Study of Policy Equalizing Administrative Positions into Functional Positions
The Indonesian government's efforts to achieve changes in the government administration system are through bureaucratic reform by equalizing administrative positions into functional positions. However, this is different from the duties of the village government center in Malang. This research aims to describe and analyze policy implementation and support and inhibiting factors for the policy of equalizing administrative positions into functional positions at the village government center in Malang. The research design uses a descriptive qualitative approach with an inductive method. The research was conducted at the Village government hall in Malang, Ministry of home affairs. The data collection techniques used were observation, interviews and documentation. Data analysis techniques are carried out using data collection, data reduction, and data categories. This research shows that implementing the policy of equalizing administrative positions into functional positions at the Village government center in Malang includes policy content and policy environment/context. The content of the policy consists of positive benefits felt by policy implementers, but there are differences in decision-making between implementers due to a lack of coordination. Meanwhile, the environment/context and the use of power give rise to conflicts of interest. In the future, it is hoped that policy implementers will socialize regarding specific functional positions because the socialization carried out so far has only been general and update the performance assessment system in the Ministry of home affairs' job application by not using officials to assess an employee's performance
The Board of Commissioners Moderates Cash Holding and Profitability on Earnings Management
One of the parameters that is used as a reference for investors and shareholders in making financial decisions is profit information in the company's financial reports. The assumption that companies with stable profits reflect optimal performance and have low investment risk encourages managers to make efforts to provide a good picture of performance, one of which is by carrying out earnings management. Deviant earnings management practices are carried out when information asymmetry occurs which arises from moral hazard and encourages management to behave opportunistically, resulting in poor earnings management, which is carried out in an inadequate manner. Earnings management is influenced by several factors, including cash holding, profitability and the board of commissioners. This research aims to examine the influence of cash holding and profitability through the interaction of the board of commissioners which is proportional to the proportion of independent board of commissioners as an internal mechanism for Good Corporate Governance within the company. The population used is all manufacturing companies listed on the Indonesia Stock Exchange, using purposive sampling to obtain 50 selected companies in the 2020-2023 observation period, with a total data sample of 200. Moderated Regression Analysis (MRA) is used as a technique to test the relationship between variables. The test results show that partially cash holding, profitability and the board of commissioners have a significant effect on earnings management. The test results also show that the independent board of commissioners is able to moderate cash holding and profitability on earnings management
Singhasari Special Economic Zone Development Strategy in Malang Regency
The government desires to accelerate equitable economic development by developing Special Economic Zones in various regions of Indonesia. This research focuses on analyzing the Policy Formulation for the through a Study of Strategy, Planning and Priority Scale and obtaining alternatives/recommendations for good problem-solving. The theory of public policy formulation is a way to solve a public problem and overcome existing public problems from several alternatives. Alternative problem-solving is selected using SWOT analysis (Strengths, Weaknesses, Opportunities, Threats). The analytical tool used in this research is a SWOT analysis approach. In contrast, the approach used is descriptive, namely collecting data through a perspective on a critical documentation approach. This research concludes that the planning for developing the Singhasari special economic zone (SEZ) is through the SO (Strength, Opportunities) Strategy, namely creating employment opportunities supported by the surrounding areas covering education and human resources. As well as the WT (Weaknesses, Threats) strategy, namely increasing the attractiveness of the Singhasari Special Economic Zone to foreign investors by making investment easier. The two priority programs were taken as the author's recommendations were given to be used as a discussion for preparing regulations. The government can propose two priority programs for the Singhasari Special Economic Zone in the current year
Performance Achievements of the East Java Province Communication and Information Service During the COVID-19 Pandemic
The public needs information relating to public bodies as consumers who receive information. Open and transparent information is regulated in Law No. 14 of 2008 concerning the Openness of Public Information. In this research, researchers conducted an evaluation study at the East Java Province Communication and Information Service in the era of the COVID-19 pandemic using mixed research methods. The research data used is questionnaires, observation, and documentation studies. This research aims to determine and analyze the Performance of the East Java Province Communication and Information Service during the COVID-19 pandemic based on Law No. 14 of 2008 concerning the Openness of Public Information. Researchers also analyzed the factors influencing the Performance of the East Java Province Communication and Information Service during the COVID-19 pandemic. The theory used is performance evaluation theory, according to Dwiyanto (2021), with five indicators: productivity, service quality, responsiveness, responsibility and accountability. This research shows that the performance of the East Java Province Communication and Information Service during the COVID-19 pandemic was based on Law No. 14 of 2008 concerning the openness of public information, which still needs improvement. In particular, the information conveyed to the public is still limited to less important information and needs to be more widely distributed. This is caused by the OPD's need for more attention in promoting the openness of public information. Many people need to learn how vital public information is, which makes people distrust a transparent government. Overall, the quality of information dissemination services to the public still needs to be improved. This needs to be strengthened again, considering human resources at the East Java Diskominfo still need to be improved
Implementation of Limited Company Social Responsibility in the Field of Natural Resources, West Kutai District
The legal product in the form of a Regent's Regulation issued by the West Kutai Regency Government, which regulates explicitly Guidelines for the Implementation of Corporate Social Responsibility, is a form of control function over companies operating in the West Kutai Regency area by the West Kutai Regency Government. Based on the description above, this article examines and analyzes the Implementation of the Social Responsibility Obligations of Limited Liability Companies in the Natural Resources Sector Law Number 40 of 2007 concerning Limited Liability Companies in West Kutai Regency and the factors that hinder its implementation. The research method used in this research is an empirical legal research method. Trubaindo Coal Mining, in implementing the Regulations on Limited Liability Company Social Responsibility Obligations in the field of natural resources based on Law Number 40 of 2007 concerning Limited Liability Companies in West Kutai Regency, has implemented the company's corporate social responsibility by the program required by the people of Muara Begai Village. Meanwhile, the inhibiting factors that arise in implementing implementation are not being able to distinguish between needs and desires; there are several groups that prioritize personal interests rather than the people at large; of course, this will interfere with the company in grouping the right groups that require Corporate Social Responsibility. The lack of Human Resources cannot be denied as an inhibiting factor, and unforeseen things such as natural disasters and floods make it impossible to carry out scheduled Corporate Social Responsibility programs
The Role of Job Satisfaction in Mediating Employee Engagement on Employee Performance
This research aims to analyze the effect of employee engagement on job satisfaction, analyze employee engagement on employee performance, analyze job satisfaction on employee performance and analyze job satisfaction in mediating employee engagement on employee performance. The sample in this research was 120 employees. The data analysis technique uses SmartPLS. The results of the analysis show that employee engagement influences job satisfaction. Employee engagement influences employee performance. Job satisfaction influences employee performance. Job satisfaction mediates the effect of employee engagement on employee performance
Legal Politics of the President's Grant of Lesion Based on the Perspective of Justice and Humanity in the Indonesian Judicial System
This research aims to explore and understand the legal politics behind granting a Pardon by the President of Indonesia in the justice system and the factors influencing the decision to grant a Pardon. The research method used is normative legal research, which focuses on positive legal analysis, legal principles, and legal doctrine. The approach used includes a statutory approach to analyze related regulations and a conceptual approach. The research results show that Granting a Pardon by the President is a constitutional right that the President has without interference from other institutions. After the amendment to the 1945 Constitution of the Republic of IndonesiafourthSometimes there are restrictions on the President's powers, which are considered too broad, and to prevent authoritarianism from the President. In line with these changes, especially in granting pardons, the President must pay attention to the considerations of the Supreme Court. This is not an intervention by the President in the Judiciary institution. However, with a checks and balances mechanism, the President has the basis for consideration from the institution concerned even though the decision to grant it is purely based on the President's constitutional rights
Study and analysis of Management of the Tinggi Hari Megalith Tourist Attraction: A case Study of Community Behavior in Simpur Village, Gumay Ulu District Lahat Regency, South Sumatra Province
This research aims to analyze community behavior in managing the Tinggi Hari Megalith tourist attraction in Simpur Village, Gumay Ulu District, Lahat Regency, South Sumatra Province, and analyze the driving factors and inhibiting factors in managing the Tinggi Hari Megalith tourist attraction in Simpur Village, Gumay Ulu District, Lahat Regency, Sumatra Province. South. In this research, researchers used qualitative research with descriptive methods. In analyzing the results of the data that researchers obtained in the field regarding community behavior in Simpur Village, Gumay Ulu District, Lahat Regency, South Sumatra Province in managing the Tinggi Hari Megalith tourist attraction, researchers used several stages, namely activities in data analysis including: Data Collection, Data Condensation , Data Display and Conclusion Drawing/Verifications. Based on the results of data analysis and theory, it was found that the norms and attitudes of the Simpur Village community influenced their behavior in managing this tourist attraction, with beliefs and evaluation of daily behavior as well as motivation to progress as supporting factors. The norms and beliefs held by the community influence their behavior in managing the Tinggi Hari Megalith Tourist Attraction. The people of Simpur Village have great motivation to increase their knowledge and welfare. However, the lack of tourists and lack of community empowerment in managing this tourist attraction, which is still managed by the Lahat Regency Culture and Tourism Office under the authority of the Jambi Regional Cultural Heritage Center, are the main obstacles. Driving factors in managing this tourist attraction include the existence of the Tinggi Hari Megalith, natural resources for making souvenirs, the friendliness of the population, and motivation to prosper, which is supported by related parties. However, inhibiting factors such as lack of human resources, funds and management authority, coupled with the lack of government policies to facilitate infrastructure and rumors of security disturbances, are still challenges. This research concludes that even though the community has great potential and motivation, various obstacles still hinder the optimization of management of the Tinggi Hari Megalith Tourist Attraction
Institutional Corruption and Economic performance Nexus: An Empirical analysis with evidence from Nigeria
Corruption has emerged as a multifaceted challenge severely impacting the Nigerian economy in recent times. The impetus behind this study stems from the recognition that no sector, whether private, public, local or traditional institution can claim to be free from corruption. The primary objective is to examine the potential repercussions of institutional corruption on the productive performance of the Nigerian economy. Employing the Ordinary Least Squares (OLS) methodology and rooted in the endogenous growth theory, the study underscores that corruption is a hindrance to economic performance in Nigeria, as supported by evidence-based research and documented cases of corrupt practices in the country.
In summary, the comprehensive view reveals that corruption detrimentally affects Nigeria's economic performance in various aspects. The study concludes that the effect of corruption on the productive performance of Nigeria is alarming and has manifested adverse consequences for the economy and if Nigeria fails to combat corruption, the nation risks facing dire consequences due to its pervasive presence. The policy recommendations emphasized that the Nigeria government should streamline and harmonize all forms of monetary transactions and payments in the country using the treasury single account (TSA), National identification number (NIN), the bank verification number (BVN) and all forms of electronic payment systems into a single digital platform and link such digital platform with the various anti-graft agencies for periodic monitoring. This will drastically reduce corruption and transactions with physical cash. Secondly, the Nigerian government should to demonstrate the political will to prosecute individuals involved in corrupt practices, regardless of their tribe, religion, or political affiliation. Such stringent actions are crucial as deterrents for others. These findings align with the ongoing institutional restructuring agenda widely advocated in Nigeria
Crossing Frontiers: A Comparative Exploration of AI Inventorship and Ownership in Patent Law
This article aims at examining inventorship and ownership of Artificial Intelligence (AI) systems in patent law. This is achieved by employing a comprehensive review of relevant patents Acts, policy documents and cases such as Thaler v. Iancu, case no. 1:20-cv-00903 (E.D. Va). The review is coupled with the analysis of AI inventorship and ownership across various jurisdictions such as the United States of America, European Union and South Africa. This is done to understand the criteria for determining inventorship, ownership and the contemporary interpretations of the concept of “intelligence." The article finds that current patent laws encounter difficulties in adequately protecting AI-generated or assisted inventions due to limitations in recognizing AI as inventors. It is therefore argued that if the current patent system cannot accommodate AI related inventions, then there is urgent need to consider a sui generis system tailored to address the unique challenges posed by AI inventions within patent law. Taken together, the article underscores the need for patent legal frameworks to ensure fair treatment and protection of AI-generated or assisted inventions. The article also notes that there is need for further research for an enhanced understanding of the interplay between AI and patent law
