Las constituciones de los sínodos convocados por el obispo de Ourense don juan de san clemente (1578-1587)
Get PDFThe synodic history of Ourense has had in Canon Duro Peña its main historian who in the Synodicon hispanum published the text and information of the oldest Synods. Of the bishop Don Juan de San Clemente (1578-1587) who would later become archbishop of Santiago, the synod texts of the 5 Synods that he met in Ourense were not known, they were not printed but sent to be copied in the Visiting books of the Parishes, but The books that are preserved from the 16th century are rare, so they have been unknown. We have located in different parishes the mandates of the Synods held in the years 1579, 1582, 1583, 1584 and 1586, which in their determinations add a norm of reforms and behaviors that in other cases would be the result of a single synod. Being unpublished, they enrich this history a lot and are of great interest to better understand the religious life of the Diocese of Ourense at a very particular moment such as the post-council of Trent.La historia sinodal de Ourense ha tenido en el canónigo Duro Peña su principal historiador que en el Synodicon hispanum publicó el texto e información de los Sínodos más antiguos. Del obispo Don Juan de San Clemente (1578-1587) que luego sería arzobispo de Santiago, no se conocían los textos sinodales de los 5 Sínodos que reunió en Ourense, no se imprimieron, pero se mandaron copiar en los libros de Visita de las Parroquias, pero son raros los libros que se conservan del siglo XVI, por lo que han pasado desconocidos. Hemos localizado en distintas parroquias los mandatos de los Sínodos celebrados los años 1579, 1582, 1583, 1584 y 1586, que en sus determinaciones suman una normativa de reformas y comportamientos que en otros casos serian el resultado de un único Sínodo. Al ser inéditos enriquecen mucho esta historia y son de gran interés para conocer mejor la vida religiosa de la Diócesis de Ourense en un momento muy particular como es el postconcilio de Trento

The current civil configuration in Spain of the so-called "Right to change the sex register" contained in Law 4/2023 of February 28 is exposed, for the real and effective equality of trans people and for the guarantee of their rights, which allows the change of the identity of any person of Spanish nationality over 16 years of age, which may be carried out by a single request to the Civil Registry.
It is about the fact that the reality that has been created by this civil regulation requires adopting canonical legislative, jurisprudential and pastoral positions, especially in two areas of canonical marriage law: preparation for marriage, and marriage annulment processes, and antecedents are indicated. canonical, and proposals for praxis are also provided that provide security in the face of this new legal reality.Partiendo de los cambios legislativos habidos en España en el ámbito civil en materia de calificación de la identidad registral de las personas, se constata que dichos cambios inciden de algún modo en el ámbito matrimonial canónico.
Se expone la configuración civil actual en España del denominado "Derecho al cambio registral de sexo" contenido en la Ley 4/2023 de 28 de febrero, para la igualdad real y efectiva de las personas trans y para la garantía de sus derechos, que permite el cambio de la identidad de toda persona de nacionalidad española mayor de 16 años que podrá llevarse a cabo por la sola solicitud ante el Registro civil
La realidad jurídica que se ha creado por esta normativa civil reclama adoptar posiciones legislativas, jurisprudenciales y pastorales canónicas sobre todo en dos ámbitos propios del Derecho matrimonial canónico: la preparación al matrimonio, y los procesos de nulidad matrimonial, y se indican antecedentes canónicos, y se aportan también propuestas de praxis que otorguen seguridad ante esta nueva realidad jurídica

La aplicación de estas medidas cautelares tiene, en principio, una razón de ser, pero pone en juego también una serie de derechos fundamentales del investigado, y acaban convirtiéndose en verdaderas penas cuando se prolongan innecesariamente en el tiempo.
