    Restorative Justice in Settling Criminal Case: A Normative-Empirical Study of the Law

    Restorative justice offers an alternative framework for addressing the needs of both victims and offenders in Indonesia. While it presents a more hopeful solution compared to traditional punitive measures, concerns about fairness remain. Specifically, victims may feel that the response to the offense does not match the seriousness of the crime, leading to a sense of being undercompensated. This article explores how restorative justice is integrated into Indonesia’s criminal justice system through both normative and empirical legal research. Bandar Lampung serves as the primary focus of this study due to its establishment of a Restorative Justice House and its reputation as a leading practitioners of restorative justice in the country. The research involved observing practices at the District Prosecutor’s Office in Bandar Lampung, allowing for an empirical understanding of how legal regulations are enacted in practice. Additionally, the study reviews the normative aspects of the law related to restorative justice, particularly focusing on the Attorney General’s Regulation No. 15 of 2020 and its Circular No. 1 of 2021 concerning the termination of prosecution based on restorative justice. The findings indicate that restorative justice is primarily applied to lesser criminal cases that fit specific criteria. These cases often involve first-time offenders, crimes that carry potential sentences of at most five years, and financial damages up to Rp 2,500,000. Of the 13 cases examined, 10 were effectively resolved using restorative justice methods. This highlights the potential of restorative justice on repairing harm, addressing victims’ needs, ensuring that offenders take responsibility, and fostering social cohesion. What sets this study apart is its combination of doctrinal legal analysis and fieldwork, enabling a comprehensive evaluation of how restorative justice norms are operationalized within prosecutorial practices in Indonesia

    Pandemic on the Ship: Emergency Legality and Human Rights Security of the Floating Isolation Policy in Indonesia

    The COVID-19 pandemic compelled governments worldwide to implement extraordinary measures that tested the boundaries of legality and human rights protection. This study examines makassar’s floating isolation policy an innovative yet controversial public health intervention that repurposed the km umsini  as a quarantine facility during the 2021 surge in infections. The policy drew debate due to its top-down implementation and concerns that s, historically, have been among the fastest environments for infectious disease transmission, including covid-19. Employing a juridical–empirical approach, this research assesses the policy’s conformity with indonesia’s constitutional obligations and international human rights standards, particularly the international covenant on economic, social and cultural rights (icescr) and the international health regulations (IHR 2005). Field data were obtained through semi-structured interviews with health officials, volunteers, supported by documentary and legal analysis. The findings reveal that while the policy effectively reduced hospital overcrowding and community transmission, it operated within a “gray zone of legality” due to the absence of explicit statutory regulation. Using state obligations theory, the human security framework, and emergency law theory, the study demonstrates that legality during crises can be sustained through transparency, proportionality, and participatory governance. It concludes that compassionate legality rooted in respect for human dignity and procedural fairness can transform emergency discretion into a framework of human-centered resilience.     HIndonesia with all its forms of diversity makes it a very multicultural country with many differences in it, thus religious moderation is one of the crucial issues and understandings that are still being socialized in Indonesia. Religious moderation is one of the ways and solutions in the midst of the increasing intolerant behavior, radicalism, liberalism and other religious issues. Religious moderation is one of the issues and understandings that continues to be socialized by the Ministry of Religion of the Republic of Indonesia from 2018 to the present. The young generation of the nation\u27s successors is a generation of change that can bring Indonesia to a more moderate generation. Thus, instilling the values of religious moderation needs to be done from childhood, one of which is through Elementary Schools (SD) or Madrasah Ibtidaiyah (MI) in particular to its students. The research method in this study is to use a Qualitative research method with data collection techniques through interviews, observations and literature studies. The results of the study show that the instillation of the values of moderation is conveyed through the subjects of the Qur\u27an and Hadith, Akhidah Akhlak, PPKN, SKI and Ke-NU-an, then through habituation and interaction in the madrasah environment.Indonesia dengan segala bentuk keberagamanya menjadikanya negeri yangsangat mulitkultural dengan banyak perbedaan di dalamnya, dengan demikianmoderasi beragama menjadi salah satu isu yang krusial dan paham yang masihterus disosialisasikan di Indonesia. Moderasi beragama menjadi salah satu jalandan solusi di tengah-tengah semakin maraknya perilaku-perilaku intoleransi ,radikalisme, liberalisme dan isu-isu keberagamaan dan lainya. Moderasi beragamamenjadi salah satu isu dan paham yang terus disosialisasikan oleh KementerianAgama Republik Indonesia sejar 2018 hingga saat ini. Generai muda penerus bangsamerupakan generasi perubahan yang dapat membawa Indonesia kepada generasiyang lebih moderat. Dengan demikian penanaman nilai-nilai moderasi beragamaperlu dilakukan sejak usia anak-anak, salah satunya adalah melalui Sekolah Dasar(SD) atau Madrasah Ibtidaiyah ( MI ) pada khususnya kepada siswanya. Metodepenelitian pada penelitian ini adalah menggunakan metode penelitian Kualitatifdengan dengan teknik pengumpulan data melalui wawancara, observasi dan studiliteratur.     The development of contemporary architecture presents challenges to environmental sustainability and human psychological needs for connection with nature. The concept of biophilic design emerged as a response to these conditions, by integrating natural elements into the built environment to improve the well-being and comfort of users. This study aims to review and reformulate the concept of biophilic design in contemporary architecture through theoretical studies, emphasizing the importance of integrating the basic principles of biophilia that are in-depth, cross-disciplinary, and relevant to the modern urban context. The method used is a literature study through analysis of literature from various relevant sources, including journals, books, and architectural case studies. The results of the study show that the application of biophilic design principles, such as the use of natural light, vegetation, cross-ventilation, and natural forms, can improve the quality of space and have a positive impact on the psychology and productivity of occupants. By integrating biophilia principles ​​into modern building design, biophilic design not only contributes to aesthetics, but also to the sustainability and health of the built environment

    Negotiating Islamic Legal Culture: Muslim Majority Participation under Non-Muslim Leadership in Multicultural Villages

    This study analyzes non-Muslim leadership in a Muslim-majority community through Islamic legal culture, highlighting how religious norms, legal consciousness, and local wisdom inform tolerance and coexistence. Using qualitative participatory action research, data were collected via participant observation, with in-depth interviews, and documentation, and also triangulation ensuring validity. The Jrahi community, grounded in Islamic values of ukhuwah (brotherhood), ʿadl (justice), and taʿāwun (mutual help), responded positively to a non-Muslim village head whose character and service aligned with principles of justice and public welfare in Islamic ethics. His election reflected a negotiation between Islamic normative ideals and pragmatic governance, prioritizing integrity, maturity, and leadership capacity over religious affiliation. Although peace promotion was absent from his formal vision and mission, it was realized through cooperation and preservation of local traditions consistent with the Islamic legal value of maslahah. The community’s choice sought to maintain unity, prevent conflict, and guard against both syncretism undermining ʿaqīdah and radical extremism disrupting social order. This case demonstrates how Islamic legal culture adapts within multicultural realities, offering insights into the acceptance of minority leadership in Muslim-majority settings without compromising core Islamic legal and ethical principles

    The Makkatte’ Tradition in The Bugis Muslim Community: A Gender and Cultural Analysis

    Female circumcision in the Bugis Muslim community is one of the processions in affirming one\u27s Islamic faith. What makes female circumcision problematic is the gender, health and cultural issues involved. Religious interpretations of the legal status of female circumcision, traditions and the impact or health risks of the practice have many aspects to analyze in more depth. Therefore, this paper aims to show how the tradition of the practice of makkatte’ (female circumcision) has developed in the Bugis Muslim community in South Sulawesi and is examined using gender analysis. This paper shows that there are differences in the practice of makkatte’ tradition in the Bugis Muslim community. In addition, this paper also shows that the makkatte’ tradition is influenced by religious factors under the pretext of being a form of consecration of religious perfection and on the other hand, tradition factors as a form of cultural conservation. From a gender perspective, the practice of makkatte’ in Bugis society is found to have improved gender conditions. Despite experiencing an increase in gender conditions which in practice is not dangerous, the practice of makkatte’ can be risky for girls\u27 psychology because it continues to infringe on women\u27s privacy

    This study examines the Surau education pattern in Minangkabau, Indonesia, as a response to the growing disconnect between youth and their cultural heritage amidst modernization. This research aims to re-document the Surau education pattern, analyze its historical and cultural aspects, and propose a revitalization model that adapts it to contemporary challenges. The study seeks to expand the paradigm of Islamic education by incorporating local cultural heritage and practices, recognizing the significance of regional traditions in shaping educational experiences within Islamic contexts. Employing a descriptive qualitative approach with an ethnopedagogical framework, this research utilizes in-depth interviews with traditional leaders, religious figures, youths, and community representatives, and participatory observation and documentation study. Data analysis was executed using thematic analysis techniques, focusing on educational patterns, values imparted, and their implications for youth\u27s social preparedness. The findings reveal that Surau education implements a contextual and practical learning model, enabling students to gain theoretical knowledge of religion and practice these values through various social and cultural activities. The Surau is an effective educational arena for instilling honesty, responsibility, deliberation, and preserving Minangkabau cultural identity. Moreover, Surau education fosters resilient mental character and social skills that support students\u27 adaptation within broader society. Surau education significantly contributes to the holistic life readiness of Minangkabau youth, establishing Surau as a traditional education model relevant to future development. This model significantly shapes a morally grounded, religious, and socially prepared younger generation. It positively impacts Islamic value-based community education and revitalizes Surau as a relevant spiritual and social learning space in contemporary society

    Beyond The Reflection: A Psychoanalytic Study of Freud’s Levels of Mind in Sylvia Plath’s Mirror

    This paper provided a psychoanalytic analysis of Sylvia Plath’s “Mirror”, grounded in Sigmund Freud’s theory of the three levels of the mind: conscious, preconscious, and unconscious. While other analyses covered the poem’s feminist and symbolic aspects, this research aimed to explore its psychological depth, particularly from the mirror’s perspective and its reflection of the woman’s inner conflict regarding identity and aging. With a qualitative analysis, the research explored how conscious awareness, preconscious thought, and unconscious dread shaped self-perception in both the mirror and its subject. The findings revealed key themes such as truth and objectivity, self-awareness, self-exploration, self-deception, inevitable passage of time, and hidden fears. By applying Freud’s structural model, this study advanced literary interpretation and emphasized mental health, gender empathy, and self-image. It aligns with Sustainable Development Goals 3 (Good Health and Well-being) and 5 (Gender Equality). In its psychoanalytic interpretation of Mirror, the study helped deepen the understanding of literature as a reflection of the human mind, with a focus on the importance of psychological health and the complexities of female identity

    Contemporary education seeks to cultivate in students a repertoire of essential competencies, including problem-solving, collaboration, critical thinking, creativity, and effective communication. In this context, it is imperative that educators adopt pedagogical strategies that actively engage learners in the construction of knowledge. Problem-Based Learning (PBL) has emerged as a pedagogical approach capable of fostering active learner participation while simultaneously enhancing problem-solving and critical thinking abilities. This study examines the effectiveness and contextual suitability of PBL in mathematics instruction as a means of promoting active student engagement. The research was conducted at a State Islamic Elementary School (Madrasah Ibtidaiyah Negeri) in Bantul District, Yogyakarta, involving a cohort of 30 fifth-grade students and their classroom teacher. Employing a qualitative methodology within a case study framework, the investigation drew upon multiple sources of evidence, including interviews, classroom observations, documentary analysis, and visual records. Data were processed using an interactive analytical model encompassing data condensation, data display, and conclusion drawing. Findings indicate that the integration of PBL into mathematics teaching substantively enhances students’ active participation in the learning process. Moreover, PBL constitutes an effective pedagogical vehicle for advancing the objectives of Indonesia’s independent curriculum within the context of elementary madrasahsPendidikan kontemporer berupaya menumbuhkan pada diri peserta didik seperangkat kompetensi esensial, meliputi kemampuan pemecahan masalah, kolaborasi, berpikir kritis, kreativitas, dan komunikasi yang efektif. Dalam konteks ini, sangat penting bagi pendidik untuk mengadopsi strategi pedagogis yang secara aktif melibatkan peserta didik dalam proses konstruksi pengetahuan. Problem-Based Learning (PBL) telah muncul sebagai salah satu pendekatan pedagogis yang mampu mendorong partisipasi aktif peserta didik sekaligus meningkatkan keterampilan pemecahan masalah dan berpikir kritis. Penelitian ini mengkaji efektivitas dan kesesuaian kontekstual penerapan PBL dalam pembelajaran matematika sebagai sarana untuk mendorong keterlibatan aktif peserta didik. Penelitian dilaksanakan di salah satu Madrasah Ibtidaiyah Negeri di Kabupaten Bantul, Yogyakarta, dengan melibatkan 30 siswa kelas V dan guru kelasnya. Menggunakan metode kualitatif dengan desain studi kasus, penelitian ini memanfaatkan berbagai sumber data, termasuk wawancara, observasi kelas, analisis dokumen, dan rekaman visual. Data dianalisis menggunakan model analisis interaktif yang mencakup kondensasi data, penyajian data, dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa integrasi PBL dalam pembelajaran matematika secara signifikan meningkatkan partisipasi aktif siswa dalam proses belajar. Selain itu, PBL terbukti menjadi sarana pedagogis yang efektif untuk mendorong tercapainya tujuan Kurikulum Merdeka di lingkungan madrasah ibtidaiyah

    The telecommunications sector is a pivotal driver of Indonesia’s digital economic growth, particularly amid the rapid adoption of information and communication technologies. CV Digital Satelit Indonesia—a service enterprise specializing in telecommunications equipment repair—has expanded its operations by integrating Islamic economic principles. This study examines how service ethics, innovative pricing, and digital marketing influence business growth within a Sharia-compliant framework. Using a quantitative design, data from 50 purposively selected respondents were analyzed through validity and reliability tests, classical assumption checks, and t- and F-tests. Findings reveal that service ethics and price innovation have a statistically significant, positive impact on business development, while digital marketing shows no significant effect. Service ethics emerged as the strongest predictor (p = 0.001), indicating that delivery grounded in honesty, accountability, and integrity fosters greater trust and loyalty. The limited impact of digital marketing likely stems from promotional content lacking the emotional and spiritual depth needed to convey Islamic values effectively. Collectively, however, all independent variables significantly affect growth, highlighting the strategic value of embedding Sharia principles in service and pricing, alongside refining Islamic-oriented digital marketing to strengthen its persuasive capacitySektor telekomunikasi merupakan pilar utama dalam mendorong pertumbuhan ekonomi digital Indonesia, khususnya di tengah percepatan adopsi teknologi informasi dan komunikasi. CV Digital Satelit Indonesia—sebuah perusahaan jasa yang bergerak di bidang perbaikan perangkat telekomunikasi—berupaya memperluas cakupan operasionalnya melalui penerapan prinsip-prinsip ekonomi Islam. Penelitian ini bertujuan untuk menganalisis sejauh mana etika pelayanan, inovasi harga, dan strategi pemasaran digital berkontribusi terhadap pertumbuhan bisnis dalam kerangka kepatuhan syariah. Penelitian menggunakan pendekatan kuantitatif dengan teknik purposive sampling terhadap 50 responden. Analisis data meliputi uji validitas dan reliabilitas, pengujian asumsi klasik, serta uji t dan uji F. Hasil penelitian menunjukkan bahwa etika pelayanan dan inovasi harga berpengaruh positif dan signifikan terhadap pengembangan bisnis, sedangkan pemasaran digital tidak memberikan pengaruh yang bermakna. Dari dua variabel yang signifikan, etika pelayanan menjadi faktor paling dominan dengan nilai signifikansi terendah (p = 0,001). Temuan ini menegaskan bahwa pelayanan yang berlandaskan kejujuran, akuntabilitas, dan integritas mampu membangun kepercayaan pelanggan secara lebih efektif. Sebaliknya, terbatasnya pengaruh pemasaran digital diduga disebabkan oleh konten promosi yang belum optimal dalam menyampaikan nilai-nilai Islam secara emosional dan spiritual. Kendati demikian, ketika dievaluasi secara simultan, seluruh variabel menunjukkan pengaruh signifikan terhadap pertumbuhan bisnis.
