    No full text
This article aims to uncover the background and dynamics of transportation infrastructure development in the Regentschap Pemalang during the Dutch colonial period. Transportation infrastructure is a vital element supporting community mobility. However, it has often been overlooked in Indonesian historiography, particularly in the context of hinterland regions such as the Regentschap Pemalang. This research employed historical research methods. The findings indicate that transportation infrastructure played a significant role in the social and economic dynamics of the Regentschap Pemalang. Transportation connected Pemalang with other regions, integrating it into the broader transportation network of Java Island. This strategic role underpinned the development and maintenance of transportation infrastructure, particularly land transportation. Roads and railway lines were types of infrastructure that frequently received attention from the colonial government. Nevertheless, such efforts did not always proceed smoothly due to financial constraints and economic disruptions caused by unstable economic conditions

This article explores how applied Sufism practices through the routines of Yasinan and Diba’an shape inner peace among students residing at Pondok Pesantren Fatkhul Mu’in Purwokerto. Amidst the academic, social, and spiritual pressures faced by these students, such religious activities serve as contemplative spaces that positively impact their emotional stability. This study employs a qualitative approach using a case study method. Data were collected through in-depth interviews, participatory observation, and documentation. The findings indicate that students who consistently participate in Yasinan and Diba’an experience reduced anxiety levels, improved concentration in learning, and a greater sense of calm in dealing with life’s challenges. The spiritual processes within these rituals foster a state of transcendental awareness that nurtures inner tranquility. These findings affirm that pesantren religious traditions are not merely cultural expressions, but also hold potential as relevant psychospiritual therapy in supporting students’ mental health

Between Text and Law: Hasan Al-Turabi\u27s Interpretation of Dilalah Lafz Al-Ahkam in Marital Prohibition Verses

    No full text
This study offers a critical analysis of the Dilalah Lafz ala al-Ahkam method (verbal indication of legal rulings) as conceptualized by Hasan al-Turabi, with particular emphasis on his interpretive approach to Qur’anic injunctions concerning prohibited forms of marriage. Employing a qualitative, library-based research methodology, this paper adopts a descriptive-analytical framework and draws primarily from al-Tafsir al-Tawhidi as the central textual source. The theoretical underpinning is grounded in the framework of mantuq and mafhum—a methodological apparatus developed by Khalid Ibn Uthman al-Sabt for legal hermeneutics within the Dilalah Lafz tradition. The analysis proceeds by identifying and cataloguing relevant Qur’anic verses addressing prohibited marriages, explicating al-Turabi’s hermeneutical approach, and subsequently assessing it through the lens of mantuq and mafhum theory. The findings suggest that al-Turabi’s interpretative method is consistent with the analytical strategies of the Mutakallimin school, especially in his reliance on explicit (mantuq) and implicit (mafhum) textual meanings to derive legal rulings

Non-Judicial Activities of the Indonesian Constitutional Court: Do They Foster Judicial Reputation?

    No full text
The Indonesian Constitutional Court is defined as a judicial body with specific competencies as stated in the 1945 Constitution. Given its significance and the heightened attention it receives from the public, the rulings of independent courts and impartial judges are vital for maintaining the reputation of the Indonesian judiciary and the public\u27s confidence in its work. In addition to adjudicating cases, the Constitutional Court and its judges are involved in various non-judicial activities. This research article explores the reasons behind the Constitutional Court’s engagement in these activities, outlines the various types of non-judicial actions, and evaluates their effect on the court\u27s reputation. The aim of this research is to establish a conceptual framework and assess the influence of non-judicial activities on judicial reputation by utilizing conceptual, statutory, and comparative frameworks, supported by empirical data from official documents.Top of Form The results show that the court participates in non-judicial activities to obtain benefits like increased popularity, public interest, visibility, preventing its decisions from being overturned by other judicial entities, and enhancing its reputation and influence. Often, these activities involve promoting the court\u27s work to both local and international judicial communities to foster dialogue and connections with similar courts and stakeholders. Furthermore, non-judicial activities can influence public interest and engagement. While these initiatives benefit the institution, judges, and the public, they do not inherently improve the Constitutional Court\u27s reputation, as its standing fundamentally relies on the quality of its decisions and its credible independence, impartiality, and integrity

The Dilemma of Administrative Sanctions in Legalizing Palm Oil Plantations in Indonesian Forest Areas

    No full text
Indonesia’s shift from criminal to administrative sanctions in addressing illegal use of forest areas—stipulated under Articles 110A and 110B of Law No. 6 of 2023—aims to legalize approximately 3.3 million hectares of unlicensed oil palm plantations. This study evaluates the effectiveness of administrative sanctions in promoting legal compliance and environmental accountability. Employing a normative legal research method with a descriptive qualitative approach, the study examines statutory frameworks, case studies, and empirical data from the Ministry of Environment and Forestry (MoEF). Findings reveal that while administrative sanctions offer expedited enforcement and reduce judicial burdens, they risk becoming legal loopholes exploited by corporations. The limited number of sanctioned companies—only 49—and the total fines of IDR 175.5 billion are disproportionately low relative to the scale of ecological damage. Nevertheless, the research highlights the potential of a hybrid enforcement model—integrating administrative, criminal, and civil legal instruments—to enhance compliance and ecological justice. It underscores the urgency of robust oversight and the application of criminal sanctions in severe cases to uphold the constitutional right to a healthy environment

    No full text
This study offers a fresh perspective on the perceptions of junior high school students toward mathematics learning in Timor-Leste, focusing specifically on seventh-grade students at Ensino Básico 3º Ciclo Santo António de Oe-Cusse. The research directly explores students’ learning experiences from their own viewpoint, which has rarely been documented in the educational context of the Oe-Cusse region. A descriptive qualitative approach was employed to understand the factors shaping students’ interest in mathematics. Eight students were purposively selected and asked to respond to the open-ended question: “What do you like about math lessons?” The findings reveal four main factors contributing to students’ enjoyment of mathematics: (1) clear teacher explanations that make the material easier to understand, (2) enjoyment of calculation activities such as addition, subtraction, and geometry, (3) the presence of games or puzzles that challenge concentration and creativity, and (4) awareness of mathematics’ relevance to daily life. These results indicate that students’ motivation to learn mathematics in this region is influenced by a unique combination of pedagogical, cognitive, and contextual factors, highlighting the importance of instructional approaches that integrate clear explanations, varied calculation activities, playful or puzzle-based elements, and real-world applications. This study provides valuable insights for developing mathematics teaching strategies that are tailored to the characteristics of students in Timor-Leste, particularly in border areas like Oe-Cusse, and opens avenues for further research on innovative teaching methods grounded in students’ perceptions and experiences

Moderasi Beragama di Era Digital: Panduan Praktis Mencegah Radikalisasi Online

    No full text
Digital-based radicalization is a serious challenge to religious and national life in the contemporary era. Social media, instant communication platforms, and other digital spaces have been exploited by radical groups to spread intolerant and violent ideologies on a massive scale. This article aims to analyze the role of religious moderation as a strategy to prevent online radicalization in Indonesia. The research method used is a qualitative literature study, utilizing data from scientific journals, official government reports, and the results of national and international surveys related to digital literacy and radicalization. The study results indicate that diverse moderation is relevant as an alternative paradigm for maintaining balance, tolerance, and inclusivity in the digital space. Its implementation can be done through strengthening digital literacy, providing creative counter-narratives, multi-stakeholder collaboration, and utilizing artificial intelligence technology to integrate extreme content. However, emerging challenges include low public digital literacy, the dominance of social media algorithms that tend to reinforce polarization, limited synergy between institutions, and the dilemma between security and digital rights protection. The conclusion of this article emphasizes that preventing online radicalization through religious moderation is not solely the responsibility of the state, but rather the collective obligation of all elements of society, including families, educational institutions, religious communities, and the media. With the right strategy and ongoing collaboration, Indonesia has a significant opportunity to become a global model in building a peaceful, tolerant, and inclusive digital ecosystem.

Living Islamic Law in Indigenous Communities in Indonesia: Integration of Fiqh in the Tradition of Mu’amalah of the Muslim Community of Banjar

    No full text
The interaction between Islamic law and local wisdom among the Muslim community of Banjar in South Kalimantan reflects the significant dynamics of living Islamic law within the framework of legal pluralism in Indonesia. The mu‘amalah practices developed in this community are not limited to the application of normative fiqh alone, but are brought to life through cultural expressions and oral traditions, such as barelaan, tukar jual, jual lah seadanya, and bawa ja dulu, which serve a dual role as ṣīghat al-‘aqd and as social devices for upholding the principles of voluntariness, openness, honesty, and justice. This study aims to trace the forms, meanings, and mechanisms of integrating the principles of fiqh mu‘āmalah into the customary order, as well as to assess its contribution to the discourse on living law and maqāṣid al-sharī‘ah. A qualitative approach within a phenomenological framework is used. Research data were collected through participatory observation in traditional markets, interviews with local scholars, customary leaders, and traders. The results reveal that local scholars play a strategic role as mediators who interpret and adapt customary practices to align with the principles of Sharia. This process gives rise to a living legal system that is deeply rooted in social legitimacy and endowed with moral authority recognized by the community. From a theoretical perspective, this study broadens the understanding of legal pluralism through a model of reciprocal interaction between Islamic customary law, fiqh mu‘āmalah, and positive law, while enriching the discourse on maqāṣid al-sharī‘ah, particularly in the dimension of ḥifẓ al-māl, which is preventing loss and fostering blessings through social practices based on community trust and ethics
