New missing persons identification methods and paternity disputes
The new DNA mapping methods may have a significant impact on paternity litigation, as they would enable the judicial contestation or the judicial establishment of a parental relationship even in cases where such disputes would have been theoretically possible, but hardly workable in practice, as the trial would have been entirely based on circumstantial evidence or, at most, on inaccurate, thus more challengeable, scientific evidence. Surrogazione di maternità e ordine pubblico: verso un cambio di rotta?
The essay analyzes the recent decision January 21st, 2022, n. 1842 with which the Court of Cassation (I Sez.) proposes a revision of the scope of application of the limit of public order constituted by the prohibition of surrogacy. In particular, the intervention focuses on the identification of the legal assets protected by the criminal law, focusing on the dignity of the pregnant woman and how this can be protected even in legal systems where surrogacy is allowed, provided that certain minimum elements are respected.Il contributo analizza la recente pronuncia 21 gennaio 2022, n. 1842 con la quale la Prima Sezione della Corte di Cassazione propone una revisione del perimetro applicativo del limite di ordine pubblico costituito dal divieto penalmente sanzionato di surrogazione di maternità. In particolare, l’intervento si concentra sull’individuazione dei beni giuridici tutelati dalla norma penale, focalizzando l’attenzione sulla dignità della gestante e di come questa possa essere tutelata anche negli ordinamenti giuridici dove la surrogazione è permessa, a patto che siano rispettati alcuni elementi minimi
La Vaccinazione obbligatoria contro il Covid-19 alla luce della Convenzione Europea dei Diritti dell’Uomo
Covid-19 vaccination is considered the only effective tool against the pandemic. To achieve public health goals, some countries, including ours, considered making it mandatory. However, the imposition of a mandatory vaccination represents a significant implication on the exercise of fundamental human rights. On 8 April 2021, the HUDOC ruled on the mandatory vaccination for the protection of the rights of the most vulnerable people. This work aims to give an analysis of main legal and ethical issues focused on this case that should be taken in consideration by the States before assessing the need for mandatory vaccination.La vaccinazione contro il Covid-19 è considerata l\u27unico strumento efficace contro la pandemia. Al fine di raggiungere gli obiettivi di salute pubblica alcuni paesi, compreso il nostro, hanno valutato l’ipotesi di renderla obbligatoria. Tuttavia, l\u27imposizione di un obbligo comporta una significativa interferenza nell\u27esercizio di diritti e libertà individuali. L\u278 aprile 2021 la Corte Edu si è pronunciata sulla vaccinazione obbligatoria a tutela dei diritti delle persone più vulnerabili. Il presente lavoro mira a fornire un\u27analisi delle principali implicazioni legali ed etiche emerse in tale pronuncia che dovrebbero essere prese in considerazione dagli Stati prima di introdurre un obbligo vaccinale generalizzato

The comment analyses a recent judgement of the Supreme Court of Italy grounded on a claim for damages against a gynaecologist who, while making a prenatal diagnostic, omitted to detect the presence of malformations in a foetus. The claim of the plaintiff refers to the violation of the right “to born in a family not fully prepared to welcome a disabled child”. The Supreme Court differently qualified the claim of the plaintiffs as a “linguistic mimetism” of a different right, precisely the “right not to be born” (wrongful life) and did not award the child any compensation. In commenting the case, the author integrates the juridical analysis by the linguistic one, in order to verify whether the juridical requalification of the plaintiffs’ claim by the Court, as grounded on the linguistic re-formulation of that claim, leads to a violation of the necessary relation between the request of the plaintiffs and the decision of the judge, provided by art. 112 of the Italian Code of civil procedure.Il presente commento analizza – tanto dal ponto di vista giuridico, quanto linguistico – la sentenza in oggetto al fine di verificare se la ri-qualificazione della domanda del ricorrente effettuata dalla Cassazione sulla base di un c.d. “mimetismo linguistico” viola il rapporto tra chiesto e pronunciato di cui all’art. 112 c.p.c
Le biobanche di popolazione al vaglio della Suprema Corte di Cassazione: alcune note critiche sull’Ordinanza n. 27325 del 7 ottobre 2021
This paper analyses the most significant issues that the Court of Cassation has tackled in its Order n. 27325/2021, which deals with the protection of participants’ data in the framework of scientific research and the complex dimension of biobanks and the related genetic databases. Special emphasis is put on informed consent and informational self-determination, in the context of bankruptcy and the purchase of the biobank by a new data controller. Subsequently, some considerations are expressed about the impact of the hypothetical application of the GDPR to the case and, finally, some solutions to tackle the current challenges are suggested.La presente riflessione analizza i profili più salienti che la Corte di Cassazione ha affrontato nell’Ordinanza n. 27325/2021, incentrata sulla protezione da assicurarsi ai partecipanti che offrono alla ricerca scientifica i propri dati genetici, nella complessa dimensione delle biobanche e degli annessi database genetici. In quest’ottica, si pone speciale enfasi sulla tutela del consenso informato e dell’autodeterminazione informativa, nel contesto del fallimento della biobanca e dell’acquisto all’asta da parte del nuovo titolare del trattamento. Inoltre, si sviluppano alcune considerazioni critiche sui possibili esiti applicativi del quadro normativo introdotto dal GDPR e si formulano, infine, alcune osservazioni propositive e conclusive

Fundamental rights have a universal extent: therefore, the work aims at drawing a comparative-law picture regarding the legal systems providing, in the field of the “end of life”, euthanasia and/or assisted suicide (Italy, Switzerland, Austria, at the first level; Belgium, Netherlands and Luxembourg at the second degree; Germany and Spain at the last stage). Attempt is made to promote the most valuable (according to the writer’s opinion) elements and to highlight their flaws, in order to outline, by some necessary adjustment, an “end of life” legislation worthy of a non authoritative country.I diritti fondamentali hanno carattere universale: pertanto si traccerà, nel lavoro, un quadro di diritto comparato relativo agli ordinamenti che, in materia di fine vita, abbiano in varia guisa previsto il suicidio assistito e/o l’eutanasia (Italia, Svizzera ed Austria ad un primo gradino; Belgio, Olanda e Lussemburgo ad un successivo stadio; Germania e Spagna, per profili distinti, in prima fila). Si tenterà di valorizzarne gli elementi, ad avviso di chi scrive, di pregio e di sottolinearne le manchevolezze, onde pervenire, con taluni necessari ulteriori aggiustamenti, ad una disciplina di fine-vita degna di un Paese non autoritario
Tra Terra e Cielo: il valore teologico della natura nel pensiero di Seyyed Hossein Nasr: The theological value of nature in the thought of Seyyed Hossein Nasr
The objective of this work is, on the one hand, to offer a sufficiently exhaustive overview of the theme of nature in the thought of Seyyed Hossein Nasr and, on the other hand, to provide a theoretical vision about the theological implications of the meaning of nature in relation both to human spirituality and to God himself. The task of the first two sections of this work will be to deepen Nasr\u27s criticisms of today\u27s epistemology, in order to show his original vision of a metaphysics of nature capable of providing the same sciences with a broader and more spiritual vision of the cosmos. In a third section, the idea of nature as an immense theophany will then be explored: a self-revelation of God through the signs that he leaves in nature and which, if well understood, allow man himself to rise spiritually. Finally, we will show how the conception of nature proposed by Nasr, through the responsible action of man who knows how to follow the will of God, can lead to an unprecedented way of thinking about the eschatological question of salvation precisely in reference to our relationship with the theophanic dimension of nature

Justice Breyer’s principled pragmatism and Kagan’s new living constitutionalism and lite textualism
This article is a comparative study of United States Supreme Court Justice Breyer and Kagan\u27s methods of judicial interpretation. By juxtaposing and comparing the justices\u27 jurisprudence, this article aspires to clarify their methods and raise questions for further analysis. This article posits that the core of Breyer\u27s interpretative methods is pragmatism. However, Breyer does account for values and purposes. Thus, he is a "principled pragmatist" for both constitutional and statutory interpretation. On the other hand, Kagan exercises a "new" living constitutionalism in her constitutional interpretation but interprets statutes as a "lite" textualist. Paragraph 1 introduces the article. Then, Paragraph 2 studies what Breyer and Kagan claim to be. Next, Paragraph 3 interrogates Breyer and Kagan\u27s judicial methods in practice. Finally, based on the justices\u27 methods, Paragraph 4 provides theories on what Breyer and Kagan may focus on in Dobbs v.
