Barikan, Nilai-Nilai Islam dan Integrasi Kehidupan Sosial-Keagamaan: Studi Living Quran dan Hadits
No full textBarikan has a religious dimension worthy of exploration. It is a Javanese cultural practice that integrates Islamic values such as gratitude, charity, and brotherhood into social life. This tradition reflects the concepts of the Living Quran and Living Hadith, where the teachings of the Quran and the Prophet’s Sunnah are manifested in collective rituals that strengthen social solidarity and religious identity. Using a qualitative approach based on ethnographic methods, this research was conducted through participatory observation and in-depth interviews in a village in East Java where this tradition is practiced. The findings reveal that the Barikan tradition is a medium for praying for ancestors and an educational platform for Islamic values such as gratitude, cooperation, and generosity. In addition to fostering ukhuwwah Islamiyah (Islamic brotherhood), this tradition also functions as a tool for social unification and a reinforcement of local Islamic identity. By uncovering the religious values embedded in the Barikan tradition, this study highlights the importance of cultural and religious acculturation in maintaining social harmony.Barikan memiliki dimensi religius yang layak untuk dieksplorasi, barikan merupakan sebuah praktik budaya masyarakat Jawa yang mengintegrasikan nilai-nilai Islam seperti syukur, sedekah, dan ukhuwah ke dalam kehidupan sosial. Tradisi ini mencerminkan konsep living Quran dan living Hadits, di mana ajaran Al-Qur'an dan sunnah Nabi diwujudkan dalam bentuk ritual kolektif yang memperkuat solidaritas sosial dan identitas keagamaan. Dengan menggunakan pendekatan kualitatif berbasis metode etnografi, penelitian ini dilakukan melalui observasi partisipatif dan wawancara mendalam di sebuah desa di Jawa Timur yang aktif melaksanakan tradisi ini. Hasil penelitian menunjukkan bahwa tradisi Barikan tidak hanya menjadi sarana untuk mendoakan leluhur, tetapi juga menjadi media pembelajaran nilai-nilai Islam, seperti rasa syukur, gotong royong, dan kedermawanan. Selain mempererat ukhuwah Islamiyah, tradisi ini juga berfungsi sebagai alat pemersatu sosial dan penguat identitas keislaman lokal. Dengan mengungkap nilai-nilai religius yang melekat pada tradisi Barikan, penelitian ini menegaskan pentingnya akulturasi budaya dan agama dalam menjaga harmoni sosial
Reassessing Tajdid al-Nikah: Maqasid al-Shariah and Legal Status of Illegitimate Children in Central Lombok
Get PDFThe practice of tajdid al-nikah (renewal of marriage) within the framework of Maqhasid Sharia presents significant issues in Islamic law, particularly concerning legitimizing the lineage (nasab) of children born outside of marriage. In Islamic law, a couple involved in adultery can validate their relationship post-birth of a child through tajdid al-nikah to establish legal paternity. Although this practice aims to fulfill maqasid al-shariah objectives, such as preserving religion and lineage, it introduces various social, ethical, and legal challenges. This study aims to evaluate the social, moral, and legal ramifications of tajdid al-nikah and assess its alignment with the core principles of maqasid al-shariah, namely, the preservation of religion, lineage, intellect, and property. Additionally, it examines local perceptions in Central Lombok regarding tajdid al-nikah and the Islamic understanding of children born outside of marriage. The research employs a combination of literature review, field investigations, document analysis, and interviews with Islamic law experts and local religious leaders, using an analytical descriptive method grounded in Islamic legal principles. The findings reveal the complexities associated with tajdid al-nikah. While the practice supports maqasid al-shariah goals such as preserving lineage and religion, issues such as the ambiguity in confirming legitimate lineage and potential social repercussions highlight the need for further study. This research advocates for continued exploration and discussion on how tajdid al-nikah can be effectively integrated within an Islamic legal framework that respects maqasid al-shariah values, justice, legal certainty, and social welfare

This study aims to analyze the role of sociological approach in Islamic law studies and its implications for the understanding and application of sharia in society. The method used is juridical-sociological research with a descriptive-analytical approach, through literature studies and studies of social phenomena that influence the dynamics of Islamic law. The results show that the sociological approach helps to understand Islamic law not only as a normative norm, but also as a system that develops in social interaction. Factors such as culture, economy, and social change influence the implementation of Islamic law in various contexts. Therefore, the integration of a sociological approach in the study of Islamic law allows for a more comprehensive and responsive analysis of the reality of society, so that Islamic law can be applied in a more relevant and equitable manner
Metode Istinbat Nahdlatul Ulama: Kajian Tentang Bahtsul Masail
Get PDFThis study aims to examine the legal istinbat method used in the Bahtsul Masail Nahdlatul Ulama (NU) forum. Bahtsul Masail is a legal decision-making mechanism unique to NU, which refers to turats (classical) books and considers the social context. This study uses a qualitative method with a descriptive-analytical approach, based on a study of literature and an analysis of official NU documents related to Bahtsul Masail. The results show that the istinbat method in NU is not only based on classical fiqh texts but also considers the maqashid of sharia and the needs of the ummah. This approach allows for flexibility in responding to contemporary issues without leaving the established corridors of Islamic scholarship. Thus, Bahtsul Masail becomes an important instrument in maintaining the relevance of Islamic law to ever-evolving social dynamics
Tinjauan Normatif Ekonomi Islam Terhadap Perjanjian Leasing
Get PDFThis study aims to examine leasing agreements from an Islamic economic perspective based on sharia principles. The method used is qualitative with a normative juridical approach, through a literature analysis of Islamic law, fatwas from scholars, and regulations related to leasing in the Islamic economic system. The results of the study show that leasing (ijarah muntahiyah bit tamlik) is justified in Islam if it fulfills the principles of justice, transparency, and does not contain elements of usury, gharar, and dzalim. In practice, some forms of conventional leasing still contain elements that contradict sharia, such as interest and unclear contracts. Therefore, a sharia-based leasing model is needed that is more in line with sharia maqashid to create a fair and sustainable economic system

Get PDFThis study aims to analyze the role of criminal aspects in overseeing capital market activities to create a fair and transparent system. The method used is qualitative with a normative-juridical approach, through a literature review of capital market legal regulations and cases of violations that have occurred. The results show that criminal instruments have an important role in preventing and prosecuting violations, such as insider trading, market manipulation, and the dissemination of misleading information. The application of criminal sanctions in capital market regulations aims to increase legal certainty, protect investors, and maintain economic stability. This study confirms that strengthening criminal aspects, including more assertive law enforcement, is necessary to create a healthier, more integrated, and sustainable capital market

Get PDFThis study aims to examine the law of interfaith marriage in the perspective of Islamic fiqh. The differing views among scholars regarding the legal status of marriage between Muslims and non-Muslims is an ongoing debate. This study uses a qualitative method with a literature study approach, analyzing the arguments of the Qur'an, Hadith, and the views of fuqaha from various schools of thought. The results show that the majority of scholars prohibit marriage between Muslims and non-Muslims who are not people of the book, while some scholars allow Muslim men to marry women of the book. However, in the modern social context, a new approach has emerged that considers the aspects of maqashid Shariah and maslahat in looking at this issue. This study emphasizes that the law of interfaith marriage still requires contextual analysis to suit social realities without neglecting the principles of Shariah

No full textThis study aims to analyze the concept of an effective legal ideal from the perspective of legal theory. The legal ideal is a normative foundation in the formation and application of law that reflects the values of justice, certainty, and expediency. This study uses a qualitative method with a literature review approach, examining various legal theories and their relevance in building a responsive and effective legal system. The results show that the effectiveness of the legal ideal is influenced by normative and institutional factors, as well as public legal awareness. An ideal law must not only be written in regulations, but must also be applied fairly and in accordance with social needs. This study emphasizes that realizing an effective legal ideal requires a balance between clear regulations, strong law enforcement, and active community participation in the legal system
Menggali Potensi Wakaf Produktif Untuk Kesejahteraan Umat
Get PDFThis study aims to explore the potential of productive waqf as an Islamic economic instrument in realizing the welfare of the ummah. Using a qualitative method and a literature study approach as well as secondary data analysis, this study examines the concept, practice, and challenges of implementing productive waqf in Indonesia. The results show that productive waqf has great potential to support the economic development of the ummah, especially in the education, health, and economic empowerment sectors. However, challenges such as low waqf literacy, weak nadzir management, and limited technical regulations are still major obstacles. This study recommends increasing the capacity of waqf managers, regulatory support, and synergy between sharia financial institutions and waqf institutions so that the potential of productive waqf can be optimized in a sustainable manner
A Pesantren Cultural Value-Based Learning Model: Integrating Islamic Values and 21st-Century Skills

Data validity was ensured through source, methodological, and time triangulation. Then, the data were analyzed using Miles, Huberman, and Saldana's (2014) interactive model, consisting of data condensation, data display, and conclusion drawing. The findings of this study lie in its innovative approach to integrating traditional pesantren values with modern 21st-century skills, focusing on character building, practical life skills, and the use of information and communication technology (ICT) to improve educational outcomes.
