JURIDICAL ANALYSIS OF THE RIGHTS OF FEMALE WORKERS IN EMPLOYMENT AGREEMENTS IN PRIVATE COMPANIES BASED ON LAW NUMBER 13 YEAR 2003 ON LABOUR
Inequality between the rights of women and men workers is still very real, with frequent violations of the maternity rights of women workers. Some companies still violate these rights, such as prohibiting pregnancy, providing health services that favour men and employers, and issues related to women\u27s reproductive organs. Although rights such as menstrual leave, maternity leave, and breastfeeding leave are stipulated in Law No. 13/2003, women workers often experience difficulties in applying for leave in accordance with their rights in the workplace. Companies use the excuse that the employment contract agreement that has been agreed upon by both parties does not bind the company to grant leave in accordance with the rights of female workers. This research aims to analyse the rights of female workers in collective bargaining agreements by referring to the rules in Law Number 13 Year 2003 on Manpower. In addition, this research also examines the legal implications in the event of default from one or both parties. The approach method used is the Normative Approach, examining the law as a norm that applies in society by using library materials or relevant secondary data. This research is expected to clarify the obligations and rights of female workers as well as the legal consequences in the event of a violation or default in the employment agreement. The results show that breach of the employment contract is a civil law problem that can be resolved administratively with the payment of compensation, but this has the potential to sacrifice the continuity of employment of employees in the company
LEGAL REVIEW OF THE VALIDITY OF ONLINE-BASED VOLUNTARY NON-EXECUTION AUCTIONS WITHOUT THE INVOLVEMENT OF AUCTION OFFICIALS
Along with technological advances, the implementation of auctions in Indonesia has shifted from conventional methods to online-based auctions. Online-based voluntary non-execution auction is a process of selling goods or assets through a digital platform without the involvement of third parties such as the court, which is carried out voluntarily by the asset owner. Minister of Finance Regulation (PMK) Number 213/PMK.06/2020 provides complete guidance on the implementation of this auction. Online auctions offer various advantages such as access without geographical restrictions, transparency, accountability, and process efficiency. However, the absence of auction officials in the implementation of online-based voluntary non-execution auctions raises questions about its legal validity. This research uses normative juridical method with statutory, comparative, and conceptual approaches. Data were analyzed descriptively and qualitatively. The results show that although online auctions facilitate wider access and participation, their validity must meet strict legal requirements. The absence of an auction official may pose legal risks regarding the validity of the transaction. Therefore, auction platforms should implement alternative mechanisms such as escrow to ensure the security and fairness of transactions. The conclusion of this study emphasizes the importance of strict regulations and efficient dispute resolution mechanisms to protect the rights of all parties involved in online-based voluntary non-execution auctions. This research provides recommendations for the adjustment of existing regulations to accommodate technological developments in the field of auctions, so as to ensure security and legal validity for all parties involved.Seiring dengan kemajuan teknologi, pelaksanaan lelang di Indonesia telah bergeser dari cara konvensional menjadi lelang berbasis online. Lelang noneksekusi sukarela berbasis online merupakan proses penjualan barang atau aset melalui platform digital tanpa keterlibatan pihak ketiga seperti pengadilan, yang dilakukan secara sukarela oleh pemilik aset. Peraturan Menteri Keuangan (PMK) Nomor 213/PMK.06/2020 memberikan panduan lengkap mengenai pelaksanaan lelang ini. Lelang online menawarkan berbagai keuntungan seperti akses tanpa batasan geografis, transparansi, akuntabilitas, dan efisiensi proses. Namun, ketidakhadiran pejabat lelang dalam pelaksanaan lelang noneksekusi sukarela berbasis online menimbulkan pertanyaan mengenai keabsahan hukumnya. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, komparatif, dan konseptual. Data dianalisis secara deskriptif dan kualitatif. Hasil penelitian menunjukkan bahwa meskipun lelang online memfasilitasi akses dan partisipasi yang lebih luas, keabsahannya harus memenuhi persyaratan hukum yang ketat. Ketiadaan pejabat lelang dapat menimbulkan risiko hukum terkait keabsahan transaksi. Oleh karena itu, platform lelang harus menerapkan mekanisme alternatif seperti escrow untuk memastikan keamanan dan keadilan transaksi. Kesimpulan dari penelitian ini menekankan pentingnya peraturan yang ketat dan mekanisme penyelesaian sengketa yang efisien untuk melindungi hak-hak semua pihak yang terlibat dalam lelang non-eksekusi sukarela berbasis online. Penelitian ini memberikan rekomendasi untuk penyesuaian regulasi yang ada untuk mengakomodasi perkembangan teknologi di bidang lelang, sehingga dapat menjamin keamanan dan keabsahan hukum bagi semua pihak yang terlibat
LEGAL STUDY IN INVESTMENT SUPERVISION POLICY
This research is motivated by the existence of Law Number 25 of 2007 concerning Investment which states that "provides protection, rights and legal certainty for investors, both foreign investors and domestic investors, in carrying out investment activities to increase national economic growth, creating jobs, encouraging the development of the people\u27s economy, and increasing the competitiveness of the national business world." The role of law is very much needed in creating legal certainty to invite investors to enter Indonesian territory. The One Stop Integrated Services and Investment Service is one of the State Institutions which operates in the field of managing business permits. There are 23 types of business permits served by the Brebes Regency DPMPTSP. This is based on Brebes Regency Regional Regulation No. 003 of 2017 concerning Delegation of Authority to the Investment and One-Stop Integrated Services Service. The aim of this research is to find out the role of DPMPTSP in increasing investment in Brebes Regency and how government policy is in creating legal protection for investors in Brebes Regency. The data collection techniques used by the author in this research are literature study and direct observation to fulfill relevant legal materials. This type of research uses qualitative research. The results of this research show the policy of the Brebes Regency Investment and One-Stop Integrated Services Service in increasing investment in Brebes Regency as well as the government\u27s policy in creating legal protection for investors in Brebes Regency
Studi Deskriptif Kuantitatif Tentang Aktivitas Belajar Mahasiswa Dengan Menggunakan Media Pembelajaran Power Point Di Jurusan Pendidikan Guru Madrasah Ibtidaiyah
Berdasarkan hasil observasi yang dilakukan oleh peneliti pada jurusan Pendidikan Guru Madrasah Ibtidaiyah Universitas Islam Negeri Batusangkar pada semester 6 tahun ajaran 2023 dapat dilihat bahwa aktivitas mahasiswa pada saat proses belajar didalam kelas terlihat masih sangat rendah, dimana dapat dilihat dari mahasiswa pendidikan guru madrasah ibtidaiyah setengah dari yang berada didalam kelas tidak memperhatikan dosen maupun teman mahasiswa lainnya yang sedang melakukan presentasi. Metode penelitian yang digunakan oleh peneliti kali ini adalah dengan menggunakan metode deskriptif pendekatan kuantitatif. Penelitian deskriptif ini adalah sebuah penelitian yang dilakukan dengan sebuah tujuan yaitu untuk mengetahui nilai variable yang jumlahnya minimal satu variable tanpa adanya korelasi dengan variable lain. Dilihat dari aktivitas pembelajaran mahasiswa, ada beberapa hal yang muncul atau terlihat dari lembar observasi yang meliputi beberapa indicator dan hasil presentasenya. Beberapa indicator tersebut diantaranya 1) Indikator memperhatikan atau visual dengan presentase sebanyak 85,3%, 2) Indikator mendengar atau listening dengan presentase sebanyak 82,2%. Jumlah dari ke dua indikator itu dapat diakumulasikan dan hasil presentasenya sebesar 83,75% dan ini tergolong ke dalam kategori hasil yang sangat besar. Berdasarkan dari hasil uji hipotesis yang sudah dilakukan oleh peneliti maka nilai signifikansinya adalah sebesar 1,000 yang berarti hasilnya lebih besar dari 0,5 maka dapat diartikan Ho diterima, oleh sebab itu dapat diambil kesimpulan bahwa data aktivitas belajar mahasiswa dengan menggunakan media pembelajaran power point di jurusan PGMI bersifat acak
Factors Causing Time Delays Completion of Construction Projects (Case Study on Facilities Building Construction Project Sports Stage 5 Construction of The East Stand)
Inaccuracy in planning project activities during project implementation greatly affects implementation delays in the field. The purpose of the study is to determine and analyze: (1) the causal factors that contribute to project completion delays, (2) the causal factors that contribute to the dominant delay in project completion, and (3) delay risk management. In the Sports facilities (Eastern Tribune Development) project. Cirebon Regency. This study is a type of quantitative descriptive study. Data collection was done through FGD, interviews and questionnaires distributed to 10 qualified respondents in the construction sector. The resources of this study are the cause of the delay in the completion of the projects. A House of Risk (HOR) approach was used to analyze the data. Research results show that (1) Cirebon Regency Sports Facilities Building (Eastern Tribune Development) project has 14 risk events and 17 identified risk causes that cause delays. (2) Control factors that cause delays in project completion include: material factors, contract document factors, project owner factors, and contractor and design consultant factors, and (3) delay risk management options, including: (a) good communication and coordination. with the owner; (b) apply a comprehensive planning approach to procurement of materials, (c) coordinate current project drawings between consultants and field workers, (d) contact consultants and supervisors
CURRENT RATIO PREDICTION BASED ON CHANGES INCREASED CASH TURNOVER AND TURNOVER RECEIVABLES FROM MANUFACTURING COMPANIES REGISTERED CEMENT SUB SECTORS ON THE INDONESIAN STOCK EXCHANGE PERIOD 2006-2017
The building materials sector is one of the sectors that is a mainstay of economic growth and is often required to continue to increase its contribution as measured by national GDP. This is a serious challenge, considering that the global economy is currently in crisis, which needs to be feared that it will have an impact on increasing infrastructure production process costs and decreasing banking liquidity levels (which makes it difficult to obtain credit, including capital and guarantees). This type of research uses basic research which aims to find new knowledge about new phenomena about fundamental phenomena. Sample selection used the Porposive Sampling method. The results partially show that Cash Turnover has an effect on the Current Ratio, while Receivables Turnover has no effect on the Current Ratio. Simultaneously, the variables Cash Turnover and Receivables Turnover influence the Current Ratio. In this way, cash will be used more quickly to finance all the company\u27s operational activities so that it does not disrupt the company\u27s financial condition and the higher the company\u27s receivables turnover, the better it will be, because the company is able to control its receivables to avoid bad debts
UTILIZATION OF QRIS E-WALLET IN GENERATION Z: RISK AND SECURITY PERSPECTIVE
Technological advancements have revolutionized payment systems, notably through the adoption of the Quick Response Indonesian Standard (QRIS) in e-wallet platforms. this study investigates the impact of Perceived Usefulness (PU), Perceived Ease of Use (PEOU), Perceived Risk (PR) and Perceived Security (PS) on Generation Z’s intention to use QRIS e-wallets. The Technology Acceptance Model (TAM) serves as the theoretical framework, employing snowball sampling for data collection. the analysis is conducted using SmartPLS 4.0, yielding significant findings: PU and PS positively influence intention to use QRIS e-wallets for transactions, whereas PEOU and PR show no significant impact. these results suggest that ecnhancing user-friendly features and ensuring robust security measures could bolster QRIS e-wallet adoption rates among Generation Z. In its practical implications, financial institutions and platform providers are encouraged to improve security and minimize the risks posed by QRIS e-wallets. The liminations of research is that only focuses on one generation and not in general QRIS e-wallet users. In addition, this research contributes to evaluating the effectiveness and efficiency of a non-cash payment system that can provide benefits, convenience, minimize the risk and security of users, especially generation Z in the context of QRIS e-wallet
PLUGIN UTILIZATION GOOGLE FORMS AUTOPROCTOR FOR ASSESSMENT OF STUDENT LEARNING OUTCOMES
Competence in the use of information technology in the learning process and learningevaluation which is increasingly oriented towards technology can no longer be avoided. Evaluate student learning outcomes with a free multi-platform digital evaluation utilizing existing facilities including Google Form. This application can be used to carry out assessments such as quizzes and collect responses.However, in practice there is a lot of fraud in the assessment or evaluation process. This research was conducted to determine the effectiveness of utilizing the evaluation process for teaching and learningactivities through online evaluation with the Google Form application and exam supervision through proctoring with the help of the Autoproctor Plugin. This research uses a descriptive qualitative approach, with data collection techniques in the form of tests and documentation. The subjects of this research involved students in class VIII K at SMPN 4 Cirebon City. The application of the Autoproctor plugin on Google Form hasproven to be effective in the process of assessing student learning outcomes. GENERAL ELECTION FOR WELFARE
General elections or Pemilu are a form of legitimate means of transitioning a regime or power. The meaning of an election is so important, because of several things that underlie it. Among them are elections which are carried out directly, publicly, freely, secretly, honestly and fairly by the community directly, which is also a form of implementing democracy. Elections as an exercise of democracy. Elections also serve as a means of realizing democracy. Leadership elections occur at the central level, where state leaders are elected, as well as at the regional level, where governors are chosen and deputy governor, as well as at the district level electing the regent and deputy regent or mayor and deputy mayor. These prospective leaders will bring a vision and mission in their election which will later become a central or regional medium-term development program outlined in the form of a medium-term development plan document or text, which will be implemented over a five-year period during the period of exercising the powers of the elected leaders. This medium-term development plan must align with central and regional government programs to support community welfare development, reflecting the essence of a welfare state. Achieving a welfare state is one of the objectives of the Unitary State of the Republic of Indonesia. This paper uses a qualitative method that processes secondary data into descriptive analysis. THE USE OF SOCIAL MEDIA IN IMPROVING THE SPEAKING SKILLS OF JUNIOR HIGH SCHOOL STUDENTS
This research is motivated by the use of social media which is used only as a vehicle forentertainment. The speaking ability of junior high school students is still low. Students arestill embarrassed when expressing opinions or during presentations. Students take turnspointing and it isn\u27t easy to appear in front. Advanced students\u27 speaking skills are still low,judging from the slow and hurried voices. So the effort made by the author is to assign aproject to make a description video. The video is uploaded to social media whose purposeis to increase students\u27 confidence. This study uses a literature study method and datacollection techniques using a documentation study. The results of the study show that theuse of social media in improving speaking skills in Indonesian lessons at the junior highschool level is effectively used.
