    Get PDF
The research aims to examine the role of Islamic matchmaking applications—Taaruf ID, Salams, and Hawaya—in promoting Islamic marriage ethics and serving as a medium for digital da’wah. The rapid development of digital technology has transformed various aspects of human life, including how Muslims approach marriage. This study explores how these platforms align with the Islamic principles of ta’aruf while integrating modern technological advancements. Using a qualitative approach, the research analyzes user experiences, platform features, and Islamic ethical frameworks to assess the extent to which these applications facilitate halal relationships. Findings indicate that these apps offer an alternative to conventional matchmaking methods while maintaining Islamic values. However, challenges such as commercialization, user authenticity, and religious adherence persist. This study contributes to discussions on digital ta’aruf, the intersection of technology and religion, and the evolving landscape of Muslim courtship in the digital era.   REFERENCES Abdullah, Najwa. “2025/7 ‘The Hijrah Phenomenon: Shifting Urban Muslim Identities in Indonesia’ by Najwa Abdullah,” 2025. https://www.iseas.edu.sg/category/articles-commentaries/page/146/articles-commentaries/iseas-perspective/page/2/. Reinterpretasi Konsep Nushuz: Falsifikasi Konsep Kebolehan Suami Memukul Istri

    Get PDF
This study aims to reexamine the concept of nushuz in Islam and criticize the view that allows husbands to beat their wives as a form of discipline. This study uses a qualitative method with a hermeneutic approach and discourse analysis of verses from the Qur'an, hadiths, and classical and contemporary tafsir. The results showed that the concept of nushuz does not always mean wife's defiance, but reflects the dynamics of husband-wife relations which must be resolved with the principles of justice and compassion. The interpretation that allows beatings is more influenced by patriarchal culture than by universal Islamic values. This reinterpretative approach emphasizes that Islam encourages the resolution of domestic conflicts through deliberation and a non-violent approach. Thus, the concept of nushuz needs to be understood in the context of gender justice that is more humanistic and in accordance with the values of maqashid sharia

The concept of gender justice in Islam is oriented towards a balance of rights and obligations without demeaning either party. This study emphasizes that the gender movement in Islam must be based on the values of the Qur'an and Islamic objectives, thus producing harmonious and fair relationships in social life

This study aims to analyze the role of law enforcement in overseeing business competition to keep it healthy and fair. Uncontrolled business competition can lead to monopolies, cartels, and abuse of dominant positions that harm small businesses and consumers. This study uses a qualitative method with a literature study approach, examining regulations such as Law No. 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition and the role of the Business Competition Supervisory Commission (KPPU). The results show that the enforcement of business competition law still faces challenges, such as weak sanctions, lack of inter-agency coordination, and obstacles in proving cases. This study emphasizes that effective law enforcement in business competition requires strict regulations, tight supervision, and legal awareness among business actors in order to create a healthy and competitive business ecosystem

Public Interest Sebagai Sumber Hukum Islam: Studi Terhadap Konsepsi Al Maslahah Najm al-Din al-Tufi

    Get PDF
This study aims to examine the concept of public interest as a source of Islamic law through Najm al-Din al-Tufi's thinking on al-maslahah. The method used is qualitative with a normative-philosophical approach, through a literature study of al-Tufi's works and classical and contemporary Islamic legal literature. The results of the study show that al-Tufi places al-maslahah as an independent source of law that can override other arguments in a particular social context, especially in the realm of muamalah and socio-politics. This concept is considered progressive because it emphasizes the flexibility of sharia in responding to the needs and interests of the ummah. This study concludes that al-Tufi's ideas provide ample room for ijtihad for the formation of Islamic law that is contextual, relevant, and responsive to the dynamics of the times

Legal Protection for Children Without Family Care: A Comparative Study of Oman, UAE, and Morocco

    Get PDF
This study aims to examine how Omani law protects vulnerable children without family care through foster care arrangements. In addition to assessing the effectiveness of this protection, the study also compares Oman's approach with that of Morocco and the United Arab Emirates, as well as the principles of Islamic Sharia law. Using a descriptive and comparative methodology, this article analyzes the legal conditions for foster care duties and monitoring procedures in Oman. It highlights strengths in the existing legal framework, but also reveals shortcomings in implementation and oversight. Learning from stronger practices in Morocco and the UAE and aligning them more closely with Sharia objectives is one of the recommendations. The research found that while the legal framework in Oman has provided a sufficient basis for the care of vulnerable children without families, there are still significant weaknesses in aspects of implementation and oversight mechanisms. Compared to Morocco and the United Arab Emirates, Oman has not fully adopted best practices in terms of monitoring, ensuring children's rights, and community involvement. The findings also indicate a gap between national legal provisions and the shariah's key objectives in protecting children's rights. By evaluating this dimension of the welfare system through contrasting regional examples and religious principles, this research contributes to the development of a new approach to child welfare

Maslahah Mursalah in Ultra Petita Decision of The Constitutional Court

    Get PDF
Ultra Petita refers to a court decision that goes beyond what was requested. Judges handling certain cases are limited to the issues raised by the parties involved. If the judge grants more than what was requested, the decision falls under Ultra Petita. In this context, the judge is only authorized to consider the claims and lawsuits based on those claims (iudex non ultra petita or ultra petita non cognoscitur). The judge only determines whether the issues at issue are true or false. Judges are prohibited from increasing or decreasing the demands and may not grant more than what is requested. This research aims to analyze two things. First, it discusses how the Constitutional Court's ultra petita decision is constructed. Second, it discusses how the principle of maslahah-mursalah is applied in the ultra petita decision of the Constitutional Court. By using descriptive analysis, the results show that the decisions of the Constitutional Court are an effort to protect the constitutional rights of citizens. Second, the ultra petita decision is in line with the principles of maslahah-mursalah. Ultra petita decisions allow constitutional judges to provide fair and valuable decisions and provide legal certainty.
