The Transformation of Islamic Economics in The Digital Era: An Analysis of Islamic Fintech and Financial Inclusion in Indonesia
The rapid expansion of Indonesia’s digital economy has transformed Islamic financial services through the emergence of sharia-compliant financial technologies, including Islamic peer-to-peer lending, equity crowdfunding, e-wallets, and digital zakat platforms. This study aims to examine the role of Islamic fintech in enhancing financial inclusion in Indonesia and to evaluate its implications for Islamic economic development within the framework of maqasid al-shariah. Employing a qualitative descriptive method based on recent academic literature, regulatory documents, and statistical reports (2020-2024), the findings indicate that Islamic fintech significantly contributes to expanding financial access, particularly among micro, small, and medium enterprises (MSMEs), women-led businesses, and rural communities previously underserved by conventional banking. However, the sector still faces major challenges, including fragmented regulations, low Islamic financial literacy, cybersecurity concerns, and limited institutional capacity in digital risk management. The novelty of this study lies in its integrated analysis of Islamic fintech from both a financial inclusion and Islamic legal-ethical perspective, emphasizing how value-based finance can complement digital innovation in Indonesia’s financial ecosystem. The study concludes that strengthening digital literacy, sharia compliance, data protection systems, and ecosystem collaboration between regulators, Islamic financial institutions, and technology providers is crucial for realizing inclusive Islamic digital finance in accordance with the objectives of maqasid al-shariah
Symbolic Restorative Justice in the Courtroom: Navigating the Intersection of Justice and Child Welfare in Indonesian Juvenile Court Decisions
Indonesian state law, particularly the Juvenile Criminal Justice System Law No. 11 of 2012, designates diversion as the primary mechanism for addressing children in conflict with the law. However, in practice, the majority of juvenile court judges continue to impose sanctions oriented toward imprisonment. This article examines the discrepancy between the statutory framework and its practical application by investigating the symbolic implementation of restorative justice in juvenile cases adjudicated by the Balikpapan District Court. It underscores the persistent tension between diversion-focused legal mandates and courtroom practices that remain entrenched in a retributive paradigm. Employing socio-legal research methods and John Braithwaite’s shaming theory, the study analyzes sixteen juvenile court decisions rendered in 2024. The findings reveal that cases involving child protection and narcotics offenses were almost invariably met with imprisonment, accompanied by symbolic interventions such as vocational training. In contrast, theft and negligence cases permitted more hybrid approaches that combined punitive and rehabilitative elements; nevertheless, these approaches failed to achieve substantive restoration. The analysis concludes that restorative justice within Balikpapan’s juvenile court system remains largely rhetorical, functioning as a normative signifier rather than an effective mechanism for healing. The article argues that meaningful reform requires strengthening diversion pathways, enhancing the role of independent facilitators, and integrating legal, cultural, and community-based values into a more inclusive and humanistic juvenile justice framework
Peran Credit Union Stella Maris dalam Penguatan Ekosistem Masyarakat Sipil di Pontianak Kalimantan Barat
The Credit Union (CU) movement in Pontianak City, West Kalimantan, has long been recognized for its significant role in enhancing the economic well-being of its members. However, its contribution to strengthening civil society dimensions is often overlooked. This study aims to analyze and identify in depth how credit unions play a crucial role in building and reinforcing the foundations of civil society in Pontianak, beyond their primary function as microfinance institutions. Using qualitative data collected in 2019 from the Stella Maris Credit Union in Pontianak, this research reveals that CU functions not only as a provider of inclusive financial access but also as an essential space for economic self-reliance, democratic participation, and social solidarity, all of which are vital elements for strengthening the civil society ecosystem. The findings demonstrate that through cooperative principles and sustainable educational programs, both financial and non-financial, CU has successfully fostered collective awareness, enhanced financial literacy, and promoted a spirit of mutual cooperation among its members. Furthermore, its participatory decision-making mechanism reflects grassroots democratic practices essential to the empowerment of civil society. Thus, the Credit Union has transformed into an agent of social change, empowering communities to act independently and collectively in addressing socio-economic challenges. The implications of this study suggest that Credit Unions should be viewed as an important pillar of civil society in Pontianak and as a potential model for other community-based institutions in Indonesia in building a more independent, empowered, and democratic society.

Legal Framework for Protecting Children from Commercial Sexual Exploitation
This study offers a critical analysis of the legal framework and policy measures aimed at protecting children from Commercial Sexual Exploitation of Children (CSEC) in South Sulawesi, Indonesia. Despite the ratification of international agreement and the enactment of domestic laws, such as Law No. 35 of 2014, the enforcement of these laws is inconsistent. This inconsistency is attributed to legal ambiguities, limited institutional capacities, and cultural attitudes that normalize exploitation. Employing a socio-legal approach, this research integrates legal analyses with field interviews to investigate the causes, manifestations, and legal management of CSEC. The findings reveal systemic shortcomings, such as the absence of specific criminalization for child prostitution and trafficking in the Criminal Code, ineffective implementation of regional regulations, and poor collaboration among law enforcement agencies, NGOs, and government entities. CSEC continues to be a pervasive issue, with victims often misidentified as offenders. The study advocates for legal harmonization with international standards, enhanced institutional collaboration, heightened public awareness, and community-based monitoring initiatives. It stresses the urgent need for child-rights-centric legal reforms to tackle the socio-cultural factors driving exploitation and to strengthen the protective role of both the state and society

The UTAUT Model on Decision to Use Amaan Islamic Fintech Financing: Prior Experience as Moderating
Entering the digital era, industry players are increasingly aggressively developing digital technology. One of the technological developments that has become the subject of recent studies in Indonesia is financial technology (fintech). There are women micro- entrepreneurs who need support in development, especially capital support to improve their businesses. PT Amaan Indonesia Sejahtera (Amaan) is an integrated solution that can be accessed by women micro-entrepreneurs in the form of financial or business capital financing. Because Amaan is one of the digital-based microfinance services with an easier mechanism and has a clear commitment to empowering women in the business sector. The study aims to test the UTAUT model with moderated prior experience. This research uses a quantitative approach. The data used is a questionnaire distributed to 250 respondents via google form. The data analysis method uses descriptive statistical analysis, multiple regression analysis and moderated regression analysis (MRA) using the SmartPLS (v3.0) analysis tool. The results show that performance expectancy, effort expectancy, social influence and facilitating conditions have a significant effect on the decision to use Amaan Islamic fintech financing. Prior experience as a moderating variable weakens the effect of performance expectancy and effort expectancy. Meanwhile, prior experience strengthens the influence of social influence and facilitating conditions on the decision to use Amaan Islamic fintech financing. RSquare shows that the user decision variable has a value of 0.539. This means that the ability of variable X to explain Y is 53.9% (medium), so it is said that the ability of the user decision variable to be influenced by the variables of performance expectancy, effort expectancy, social influence, facilitating conditions and prior experience is quite strong. While the remaining 46.1% is influenced by other variables outside the study
Constitutional Analysis of Religious Moderation Policy in Serbia: Between Legal Precepts and Social Norms
This study examines the alignment between Serbia’s religious moderation policies and its constitutional guarantees of religious freedom, secularism, and non-discrimination. While Serbia’s 2006 Constitution enshrines these principles, the practical application of religious policies reveals discrepancies shaped by social norms and dominant religious narratives. The preferential treatment of "traditional" religious communities, especially the Serbian Orthodox Church, reflects a persistent intertwining of national identity with Orthodox Christianity. Through legal analysis and case studies, the study illustrates how cultural and institutional biases can undermine formal constitutional protections. It also explores the role of public perception, media discourse, and policy implementation in reinforcing religious hierarchies. Ultimately, the study argues that Serbia’s religious moderation remains only partially consistent with constitutional ideals, as prevailing sociocultural dynamics continue to influence both interpretation and enforcement. A more inclusive approach requires bridging legal norms with democratic values of pluralism and equal treatment for all religious communities
