks to the performative nature of the translative act) the two translators succeeded in reproducing the characteristics of Céline’s funambolic and agitated prose.Questo articolo prende in esame la traduzione da parte di Gianni Celati e Lino Gabellone di Entretiens avec le professeur Y, pamphlet scritto da Louis-Ferdinand Céline e pubblicato da Gallimard nel 1955. Dopo un\u27iniziale contestualizzazione dell\u27opera di Céline all\u27interno del movimento modernista e una ricostruzione delle principali particolarità della scrittura celiniana, il contributo presenta una serie di esempi delle strategie traduttive adottate dai traduttori italiani. Da essi emergerà come, tanto sul piano lessicale (grazie all’adozione da parte dei traduttori di una koiné settentrionale), quanto su quello della resa dialogica (grazie alla performatività dell’atto traduttivo) i due traduttori siano riusciti a riprodurre le caratteristiche della prosa celiniana

    In his Lectio, Pagani moves towards an ontological foundation of human freedom. In his opinion, Rosmini’s notion of freedom cannot be understood if not by starting from the “initial being”, that is, that initial or original being that is the form of our mind, of our desire and of our humanity as a whole. This initial being is virtually infinite, but the human being by participating in it, can (in turn) participate in the infinity that pertains to it. This can happen in three ways, that correspond respectively to three fundamental ontological “forms”: the real, the ideal and the moral one. Rosmini, therefore, roots freedom in the intuition of being – that initial being that gives form to the human person. Thanks to the intuition of being, the human being embraces – in the ontological horizon, precisely – every reality, including himself; that is, he has the world present to himself, as something relative to that horizon: as something with respect to which he can therefore place himself according to freedom.In his Lectio, Pagani moves towards an ontological foundation of human freedom.     Musica mensurabilis: Scrittura e misura del tempo in musica

    Al tramonto del XV secolo, il problema del tempo musicale – in senso assoluto, come durata, e relativo, come rapporto fra durate – diviene oggetto preferenziale della riflessione teorica dei musici Johannes Tinctoris († ca. 1511) e Franchino Gaffurio († 1522). Entrambi rivolgono le loro energie alla sistematizzazione e alla razionalizzazione della semiografia mensurale – il sistema notazionale usato per definire durate e rapporti fra durate –, applicando alle figure musicali, ai segni di mensura e a quelli di proporzione criteri stabili e matematicamente fondati. La fissazione di una norma e di un confine certo tra prassi ortodosse e non ortodosse ha un significativo impatto nel ruolo del notatore, che vede ridursi il margine per la sua autonoma interpretazione della lingua musicale e della sua scrittura in favore di una ‘codificazione’ con ambizioni universalistiche; contestualmente, giunge al termine la stagione delle libere e rizomatiche sperimentazioni sul ritmo notato e cantato. Il contributo ripercorre brevemente le tappe del processo di razionalizzazione della notazione mensurale, illustrando come tale processo sia dipeso anche dall’imporsi dei modelli di calcolo della aritmetica commerciale o ‘d’abaco’
