Inwiefern muss sich der eigene Titel von denen anderer Werke unterscheiden? Oder erstreckt sich der Urheberrechtsschutz des Werkes auch auf den Titel? Der Beitrag bietet einen einführenden Überblick über die gesetzlichen Bestimmungen zum Titelschutz. Im Fokus steht dabei das Markengesetz, aber auch das Urheberrecht wird in Hinblick auf die Titelbezeichnungen näher in den Blick genommen und es werden ausgewählte Gerichtsurteile zum Titelschutz vorgestellt.When selecting a title for publication, one faces the question of which legal frame-work must be observed. To what extent must one's own title differ from those of other works, and does the copyright protection of the work also extend to the title? This article provides an introductory overview of the legal provisions regarding title protection. The focus is on trademark law, but copyright law with regard to title designations is also examined, and selected court rulings on title protection are presented.AlternativeReviewe
Perceived microaggressions and quality of life : the mediating role of personal resources and social support among people with African migration background in Germany
No full textIn contemporary discourse, microaggressions are not mere fleeting occurrences but pervasive daily experiences that significantly influence individual and collective well-being. This current study delves into the role of personal resources and social support as mediators in the relationship between microaggressions and quality of life. The study analyses cross-sectional data from 604 African migrants in Germany, employing Structural Equation Modelling techniques. Five direct associations were examined alongside three separate mediation analyses to evaluate the predictive effect of microaggressions on quality of life through personal resources, social support, and the combined influence of both. The results indicate a negative association between microaggressions, personal resources, social support, and quality of life. Microaggressions constrain personal resources and social support, thereby compromising quality of life, as evidenced by the attenuating effects observed in the mediation analyses. Furthermore, the serial mediation model highlights the distinct contributions of personal resources and social capital. The findings underscore the serialised nature of microaggression’s impact on quality of life, suggesting that neither personal resources nor social support can fully mitigate its effects. This study posits that microaggressions manifest through migrants’ social interactions and exchanges, undermining personal resources and social support networks essential for enhancing their quality of life.PeerReviewe

Der Schwerpunkt liegt darauf, wie emotionale und stilistische Aspekte die Rezeption beeinflussen und welche Ansätze zur Sicherstellung der Zuverlässigkeit generierter Inhalte beitragen können. Dabei wird die Funktionsweise von KI-Chatbots und die Wirkung von Techniken wie Reinforcement Learning, Fine-Tuning und Retrieval Augmented Generation (RAG) analysiert, um ihren potenziellen Einfluss auf Qualität und Konistenz der Tonalität zu verstehen.The article examines the significance of the tonality of generative artificial intelli-gence (AI) for the dissemination and perception of information as well as possible strategies for minimising hallucinations and disinformation. The focus is on how emotional and stylistic aspects influence reception and which approaches can con-tribute to ensuring the reliability of generated content. Framework zur Bewertung von Open- und Closed-Source-LLMs in der Klassifikation von Nachrichtenmeldungen für das Supply-Chain-Riskmanagement
No full textDiese Arbeit stellt ein Framework zur systematischen Vergleichsanalyse offener und proprietärer Large Language Models (LLMs) für die Relevanzklassifikation von Nachrichten im Supply-Chain-Risk-Management vor. Es ermöglicht Modellvergleiche ohne annotierte Referenzdaten und liefert quantitative und qualitative Einsichten in Konsistenz, Robustheit und Eignung verschiedener Modelle. In einer exemplarischen Anwendung wurde das Framework genutzt, um 22 LLMs anhand der Relevanzklassifikation von 15.000 Nachrichtenartikeln im Kontext der Automobilindustrie zu analysieren. Die Ergebnisse zeigen, dass leistungsfähige Open-Source-Modelle in Einzelfällen mit kommerziellen Systemen vergleichbar sind und unterstreichen die Bedeutung kontinuierlicher Modellwahl und -evaluation für den praktischen Einsatz.PeerReviewe
