IN DEFENCE OF THE RIGHTS OF THE EXCLUDED CLASSES: A PROPOSAL BASED ON THE THOUGHT AND WORK OF MIGUELINA ACOSTA CÁRDENAS

    No full text
Objective: This work aims to gather the philosophical thought of Miguelina Acosta through a systematic study of her life and work in order to find an effective proposal to address the problems of the excluded classes.   Theoretical framework: This research is developed from a contemporary perspective focused on neoindigenism, but also takes for its philosophical construction a political, legal and sociological analysis that allows the construction of an integrated response.   Method: Firstly, the dissonance between the factual reality and the Peruvian legal structure, which are unfavourable to the causes of neoindigenist struggles, was analysed. Secondly, it was analysed the implications of the visibility of social demands as a propelling entity for change, which is also necessary in a class-based society that ignores ‘the other’. Finally, the need for social awareness was evaluated as a preponderant factor for the sustainability of change.   Results and Discussion: From the constructive analysis, the need to develop a solution perspective that integrates the three perspectives studied, not as a cause-effect sequence of one over the other, but as a mutual coexistence that guarantees the success of the others, can be raised.   Research Implications: By addressing the problem of the excluded classes from this tripartite approach, the problem of the other ceases to be an individual need for recognition, and becomes a social need of integration in which all individuals are collectively part of the solution.   Originality/Value: Through this research work, it seeks to contribute to the social discussion for the integration of the other in an equitable way. Further research that seeks the materialisation of this approach would expand the effectiveness of the proposed strategy

LA CAÍDA DE RUE V. WADE: EL DERECHO AL ABORTO DE LAS MUJERES EN ESTADOS UNIDOS DESDE UNA PERSPECTIVA INTERNACIONAL

    No full text

    No full text

    No full text
Objective: This study evaluates how regulatory frameworks in major oil-producing jurisdictions influence the regulatory predictability of flare-gas-powered off-grid data centres.   Theoretical Framework: The analysis draws on regulatory-governance literature that conceptualises predictability as the stability, transparency and coherence of legal and administrative behaviour. This framework is applied to flare-gas utilisation, private generation, environmental licensing and investor-exit mechanisms.   Method: A comparative-legal method is employed, based on qualitative analysis of legislation, investment treaties and policy instruments across seven jurisdictions: the United States, Canada, the United Arab Emirates, Oman, Qatar, Nigeria and Indonesia.   Results and Discussion: Findings show that North America and the Gulf States demonstrate the highest regulatory predictability, characterised by transparent licensing, durable fiscal rules and consistent administrative practice. Indonesia reflects a progressively integrated and stablising model. Nigeria, while legally advanced, exhibits reduced predictability due to currency volatility and inconsistent regulatory implementation.   Research Implications: The study clarifies institutional features that most reliably support methane-reduction infrastructure and provides guidance for jurisdictions seeking to scale flare-gas-to-compute projects.   Originality/Value: This research offers the first cross-jurisdictional assessment of flare-gas digital infrastructure based explicitly on regulatory predictability, demonstrating its central role in investment outcomes
