Inheriting Inequity: A Comparative Legal Dissection of Gender Discrimination in Indonesian Inheritance Law
As Indonesia adopts Islamic law, civil law, and customary law in its legal system, it is suspected that some serious issues emerge in its implementation. One of them is gender inequality issue in its inheritance law. While the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW) has been ratified by the country, discriminatory practices persist as a result of patriarchal interpretations of the law and dominant patrilineal customs. This study aims to analyze gender inequality in inheritance distribution by examining how legal systems in Indonesia align with or diverge from the international human rights norms, particularly CEDAW. Using a normative legal method and comparative approach, this study looked into the legal structure, substance, and culture of inheritance legal systems in predominantly Muslim countries such as Egypt, Tunisia, Morocco, Pakistan, Thailand, Malaysia, Singapore, Brunei Darussalam, and Indonesia based on Lawrence Friedman’s legal system theory. The results showed that Indonesia’s civil law had a tendency to conform to the international gender equality norms. However, the Islamic and customary inheritance practices in the country were still strongly influenced by patriarchal values. In comparison, some of the other countries studied in this research demonstrated greater flexibility in aligning their Islamic inheritance laws with the gender justice principles. These findings underscored the urgent need for Indonesia to develop context-sensitive legal reform strategies that include progressive ijtihad, transformation of patriarchal customs, and synchronization of the national inheritance law with the international human rights standards
Legal Uncertainty and Its Implications for Innovation and Equality in Ride-Hailing
Transportation plays a vital role in national development and public welfare. However, regulating ride-hailing in Indonesia encounters significant challenges, particularly regarding legal certainty and fairness. This study investigates the complexity of legal uncertainty and inequality within the partnership framework of ride-hailing services. Using a normative legal approach comprising legislative, conceptual, and comparative methods, the study finds that overlapping laws, lack of uniform operational standards, and inconsistent law enforcement create legal ambiguity. Moreover, it identifies systemic inequalities in the ride-hailing partnership model, where drivers are in a structurally weaker position than platform companies. These imbalances are inadequately addressed under the current Civil Code, resulting in unfair fare systems, insufficient driver protection, and unequal licensing practices. The main findings indicate the need for clear and cohesive legal instruments that ensure equal legal standing for all stakeholders. The study contributes to legal scholarship by proposing a revised partnership model rooted in legal certainty and social justice principles. It recommends regulatory harmonization, restructuring the partnership framework to reflect equitable legal positions, and implementing responsive legal standards. These steps are essential for developing a fair, sustainable, and inclusive transportation ecosystem in Indonesia
Implementasi Program Pendidikan Inklusi di Sekolah Alam Banyu Belik Kedung Banteng
Inclusive education is an educational system that accommodates all students,including children with special needs, to learn together in one learning environment.This concept is in line with the Indonesian national education philosophy that upholdsaccess to education without discrimination. The implementation of inclusive educationin Indonesia is based on government regulations, such as the Ministerial Decree No. 70of 2009 and Law No. 20 of 2003 Article 32. Banyu Belik Nature School implements theconcept of inclusive education by integrating the 2013 curriculum, the independentcurriculum, and the adaptive curriculum called the "cassava curriculum". Thisprogram involves nature as the main learning medium and source, as well as developslife skills with an environmental awareness. However, there are several challenges inits implementation, such as the readiness of human resources, supporting facilitiesand infrastructure, public acceptance and attitudes, and policies that are not yet fullysupportive. Efforts that can be made to overcome these challenges include trainingand mentoring for teachers, procurement of accessible facilities, public outreach,policy advocacy, and the establishment of a disability service unit. The success ofinclusive education heavily depends on teacher competencies, collaboration amongstakeholders, and a comprehensive transformation within the education system
Determining Consumer Intentions Towards Using Sharia Fintech Lending: Technology Acceptance Model Approach
Conventional and Islamic fintech lending in Indonesia has experienced relatively rapid development. However, the accumulation of financing distribution of Islamic fintech lending is still far below that of conventional fintech lending. Demographic factors, namely the majority of the Indonesian Muslim population, do not make Islamic fintech lending their primary choice for borrowing funds online. Based on the Technology Acceptance Model theory, this study analyses the factors influencing consumer intentions to borrow from Islamic fintech lending. The analysis of this study uses a variant-based Structural Equation Model (SEM) with Partial Least Squares (PLS). The sampling technique uses purposive sampling and obtains 113 data points. The study\u27s results indicate that subjective norms positively affect perceived usefulness and ease of use, and perceived ease of use positively impacts the perception of usefulness. The subjective norms and perceived usefulness have been proven to be significantly positive in encouraging the intention to borrow in Islamic FinTech lending. In contrast, the perceived ease of use has not been proven to influence the intention to borrow in Islamic Fintech lending. The moderating variable in this study, namely knowledge of usury, is proven unable to moderate the relationship between subjective norms, perceived usefulness, and perceived ease of use on the intention to borrow in Islamic fintech lending
Pengembangan Objek Wisata Melalui Sistem Informasi Geografis di Kabupaten Aceh Jaya
Artikel ini bertujuan untuk melihat distribusi pola persebaran objek wisata di Kabupaten Aceh Jaya. Penelitian ini juga menganalisis strategi pengembangan objek wisata dengan menggunakan Sistem Informasi Geografis di Kabupaten Aceh Jaya. Pengambilan data menggunakan wawancara, observasi, dan dokumentasi. Teknik analisa menggunakan analisis deskriptif dengan analisis SWOT. Hasil penelitian ini mengambarkan pola persebaran objek wisata di Kabupaten Aceh Jaya tersebar luas di pesisir Pantai yang meliputi potensi kawasan objek wisata dalam bentuk panorama alam, berkemah, memancing, menyelam, dan outbond. Berdasarkan analisis SWOT masih terdapat beberapa kelemahan dan ancaman dalam pengembangan objek wisata di Kabupaten Aceh Jaya. Kelemahan yang terdapat pada umumnya mengenai akses transportasi menuju Lokasi objek wisata menjadi isu prioritas dalam pengembangan objek wisata. Sedangkan ancaman yang terdapat pada objek wisata terdapat pada aspek bencana alam serta kerusakan pada aspek lingkungan akibat dari kesadaran pengunjun. Adapun upaya pemerintah yang telah dilakukan ialah melakukan sosialisasi objek wisata melalui hasil aplikasi Sistem Informasi Geografi, percepatan pembangunan sarana (pertunjukan, restoran, biro perjalanan) dan Prasarana dalam bentuk akses transportasi di lokasi objek wisata
The Manuscript Kifayah Al-Muhtaj fi Al-Isra Wa Al-Miʻ\u27raj By Sheikh Daud Al-Fatani: a Brief Review
The event of Isra’ and Mi\u27raj is one of the most significant events in Islam. This event holds deep meaning, especially for the Muslim community. Manuscripts have been used as a medium to share the story of Isra’ and Mi\u27raj. One of the most influential manuscripts in the Nusantara region about Isra’ and Mi\u27raj is Kifayah al-Muhtaj fi al-Isra wa al-Miʻraj, written by Sheikh Daud al-Fatani, a scholar from Patani and now preserved in the Balai Khazanah Islam Sultan Haji Hassanal Bolkiah. This research uses a philological study. The research results show that Balai Khazanah Islam Sultan Haji Hassanal Bolkiah houses several important Islamic manuscripts, one of which is the Kifayah al-Muhtaj fi al-Isra wa al-Miʻraj manuscript by Syekh Daud al-Fatani. The existence of this manuscript affirms the intellectual development of Islam in the Nusantara region, marked by the production and reproduction of Islamic texts. It also emphasizes that Jawi script, the Arabic letters used in Malay phonology, became one of the distinctive features of Islamic manuscripts produced in the Nusantara region
The The Political Relevance of Kartosuwiryo\u27s Hijrah in the Global Context: Inspiration for Struggle in the Modern Era
Sekarmadji Maridjan Kartosuwiryo, familiarly called Kartosuwiryo, was the proclamator of the Islamic State of Indonesia. Kartosuwiryo believed Islam had a significant influence on every aspect of human life. The idea he wanted to realize was establishing the Islamic State of Indonesia, and hijrah politics was one of Kartosuwiryo\u27s efforts toward the Islamic State of Indonesia. This article will analyze the basic concept of the hijrah political thought of Sekarmadji Maridjan Kartosuwiryo in establishing the Islamic State of Indonesia. The method used is qualitative, with literature studies such as books, journals, articles, and others. In addition, the author uses a historical approach and the construction of a day approach to explore information about Kartosuwiryo\u27s hijrah politics. The results showed that Kartosuwiryo\u27s hijrah politics was an Islamic-based struggle to build a state with laws and order based on the Qur\u27an. This concept remains relevant to address modern global challenges, such as migration, religious identity, and cross-cultural solidarity. In addition, this article also shows that the politics of hijrah is not only a strategy of resistance against colonialism but also has relevance in the modern era. Hijrah can be translated as an effort to create social transformation, such as community empowerment, cross-cultural solidarity, and humane management of global migration. By adapting to digital technology, the concept of hijrah can also encourage interfaith dialogue and spread social justice values in an increasingly connected world
Efektivitas Terapi Sholat terhadap Reduksi Kecemasan pada Anak Yatim Piatu: Studi Kasus di Panti Asuhan Baiti Jannati
Anxiety disorder is a common psychological issue faced by orphans, particularly those residing in orphanages. The absence of parental figures, lack of emotional support, and social pressures often trigger chronic anxiety that affects children’s mental well-being. This study aims to analyze the effectiveness of prayer therapy in reducing anxiety levels among orphans at Baiti Jannati Orphanage in Purwokerto. Employing a qualitative case study approach, data were collected through in-depth interviews, participatory observation, and documentation involving two children undergoing regular prayer therapy. The findings indicate that performing prayer (sholat) with focus and devotion significantly contributes to inner calmness, reduction of anxiety symptoms, and enhancement of spiritual resilience. The ritualistic and contemplative aspects of prayer serve as essential tools in fostering psychological stability among the children. This study recommends integrating spiritual practices into social and mental health intervention programs for orphans
Muslim Society\u27s Desensitization to the Quality of Infotainment Programs on Television
This study examines the desensitization of Muslim society towards the quality of infotainment on television. Although the results of the KPI survey stated that infotainment broadcasts on television were considered to be of poor quality, the reality is that they persist and are in demand. Based on the theory of value and expectation, audiences tend to consume media content when their expectations are met repeatedly. This field research uses a mixed method with a quantitative approach to test the level of desensitization. The respondents also serve as informants as data in qualitative research to determine perceptions, influencing factors, and consumption patterns of infotainment. The sample was a purposive sampling of 47 Muslims in Pekalongan with instruments adopted from the KPI survey. Data analysis used regression analysis and value and expectation theory. Desensitization in this study can be interpreted in two forms: (1) hypothesis, the audience is aware of the low quality of infotainment but still watches it, or (2) findings, the audience considers infotainment to be of good quality but rarely watches it. Compared to the national and quantitative KPI survey, this study focuses on the Muslim society in Pekalongan using a mixed-method approach. The results show that the majority of Muslims in Pekalongan still watch infotainment solely for entertainment, not because of its quality
Communication Patterns of Sundanese Ulama to Maintaining Religious Tolerance in West Java: Article in Production (PDF available soon)
West Java is a province that is synonymous with a polite, courteous, and friendly society. Still, ironically, West Java is claimed to be a province that is considered intolerant in matters of communication between religious communities. Even though in West Java there are many religious organizations, there are ulama in various regions, but the label as an intolerant province is challenging to get rid of. This research uses qualitative research with phenomenological theory to determine the da\u27wah communication by Sundanese ulama in maintaining religious tolerance in West Java. The research results show that the ulama is little involved because the ulama is busy coaching the congregation, solving fiqh problems, and improving the practice of ritual worship. Even if there are ulama who are busy with tolerance activities, this is initiated by the government, which holds various ceremonial activities; the ulama themselves do not have the initiative to keep them. The formal activities most often carried out by the government and ulama include the socialization of Governor Regulations, Laws, guidance, and dialogue between religious communities. There are two types of mass organizations and ulama in implementing ummah harmony, namely mass organizations and ulama, which are strict and firm without compromise. There are mass organizations and ulama who are moderate and love pluralism
