    Cyber(in)sicurezza in sanità: un ponte comunicativo tra medicina, informatica e diritto

    The advent of digitalization has significantly shaped the healthcare sector, introducing advanced technological solutions while simultaneously exposing health infrastructures to ever-evolving cyber threats. This paper aims to bridge the gap between key disciplines – medical science, IT, and law – realities that are often ideologically distant but must now collaborate to address the growing digital risks in healthcare. To this end, interviews have been conducted with two professionals embedded in the healthcare system – a telesurgeon and a computer engineer – whose insights will be presented. Through their perspectives, this paper seeks to “diagnose” the current and future challenges related to cybersecurity in healthcare.L’avvento della digitalizzazione ha plasmato in modo significativo il settore sanitario, introducendo soluzioni tecnologiche avanzate, ma al tempo stesso esponendo le infrastrutture ospedaliere a nuovi rischi cibernetici. Il presente contributo si propone di instaurare un ponte di dialogo tra diverse discipline – medicina, informatica e diritto – troppo spesso ideologicamente distanti, ma che oggi più che mai devono collaborare per affrontare le emergenti minacce digitali in sanità. A tale fine, verranno presentate le interviste condotte con due professionisti inseriti nell’organigramma sanitario: un telechirurgo ed un ingegnere informatico. Attraverso le loro testimonianze dirette, si cercherà di ricostruire e “diagnosticare” le attuali e future sfide legate alla cybersecurity nel settore sanitario

    The relationship between the right to mental health and neurotechnologies has not been properly explored yet. This paper replies to the following research questions: a) Can the right to mental health benefit from neurotechnologies?; and b) How does the right to mental health take shape in the context of this kind of technology? We demonstrate that neurotechnologies can contribute to the realisation of the right to mental health. Techniques such as deep brain stimulation, neuroimaging and mobile apps can help prevent and treat mental disorders. In addition, we examine how the right to mental health applies in the field of neurotechnologies.     The present investigation commences with a series of preliminary considerations on the bioethics of the commencement of life as practiced by Hindus, with reference to the role of procreation for individual adherents, to comprehend its pertinence within the overarching framework of religious precepts. Moreover, this contribution proffers a delineation of parenting by substitution within the Hindu religion in circumstances of infertility or sterility. The analysis concludes with a discussion of the possibilities offered by Indian legislation for third-party reproduction, and devotes concluding reflections to this topic, which is currently the subject of a wide (not only religious) debate.La presente indagine muove da alcune considerazioni preliminari aventi ad oggetto la bioetica hindu di inizio vita con particolare riguardo al ruolo della procreazione per i singoli fedeli al fine di comprenderne la rilevanza nella più ampia cornice dei precetti religiosi. Inoltre, questo contributo fornisce una descrizione della genitorialità per sostituzione nella religione induista nei casi di infertilità ovvero di sterilità. L’analisi, infine, si sofferma sulla possibilità offerta dalla legislazione indiana di accesso alla gestazione per altri, dedicando alcune riflessioni conclusive a tale modalità riproduttiva, al momento materia di una ampia discussione (non solo religiosa)

    Although public administrations increasingly experiment with, deploy, and buy artificial intelligence systems, evidence shows that environmental costs are not adequately assessed in the procurement of those systems. The article demonstrates the inadequacy of the normative framework which, in the Italian legal system, currently applies to the public procurement of AI. Such framework, in fact, has not been amended in order to take into adequate account the specificities of AI. What is more relevantly lacking, especially, is the determination of minimal environmental criteria in the field of AI. The article insists on the need to invest in the competences of the human resources employed by public administrations, both in terms of training and in terms of recruitment, in order to pursue greater awareness and sustainability in the public procurement of AI systems. Sebbene le pubbliche amministrazioni sperimentino, impieghino e acquistino sempre più frequentemente sistemi di intelligenza artificiale, i dati mostrano che i costi ambientali non sono adeguatamente valutati nell’approvvigionamento di tali sistemi. L’articolo mette in luce l’inadeguatezza delle regole che attualmente disciplinano l’acquisto di IA. Il quadro normativo, infatti, non è stato modificato al fine di tenere adeguatamente conto delle specificità dell’IA. La lacuna più grave, in particolare, è rappresentata dalla mancata determinazione dei criteri ambientali minimi nel campo dell’IA. Per rimediare a tali criticità e perseguire maggiore consapevolezza e sostenibilità ambientale negli appalti pubblici aventi ad oggetto l’IA, l’articolo insiste sulla necessità di investire nelle competenze delle risorse umane impiegate dalle pubbliche amministrazioni, sia in termini di formazione, sia di reclutamento
