    Efficacité des outils de l’évaluation environnementale et sociale dans le sous-secteur routier pour la protection des bassins hydrologiques : une étude de cas des pistes Akpro-Missérété – Kpédékpo et Calavi Kpota – Hêvié Cococodji au sud-Bénin

    La protection des bassins hydrologiques constitue un enjeu majeur dans le sous-secteur routier, compte tenu des impacts environnementaux et sociaux liés aux infrastructures. L’étude menée sur les axes Akpro-Missérété – Kpédékpo et Calavi Kpota – Hêvié – Cococodji, a évalué l’efficacité des outils d’Évaluation Environnementale et Sociale (EES). Elle s’appuie à la fois sur l’analyse de sources documentaires et sur des enquêtes auprès de 140 riverains et 77 personnes ressources, avec traitement par statistiques descriptives et analyses thématiques. Il est observé une application incomplète et inégale des outils EES. Sur la route Akpro-Missérété – Kpédékpo, 56,25 % des outils sont partiellement mis en œuvre et 18,75 % pleinement opérationnels. En revanche, sur l’itinéraire Calavi Kpota – Hêvié – Cococodji, seuls 12,5 % sont appliqués. Les mesures de protection des bassins hydrologiques apparaissent insuffisantes, le suivi environnemental reste irrégulier et la participation communautaire limitée. L’efficacité réelle des EES demeure faible, exposant les écosystèmes à de forts risques. Une intégration systématique, un suivi post-travaux rigoureux et une implication accrue des communautés sont indispensables afin de renforcer la durabilité et la performance environnementale des projets routiers

    Le changement climatique dont on parle tant n’est pas un fait nouveau. C’est un fléau de portée mondiale qui a de répercussions visibles dans les milieux. Au tertiaire, les changements climatiques ont entraîné l'assèchement du bassin tchadien. L'environnement lacustre de la cuvette tchadienne s'est modifié considérablement au cours du quaternaire récent en fonction des variations climatiques. Comparativement aux fleuves et océans, les lacs sont de faibles dimensions occupant une dépression fermée et sont alimentés soit par les eaux d’un fleuve favorable au système de capture, ou soit directement par les eaux de pluie. L’objectif de cette étude est d’analyser le devenir du lac-Wey, dont l’apport maximal vient du fleuve Logone, aussi bien en eau comme en matériaux de divers calibres. L’analyse des données climato-pluviométriques à la latitude de Moundou a montré que la décharge du fleuve Logone dans ce lac, en temps de bonnes pluviométries (1500 à 1700 mm/an), renforce l’aggradation du lac dont la profondeur moyenne de 3,5 m des années 1960 n’est plus qu’à 2,0 en période de crue et de 1,72 m  pendant l’étiage

    This article will conclude with recommendations aimed at improving the legal and institutional framework surrounding the interim relief order, in order to ensure better protection of public freedoms in the DRC. This will involve identifying the reforms needed to strengthen access to administrative justice, reduce appeal processing times and improve citizens' awareness of their rights. In short, this study aims to contribute to the debate on the need to strengthen mechanisms for the protection of public freedoms, while highlighting the importance of interim relief as a legal tool in the fight for a rule of law that respects human rights in the Democratic Republic of Congo

    The irrevocability of judgments rendered by the Constitutional Court constitutes one of the cardinal principles of the Congolese legal order. It aims to guarantee the stability of judicial decisions and legal certainty by conferring upon these judgments an absolute and final authority. However, this irrevocability, elevated to the rank of an intangible principle, encounters the fundamental requirement of the right to appeal, recognized by the Constitution of February 18, 2006, as amended and supplemented by Law No. 11/002 of January 20, 2011, as well as by international human rights instruments as a non-derogable right. This paradox raises a central question: how can the need for stability of constitutional rulings be reconciled with the imperative of guaranteeing every litigant an effective remedy against a decision tainted by error or manifest injustice? Through an in-depth doctrinal and jurisprudential analysis, this article examines the compatibility between the irrevocability of Constitutional Court judgments and the principle of non-derogability of the right to appeal, within the framework of Congolese positive law. It also proposes possible reform pathways aimed at ensuring a better balance between the authority of res judicata in constitutional matters and the effective protection of fundamental rights

    Preventive detention in military law violates the principle of individual freedom and the presumption of innocence, as it can be extended up to twelve months by the investigating judge. It therefore socially appears as a definitive sentence. However, the arrested person is presumed innocent and has the right to be tried without undue delay.The absence of judicial oversight before the military prosecutor fosters abuses committed by magistrates during the period of preparatory investigation. Arrests and detention of civilians by the military prosecutor for civil matters remain unsatisfactory. These behaviors call for and require several recommendations aimed at amending certain provisions of the military judicial code for the benefit of the Congolese people, who are victims of illegal detention and arbitrary arrests

    Etude de la corrélation entre les paramètres cliniques et la concentration plasmatique de cortisol chez les chiens anesthésiés avant la stérilisation

    La présente étude a pour objectif général d’évaluer les effets de la prémédication des agonistes α-2 adrénergiques et de Kétamine sur la corrélation entre les concentrations plasmatiques de cortisol et les paramètres cliniques chez les chiens stérilisés. Pour y parvenir, seize chiens dont huit mâles et huit femelles de race commune en bonne santé âgés en moyenne de 1,5 an pesant de 15 à 20 kg ont été tous anesthésiés avec la combinaison xylazine-kétamine (3mg/kg et 10mg/kg de PV en IM respectivement). A l’issue de nos expérimentations, il s’est avéré que : les taux plasmatiques de cortisol des chiennes stérilisées (OVH) sont significativement différents de ceux des chiens castrés à l’incision, à la fin de la stérilisation (sortie des organes) et à 90 minutes après la fin de la stérilisation. Les fréquences cardiaques des chiennes ovariectomisées sont significativement différentes des ceux des chiens castrés à 180 minutes après la fin de la stérilisation. Une ccorrélation est significativement négative entre le taux de cortisol plasmatique et :les fréquences respiratoires (r=-0,68*, -0,80*** , -0,67**, -0,78***) respectivement avant l’administration de l’anesthésie, à l’induction, 120 minutes et 180 minutes après la fin de la stérilisation ;les fréquences cardiaques (r=-0,55*,-0,57*,-0,78**) respectivement 60, 90 et 120 minutes après la fin de la stérilisation.Une corrélation positive significative entre le taux de cortisol plasmatique et :Les fréquences respiratoires (r=0,74**,0,61* ,0,75***) respectivement à l’incision, 90 minutes et 150 minutes après la fin de la stérilisation ;Les fréquences cardiaques (r=0,79***, 0,83***,0,70**,0,55*) respectivement à l’incision, à la fin de la stérilisation, 30 minutes et 120 minutes après stérilisation

    La gestion des résidus et déchets miniers pose un réel problème environnemental, au vu de la concentration des métaux accompagnateurs dans les rejets miniers après extraction du métal d'intérêt du minerai. Dans l'article 4 ; la réglementation nucléaire nationale, stipule que la radioactivité renforcée n'est pas exclue du champ d'application de la réglementation puisqu'elle constitue une radioactivité naturelle "perturbée" et de ce fait, entre dans le champ d'application du décret n° 05/022 du 29 mars 2005. Ceci a été démontré par les résultats trouvés et conforte la mise en place d'une stratégie de gestion et de contrôle des déchets et résidus dans le secteur minier

    FEASIBILITY OF METAKAOLIN AND LIME MATERIAL AS A BINDER MIXTURE FOR CONCRETE THE CASE OF BALENGOU CLAY IN WEST CAMEROON AND THE LIME OF FIGUIL NORTHERN CAMEROON

    Diverse complexities and challenges are faced during cement production processes especially the Portland cement. The process requires huge amounts of energy and these fossils fuels when burnt at up to 1450°C released excessive greenhouse gases such as CO2 which contributes to the calamity called global warming. All these facts, in addition to the low economic growth of countrys, and the expensive price of construction materials, reduce the availability of a liveable, ecological and sustainable shelter house for the middle classes. It is in this line that we thought of valorising the calcined clay from Balengou by studying the feasibility of making a binder by mixing it with lime from Figuil as this could help to partially cover some domains done by Portland cement, to improve the lime mortar properties, to reduce the construction cost, and to reduce the degradation of the ozone layer. In this work, Hallosysite clay from Balengou was calcined at 750°C, mixed with lime and the effects of it at metakaolin percentage substitution to lime (10 %, 15 %, 20 %, 25% to 90 %.) were examined on their physico-mechanical properties such as Consistency, water absorption, pozzolanicity etc. In the lime-metakaolin mixture with metakaolin from Balengou’s clay, as we increase the percentage of metakaolinin the paste, the setting duration reduces. The proportion of pure lime improves the plasticity of the paste while the metakaolin at its optimum percentage (20%) increases the strength of the paste to its maximum value at about 28 days. The low energy consumption during the manufacturing process and the CO2 absorption during the carbonation process reduce the environmental impact and cost of lime-metakaolin mixture. Also, the aesthetic appearance of that paste makes it adequate for internal pointing and plastering. At 20% of metakaolin in the paste, the pozzolanicity is at the highest point and the paste gains good plasticity and perspiration with optimum resistance. Lime-metakaolin mixture is good for works where the need of breathability and lower strength is of great importance. Then, we do not recommend it for works with high strength structural elements

    The authentication of wills is a crucial issue in estate planning, particularly in the Democratic Republic of Congo (DRC), where testamentary practices vary widely due to cultural and legal factors. Among these practices, oral wills play a significant role, especially in rural communities where their use is often preferred for reasons of accessibility and tradition. However, this form of will presents unique challenges in terms of authentication. The lack of a clear legal framework and the high risk of contestation exacerbate family and community tensions, jeopardizing the rights of heirs. This context underscores the importance of exploring the issues related to the authentication of oral wills in the DRC in order to propose appropriate solutions to strengthen legal security and the protection of last wishes. This work aims to analyze the societal and legal implications of this testamentary method, while suggesting necessary reforms for better regulation
