Get PDFIn this study, we will comment on the position adopted by the Portuguese Supreme Administrative Court in its judgement of November 9th, 2022 (Case no.0386/10.9BEVIS) regarding the application of certain internal VAT exemptions to a social economy entity. In our work, we will try to highlight the importanceof the position adopted by the Supreme Administrative Court in what concerns to the watertight and autonomous consideration of social economy entities within a business group and to the strict interpretation of VAT exemptions (including the non-profit organization’ concept), also adding some thoughts in what concerns to the prevention of abusive tax planning situations involving the social economy.No presente estudo, comentaremos a posição adotada pelo Supremo Tribunal Administrativo no Acórdão proferido a 9 de novembro de 2022 no âmbito doProcesso núm. 0386/10.9BEVIS a respeito da suscetibilidade de aplicação de determinadas isenções internas de IVA a uma entidade da economia social.No nosso trabalho, procuraremos evidenciar a importância da posição adotada pelo Supremo Tribunal Administrativo ao nível da consideração estanque eautónoma das entidades da economia social no seio de um grupo empresarial e da interpretação estrita das isenções de IVA (incluindo o conceito de organismo sem finalidade lucrativa), acrescentando algumas reflexões sobre a necessidade de prevenção de situações de planeamento fiscal abusivo envolvendo as entidades deste setor
COOPERATIVISMO FINANCIERO: ANÁLISIS COMPARATIVO DE LA ESTRUCTURA REGULATORIA DE LAS ORGANIZACIONES DE ECONOMÍA SOCIAL DEL SECTOR FINANCIERO COOPERATIVO EN COLOMBIA Y ESPAÑA
Get PDFThe solidarity economy sector is regulated in the Colombian and legal system through various regulatory instruments that associate it, in the first case, withthe development of nonprofit activities. This sector includes, among other organizations, the so-called financial cooperatives. This paper seeks to make ancomparative analysis of the main regulatory aspects applicable to these entities in both legal systems, in order to place them within the organizations of the social economy and identify possible regulatory changes that allow the same sector to operate more efficiently and with more coverage in the Colombian market. From the analysis carried out, it is concluded that it is necessary to adjust the functioning of financial cooperatives by adapting it to the concept of the social economy, allowing business concerns to participate, adjusting the minimum capital to territorial contexts, implementing institutional systems of protection and permitting the execution of other operations authorised for credit institutions.El sector de la economía social o solidaria se encuentra regulado en los ordenamientos jurídicos colombiano y español a partir de diversos instrumentos normativos que lo asocian, en el primer caso, al desarrollo de actividades sin ánimo de lucro. Forman parte de este sector, entre otras organizaciones, las denominadas cooperativas financieras. El presente trabajo pretende realizar un análisis comparativo de los principales aspectos regulatorios aplicables a estas entidades en uno y otro ordenamiento, con el fin de ubicarlas dentro de las organizaciones de la economía social e identificar posibles modificaciones normativas que permitan que el mismo sector pueda operar de una manera más eficiente y con más cobertura en el mercado colombiano. Del análisis realizado se concluye que para esta finalidad es necesario ajustar el funcionamiento de las cooperativas financieras adaptándolo al concepto de economía social, permitir en ellas la participación de personas mercantiles, ajustar los capitales mínimos a contextos territoriales, implementar sistemas institucionales de protección y permitir la ejecución de las demás operaciones habilitadas a los establecimientos de crédito
LA NARRATIVA EN LA LITERATURA JUVENIL. UNA APROXIMACIÓN A LA OBRA DE CARLO FRABETTI
Get PDFThis paper examines the theoretical and methodological conceptions by Montesino (2003),Teixidor (2005), Cerrillo and Sánchez (2006), Cerrillo (2015), and Herrera (2018) regarding literature for teenagers and young people. It considers such literature both as an art form and as a vehicle fortransmitting ideas and values related to establishing communication. This is a fundamental characteristic of the novel within this genre of literary creation. This study aims to delve into Carlo Frabetti’s narrative by analyzing two of his novels: Terrible Ángel and Calvina. To achieve this, the study utilizes bibliographic review methods to explore the theoretical and methodological conceptions of narrative features for children and young people. Additionally, content analysis and inductive-deductive analysis are employed to elucidate the characteristics of children’s and young adult narratives in the selected novels. Frabetti is renowned for creating more than forty works for children and young people and has received the Cervantes Chico Prize and the Barco de Vapor Prize for his novel Calvina. This article highlights specific features of Frabetti’s narrative style and examines how his work contributes to the promotion of young adult literature.En el presente trabajo se abordan concepciones teóricas y metodológicas de Montesino, 2003; Teixidor, 2005; Cerrillo y Sánchez, 2006; Cerrillo, 2015 y Herrera, 2018 sobre la literatura para adolescentes y jóvenes como condición de arte literario y de vehículo transmisor de ideas y valores relacionada con la posibilidad de establecer la comunicación. Esta es una característica fundamental de la novela en este tipo de creaciones literarias. Este trabajo tiene como objetivo acercarnos a la obra narrativa de Carlo Frabetti, a través del análisis de dos de sus novelas: El ángel terrible y Calvina. Para ello se tuvo encuenta los métodos de revisión bibliográfica para abordar las concepciones teórico-metodológicas sobre los rasgos de la narrativa para niños y jóvenes; el análisis de contenido y el inductivo-deductivo, para explicar las características de la narrativa infantil y juvenil presentes en las novelas objeto de estudio. Frabetti se ha destacado por la creación de más de cuarenta obras infantiles y juveniles, es Premio Cervantes Chico y Premio Barco de Vapor por su novela Calvina. Con este artículo se reconocen algunos rasgos de la narrativa desarrollada dicho escritor y cómo, desde su obra, se puede contribuir al proceso de promoción de la literatura juvenil
