On the Issue of Corporal Punishment in the Development of Family Education and School Education
The aim of the text is to provide an overview of the development of the issue of corporal (physical) punishment in Czech lands as a logical source of the current state of general opinion on physical punishment of children. Under the influence of a new paradigm in the concept of the child, the social view of many pedagogical categories, including punishment, is gradually changing, even though it is a very lengthy transformation. In the text, the authors draw on new findings from neuroscience that demonstrate the negative impact of punishment on healthy child development and confirm the intuitive results of respectful and non-violent pedagogical approaches in schools and a family environment. According to Czech law it is not legal to use corporal punishment in schools. However, the inadmissibility of corporal punishment in the family environment is nowhere declaratively anchored, although the Czech Republic was already warned about this shortcoming by the European Committee of Social Rights in 2013. The final part of the text is devoted to the current state of the issue, as perceived not only by the general public but also by the Czech judiciary and the current political elites. The authors thus look at the current social debate on the topic of corporal punishment and the process of implementation of the new law dealing with corporal punishments into the current Czech legislation
