    ABUSE OF POWER AND CORRUPTION IN THE VIETNAM LEGISLATIVE PROCESS

    Objective: The study aims to analyze the relationship between abuse of power and corruption in the legislative process and offers recommendations for controlling power and mitigating corruption and negative practices in legislative activities.   Theoretical Framework: The study is based on the theoretical framework of the Party's viewpoint and the State's laws on anti-corruption in ethical and legal standards, the results of the act of drafting and promulgating legal documents. Issues beyond the above framework are abuse or misuse of power, violations of the Party's viewpoint and the State's laws.   Methodology: The study adopts the collection of practical data from competent authorities, analysis, evaluation to produce results on abuse of power in the construction and promulgation of legal documents.   Findings and Discussion: The study concludes that the best use of power control in the development and promulgation of documents is to have an independent control agency higher than the law-making agency (under the National Assembly); policies must have proper policy impact assessment; have a legal framework on lobbying and specific legal responsibilities if violated; have specific legal sanctions applied to entities that promulgate wrong laws.   Research Implications: By clarifying the role of independent control authorities, law-making authorities, transparency in lobbying and the policy impact assessment process when issuing legal documents..., abuse of power in law-making and promulgation can be limited. Accordingly, laws will be appropriate and have a positive impact on economic and social relations and national development.   Originality and Value: This study establishes the connection between the principle of law making and the activities of law making and promulgation; between the transparency in policy making and evaluation and the provisions conveying policies in legal norms; between the independence and criticism of the competent appraisal authority and the law making and promulgation agency, and between the mechanisms and processes of lobbying, law making and promulgation

    DYNAMIC ASSESSMENT OF GROWTH, YIELD, AND QUALITY TRAITS IN HIGH-YIELDING RICE VARIETIES UNDER TIDAL AGROECOSYSTEMS

    Introduction: Swamplands, including tidal and freshwater areas, offer significant potential for agricultural expansion in Indonesia, particularly for rice cultivation. However, challenges such as low productivity and quality hinder the full realization of this potential. While new high-yielding varieties (NHVs) like Inpara-3, Inpari-33, Inpari-47, Inpari-48, and Logawa have been developed to address these challenges, factors like pre-harvest conditions (NHV selection) and post-harvest processes (drying, milling, storage) significantly impact rice quality.   Objective: This study aims to evaluate the performance of several new high-yielding varieties of rice in tidal lands based on growth, yield, and grain quality.   Method: The study collected data on growth, yield, and quality parameters. Statistical analysis (ANOVA and Duncan's Multiple Range Test) was used to compare treatment means and identify correlations between variables.   Results and Discussion: The study revealed that new high-yielding rice varieties (NHVs) demonstrated significant adaptability to tidal agroecosystems, with notable effects on plant height, panicle length, 1,000-grain weight, harvest age, and dry grain yield. Inpari-33, Logawa, and Inpari-47 showed superior performance, yielding 5.48 t/ha, 5.33 t/ha, and 5.29 t/ha, respectively, while also exhibiting good growth characteristics. All tested varieties fell into the third category of medium-quality rice due to a high percentage of broken grains, influenced by genetic traits and post-harvest processing.   Research Implications: The study identifies Inpari-33, Logawa, and Inpari-47 as promising NHVs for tidal rice cultivation. By highlighting the potential of these varieties in challenging environments, the research contributes to improving rice production and food security in marginal areas

    THE UTILIZATION OF IMPROVISED FUMING DEVICE IN DEVELOPING OF LATENT FINGERPRINT

    Objectives: This study aims to assess the effectiveness of an improvised fuming device as a cost-efficient alternative for developing latent fingerprints. Specifically, it evaluates its practical application, identifies the challenges encountered by the Philippine National Police Forensic Group (PNPFG), and offers recommendations to improve the efficiency of latent fingerprint development using this alternative tool.   Theoretical Framework: Grounded on a practical forensic science framework, the study highlights the significance of accessibility and adaptability in crime scene investigations, particularly under resource constraints. The development of latent fingerprints plays a crucial role in criminal identification, but traditional fuming devices are often costly and electricity-dependent. In contrast, the improvised device offers a low-cost, portable, and electricity-free solution.   Method: A case study approach was employed involving ten (10) experienced fingerprint examiners from the PNPFG – Fingerprint Identification Division. Each participant, aged 25–30 with at least three years of forensic experience, independently performed latent fingerprint development using the cyanoacrylate method and the improvised fuming device from June 1, 2023, to the present. Data were gathered through in-depth interviews and analyzed using thematic analysis based on Braun and Clarke’s method.   Results and Discussion: Findings reveal that the improvised device effectively develops latent prints on small to medium-sized objects, such as glass shards, knives, pens, and identification cards. The examiners reported that, although preparation takes longer due to manual heating, the results closely resemble those achieved with the standard fuming box. Key challenges include selecting appropriate evidence sizes and determining the optimal amount of cyanoacrylate. However, no safety issues were encountered when appropriate PPE and procedures were followed. The ideal exposure time was identified as 20–30 minutes, with heat levels from boiling water significantly influencing fume intensity.   Implications: The study concludes that the improvised fuming device is a viable, cost-effective, and practical tool for crime scene application, particularly in remote or resource-limited settings. Its successful implementation can aid in strengthening forensic capabilities of the PNP, making fingerprint development more accessible and timely. Standardizing training and ensuring the availability of various fuming box sizes are recommended to optimize its use in real-world forensic scenarios.   Originality/Value: This study is the first to comprehensively document and evaluate the use of a locally assembled, improvised cyanoacrylate fuming device in a real-world forensic setting within the Philippines. It offers valuable insights for law enforcement agencies facing budgetary limitations and provides a replicable model that promotes innovation, sustainability, and adaptability in forensic practice

    Objective: The theory of leader member exchange (LMX) is complemented by team member exchange (TMX) to increase extra performance mediated by work engagement (WEN) and organizational service climate (OCL). Therefore, this research aimed to examine the influence of WEN as a mediator of LMX and TMX on organizational citizenship behavior (OCB) and OCL as a moderating variable.   Theoretical Framework: This study is based on social exchange theory, balance theory, and job-demand resource model to test the influence of LMX and TMX on OCB mediated by WEN and moderated by OCL.   Method: Data was obtained through a survey with a questionnaire having a sample of 500 employees of micro, small, and medium enterprises (MSME) in Indonesia. Testing the relationship model using structural equation modeling (SEM) with a two-stage approach in AMOS was carried out after testing the questionnaire to be valid and reliable and there was a correlation between the variables studied.   Results and Discussion: The results showed that WEN was a mediating variable and OCL moderated the relationship model. However, LMX did not affect OCB directly like TMX and WEN.   Research Implications: This research provided implications to build OCL in MSME and extended the direct influence of LMX on OCB.     Objective: This study aims to clarify the legal solutions to the problem of conflict of jurisdiction between administrative judiciary bodies, whether this conflict is negative or positive, and this conflict occurred whether between two administrative courts or between two administrative courts of appeal, or between an administrative court and an administrative court of appeal, or between an administrative court of appeal and the Council of State, which leads to conflicting final rulings.   Theoretical Framework: This article details the rules stipulated in the amended and supplemented Civil and Administrative Procedures Law, which are intended to provide solutions to this problem. These rules are for resolving conflicts of jurisdiction, deciding on issues of connection, and settling issues of jurisdiction, through what is known as the referral system.   Method: The analytical and descriptive approaches were adopted in line with the nature of the subject, which requires this.   Results and Discussion: The results obtained demonstrate the importance of resolving conflicts of jurisdiction between administrative judiciary bodies, especially in the case of negative conflict, so that the case does not remain without a fair solution.   Research Implication: This research has led to important results, perhaps the most important of which is that conflicts of jurisdiction must be resolved if they occur, so that the case does not remain without a fair solution, on the one hand, and so that conflicting rulings in a single case can be avoided.   Originality/Value: This research is characterized by originality and great scientific value, as the Algerian legislator’s determination of the rules of jurisdiction did not prevent the occurrence of a conflict of jurisdiction. For this reason, the legislator intervened to establish solutions that would put an end to the denial of justice and resolve cases within reasonable timeframes

    Objective: Aim The aim of this research is to examine the extent to which the Algerian legislator has established the independence of the High Council of the Judiciary in terms of its composition and functions, in accordance with Organic Law No. 22-12, given the constitutional status it occupies in supervising the professional career of judges and guaranteeing the independence of the judiciary and the immunity of its judges.   Theoretical Framework: This study is divided into two sections: - The first section discusses the composition of the Supreme Council of the Judiciary under the new law, which the legislator has restored in this respect by increasing the number of its members, mixing elections and appointments from within and outside the judiciary, and referring its organisation to Organic Law No. 22-12. - The second section deals with the powers of the SJC as an independent body with legal personality and financial and administrative autonomy. It has been granted a number of powers, including administrative, disciplinary and advisory powers.   Methodology: Methodology In our study, we used an analytical approach to analyse the legal texts that regulate the composition of the Supreme Council of the Judiciary and organise its competences.   Results and Discussion: The research findings address the role of Organic Law No. 22-12 in strengthening the independence of the Supreme Council of the Judiciary, both organically and functionally, in line with the constitutional amendment of 2020. However, there are a number of imbalances and shortcomings that the legislator will have to address in the future, particularly with regard to the Council's subordination to the executive, in particular to the President of the Republic.   Research Implications: The study of this topic has implications for official bodies, especially the judiciary as the protector of rights and freedoms, the parliament and all those who advocate the independence of the judiciary and the achievement of justice, contributing to the development of legal regulations governing the judiciary.   Originality/Value: This research provides a new contribution to the field of the independence of the Supreme Council of the Judiciary in Algerian legislation by addressing old gaps and focusing on new changes in terms of composition and competencies, emphasizing them to consolidate the principle of the rule of law

    THE RIGHT OF ACCESS TO JUSTICE IN ENVIRONMENTAL MATTERS

    Objective: This research aims to highlight that the issue of environmental protection within the framework of sustainable development requires, in addition to the principles established by the Algerian legislator in the law on environmental protection, other mechanisms that involve recourse to the judiciary to defend the environment against any harm to its elements. Moreover, the issue of environmental protection is not the sole responsibility of the State, but requires the participation of all. The Algerian legislature has recognized the role of civil society in protecting the environment and has granted it the right to take legal action.   Theoretical Framework: This research is based on the definition of the concept of the right of access to justice in matters related to environmental protection and its connection with the right to a healthy environment. It also emphasizes the legal establishment of this right, as well as the conditions and methods associated with the exercise of the right to access to justice in environmental matters. This includes the participation of civil society organizations and their exercise of this right in accordance with the conditions and rules established by Law 03-10 on Environmental Protection in the Framework of Sustainable Development.   Methodology: A qualitative research approach will be adopted, primarily focusing on highlighting and describing the laws that enshrine the right to access the judiciary in the environmental field, followed by an analysis and evaluation of these texts.   Results and Discussion: The results of the research shed light on the extent to which the Algerian legislator, through Law 03-10 on the protection of the environment in the context of sustainable development, has established a comprehensive legal framework for the right of access to justice in environmental matters. It also defines the conditions and methods of this right that the Algerian legislator has established to provide legal protection for the environment, and discusses the effectiveness of this right in ensuring legal protection for the environment.   Research Implications: The implications of this research highlight the legal means that have been legally established to protect the environment by providing a clear perspective on the right of access to justice in environmental matters, and the means to exercise this right.   Originality/Value: This research offers a new contribution to the current knowledge of the legal mechanisms available to provide legal protection for the environment, by outlining the methods of exercising this right in accordance with Law 03-10 on Environmental Protection in the Framework of Sustainable Development

    Objective: The objective of this study is to investigate leadership strategies for managing outsourced teams in the biotechnology sector, with the aim of understanding how strategic governance can enhance performance, innovation, and value creation across complex, externally managed value chains.   Theoretical Framework: The research draws upon a robust theoretical foundation, highlighting Porter’s value chain theory, dynamic capabilities, open innovation, and contemporary leadership models such as adaptive, transformational, and boundary-spanning leadership. These frameworks support the analysis of leadership practices in fragmented and knowledge-intensive environments.   Method: A mixed-methods approach was adopted, combining an extensive literature review with a sector-specific survey targeting biotech professionals involved in outsourced operations. The survey integrated both quantitative and qualitative questions to capture organizational practices, leadership perceptions, and operational outcomes across varied outsourcing intensities.   Results and Discussion: The results reveal that outsourcing is a key strategic lever for biotech firms, enabling access to specialized capabilities. However, challenges related to knowledge transfer, team cohesion, and leadership complexity persist. Effective governance was associated with adaptive leadership, emotional intelligence, and trust-based coordination. The findings emphasize the need for context-specific leadership models and highlight discrepancies between conventional practices and emerging governance demands.   Research Implications: This study offers practical insights for biotech leaders, contract managers, and innovation strategists, informing decisions on team management, partner engagement, and outsourcing strategy. Impacted areas include R&D leadership, innovation management, and value chain design.   Originality/Value: This research contributes to literature by addressing a critical gap in leadership theory applied to outsourced biotech contexts, offering an empirically grounded framework for effective team orchestration across organizational boundaries

    Purpose: The study aims to examine the influence of youth participation on national integration in Mogadishu, Somalia. The general objective of the study was to examine the influence of youth participation on national integration in Mogadishu, Somalia.   Conceptual framework: Specifically, it analyzed the influence of youth participation on national integration in Mogadishu, Somalia.   Methodology: The data was collected from 84 quantitative respondents. The data obtained from the field was analyzed using SPSS. The attained study results were descriptively analyzed based on the frequency percentages and means.   Results: The findings on the first objective revealed that the influence of Youth Participation on National Integration in Mogadishu, Somalia, was moderate, with a mean score of 3.31, indicating the presence of Youth participation in national integration was generally moderate.   Conclusion: The study concludes that increased youth participation has the potential to increase national integration. The study further concludes that their government can integrate youth into the national integration since they are valuable.   Recommendation: The study recommends that to increase youth participation in national integration, the youth need to be politically integrated into the national building, and there is a need for social system development to support the involvement of the youth in national integration.   Research Limitations: The challenges faced by the researcher are financial obstacles and time limits.   Originality/Value: The study examined the influence of youth participation on national integration in Mogadishu, Somalia

    Objetivo: El objetivo del presente trabajo es analizar la viabilidad de la justicia transicional como mecanismo para atender las violaciones masivas de derechos humanos cometidas en Venezuela, tomando como referencia en una eventual transición democrática la experiencia colombiana posterior a los Acuerdos de Paz de 2016.   Marco Teórico: La investigación se fundamenta en los pilares de la justicia transicional y en cómo los mecanismos de esta rama alterna del derecho penal se presentan como vía para la reconciliación y reconstrucción del tejido social, considerando los marcos normativos internacionales y regionales.   Método: Fue utilizado un enfoque cualitativo de tipo documental, basado en el análisis de fuentes jurídicas, informes institucionales y literatura especializada, así como en la comparación de las estructuras institucionales de Colombia y Venezuela.   Resultados y Discusión: Los resultados indican que el sistema penal ordinario venezolano carece de capacidad para abordar las violaciones registradas, siendo necesaria la creación de una Comisión de la Verdad, mecanismos de reparación integral y espacios de participación activa de las víctimas. Se discute cómo estas medidas, adaptadas al contexto venezolano, pueden fortalecer una transición democrática.   Implicaciones de la investigación: El estudio ofrece lineamientos prácticos para planificar y ejecutar mecanismos transicionales eficaces que integren justicia, verdad y reparación.   Originalidad/Valor: El valor del trabajo radica en su enfoque comparativo y propositivo, que vincula una experiencia regional con propuestas concretas para Venezuela, en el contexto de una eventual transición a la democracia
