Eutanasia frente a la dignidad constitucional
The approval of the recent euthanasia law in Spain has raised blisters in the medical community and the scientific community because the law has been processed without the opinion of the doctors. This article attempts to clarify confusing concepts such as dignity or euthanasia that are handled without precision in the media; it also collects the arguments in favor of euthanasia and refutes them with legal arguments, reaching the conclusion that we should support a palliative care law that would guarantee a dignified death with comprehensive care for the sick and the family, protecting the constitutional dignity of all citizens without distinction because of their age, income or health.La aprobación de la reciente ley de eutanasia en España ha levantado ampollas en la comunidad médica y la comunidad científica por cuanto se ha tramitado la ley sin contar con la opinión de los facultativos. Este artículo intenta aclarar conceptos confusos como el de dignidad o eutanasia que se manejan sin precisión en los medios de comunicación; también recoge los argumentos a favor de la eutanasia y los rebate con argumentos jurídicos, llegando a la conclusión de que deberíamos apoyar una ley de cuidados paliativos que garantizara una muerte digna con atención integral al enfermo y la familia, protegiendo la dignidad constitucional de todos los ciudadanos sin distinción por razón de su edad, renta o salud

This article offers the translation of two works of Isidore ofSeville: the Allegoriae quaedam Sanctae Scripturae (CPL 1190) and theDe haeresibus (CPL 1201). The first one is a treatise of biblical exegesis in which the author offers the spiritual meaning of the mainprotagonists of two Testaments, both of concrete characters (Adam,Eve, Noah, Abraham, the four evangelists, the Virgin Mary, etc.) asof type characters (the deaf, the blind, the demonized, the widow,etc.). The De haeresibus is a small treatise on religious controversyin which Isidore distinguishes between the orthodox Christian, thewrong kind of Christian, the heretic and the schismatic, and thenpresents a select catalog of the main heresies of the Church,as well as the best known Jewish sects and the most relevantGreek philosophical doctrines.Este artículo ofrece la traducción de la dos obras de Isidoro deSevilla: las Allegoriae quaedam Sanctae Scripturae (CPL 1190) y el Dehaeresibus (CPL 1201). Las primeras son un tratado de exégesis bíblica de carácter alegórico en las que su autor ofrece el sentido espiritual de los principales personajes de los dos Testamentos, tanto depersonajes concretos (Adam, Eva, Noé, Abraham, los cuatro evangelistas, la Virgen María, etc.) como de personajes tipo (los sordos,los ciegos, los endemoniados, la viuda, etc.). El rescripto de Adriano a Minucio Fundano y el cristianismo
This document completed the measures taken by Trajan, whichin no case pursued a clear political goal: the aim was in fact to clarify the accusations against members of Christian communitieswhich had cropped up in the most important urban centers of theEmpire.The said rescript, as well as the references of ulterior authors(Tertullianus, Justin, Eusebius of Caesarea and Irenaeus), allows usto trace the existence of a number of martyrs on concrete locationseven if the chronology is uncertain at times: Ignatius of Antioch,Simeon, Telesphorus, Symphorosa and her seven children…The legal base that allowed for such behavior dated back to theyear 123, which means that Hadrian’s edict to Minucius Fundanusis linked to the one sent by Trajan to Pliny the younger a decadeearlier. Both texts are to be taken, therefore, as legal regulations putinto practice not only throughout the 2nd century but also in timesof the Severus´dinasty.Este documento completaba las medidas del emitido por Trajano, aunque en el fondo ninguno de ellos perseguía un objetivopolítico claro: su finalidad se dirigía a solucionar las acusacionescontra los miembros de las comunidades cristianas, surgidas en elmarco de los centros urbanos más significativos del Imperio.Dicho rescripto, así como las referencias de autores posteriores(Tertuliano, Justino, Eusebio de Cesarea e Ireneo), nos permite rastrear la existencia de algunos mártires en ámbitos geográficos muyconcretos, como Ignacio de Antioquía, Simeón, Telesforo, Sinforosay sus 7 hijos…, aunque la cronología en algunos casos sea incierta.La base legal de tal comportamiento tendría su aplicación apartir del año 123, de modo que el edicto de Adriano a MinucioFundano se unía al dirigido una década antes por Trajano a Plinioel Joven, convirtiéndose ambos en una normativa legal puesta enpráctica no solo durante todo el siglo II sino también en tiempos delos Severos.

RETOS ACTUALES DE LA ADMINISTRACION DE JUSTICIA EN LA IGLESIA
In this article, the author addresses some of the most pressing challenges facing the administration of justice in the Church and in society today. These challenges include, from the credibility crisis that the administration of justice is going through in the Church, to some pressing issues to be addressed in the field of matrimonial, criminal and administrative proceedings. Some guidelines for the future and strategies for overcoming this crisis are offered in line with the nature of ecclesial law and the social function that corresponds to the same procedural activity.El autor aborda en este artículo algunos de los desafíos más apremiantes con los que se enfrenta hoy la administración de justicia en la Iglesia y en la sociedad. Entre estos desafíos se hallan, desde la crisis de credibilidad que atraviesa la administración de justicia en la Iglesia, hasta algunas cuestiones apremiantes a las que atender en el campo de los procesos matrimoniales, penales y administrativos. Se ofrecen algunas pautas de futuro y estrategias de superaciónde esta crisis en consonancia con la naturaleza del Derecho eclesial y la función social que corresponde a la misma actividad procesal
INTERVENCIONISMO E INJERENCIAS DE LA AUTORIDAD ECLESIÁSTICA EN EL DERECHO DE ASOCIACIÓN. ESTUDIO DE CASOS
This article specifies, on the one hand, what freedom or the right of association in the Church entails; and, on the other hand, the faculties of the ecclesiastical authority with respect to the associations of the faithful (vigilance, visitation and regime), above all to highlight that such competences cannot hinder the right of association, much less limit it, replace it or reorder it to its own whim. Rather on the contrary, they should encourage him, accompany him, guide him, follow him,… in short, take care of him. To this end, the ius statuendi contained in canon 94 § 1 is analyzed and the need to reconcile the right of association with the faculties that corresponds to the ecclesiastical authority is reflected, in order to seek a balance that guides the relationship of the members of an association with the hierarchy, in an exercise of ecclesial co-responsibility that Pope Francis calls synodality, inviting one and the other to walk together in the evangelizing mission that we all have as members of the Church, the People of God.En este artículo se concreta, de una parte, lo que comporta la libertad o derecho de asociación en la Iglesia; y, de otra, las facultades de la autoridad eclesiástica respecto de las asociaciones de fieles (vigilancia, visita y régimen), sobre todo para resaltar que tales competencias no pueden dificultar el derecho de asociación, ni mucho menos limitarlo, sustituirlo o reordenarlo a su capricho. Más bien al contrario, deben animarlo, acompañarlo, orientarlo, seguirlo, … en definitiva, cuidarlo. Con esta finalidad, se analiza el ius statuendi contenido en el canon 94 § 1 y se reflexiona sobre la necesidad de conciliar el derecho de asociación con las facultades que compete a la autoridad eclesiástica, para buscar un equilibrio que guíe la relación de los miembros de una asociación con la jerarquía, en un ejercicio de corresponsabilidad eclesial que el papa Francisco llama sinodalidad, invitando a unos y otros a caminar juntos en la misión evangelizadodra que todos tenemos como miembros de la Iglesia, Pueblo de Dios
LA INMATRICULACIÓN POR CERTIFICACIÓN ECLESIÁSTICA
The certification issued by the diocesan, under the protection of art. 206 of the Mortgage Law of 1946, was a valid document that satisfied an imperativeneed. It provided legal security to many properties that the church owned continuously, peacefully, and publicly, especially temples used for worship, but which lacked legal security, since even though they were notoriously part of the patrimony of the Catholic Church, the latter was forbidden to register them in the Land Registry. This impossibility to immatriculate these properties placed the Catholic Church in a position of legal uncertainty and inequality compared to other religious denominations that were able to immatriculate theirproperties. With this certification, the ecclesiastical authorities provide legal security to the registry entries in the Property Registry.La certificación expedida por el diocesano, con amparo al art. 206 de la Ley Hipotecaria de 1946, era un documento perfectamente válido y que salía al paso de una necesidad imperiosa, la de dotar de seguridad jurídica a muchas fincas que la iglesia poseía de manera continua, pacífica y públicamente, en especial de los templos destinados al culto, pero que adolecían de una seguridad jurídica, ya que aun siendo notorio su pertenencia al patrimonio de la Iglesia católica, se prohibía a ésta inscribirlos en el Registro de la Propiedad. Esta imposibilidad de inmatricular estos bienes hacía que la Iglesia católica estuviese en una posición de inseguridad y de desigualdad jurídica frente a otras confesiones religiosas que sí podían inmatricular sus bienes. Con esta certificación las autoridades eclesiásticas aportan seguridad jurídica a las tablas registrales del Registro de la Propiedad
La atmosfera del milagro: Una aproximación a la experiencia taumatúrgica (prácticas y ritos) a través de los retablos medievales de santos en la corona de Aragón
The medieval altarpieces are an important source of knowledge about liturgical practices and devotional rites performed in front of graves of saints. The scenes of performed in front of graves of saints. The scenes of miracles in their tombs, included within the narrative cycles of altarpieces, allow us to reconstruct the environment where medieval man interacted with the holy remains and the belief in miracles. Through the late Major Altarpiece of the Church of San Vicente Sarrià together with a group of Aragonese altarpieces ranging from the Thirteenth to the fifteenth century is analyzed in this article analyzes the meaning and function of votive image, types of rites and the way of representing them iconographically in tables, we will analyze different devotional actions recorded in each one to understand who the man´s relationship with the supernatural. The original function of altarpieces such as that of San Vicente in medieval visual culture will also always be considered.Los retablos medievales son una importante fuente de conocimiento visual sobre prácticas litúrgicas y ritos devocionales realizados frente a los sepulcros de santos. Las escenas de milagros ante sus tumbas, incluidas dentro de los ciclos narrativos de los retablos, permiten reconstruir cómo era el ambiente donde interactuaba el hombre medieval con los restos santos y la creencia en los milagros. Tomando el retablo Mayor tardogótico de la Iglesia de San Vicente Sarrià como eje, junto con un grupo de retablos aragoneses que van desde el siglo XIII al XV, se analiza en este artículo el significado y función de las imágenes votivas, tipos ritos y la forma de representarlos iconográficamente en las tablas, deteniéndonos en las distintas acciones devocionales registradasen cada una de ellas, con el fin de analizar la relación del hombre con lo sobrenatural, sin perder de vista el sentido primigenio de este tipo de retablos(como el de Sarrià) en la cultura visual medieval
Wittgenstein y el neopirronismo : Metafilosofía, argumentos y persuasión
Wittgenstein’s latest work, On Certainty, has not only been read as the dissolution of Cartesian skepticism but as a proposal of a new skepticism. This “new” skepticism has been understood by R. Fogelin (1976 [2002], 1981, 1994) as close to Sextus Empiricus’s Pyrrhonism. Therefore, he called it Neopyrrhonism. To Fogelin, both authors share the epistemological strategythat assumes that basic beliefs of common sense do not require any type of justification but cannotbe doubted either. My proposal is to review this epistemological interpretation of the notion of Neopyrrhonism in light of the metaphilosophical aspects developed by both authors. These aspects highlight the non-theoretical and therapeutic way of understanding philosophy, as well as the persuasive-argumentative abilities they share. Thus, I suggest conceiving of Neopyrrhonism as metaphilosophy rather than as one kind of philosophy focused on the problem of knowledge orjustification.El último texto de Wittgenstein, Sobre la certeza, no sólo se ha leído como la disolución del escepticismo cartesiano, sino como una propuesta de un nuevo escepticismo. Este “nuevo” escepticismo ha sido entendido por R. Fogelin (1976 [2002], 1981, 1994) como cercano al pirronismo de Sexto Empírico. Por ello, lo llamó neopirronismo. Para Fogelin, ambos autores comparten la estrategia epistemológica que supone que las creencias básicas del sentido común norequieren ningún tipo de justificación pero tampoco se puede dudar de ellas. Mi propuesta es revisar esta interpretación epistemológica de la noción de neopirronismo a la luz de los aspectos metafilosóficos desarrollados por ambos autores. Estos aspectos ponen de manifiesto la forma no teórica y terapéutica de entender la filosofía, así como la capacidad persuasiva-argumentativa que comparten. Así, sugiero concebir el neopirronismo como metafilosofía y no como una clase de filosofía centrada en el problema del conocimiento o la justificación.
