From RTBF to Devoir de Mémoire: The Imperative of Amanah and Adālah in Regulating Former Corruption Offenders\u27 Candidacy

    No full text
The Indonesian regulation permitting ex-corruption convicts to run for public office after a five-year waiting period creates a critical normative dilemma, particularly when intersecting with the EU-centric\u27 Right to Be Forgotten\u27 (RTBF). This article explicitly aims to analyze and challenge the applicability of the RTBF framework to the candidacy of former corruption offenders by re-examining it through the lens of Islamic leadership ethics, specifically the principles of amanah, adālah, and fiqh siyasah. Using a normative-juridical approach, this study analyzes Indonesian electoral regulations and the RTBF doctrine, synthesized with classical and contemporary Islamic jurisprudence, with particular emphasis on Maqāshid al-Sharīʿah and the doctrine of sadd al-dharāʿīʿ. The findings reveal two key points: First, the five-year waiting period fundamentally misapplies RTBF by equating public records of corruption with private data; this article proposes its antithesis, devoir de mémoire (the duty to remember), as the required public policy framework. Second, Islamic jurisprudence establishes adālah (moral integrity) as a binding legal qualification (sharṭ) for public office, and corruption legally and perpetually nullifies this qualification. The study concludes that spiritual taubah (repentance) is distinct from public-legal qualification (ḥaqq al-ummah) and does not automatically restore eligibility. Therefore, disqualifying former corrupt officials does not violate rights but represents a necessary implementation of sadd al-dharā’iʿ to safeguard public amanah and protect the public interest

    No full text
This study examines the integration of Samin cultural heritage within the development of the Bojonegoro Geopark, with particular attention to its representation in geopark planning, educational functions, and community participation. The research examines the integration of Samin cultural values, historical narratives, and social practices into the geopark framework. It also analyzes the forms and extent of Samin community participation in geopark-related initiatives and identifies the challenges of maintaining cultural identity within tourism-oriented development. The research employs a qualitative methodology that draws on empirical, historical, and conceptual approaches. Data were collected through in-depth interviews with Samin elders, community leaders, village officials, and members of Samin communities. Document analysis was used to examine policy documents, cultural records, and geopark planning materials. The data were analyzed using thematic analysis to identify recurring patterns, meanings, and relationships relevant to cultural representation and participation. The findings indicate that Samin\u27s teachings emphasize honesty, non-violence, social responsibility, religious devotion, and harmony with nature. These values function as living traditions that support the educational, conservation, and community empowerment pillars of UNESCO Global Geoparks. The study also reveals active community participation in cultural preservation through rituals, traditional architecture, and cultural products. However, challenges emerge in balancing cultural authenticity with tourism-driven economic interests. The study concludes that inclusive governance and culturally sensitive geopark management are essential to ensure sustainable heritage preservation and community-centered development

This study aims to analyze the trends and developments in Islamic education curriculum research during the past decade (2014-2024) through a bibliometric approach. Employing the Bibliometrix R package and VOSviewer, 616 Scopus-indexed documents were analyzed to identify publication patterns, scholarly collaboration, bibliographic coupling, thematic evolution, and keyword co-occurrence. The results indicated a notable rise in academic publications during the past decade, particularly from Indonesia, Malaysia, and the United Kingdom. Five main keyword clusters were identified, namely integration of Islamic education within the framework of educational reform, multicultural education, institutional practices, socio-cultural involvement, and curriculum development. Thematic evolution indicated that character education, multiculturalism, and Islamic identity were the basic themes, although topics like sex education and extremism exhibited a changing pattern facing global challenges. Despite the growing interest in these issues, bibliographic analyses reveal fragmented work and limited local citations. Additionally, the study highlights the increasing role of international collaborations in advancing Islamic education research and the growing focus on integrating contemporary societal issues within the curriculum. This research offers significant insights into the shifting focus areas within Islamic education, reflecting both regional and global academic trends, and suggests areas for further development in curriculum and educational practices. This research contributes to achieving SDG 4 by advancing understanding of how Islamic education can be aligned with global educational objectives, promoting a more inclusive and equitable approach to curriculum development.Penelitian ini bertujuan untuk menganalisis tren dan perkembangan riset kurikulum pendidikan Islam dalam dekade terakhir (2014-2024) melalui pendekatan bibliometrik. No full text
As new learning methods continue to emerge, Self-Directed Learning (SDL) remains a crucial element in the field of education, specifically for promoting inclusive quality education. This research is a Systematic Literature Review using the PRISMA framework to explore research trends, factors, and impacts of self-directed learning within Indonesian adult education, focusing on 25 Scopus-indexed publications from 2019 to 2024. The findings indicate a notable rise in related publications, particularly post-2022, with quantitative research methods being the most applied and undergraduate students serving as the primary subjects, which highlights a gap in representing broader adult learner populations. Thematic analysis reveals that SDL is effectively cultivated through structured antecedents, specifically gamified MOOCs, Learning Management Systems, and flipped classroom pedagogies, which causally link to enhanced digital literacy, creativity, and learner autonomy. Crucially, the study distinguishes that while purposeful educational technology fosters independence, uncontrolled social media usage acts as a potential hindrance to self-regulation. Based on these insights, the researchers recommend prioritizing guided technology integration and suggest that future studies diversify methodologies and broaden participant scopes beyond undergraduate students to better address the inclusive nature of adult education. Aligning with SDG 4 and SDG 10, this study positions SDL as a catalyst for inclusive quality education and reduced inequalities, empowering diverse learners, particularly marginalized groups, to achieve autonomy and lifelong growth.

The Construction of Women\u27s Power in the Film Hati Suhita

    No full text
This article examines the construction of women\u27s power within the context of Islamic boarding schools (pondok pesantren), using the film Hati Suhita as a case study. Employing content analysis and Mansour Fakih\u27s theory of gender, this study explores the historical, social, and cultural influences on the perception of women\u27s power. The film reveals that the construction of women’s authority in pesantren is shaped by both internal and external forces that have traditionally relegated women to subordinate roles. However, Hati Suhita illustrates that gender constructions are not fixed. The character Alina Suhita challenges traditional norms, presenting a compelling narrative in which women can occupy roles equal to men. The acknowledgment of women’s power in the film reflects a positive influence, particularly in education and leadership. The findings highlight the importance of transforming discriminatory gender constructs, a goal achievable through education, advocacy, and policy reform. This study provides significant insight into how gender dynamics in Islamic educational settings can evolve to support greater inclusion and empowerment

The Struggle of Sinden: Female Artists, Family Economy, and Religious Identity in Art

    No full text
This study aims to analyze the role, contribution, and convergence of the Sinden (traditional female singer) profession in strengthening the family economy while navigating the challenges of religious identity in Solo, Central Java. This study uses a qualitative approach with an interpretive paradigm and a phenomenological approach. The data collection technique uses in-depth interviews with active Sinden informants with dual roles as housewives and artists. The results of the study indicate that the economic contribution of the head of the family includes the role of an economic safety valve, household financial manager, and teamwork builder in the family. The study also reveals a convergence between religious beliefs and their profession, as Sinden. Despite the ambiguity of this profession in religious communities, primarily due to stage performances that do not strictly adhere to Islamic guidelines, Sinden consistently upholds standards of modesty, religious principles, and their dignity as Muslim women. This study contributes to providing an overview of the dualism of women\u27s roles in the context of Javanese-Islamic culture, which adds insight into the complex interactions between gender, economy, art, and religion in the lives of contemporary traditional societies

Land, Law, and Legitimacy: Unveiling the Evidentiary Power of Ownership Certificates in the Confluence of Islamic and Agrarian Legal Traditions

    No full text
This study examines the legal status of land ownership certificates from the perspectives of positive law and Islamic jurisprudence. It explores national procedures for land certification and Islamic concepts of ownership and evidence, such as ikrar (declaration), shahadah (witness testimony), and ihya al-mawat (revival of dead land). Using a qualitative, normative-juridical method, the research analyzes statutory land rules and Islamic legal principles. Findings show that land certificates have strong evidentiary value under national law. However, bureaucratic delays, high administrative costs, and maladministration hinder the process. In Islamic law, such certificates may be recognized as valid ownership proof if acquired lawfully and aligned with justice and public welfare (maslahah). Islamic jurisprudence also emphasizes clarity in property rights to prevent disputes and promote fairness. Ultimately, while the two legal systems operate on distinct foundations, they can be integrated to build a more just and legally certain framework for land ownership
