Régimen jurídico de los bienes de interés cultural de los monasterios y conventos que dejan de estar habitados
Get PDFThis article analyzes the legal situation of the goods belonging to monasteries and convents that are to be closed. It is an increasing phenomenon in countries that have had an old Christian tradition —such as Spain—, and nowadays they are undergoing a situation of progressive secularization. Both real estate and movable property usually have an important historical-artistic importance, which affects their use and legal treatment. This article begins studying the legal mechanisms provided by Canon Law in order to suppress a house. Afterwards, it will be possible to know who will be the new owner of the goods. It will also be necessary to address the legal-canonical and civil regime that affects its conservation and, where appropriate, the transfer of objects.Este artículo analiza cuál es la situación legal en que quedan los bienes de los monasterios y conventos que deben cerrarse. Se trata de un fenómeno cada vez más frecuente en países de antigua tradición cristiana —como es el caso de España— que están atravesando una situación de progresiva secularización. Tanto los inmuebles como los bienes muebles suelen tener un importante valor histórico-artístico, lo que afecta a su uso y tratamiento jurídico. Se comienza estudiando los mecanismos que prevé el Derecho canónico para suprimir una casa. A partir de aquí, se podrá conocer quién será el nuevo propietario de los bienes. Será preciso afrontar también cuál es el régimen jurídico-canónico y civil que afecta a su conservación y, en su caso, al traslado de los objetos

Get PDFThe work presented has the following approach: starting from the Pope\u27s reflection on the planet and ecological problems, it is intended to show the philosophical influences that underlie Francisco\u27s exposition. These influences make it possible to describe a philosophical profile present in the encyclical Laudato si’. In addition, since philosophy claims to know, it is not exhausted only in knowledge, but tries to know in order to act; therefore, the presence of an ethical proposal follows; and since all ethics leads to action, it follows that action cannot be without some indicators, without an axiology on which human action on the planet revolves. The result is that Francisco offers an ethic of otherness that feels the other as an authentic neighbor, even those who are in the future. It is an ethic of common benefit and caring for the other whose fundamental axis is the person and for this reason he reflects the phenomenon of human life within life on Earth, with which its philosophical approach seems personalist, from a point of Christian view.El trabajo que se presenta tiene el siguiente planteamiento: partiendo de la reflexión del Papa sobre el planeta y los problemas ecológicos, se pretende mostrar las influencias filosóficas subyacentes en la exposición de Francisco. Esas influencias muestran un perfil filosófico en la encíclica Laudato si’. Dado que la filosofía pretende saber, no se agota sólo en el conocimiento, sino que intenta saber para obrar; por consiguiente, hay una propuesta ética; y como la ética lleva a actuar, se sigue que la acción responde a unos valores, una axiología sobre la que gira la actuación humana en el planeta. El resultado es que Francisco ofrece una ética de alteridad que siente al otro como auténtico prójimo, incluidos los futuribles. Es una ética del bien común y del cuidado del otro cuyo fundamento es la persona, y así reflexiona sobre el fenómeno de la vida humana dentro de la vida en la Tierra, con lo que su enfoque filosófico parece personalista, desde un punto de vista cristiano

El desenlace del discipulado de Pedro a la luz de Jn 21,15-19
Get PDFThe evidence of a resolution for the discipleship of Peter in John 21, consistent with the body of the story (John 1-20), denotes both the literary and theological unity of the Fourth Gospel (John 1-21): the promise of a future followup that has been pending since John 13:36 comes to fulfillment in John 21:19; also the enigmatic nickname that Jesus imposes on Simon, son of John, at the beginning of the story (John 1: 42) finds clarification only in John 21,15-17. At the same time, this evidence highlights an important novelty regarding previous literary development: the beloved disciple now communicates his awareness, his intuitive knowledge of the Lord to Simon Peter (John 21: 7. 20). Such a procedure lacks a parallel throughout the body of the Gospel story, indicating, from the diachronic perspective, a new stage in the development of theological reflection of the Johannine community. La evidencia de un desenlace para el discipulado de Pedro en Jn 21, coherente con el cuerpo del relato (Jn 1-20), denota la unidad tanto literaria como teológica del cuarto evangelio (Jn 1-21): la promesa de un futuro seguimiento que había quedado pendiente en Jn 13,36 llega a su cumplimiento en Jn 21,19; pero también, el enigmático sobrenombre que impone Jesús a Simón, hijo de Juan, al inicio del relato (Jn 1,42) solo halla dilucidación en Jn 21,15-17. Sin embargo, al mismo tiempo, dicha evidencia destacará una novedad importante respecto al desarrollo literario anterior: el discípulo amado comunica ahora su ciencia, su conocimiento intuitivo del Señor a Simón Pedro (Jn 21,7.20). Tal modo de actuar carece de paralelo a lo largo del cuerpo del relato evangélico, indicando, desde el plano diacrónico, un nuevo estadio en el camino de reflexión teológica de la comunidad joánica

Get PDFIn this essay I analyze the theological accuracy of the conviction explored by the philosopher Gianni Vattimo (1936-2023) in some of his latest works: postmodern nihilismisthe present-day truth of Christian Religion. To do so, I begin with a synthesis of the way in which, according to the author, nihilistic hermeneutics is able to recover the Christological singularity of Christian Revelation. In a second moment, I expose some of the motives with which Christian theology critically takes full responsibility for –through its own hermeneutics: the confession of Faith–entering deeply into the question of the God of Jesus Christ in order to understand what is the true dimension of the “Christian spirit” of the nihilistic search.Este ensayo analiza la veracidad teológica de la convicción que explora el filósofo Gianni Vattimo (1936-2023) en algunas de sus últimas obras: el nihilismo posmoderno es la verdad actual del cristianismo. Para ello, se parte de una síntesis del modo en que, según el autor, la hermenéutica nihilista recupera la singularidad cristológica de la Revelación cristiana. En un segundo momento, se exponen algunos de los motivos con los que la teología asume críticamente mediante la confesión de la fe –que representa su propia hermenéutica–, la responsabilidad de entrar a fondo en la cuestión del Dios de Jesucristo para entender cuál es la verdadera dimensión del “espíritu cristiano” de la búsqueda nihilista

After confirming its paradoxical actuality in the frayed contemporary culture, this selective and succinct study addresses in its nuclear part the defining axes of the Christian-Paschal novelty, from the suggestive anthropological bases to its own theological semantics, with a special focus on the formal traits that, from their organic unity, give it its singular procedural meaning and its identity in the field of Church’s life. From them, a series of questions and challenges to the praxis of the faith of the communities are imposed as pressing urgencies.La crisis contemporánea sobre la iniciación sacramental demanda una clarificación doctrinal y una nueva re-programación en la vida de las comunidades. Tras constatar su actualidad paradojal en la deshilachada cultura contemporánea, este estudio, selectivo y sucinto, aborda en su parte nuclear los ejes definidores de la novedad cristiano-pascual, desde las sugerentes bases antropológicas a su semántica teológica propia, con un especial detenimiento en los rasgos formales que, desde su unidad orgánica, le dan su singular sentido procesal y su identidad en el ámbito de la vida eclesial. Get PDFTrinitarian ontology or metaphysics provides a light, based on intradivine relations, on our praxis of love in all its facets: friendship, erotic-sexual desire, espousal, civic and ecclesial fraternity, etc. This work mainly addresses the challenge of ‘polyamory’, whose discourse is sometimes misinterpreted as akin to Trinitarian theology. Polyamory is a reactive symptom of ‘romantic love’ which is defined by a sexualisation of human love similar to that of some pseudo-mystical ideas. Therefore, a desexualisation of the God\u27s mystery must take place. In response, we turn to the perspective of Trinitarian friendship, explaining the meaning of the Trinitarian paradigm of ‘the third’ (person), the condilectus (Richard of St. Victor). On the other hand, the visions of love implicit in some heretical conceptions of God are made explicit. From the paradigm of the third, some basic anthropological-trinitarian principles are outlined to understand the fraternal bonds of conviviality and conjugal love.La ontología o metafísica trinitaria ilumina, a partir de las relaciones intradivinas, nuestra praxis sobre el amor en todas sus facetas: amistad, deseo erótico-sexual, esponsalidad, fraternidad cívica y eclesial, etc. Este trabajo hace frente principalmente al desafío del “poliamor”, cuyo discurso a veces se mal interpreta como semejante a la teología trinitaria. El poliamor es un síntoma reactivo del “amor romántico” que se define por una sexualización del amor humano similar a la de algunas ideas pseudomísticas. Por ello, debe operarse una desexualización del misterio divino. Como respuesta acudimos a la perspectiva de la amistad trinitaria explicando el significado del paradigma trinitario amical del tercero, el condilectus (Ricardo de San Víctor). Por otro lado, se explicitan las visiones del amor tácitas en algunas concepciones heréticas sobre Dios. Desde el paradigma del tercero, se esbozan unos principios antropológico-trinitarios básicos para comprender los lazos fraternos convivenciales y el amor conyugal
