    Materi ini menganalisis Konflik Israel-Palestina melalui lensa hukum pidana internasional dengan fokus pada pelanggaran hukum yang terjadi selama konflik tersebut. Penelitian mencakup serangkaian peristiwa, termasuk tindakan militer, pendudukan, dan kebijakan keamanan yang telah memberikan dampak signifikan terhadap populasi sipil. Pendekatan hukum pidana internasional digunakan untuk mengevaluasi apakah tindakan yang diambil oleh Israel atau Palestina melanggar norma-norma hukum pidana internasional, seperti peraturan Konvensi Jenewa dan Statuta Roma yang mendefinisikan kejahatan perang dan kejahatan terhadap kemanusiaan. Selain itu, dampak psikologis dan kemanusiaan konflik tersebut juga diperhitungkan, memberikan dimensi tambahan pada analisis hukum. Hasil penelitian ini memberikan wawasan mendalam tentang kompleksitas hukum pidana internasional dalam konteks konflik ini, mengidentifikasi tantangan dalam menentukan tanggung jawab hukum individu dan negara. Implikasi kemanusiaan dan hak asasi manusia juga menjadi fokus, menyoroti perlunya pendekatan yang holistik untuk mencapai keadilan dan perdamaian berkelanjutan di wilayah tersebut

    Aborsi adalah tindakan mengakhiri kehamilan. Di Indonesia, perbuatan ini dilarang dan tercantum dalam bab “Kejahatan terhadap Kehidupan” KUHP. Meskipun aborsi merupakan tindakan ilegal, undang-undang dan peraturan yang ada saat ini tidak cukup menjawab alasan perempuan melakukan aborsi, dan faktanya masih banyak perempuan yang melakukan aborsi karena berbagai alasan. Secara umum, aborsi dapat dibagi menjadi dua kategori: aborsi yang tidak disengaja dan aborsi yang disengaja. Aborsi yang tidak disengaja adalah aborsi yang tidak diinginkan yang terjadi tanpa keterlibatan apa pun. Sebaliknya, aborsi yang diinduksi adalah aborsi yang terjadi karena suatu tindakan. Pasal: Pasal 194 berlaku juncto Pasal 75 ayat (2) Undang-Undang Kesehatan Nomor 36 Tahun 2009 dan/atau Pasal 348 KUHP (KUHP) dan/atau Pasal 299 KUHP. Pelaku. Mereka akan diadili berdasarkan KUHP. Pelaku terancam hukuman maksimal 10 tahun penjara atau denda maksimal Rp 1 miliar. Menurut Pasal 299 KUHP, siapa pun yang dengan sengaja menganiaya seorang perempuan tidak boleh memberitahukan kepadanya bahwa kehamilannya dapat mengakibatkan aborsi, atau bahwa kehamilannya dapat mengakibatkan aborsi

    Tindak pidana adalah perbuatan yang dilarang oleh hukum dan dapat dikenai sanksi pidana. Tindak pidana dapat terjadi di perbankan syariah  dilakukan dengan berbagai macam modus yang dilakukan pihak internal perbankan maupun eksternal. Aksi kejahatan tersebut dapat merusak dan merugikan perekonomian Negara, seperti pembiayaan fiktif, akibat dari tindakan kejahatan tersebut menimbulkan rasa ketidak percayaan terhadap lembaga keuangan, merusak peredaran uang dan merugikan perekonomian Negara. Metode yang digunakan dalam penelitian ini adalah melalui studi kepustakaan (library research) dengan cara membaca, mengutip dan menganalisis teori-teori hukum dan peraturan perundang-undangan yang berhubungan dengan permasalahan dalam penelitian. Hasil dan kesimpulan dalam penelitian ini adalah aksi tindak pidana pembiayaan fiktif yang terjadi karena kurang optimalnya pelaksanaan prinsip kehati-hatian yang berujung pada kerugian yang diderita oleh bank. Akibatnya kerugian risiko operasional yang disebabkan oleh tidak optimal fungsi sistem informasi dan pengawasan pihak internal bank syariah, lemahnya sistem administrasi,  kelalaian SDM baik disengaja maupun tidak, kebijakan bisnis yang keliru, serta  tidak  terlaksanya  sistem  dan  prosedur  kerja  yang  baik.     The company\u27s activities are essentially a joint effort between employers and workers to grow the company and improve workers\u27 welfare. This research was conducted based on the author\u27s interest in finding out the implementation of the work agreement between midwives and Dera As-Syifa Hospital, where, based on the secondary data that the author obtained, the work agreement form is PKWT. The Manpower Law has stipulated that PKWT is only for jobs that are not permanent or core business. The problem in this study is :P First, we will discuss implementing the work agreement between Dera As-Syifa Hospital and Health Workers. Second, what are the legal consequences if the minimum wage paid is not by the UMP/UMK Brebes? This study uses a normative research method, namely legal research conducted by researching library materials or secondary data. Then, it continued with the collection of primary material data through direct interviews and observations as well as secondary materials obtained from literature studies in the form of law books, legal journals, and other literacy associated with the core of this research. The results of the study showed that PKWT used in the working relationship between midwives and Dera As-Syifa Hospital based on Permenkes 1199 of 2004, which regulates the employment relationship for health workers can be held with PKWT so that it is an exception to the provisions regulated in the Manpower Law along with the Job Creation Law and PP 35/2021. However, the implementation of PKWT at Dera As-Syifa Hospital is still not appropriate because there is still a probationary period of 4 months with salary deductions, so during the probationary period, the salary is not by the provisions of the minimum wage applicable in Brebes Regency. According to relevant regulations, companies that provide salaries below the minimum wage can be subject to sanctions and automatically change PKWT to PKWTT. However, such conditions do not affect the company; workers still receive such treatment

    Within the field of medicine, practitioners are guided by teachings on ethics and morals to fulfill their duties and responsibilities in serving the community. Imagine a scenario when a doctor breaches the relevant ethical and moral standards. If such a situation arises, the discipline will be enforced either by the professional association responsible for setting the ethical guidelines or by legal authorities who will process and impose penalties to prevent doctors from neglecting their duty to get informed permission and engaging in malpractice. Informed consent serves a dual purpose for both patients and doctors. For doctors, it provides a sense of assurance when performing medical procedures on patients and acts as a form of protection against potential legal claims or lawsuits that may arise from any unforeseen accidents. Regarding informed consent, it refers to the patient\u27s entitlement to receive comprehensive information regarding their medical condition, the recommended medical procedures, and the potential outcomes associated with each decision

    Consumer Protection is any effort that guarantees legal certainty to protect consumers against expired food. This study aims to explore policies and legal protections for consumers related to expired foods, as well as the efforts that consumers can take in dealing with them. In this study, the author uses a normative juridical approach, which is a method of literature law research which is carried out by researching library materials or secondary data. Then it was continued with the collection of data on secondary legal materials obtained from literature studies in the form of law books, legal journals, and other literacy associated with the core of this research. Verification of tertiary legal materials obtained from law dictionaries, Indonesian Language dictionaries, and other dictionaries. This research can provide new insights for legal practitioners and judges in developing civil law. In addition, the study also promotes a better understanding of the role of the local government in Kuningan Regency in improving consumer protection and overcoming barriers such as public mindset, buyer negligence, lack of knowledge about expired food, and inadequate legal supervision

    APPLICATION OF RESTITUTION CRIME IN CASES OF MOLESTATION OF MINORS

    The provision of restitution rights as a form of compensation to children victims of criminal acts of molestation is becoming an interesting issue related to child protection because sexual violence is a type of violence with a high number every year. In this study, the author made 2 (two) problem formulations, namely: how to apply the criminal restitution in the crime of child molestation and what are the obstacles to the implementation of the provision of restitution. This study took a verdict in 2021 regarding cases of sexual abuse that positioned children as victims. The legal research method used is normative juridical which is qualitative to obtain descriptive results. The following are the results of the research that the author has found: The provision of restitution to children victims of criminal acts of abuse is the right of children of victims of criminal acts based on Article 7A of Law Number 13 of 2006, Article 71D of Law Number 35 of 2014 and Article 3 of Government Regulation Number 43 of 2017. An application for restitution can be submitted at the time before the judgment or after the judgment has obtained permanent legal force. So that the provision of restitution to the victim\u27s child is not fundamental. Furthermore, the author found that there was a provision of restitution in the verdict so that the defendant was burdened with the obligation to pay restitution in the amount of Rp.331,527,186.00 (three hundred and thirty-one million five hundred and twenty-seven thousand one hundred and eighty-six rupiah) to the victim\u27s children who had applied for restitution as many as 12 restitution applications. The Panel of Judges upholds procedural principles and does not look at the aspect of child protection

    Pengaruh Audit Internal dan Kepemimpinan Beretika Terhadap Implementasi Good Corporate Governance Serta Dampaknya pada Kinerja Perusahaan

    The performance of BUMNs is not optimal because there are still many BUMNs that experience losses. Company performance has long been a source of discussion. Thus, the purpose of this research is to analyse the relationship between internal audit, ethical leadership and the implementation of good corporate governance in improving company performance. The population of this study were 36 BUMNs in Indonesia, with a sample size of 182 respondents, selected using saturated/census sampling techniques. Data were obtained by online surveys through google forms and direct visits to several BUMNs, then analysed using SEM-PLS. The type of question used in this research is a closed question. The results prove that internal audit affects the implementation of good corporate governance and company performance. Ethical leadership affects the implementation of good corporate governance and company performance. Furthermore, the research results prove that the implementation of good corporate governance has an influence on company performance. This research can contribute to BUMNs in Indonesia, especially in improving the performance of their companies, increasing the trust of investors, stakeholders, and society in general to BUMNs.Kinerja BUMN belum optimal dikarenakan masih banyak ditemukan pada beberapa BUMN yang mengalami kerugian. Kinerja perusahaan sudah lama menjadi sumber diskusi. Dengan demikian, tujuan riset ini adalah menganalisis hubungan antara audit internal, kepemimpinan beretika dan implementasi good corporate governance dalam meningkatkan kinerja perusahaan. Populasi penelitian ini adalah 36 BUMN di Indonesia, dengan jumlah sampel sebanyak 182 responden, yang dipilih dengan sampling jenuh/sensus. Perolehan data dengan survei online melalui google forms serta mendatangani langsung ke beberapa BUMN, kemudian dianalisis menggunakan SEM-PLS. Jenis pertanyaan yang digunakan dalam riset ini adalah pertanyaan tertutup. Hasil riset membuktikan bahwa audit internal berpengaruh terhadap implementasi good corporate governance dan kinerja perusahaan. Kepemimpinan beretika  mempengaruhi implementasi good corporate governance dan kinerja perusahaan. Selanjutnya, hasil riset membuktikan implementasi good corporate governance memiliki pengaruh pada kinerja perusahaan. Riset ini dapat memberikan kontribusi bagi BUMN di Indonesia khususnya dalam meningkatkan kinerja perusahaannya, meningkatkan kepercayaan investor, stakeholder, dan masyarakat umum kepada BUMN

    Cases of domestic violence are of such high urgency that the state both preventively and repressively prevents and overcomes these problems so as to provide guarantees regarding order and security in social life. In the current era of decentralisation, integrally and holistically the Regional Government in carrying out regional autonomy based on the principle of medebewind is obliged to make implementing regulations of the Law both in the form of Regional Regulations, as well as Regional Regulation of Majalengka Regency Implementing Agencies, and Regional Regulation of Majalengka Regency Implementing Programs. Seeing the seriousness of the number of domestic violence cases in Majalengka, which is getting higher every year, the Regional Government of Majalengka Regency normatively issued Regional Regulation of Majalengka Regency Number 2 of 2021 concerning the Implementation of Protection of Women and Children, and in action the implementer of the Regional Regulation is equipped with an implementing agency implementing the regional regulation, namely the Majalengka Regency Office of Women\u27s Empowerment, Child Protection and Family Planning . The results showed that the implementation of Majalengka Regency Regional Regulation Number 2 of 2021 and the role of Women\u27s Empowerment, Child Protection and Family Planning Majalengka Regency were considered successful in resolving domestic violence cases that occurred in Majalengka Regency in a non-litigation or mediation manner, thus it has become the duties and functions of Women\u27s Empowerment, Child Protection and Family Planning Majalengka Regency to handle domestic violence cases at the non-litigation or mediation level in a family manner with the relevant parties

    Law in its usefulness must then guarantee 4 substances, namely legal certainty, legal expediency, legal justice, and acceptance or recognition of law by citizens of the community governed by law. In the context of this research, it focuses on the unclear position of the inheritance of children outside of marriage due to legal dualism in Indonesia, namely civil law and Islamic law. In the legal facts that occur today, heirs of children outside of marriage are victims of adultery and/or invalid marriages because they do not meet the requirements regulated by Number 1 of 1974 concerning Marriage and the Civil Code. The presence of two laws with different elements and styles between Islamic law and civil law creates a disparity in legal substance, so that at the level of its application the community is given a choice as to which law they will adhere to or use. This study aims to analyse and examine the status of the position of origin of children outside of marriage in the perspective of the Civil Code and Presidential Instruction Number 1 of 1991 concerning the Compilation of Islamic Law which has implications for the distribution of inheritance. The results of the study show that civilly, the legal position of children outside of marriage can be elevated to the status of legitimate children if they receive recognition from their biological father which is then legalised through a court decision, even though civilly children outside of marriage receive a share of inheritance of one third of what they should receive as biological children. Meanwhile, in the provisions of Islamic law, children outside of marriage are adulterous children so that they only have nasab from the mother and her mother\u27s family, so that children outside of marriage then if they get inheritance from their biological father, it is only in the form of a mandatory will and not inheritance
