Role Of Quantity Surveyor
Objective: The purpose of this research is to define role of quantity surveyor from law perspective and define the ideal regulations towards role of Quantity Surveyor in Indonesia.
Method: The research method used is literature research with a legal approach and case studies regarding legal gaps regarding the limitations of what Quantity Surveyors can do in carrying out their duties as construction agreement makers and providing legal certainty for construction agreements.
Results: The research results the function of QS is as a party that can guarantee legal certainty in construction agreements, for this reason ideal rules are needed to describe the role of QS in law and the absolute requirements for becoming a QS profession that have been fulfilled. This standard is like other jobs such as a lawyer or notary. A quantity surveyor who has legal knowledge can handle and avoid problems that occur later from a legal perspective and immediately draw up an agreement
Collaborative Governance in Local Economic Development: the Case in East Java, Indonesia
Purpose: The aims of this study is to analyze the local economic development in Sumenep Regency with a collaborative governance perspective. We employed qualitative research techniques that focused on describing and understanding the subject.
Methods: Our analysis of the data involved interactive methods. We conducted in-depth interviews with 30 individuals who represented various stakeholders in local economic development, including the government, private sector, community, media, and universities. Research is focused on context systems, collaboration drivers, collaboration dynamics and collaborative action. In this study, the weak collaboration context system is caused by weak network ties and low stakeholder interaction frequency. Meanwhile the leadership factor has an important role in building and strengthening stakeholder networks and interactions as a driving force for collaboration.
Finding: The findings of this study construct the theory of collaborative governance put forward by Emerson and Nabatchi (2015) by adding elements of social capital, forming collaborative institutions (Koperasi or BUMDes) and strengthening collaborative institutional capacities.
Contribution/Originality: The research uncovers the significance of collaborative institution formation (Koperasi or BUMDes) and the role of social capital in successful collaborative governance for local economic development. These research suggests a collaborative governance model based on Emerson and Nabatchi's regime combined with collaborative institution formation. Emphasizes the importance of strengthening social capital and collaborative institutions for achieving successful collaborative goals in local economic development
Al-Fuzai: an Arabian Literary Figure
Objective: Translation, especially literary translation, helps nations and peoples understand each other, and this is the ultimate goal to this writer’s introduction in this widely circulated magazine.
Method: This research relies mainly on reading texts written by Al-Fuzai and searching for what was written about his literature in Arabic, as well as translating some of those texts from Arabic to English carried out by the author of this research.
Results: This paper is a literary translation that addresses the gap that exists between languages and can be addressed through translation. Reading this paper will make the English reader familiar with excerpts and translations for the writer in question.
Conclusion: That gap that exists between languages can be narrowed through communication through translation, as well as learning about the literature and sciences that others have that we need
The Principle of Publicity in the Binding of Guarantees For Credit in the Distribution of Credit in Banking Institutions Linked to the Prudential Banking Principle
Objective: This research aims to determine the principle of publicity in binding collateral for mortgage rights in lending to banking institutions about the tenets of Prudential Banking.
Method: The type of research used is normative legal research to test applicable norms or provisions. It can also be researched by examining library materials or secondary data. Doctrinal legal research. The approach method used is the conceptual approach method.
Result: Economic actors complete their financial needs by borrowing funds or capital, which is called credit, through public or private banks, users of banking products or services because there are still practices that are considered not in line with existing regulations, thus resulting in or having an impact on the debtors and creditors themselves. It can harm both parties, both materially and immaterially.
Conclusion: The application of the principle of prudence in credit distribution is critical to ensure that the bank is always in a healthy condition, always in a liquid, solvent and profitable condition, especially in the distribution of funds with collateral for land rights; the application of the publicity principle is also very influential in determining the position of the bank, especially in taking back credit repayments. Therefore, the focus of prudence and the direction of publicity support the achievement of legal certainty for parties entering into agreements in credit agreements, especially in providing mortgage credit
Human Capital is the Key to the Successful Competitiveness of Countries in the Asean
Objective: This research aims to look at competitiveness in the Asean region. Knowing the factors driving competitiveness then mapping the strength of competitiveness based on the driving factors for each country in ASEAN. So you will know which countries with high competitiveness are influenced by what factors. The results will be an illustration for other countries in ASEAN to improve these factors with the aim of increasing competitiveness.
Method: The method used to determine the factors driving competitiveness is to use panel data regression with the Stata application. Then group them using main factor analysis with SPSS so that country categories are found based on the factors driving their competitiveness. The data used are 12 indicators forming independent and dependent variables. Obtained from various relevant sources. In a period of 10 years, namely 2010 to 2019.
Results: The results of multivariate linear regression showed that both simultaneously and partially Human Capital Development (HCD), Human Capital - High Education (HCH), Research and Technology Development (RTD), and Social Capital – Unemployment (SCU) had a significant influence on Competitiveness. HCD has the greatest influence on competitiveness. This research can provide an illustration for each country in ASEAN that the driving factors of competitiveness needed to achieve high competitiveness are HCD and HCH because of their large influence in the regression model. Countries with very strong competitiveness also have very strong HCD and HCH factors and vice versa. This can be a consideration for each country in making policies related to increasing national competitiveness. Because high competitiveness indicates a high level of population welfare
IMPLEMENTATION OF CHANGES IN THE MINIMUM AGE FOR MARRIAGE FOR MEN AND WOMEN IN VIEW OF ISLAMIC LAW IN INDONESIA
Objective: Indonesia is a constitutional state with a Muslim majority that uses Islamic law as a source of law which is then codified in law (taqnin al-ahkam). This was born marriage law, judicial law, religion, zakat law, and waqf law. After the enactment of Law no. 16 of 2019 concerning Marriage there are changes regarding the minimum age limit for marriage.
Methods: This type of research is empirical juridical in nature which in other words is a type of sociological legal research and can also be called field research, which examines the legal provisions that apply and what actually happens in society
Results: The results of this study concluded that there were many marriage dispensation applications to the Religious Courts. This is influenced by several factors, namely legal substance factors, educational factors and economic factors.
Conclusion: This research examines application of the marriage age limit must be updated in accordance with current Islamic law
Consumer Protection in Indonesia: Exploring the Adverse Effects of Misusing Exoneration Clauses on Consumer Rights in Legal Perspective
Objective: This research examines the misuse of exoneration clauses disadvantaging consumers and explores methods for safeguarding consumers against their adverse effects.
Theoretical Framework: The research utilizes normative analysis of relevant legal regulations, drawing from primary, secondary, and tertiary legal sources.
Method: The employed method involves normative qualitative analysis to assess the impact of standard agreements embedding exoneration clauses on consumers.
Result and Conclusion: The study concludes that exoneration clauses within standard agreements often result in consumer losses. Such clauses arise from an imbalance in agreement dynamics, where the dominant party imposes terms, taking advantage of the other party's dependence. As these clauses necessitate mutual consent, their presence renders agreements invalid, thus violating legal norms.
Originality/Value: The research's contribution lies in recommending governmental oversight to supervise business entities in drafting agreements. This oversight aims to ensure the protection of consumer rights and adherence to legal standards
Communication Media Public Relations Unit Work Special Executor Upstream Oil and Gas Activities in supports the 1 Million Barrel Oil Per Day 2030 Program
Objective: The aim of this research is to define the role of media relations implementation at SKK Migas, Public Relations plays more of a role as a communication technician and facilitator. As a communications technician, Public Relations plays the role of creating and implementing Media Relations activities, where Public Relations is not placed as a source of information in Media Relations activities.
Method: The research method used is a case study method, because this research aims to observe real events that occurred in media relations carried out by the Special Task Force for Upstream Oil and Gas Activities to realize the program for handling oil reserves with stakeholders in Indonesia. The things examined in this research are related to the data and facts contained in the implementation of the Special Oil and Gas Working Unit program, a single 1 Million BPOD program. This research provides a relatively complete picture of what happened when the research was conducted.
Results: The results of research on the program implementation process in operational activities in the upstream oil and gas industry are known to often encounter obstacles. Various problems in the operational activities of the upstream oil and gas industry have resulted in two broad outlines that are relevant to the function of public relations. Negative reporting in the media, relations with local media and local journalism organizations are examples of the main focus of all discussions in the Media and Publications section
The Influence of Social Environment and Learning Motivation on The Ability to Memorize the Qur'an in Indonesian Islamic Boarding
Objective: This research is motivated by the social environment that has not been fully established with values and educational surroundings. The objective of this study is to analyze the students' ability at Tarbiyatussiby de Mempawah in the academic year 2019-2020 to learn about the coronavirus and its impact on the social environment.
Method: This research adopts a quantitative method. It involves 38 students and two teachers as participants. Data collection techniques include participatory observation, indirect communication, measurement techniques, and documentary study. Quantitative data analysis is conducted using SPSS software.
Results: The research findings are as follows: 1) The students' social environment scores an average of 81.64. 2) The students' motivation to learn about the coronavirus averages at 82.56, indicating a very good category. 3) The students' ability to learn about the coronavirus is rated at 89.24, which falls under the very good category or according to the standards of Tajwid science.
Conclusions: The research indicates that the students' social environment has a high score of 81.64. The students' motivation to learn about the coronavirus is significantly high, with an average of 82.56, falling into the category of very good. The students' ability to learn about the coronavirus also demonstrates impressive results, with a score of 89.24, which is considered very good. These findings suggest that the students have a positive inclination towards understanding the subject matter of the coronavirus in accordance with the standards of Tajwid science
Effective External Control Strategy to Improve Network Governance in National Development
Purpose: This research aims to explore the synchronization of planning and budgeting for development in Indonesia, focusing on governance and network management perspectives. It seeks to understand the complexity and effectiveness of networks in national development management and the impact of external control on task implementation.
Theoretical Framework: The study adopts a post-positivist approach, emphasizing the importance of governance structures and network management in development planning. It highlights the roles of independent bodies such as the Legislative/Regional Assembly (DPR/DPRD), Audit Board of the Republic of Indonesia (BPK), and Financial and Development Supervisory Agency (BPKP) in overseeing development processes and preventing waste and misappropriation.
Method: A qualitative methodology was used, incorporating data from various government institutions and professional organizations. Data collection involved in-depth interviews and document analysis. The study employed data reduction, data display, and conclusion drawing/verification techniques to ensure a robust analysis.
Results: The findings indicate a critical need for external control in ensuring adherence to plans and preventing misappropriation in development management. A significant overlap between the duties and authorities of BPKP and BPK was identified, suggesting a need for regulatory reform to enhance the efficiency and effectiveness of state financial oversight.
Conclusion: The study concludes that efficient and effective external control is essential for achieving transparency and integrity in state finances management. It recommends regulatory reforms to clarify the roles of BPKP and BPK, thereby improving the effectiveness of financial oversight. These changes are crucial for supporting the attainment of national development objectives and ensuring sustainable growth
