Community Response to The School at The Dawn Policy of The Regional Government of East Nusa Tenggara For Legal Protection of Children in The City of Kupang
Objective: This paper aims to analyze the policy of the East Nusa Tenggara provincial government regarding morning schools for high school students in Kupang City, which has sparked both support and opposition within the community. The article will delve into the reasons behind the resistance to this policy and assess whether it aligns with current Indonesian legal regulations.
Method: To address these issues, the research collects data through interviews, observations, and literature reviews. The study employs legal, case, conceptual, and comparative approaches.
Result and Discussion: The findings indicate that the morning school policy discriminates against students and teachers and violates students' fundamental rights.
Conclusion: The paper concludes that this policy has caused unrest among students, teachers, and parents. The school authorities implement this policy due to their subordination to regional government control. The policy is crafted without adequate study and has negative consequences, especially for students
Leadership Skills and Virtual Team Performance – The Case of Lebanese Multinational Companies
Purpose: This study investigates the influence of leadership skills on virtual team performance within multinational corporations in Lebanon. Drawing upon established literature, the research examines four key leadership dimensions: motivation, coaching, appreciation, and empowerment, exploring their respective impacts on virtual team effectiveness.
Design/methodology/approach: The study, conducted in Lebanon, aimed to explore the influence of leadership skills on virtual team performance through a positivist, deductive approach using a survey method and mono-quantitative methodology. Analyzing 148 individuals across various global Lebanese enterprises, the research employed descriptive statistics, correlation, and regression analyses in SPSS to investigate the relationship between leadership abilities and virtual team effectiveness in the context of businesses utilizing remote collaboration due to globalization and technological advancements.
Findings: The study aligns with prior research attributing positive correlations between leadership skills and enhanced team performance. Findings support the hypothesis that leadership motivation skills significantly enhance virtual team performance. Transformational leadership qualities, characterized by strong motivational capabilities, correlate positively with virtual team effectiveness.
Implications: The findings underscore the pivotal role of specific leadership competencies in driving virtual team performance within multinational corporate structures. These insights contribute to a deeper understanding of how leadership motivational skills can be leveraged to optimize virtual team dynamics, ultimately improving organizational outcomes in diverse, multinational contexts
Leader Social Capital in Real Estate Firms Via Colleague Ingredients
Objective: The following were the objectives of this study: (i) analysis and measurement of leader social capital in real estate firms in Hanoi and neighboring provinces, Vietnam, via colleague ingredients; (ii) comparison of assessments of the leader social capital in real estate firms in Hanoi and neighboring provinces, Vietnam, via colleague ingredients, between respondents.
Method: The data used in this study are primary, including survey data obtained from the respondents. We designed a questionnaire related to the leader's social capital via colleague ingredients in real estate firms in Hanoi and neighboring provinces, Vietnam. We determined the observed variables (scales) of the leader's social capital via colleague ingredients in real estate firms in Hanoi and neighboring provinces, Vietnam, based on previous studies and expert interview results. We use both qualitative and quantitative research methods, including descriptive statistics, the independent T test, and ANOVA analysis.
Results: According to the findings of this study, three attributes of the leader's social capital via colleague ingredients in real estate firms in Hanoi and neighboring provinces, Vietnam, were quite high. All the attributes of the variables are statistically significant. There is no statistically significant difference in the leader's social capital via colleague ingredients in real estate firms in Hanoi and neighboring provinces, Vietnam, between these different genders, marital statuses, and ages.
Conclusions: It was found that, although still difficult, the current real estate market has more opportunities than challenges. Because macroeconomics, the world economy, and Vietnam are showing signs of recovery, inflation and interest rates are no longer increasing and are gradually decreasing; legal and institutional problems are also gradually being resolved and implemented; planning at all levels is being completed; and public investment and infrastructure development have been promoted. This article is an academic contribution that enables understanding of the research developed and focuses on leaders' social capital via colleague ingredients in real estate firms in Hanoi and neighboring provinces, Vietnam, considering data from several reference research databases and survey results
Jurisdiction in Intellectual Property Disputes
Objectives: This study seeks to highlight what international jurisdiction in intellectual property disputes is contractual or non-contractual, in order to identify problems related to the subject, including specific controls, and the extent to which the governing rules relate to public order. The scope of the research is limited to the relevant provisions of the Convention and of the law, indicating the position of the Iraqi and Egyptian legislature and referring to certain French and other laws. There are two types of disputes raised by intellectual property rights. The first is violations such as theft and others. The second is disputes arising from contractual relations and breaches of obligations by one of the parties to the relationship.
Method: In this study, we will attempt to follow a scientific methodology based on the analysis and discussion of legal texts, jurisprudence and jurisprudence on the subject of the study in order to obtain a legal opinion and an integrated view of the subject.
Result: Determining the jurisdiction of national courts in the settlement of intellectual property disputes is not a problem in the event of a national dispute but in the event that it includes a foreign element, the conflict of jurisdiction is problematic and is resolved through objective or personal controls. In the event that the parties agree to resolve the dispute by arbitration, the jurisdiction might be decided by determining the law applicable to the dispute or might be invoked through contract clauses, citizenship, or other controls.
Conclusion: we consider that the development of laws and legislation protecting contractual and non-contractual intellectual property rights is very slow to keep pace with violations
THE IMPACT OF E-SERVICE QUALITY ON E-LOYALTY THROUGH THE MEDIATING EFFECTS OF E-SATISFACTION AND E-TRUST IN LEBANON
Purpose: This study seeks to explore the relationships between e-service quality, e-satisfaction, e-trust, and e-loyalty within the context of Lebanon's digital landscape. By investigating the mediating effects of e-satisfaction and e-trust, the research aims to provide nuanced insights into the intricate dynamics shaping e-loyalty in the Lebanese online environment. The findings are anticipated to contribute valuable knowledge for businesses and policymakers seeking to enhance electronic service offerings and foster customer loyalty in the digital realm.
Design/methodology/data analysis: In this comprehensive quantitative study, a validated questionnaire was deployed to survey Lebanon's diverse online shopper demographic. The participation of 2378 individuals from varied backgrounds added depth and representativeness to the data. The analytical phase employed T-test, ANOVA, and Structural Equation Modeling (SEM) techniques, leveraging SPSS software for robust statistical analysis and interpretation. This methodological approach ensures a thorough examination of the dynamics influencing online shopping behavior in the Lebanese context.
Findings: Highlighting critical insights for E-commerce and e-retail, this study emphasizes the pivotal role of website efficiency and information quality. The findings underscore that a streamlined website contributes significantly to fostering customer trust, satisfaction, and loyalty. These essential factors identified in the study illuminate the pathway for businesses to enhance their online platforms, ultimately strengthening the bonds with customers and cultivating sustained loyalty in the digital realm.
Originality/value: This study is important because the pandemic and lockdowns have changed consumer purchasing behaviour. Customers are more critical of e-commerce platforms and more comfortable using multiple devices to access online stores and apps as they shop more online.
Practical implications: This study is timely and relevant for businesses trying to stay competitive in the changing e-commerce landscape due to consumer behaviour changes
Exploring the Impact of Smart Governance and Business Capability on Business Collaboration and the Implication on Sustainable Performance of Micro Business in Belitung
Purpose: Geopark development generates several investment opportunities in various sectors, including micro-enterprises. However, there is still a phenomenon of unsustainable performance problems in micro-enterprises in the Belitung Islands, in sales and productivity. This research aims to examine the influence of smart governance and business capabilities on the sustainable performance of micro-enterprises in Belitung, both directly and indirectly through business collaboration.
Design/methodology/data analysis: This study used a quantitative research design. The population in this study were all micro-businesses in the Belitung Islands. The sample size was 200 respondents concerning the analytical technique used in hypothesis testing, namely structural equation modeling. Respondents in this study are small business actors in the Belitung Islands who have implemented smart technology.
Findings: The results of hypothesis testing show that: smart governance has a significant effect on business collaboration, business capabilities have a significant effect on building business collaboration, smart governance has no effect on sustainable performance, business capabilities have a significant effect on sustainable performance, business collaboration has a significant effect on sustainable performance, smart governance has an effect on sustainable performance through business collaboration, and business capabilities have an effect on sustainable performance through business collaboration.
Originality/value: The results of this study indicate the important role of business capability in building business collaboration of micro-business actors in Belitung which has implications for improving sustainable performance.
Practical implications: The managerial implication of these findings is that efforts to improve sustainable performance for micro businesses in Belitung can be done by prioritizing the development of business capabilities capable of building business collaboration, with an emphasis on encouraging increased customer trust
Enhancing Poor Community Welfare Through Evidence-Based Poverty Alleviation Programs in Serdang Bedagai Regency, North Sumatra, Indonesia
Background: Effectively reducing poverty is vital for development, requiring comprehensive and efficient solutions. The government has initiated poverty alleviation initiatives, including the implementation of programs such as Non-Cash Food Assistance (BPNT) and the Family Hope Program (PKH). This program is expected to stimulate community economic activity. This research aims to analyze the relationship between socio-economic resources and the welfare of the poor in Serdang Bedagai Regency through a poverty alleviation program.
Method: The study adopted a causality, relationship, or influence model, examining the proposed hypotheses through the analysis method of SEM. The SEM analysis methods were used to identify the dimensions of a construct and concurrently measure the influence or degree of relationship between factors with identified dimensions.
Results: The result showed that socioeconomic resources had a direct impact on community welfare. Simultaneously, poverty alleviation programs also directly contribute to enhancing the welfare of these communities. Socioeconomic resources do not directly or indirectly influence the effectiveness of poverty alleviation programs. The current poverty alleviation programs alone are insufficient to expedite efforts in uplifting community welfare.
Conclusion: Various aspects of road infrastructure, including road quality, ease of mobility, connectivity, minimal obstacles, security/safety, accessibility, and timeliness, were developed as crucial factors influencing economic players in the tourism sector. Recognizing these facets had substantial policy implications, showing the importance of prioritizing road infrastructure development in the holistic progress of Lake Toba KSPN
NAVIGATING CLEAN WATER CHALLENGES: ASSESSING STRATEGIES AND OUTCOMES IN BALI'S PAMSIMAS PROGRAM
Objective: This study investigates the impact of the Community-Based Drinking Water and Sanitation Provision Program (Pamsimas Program), implemented in Bali from 2017 to 2021, on improving access to clean drinking water and sanitation in rural communities.
Theoretical framework: It draws on the S-shape and Inverted L-shape curves to emphasize planned interventions and incentives, while the Theory of Change guides program evaluation by explaining how interventions lead to outcomes. Employing a five-stage results chain, the program focuses on inputs, activities, outputs, outcomes, and long-term impacts.
Method: Through a comprehensive analysis of the program's effectiveness, we employ a natural experiment approach using Propensity Score Matching (PSM) and Multinomial Ordered Logit/Probit regression. The study compares villages receiving Pamsimas interventions in 2019, 2020, and 2021 with non-intervention villages, employing data from the 2014, 2018, and 2021 Village Potential Census (Podes).
Results and conclusion: The findings reveal that Pamsimas significantly influences the choice of water sources and sanitation practices in beneficiary villages. The estimated marginal effects demonstrate a substantial improvement in water quality and sanitation in program-receiving villages compared to control villages. The paper concludes that the Pamsimas Program, by targeting easily achievable improvements, aligns with the pragmatic trend in development economics and provides valuable insights for future water and sanitation interventions.
Originality/value: The analysis, guided by the paradigm shift in development economics towards pragmatic and low-hanging fruit solutions, positions Pamsimas as an effective strategy despite not being as cost-effective as certain health programs.Este estudio investiga el impacto del Programa Pamsimas, implementado en Bali desde 2017 hasta 2021, en la mejora del acceso a agua potable y saneamiento en comunidades rurales. Utilizando una cadena de resultados de cinco etapas, el programa se centra en insumos, actividades, resultados, impactos y efectos a largo plazo. A través de un análisis integral de la efectividad del programa, empleamos un enfoque de experimento natural utilizando Propensity Score Matching (PSM) y regresión logística/probit ordenada multinomial. El estudio compara las aldeas que recibieron intervenciones de Pamsimas en 2019, 2020 y 2021 con aldeas no intervenidas, utilizando datos del Censo Potencial de Aldeas (Podes) de 2014, 2018 y 2021. Los hallazgos revelan que Pamsimas influye significativamente en la elección de fuentes de agua y prácticas de saneamiento en las aldeas beneficiarias. Los efectos marginales estimados demuestran una mejora sustancial en la calidad del agua y el saneamiento en las aldeas que reciben el programa en comparación con las aldeas de control. El análisis, guiado por el cambio de paradigma en la economía del desarrollo hacia soluciones pragmáticas y de bajo costo, posiciona a Pamsimas como una estrategia efectiva a pesar de no ser tan rentable como ciertos programas de salud. El artículo concluye que el Programa Pamsimas, al dirigirse a mejoras fácilmente alcanzables, se alinea con la tendencia pragmática en la economía del desarrollo y proporciona ideas valiosas para futuras intervenciones en agua y saneamiento
Highlighting the State of Correctional Institutions in Indonesia After the Prisoner Assimilation Policy in The Covid-19 Pandemic
Purpose: The purpose of this research is to show the condition of correctional institutions in Indonesia after the Covid-19 outbreak, where at that time the government implemented an assimilation policy as a limitation on social distancing.
Theoretical framework: The problem of criminal implementation in Indonesia has received ongoing attention. The implementation of punishment should be adjusted to correctional standards in accordance with correctional objectives which cannot be separated from the rights of prisoners which are difficult to achieve in conditions of overcapacity.
Design/methodology/approach: This research is qualitative by drawing conclusions based on the orientation of data output from the Indonesian Directorate General of Corrections. Where the author will provide conclusions on the condition of correctional institutions after the 2020 assimilation policy, which has pros and cons in society, whether it will have a positive effect in the long term or not. If we refer to global correctional standards, the amount of capacity is the basis for assessing the achievement of correctional goals.
Findings: Based on Permenkumham Number 32 of 2020 regarding assimilation as a policy to limit social distancing and protect the rights of prisoners during the COVID-19 pandemic, it has been shown that something that is considered a good answer to the overcapacity of prisons in almost all regional offices in Indonesia is in fact not providing significant change. Data from correctional institutions in all provincial regional offices in Indonesia shows that the total number of inmates in 2019 was 199,965 inmates, in 2020 there were 205,484 and in 2022 there were 225,877 inmates with a maximum capacity of 137,031.
Research, Practical & Social implications: The problem of criminal implementation is in the spotlight due to overcapacity in almost all correctional institutions. It would be best for the government, in this case the Indonesian Ministry of Law and Human Rights, to look for alternatives to criminal enforcement in the future.
Originality/value: The research results show that the condition of prisons after the Covid-19 pandemic has not shown any changes to date. The hope of assimilation as an answer to the problem of overcapacity is not in line with the large number of prisoners held in 33 provinces as regional offices implementing corrections
Revitalization of Village Autonomy Based on The Principle of Subsidiarity and Village-Scale Local Authority in Natural Resource Management
Objectives: The objective of this research is to explore and advocate for the revitalization of village autonomy, particularly through the principle of subsidiarity and village-scale local authority. It aims to analyze the current state of village autonomy within the framework of the Village Law, with a focus on managing natural resources at the local level.
Methods: This research employs a normative approach to examine the legal and political aspects of village autonomy, specifically within the context of the principle of subsidiarity. It involves an analysis of existing legal frameworks, particularly the Village Law, to understand the dynamics of state and village relations concerning the management of natural resources. Additionally, the research investigates how the principle of subsidiarity can be applied to empower villages in managing resources within their jurisdiction.
Results: The findings of this research indicate that the principle of subsidiarity can serve as a foundational concept for regulating village-scale local authority. It suggests that village autonomy, particularly in managing natural resources like regional forests, mangrove forests, small islands, coastal areas, and marine areas, can be bolstered through the application of this principle. The research highlights that village autonomy should not only be declarative but also constitutive, allowing villages to expand their authority over specific natural resources.
Conclusion: In conclusion, the revitalization of village autonomy, guided by the principle of subsidiarity and village-scale local authority, emerges as a viable legal and political alternative. By emphasizing the handover of certain natural resource management responsibilities from the state to villages, as regulated by law, this approach seeks to strengthen village authority and promote effective resource management at the local level
