CONTEMPORARY APPLICATIONS OF CASH WAQF IN ISLAMIC FINANCIAL INSTITUTIONS

    Get PDF
This study discusses the contemporary applications of cash waqf in Islamic financial institutions. It comparatively examines diverse interpretations from both classical and contemporary fuqahā’. This study rigorously examines the innovative models and product structures of cash waqf employed by Islamic financial institutions. The analysis delves into the distinct Sharīʽah principles and jurisprudential implications of each model. Furthermore, the research explains the socio-economic impact and financial sustainability of these initiatives. Qualitative approach is used in this paper to conduct a comprehensive review of the diverse perspectives of jurists across the four principal Sunni namely, the Ḥanafiyyah school, the Mālikiyyah school, the Shāfiʽīyah school and Ḥanbaliyyah school, including contemporary fiqh al-wāqiʽ perspectives on contemporary applications of cash waqf in Islamic financial institutions within Malaysian context. This study synthesizes secondary data from a comprehensive review of academic and professional sources. It draws upon a wide range of materials, including both foundational and current scholarly manuscripts, journal articles, and research papers, alongside professional resources such as official documents, reports, and digital publications on the Makmur myWakaf Fund (MWF), PMB–An-Nur Waqf Income Fund, Maybank Mixed Assets-I Waqf Fund (MMAIW), Kenanga Waqf Al-Ihsan Fund (KWAF), and iTEKAD CIMB Islamic Rider Entrepreneur Programme. The findings reveal that Islamic Financial Institutions (IFIs) are revitalizing cash waqf through innovative financial products. This study contributes to the understanding that, by seamlessly integrating the profit motive of finance with the social objectives of waqf, IFIs have pioneered innovative financial instruments, such as cash waqf-linked investment products, waqf-based unit trusts, and waqf-shares, that facilitate the channelling of pecuniary returns (manfa‛ah) toward philanthropic endeavours, thereby bolstering the fund’s sustainability and growth which aligns directly with Bank Negara Malaysia’s (BNM) Value-Based Intermediation (VBI) vision and strategically embeds corporate social responsibility (CSR), environmental, social, and governance (ESG) investing, and sustainable and responsible investment (SRI). The findings provide crucial guidance for cultivating a supportive legal and regulatory framework to harness the long-term socioeconomic potential of cash waqf. &nbsp

Empowering Mustahiq Through Productive Zakat: A Maqashid Sharia Analysis of The "Surabaya Berdaya" Program

    Get PDF
This study evaluates the "Surabaya Berdaya" program initiated by BAZNAS Surabaya as a model of productive zakat aimed at empowering mustahiq through sustainable economic development. Grounded in the Maqashid Shariah framework, particularly the objective of Hifz al-Mal(protection of wealth), this study investigates the effectiveness of the program in transforming zakat beneficiaries into independent economic actors. A qualitative descriptive approach was employed, with data collected through interviews with program implementers and mustahiq, direct observations, and documentation analyses. The interview data were further analyzed using open coding techniques, allowing the emergence of key themes that were subsequently mapped to empowerment indicators. Verbatim quotations selected from informants were included to enhance methodological rigor and authenticity. The programme offers business capital, vocational training, business equipment, and ongoing mentoring to support micro-entrepreneurship. Field findings indicated increased income levels, improved financial literacy, and enhanced self-confidence among participants. Empowerment was observed through multidimensional indicators, such as self-agency, skill acquisition, resilience, and cooperative networks. The analysis shows that zakat utilization in this program aligns effectively with Maqashid Shariah, when combined with ethical governance, contextual sensitivity, and post-disbursement support. However, disparities in outcomes highlight the need for adaptive mentoring and personalized empowerment pathways. This study contributes to the growing literature on Islamic social finance by offering empirical insights into the operationalization of Maqashid Shariah in urban zakat programmes. It recommends further research into the long-term impact, integration with digital zakat systems, and policy innovation to enhance program scalability and effectiveness

Capital Accounting Based on Local Cultural Values by Gorontalo Travelers to Mecca

    Get PDF
This study aims to understand the capital accounting practices of travelers from Gorontalo to Mecca using bicycles based on local cultural values. This study is positioned within the Islamic paradigm using an Islamic ethno-methodology approach. The data analysis method consisted of five stages: charity, knowledge, faith, revelation-based information, and courtesy. The findings show that the primary sources of capital are merchandise sales and support from friends and fellow Muslims. This capital is used to finance travel necessities, including food, accommodation, and bicycle repairs, as well as charity throughout the journey. In practice, initial capital recording was done in writing, but as the journey progressed, financial records were retained only in memory. This reflects a non-material value-based accounting concept in which the belief in sustenance predestined by the Creator serves as the primary foundation for financial management. Additionally, in Gorontalo’s Islamic culture, this belief is reflected in the phrase Diila o, onto, bo wolu-woluwo, meaning "unseen but existent." This phrase teaches that in life, one should not only focus on visible aspects, but also appreciate the existence of the unseen but real. These findings indicate that capital accounting practices in this journey are not solely focused on financial recording, but also encompass broader spiritual and social values

Kritik Terhadap Konsep Negara Ideal AL Farabi Serta Relevansinya Dengan Era Modern

Abstract: Al-Madinah al-Fadhilah or what is called the ideal state is a concept of government initiated by a Muslim scholar named Al Farabi. The concept has an orientation towards achieving the highest happiness of society through cooperation, justice, and wise leadership that directs society towards common goals, not individual interests, by using normative approaches and qualitative research this research can produce a critical analysis of the concept of Al Farabi who initiated the concept of al-Madinah al-Fadhilah by mixing the realm of philosophy which of course many of these things are not understood for its implementation in the present day which in the end, the concept of al-Madinah al-Fadhilah is more appropriately understood as a political ideal rather than an applicable government system. The system functions as an ideal moral standard for evaluating every existing political system and behind the concept that was initiated there are shortcomings because the concept is very philosophical so it is difficult for today's society to understand, basically the concept of the ideal state of Al-Farabi is heavily influenced by Greek philosophy and Islamic theology, which makes it tend to be theoretical and difficult to realize in the real practice of state life. To determine whether the concept proposed by Al Farabi is still relevant or contradictory, the author has entitled this article: "A Critique of Al Farabi's Concept of the Ideal State and Its Relevance to the Present Era." This research explores the efforts of non-Muslim business actors in obtaining halal certification as a form of protection for Muslim consumers in Klepu, a multicultural village in Sooko, Ponorogo. Using a qualitative phenomenological approach, the study examines how non-Muslim entrepreneurs perceive and implement halal principles, even without formal certification. Data were collected through interviews, field observations, and documentation, and analyzed using triangulation techniques. The findings reveal that: (1) although non-Muslim business actors have not officially obtained halal certification, they have begun aligning their business practices with halal standards; (2) these efforts are motivated by moral responsibility and respect for Muslim consumers, as well as business opportunities; and (3) consumers feel more secure when halal certification is present, while business owners view it as a way to enhance market access and build interfaith trust. The study concludes that halal certification, even when pursued voluntarily by non-Muslims, contributes significantly to consumer protection and inclusive economic growth

Epistemological Transformation of Hadith Transmission in Post-3rd Century of Sufi Tradition

    Get PDF
The discourse on hadith transmission within the Sufi tradition presents a compelling subject for inquiry, particularly concerning its inherent dynamics and the intellectual tensions arising between Sufi practitioners and ḥadīth scholars. While Sufis define themselves as guardians of Prophetic teachings through spiritual realization and divine connection, a paradoxical divergence emerges: their methods of transmission often contravene the principles of validation recognized by mainstream scholarship. Departing from this apparent contradiction, this study investigates the epistemological framework through which Sufis engage with hadith and the methodological principles underpinning their transmission practices. Employing a descriptive-qualitative methodology in library research methodology, relevant data were systematically collected, verified for authenticity, classified thematically, and subjected to critical analysis and reflection. This inquiry reveals that the transformation within Sufi circles and the doctrine of taṣawwuf itself is fundamentally shaped by historical shifts, with each epoch developing distinct forms and modes of praxis. The principal finding of this research lies in the demonstration that the evolution of transmission practices follows a discernible trajectory: it originated within the traditional framework governed by the isnād system, transitioned into a phase marked by the simplification or truncation of isnāds, and culminated in the emergence of methods radically distinct from the established tradition of hadith scholars. This final stage is characterized by alternative methodologies based on kashf and ru’yā. The adoption of these alternative methods stems from the Sufi ambition to maintain a continuous spiritual connection with the Prophet, a connection they contend is accessible primarily through contemplative practice. While contemplation possesses a basis for legitimacy within Prophetic tradition, its application as a formal channel for transmitting ḥadīth risks replicating a historical peril: the proliferation of fabricated hadiths. This risk arises from the inherent difficulty of verifying the chain of transmission (isnād) and the matn of such experientially-received knowledge through the systematic criteria developed within the classical science of hadith.

Integration of Spiritual Healing and Islamic Education through Ruqyah

    Get PDF
This study aims to analyze the integration between spiritual healing and Islamic education in the practice of ruqyah in Ponorogo. It has been perceived solely as a method of spiritual healing through reciting verses from the Qur'an and special prayers. Some researchers said that it not only serves as therapy but also as Islamic education. This study employed a qualitative case study approach, focusing on the ruqyah practices of Jam'iyyah Ruqyah Aswaja (JRA) Batoro Katong Ponorogo. The data was obtained through interviews, observations, and documentation. Then, it was analyzed using the Miles and Huberman model. The findings reveal that ruqyah serves a dual function: first, as a means of healing for individuals experiencing medical, non-medical, or psychological disorders; second, as an instrument of Islamic education that instills the values of faith, worship, and morals in patients. The integration of these two functions shows that ruqyah can be positioned as a holistic religious practice, combining therapeutic and pedagogical aspects. This study implies that ruqyah can be developed as an integrative non-formal model of Islamic education, serving not only as a spiritual healing therapy but also as a medium for nurturing faith, worship, and moral values within the community
