PROTECTION OF TRADEMARKS IN ISLAMIC LAW AND ITS VIOLATIONS IN PAKISTAN
This article highlights several issues not only in regard to importance of trademark but also its impact on growth of economy and consumer protection. Trademark protection law is facing great challenges in Pakistan as it has failed to provide an adequate remedy to the victims. Its violations become more often when there is confusion in masses that whether under Islamic Law it falls in the definition of asset or not? Violation of intellectual property rights (IPRs) as a whole and specially trademark is one of the major reasons behind low foreign direct investment in Pakistan and also low spending on research and development in trade and business. Some sectors bear more losses and some comparatively less but overall these laws are less effective in Pakistan due to many reasons. Strong protection of trademark can lead toward a confident business environment where not only traders but also consumers will enjoy the confidence. Trustworthy situation will attract more enterprises as well as multinational firms in the country and ultimately result in growth of business and ballooning of economy. Violation of trademark casts human lives sometime. According to CNN almost 45 to 50% of the total medicines in Pakistan are counterfeited with the fake packaging. We still remember when 120 people died together by taking such fake heart medications at Punjab Institute of Cardiology Lahore in 2012. Supreme Court of Pakistan had also observed in a case The Seven-UP Company vs. Kohinoor Thread Ball Factory etc. that this is not so to merely protect the proprietor of registered trade mark but to safeguard the interest of public. Fake culture promotes dishonesty and mistrust in the society which shakes the moral values and believe upon principled life so government should play a vibrant role to curb this menace
ہندوستان میں سلسلہ چشت کا تعارف اور ارتقاء: THE INTRODUCTION AND EVOLUTION OF CHISHTIYA SUFI ORDER IN INDIA
Sufism possesses a prominent place in the propagation of Islam and its basic teachings are the teaching of simplicity with purity and piety. The land of Hind has had been center of Sufiya since centuries and uncountable Sufiz had come here to preach and spent their whole lives in this land till died. Sufism began and evolved with the teachings of Khawaja Hasan Basri and then four major Sufis came into existence, one of which is the Chishtiya Sufi order. It started with Hazrat Ishaaq Shaami, Hazrat Ziauddin Chishti and then spread to the land of India by Hazrat Khawaja Moinuddin Chishti a caliph of Khawaja Usman Haruni. After him, through Khawaja Bakhtiar Kaki, Fariduddin Masood Ganj Shakar, Nizamuddin Auliya and Hazrat Chirag Dehlavi. The Chishti Order has had a lasting impact on the spiritual and cultural landscape of India, promoting a message of love, tolerance, and inclusivity. Its unique teachings were going to influence people across various cultures and religions so it became the largest Sufi order of the subcontinent thanks to Khwaja Noor Mahd Maharavi, Khwaja Muhammad Sulaiman Tunsvi and Khwaja Qamaruddin Sialvi. IMPACT OF TEACHING EXPERIENCE OF TEACHERS ON THE ACCOMPLISHMENT OF THEIR PROFESSIONAL RESPONSIBILITIES
This study explores the impacts of teaching experience on the accomplishment of professional responsibilities among teachers. Teaching experience is a critical factor influencing teachers\u27 effectiveness, classroom management, and student outcomes. This research examines how varying experience levels affect teachers\u27 ability to fulfil their professional duties, including lesson planning, student assessment, and classroom engagement. Data were collected through surveys and interviews with teachers from diverse educational backgrounds and experience levels. The results show that more seasoned educators are better at handling classroom dynamics, modifying their teaching methods, and meeting the demands of a wide range of students. They also demonstrate greater confidence in their academic skills and are more thoughtful about curriculum development. Conversely, novice teachers often face challenges in these areas, requiring extra support and qualified development. The study underscores the importance of continuous professional growth and mentorship programs to enhance the capabilities of less experienced teachers. By fostering a supportive environment, educational institutions can ensure that all teachers, regardless of their experience level, are equipped to meet their professional responsibilities effectively. This research contributes to the ongoing discourse on teacher development and highlights the need for targeted interventions to support educators at different stages of their careers
نظم حکومت میں تصور استثناء: اسلامی تعلیمات کی روشنی میں تجزیاتی مطالعہ: THE CONCEPT OF IMMUNITY IN GOVERNMENT ADMINISTRATION: AN ANALYTICAL STUDY IN THE LIGHT OF ISLAMIC TEACHINGS
No doubt the concept of governance is considered very important in the state administration and it is created to run the government system. Governance is the name of a sense of responsibility which governs the state while discharging its responsibilities. But the basic rights of the rulers are protected and in the legal language it is called privilege. Therefore, whenever administrative rules are made for the administration of the state, it includes administration. Laws are also made for the facilities and privileges of the rules. That is why the rulers are given a privileged position over other members of the society and their status in the society is highly regarded, because they have the primary responsibility of representing the people which is given to them by the people. The facility is called an exception in legal parlance. Governance in Islam is considered a duty and responsibility and the sense of responsibility is realized by fulfilling its legal requirements. In order to end the chaos in the society and to send a message of peace, love and brotherhood, it should keep in view that they are given relief so that they can fulfill their duties in a better way and live a good life as a ruler. وحی ا ور اس کی حفاظت سے متعلق مستشرقین کے نظریات و افکار کا جائزہ: A REVIEW ORIENTALIST THOUGHT REGARDING REVELATION AND ITS PRESERVATION
Human guidance is not solely reliant on reason and observation; rather, revelation is an essential necessity for proper guidance. The need for revelation arises precisely in instances where reason and senses cannot assist. Therefore, it is not necessary for every aspect of revelation to be comprehensible through reason alone. Just as determining the color of an object does not require reason but is a matter of direct perception, similarly, the knowledge of religious beliefs is derived from revelation rather than pure intellect. Relying solely on reason for understanding these beliefs is not appropriate. Consequently, if one has faith in the complete wisdom of Allah, it must also be acknowledged that the comprehensive system established for guiding His servants is termed revelation. Thus, revelation is not just a religious belief; it is also a rational necessity, and denying it is essentially rejecting divine wisdom. The Orientalist approach in this regard needs a special focus, liable to evaluated in the light of Qur’an and Sunnah. The following research discuss the same. But it is a strange thing that in all of them, only in relation to the revelation revealed to the Holy Prophet, PBUH the Orientalists raised various kinds of objections. In which the revelation was the unconsciousness of the Prophet PBUH, the conditions of its revelation were epileptic, the spiritual events were fallacies and the Qur\u27an has been described as a book containing the teachings of Judaism and Christianity. Their intention with such objections is to make Muslims doubt the truth and authenticity of divine revelation
شاہد نقوی کی غزل گوئی کا تجزیاتی مطالعہ: ANALYTICAL STUDY OF SHAHID NAQVI\u27S GHAZAL POETRY
The ghazal, which evolved from the ode, has developed with remarkable distinction and thematic diversity, making it a crown jewel of Urdu poetry. Considered the pride of Urdu poetry, the ghazal has always been popular across different eras. It has continued to evolve from its beginnings with poets like Amir Khusro, Wali Deccani, Mir Taqi Mir, and Mirza Ghalib up to the present day. Among these poets is Shahid Naqvi, who has explored various forms of Urdu poetry, including the ghazal. Shahid Naqvi was a notable poet, known for his elegies, salutations, and ghazals. Following in the tradition of renowned elegy poet Anees, he also started his literary journey with ghazal writing. Remarkably, he gained the same recognition in ghazal writing as he did in elegy. Although he has published several collections of ghazals, "Zameer-e Masloob" stands out, including both ghazals and poems. Naqvi enriched his ghazals while staying true to classical styles. His poetry is rich in cultural and artistic value. This article provides an analysis of Shahid Naqvi\u27s ghazal writing, showing how he transformed life\u27s bitter experiences into poetry. He balances emotional depth with imagination and intellectual foundations. Naqvi addresses both personal and worldly sorrows, guiding his audience from despair to hope, and teaching them to face life\u27s challenges. Shah Waliullah\u27s scholarship was not only focused on the the revival of religious sciences, he also focused the Islamic economic and social system to protect them from the injustices. His work is appreciated by the scholars. Famous Fuqha thinkers and researchers have done research on his life and thought. Since he is a largely accepted personality for all schools of thought, his teachings in the subcontinent are also wide and unlimited. Dr. Mahmood Ahmad Ghazi Sahib also belongs to the same region, he too was not only influenced by this prominent scholar, but he become da’i of his message where he spread the ideas of Shah Waliullah in his lectures, authored work and research articles at varous places. In this paper, an attempt has been made to highlight the services of Dr. Ghazi in promoting the intellectual and academic services of Shah Waliullah besides the influence of Hazrat Shah Waliullah on him. This paper explores the relationship between thoughts of Shah Waliullah and Dr. Ghazi to highlight the importance and usefulness of their work in the contemporary times for more intellectual development of the Muslim Society
عربی کتب سیرت کےمنتخب اردو تراجم کا جائزہ (1947ء سے 1980ء تک): A LITERATURE REVIEW OF SELECTED URDU TRANSLATIONS OF ARABIC BOOKS OF SEERAH 1947 TO 1980
The research review delves into the translation of Urdu books from Arabic originals, focusing on works that narrate the life of the Holy Prophet Muhammad (PBUH). The work of writing on the bibliography of Holy Prophet Muhammad peace be upon him was initiated since the days of his time and the work is still being carried out by the scholars of different languages in general but Arabic in particular. They tried their best to preserve the life of Holy Prophet Muhammad peace be upon him and different aspects his seerah. The article throws the light on Urdu writings on the life of Holy Prophet Muhammad peace be upon him translated from Arabic texts written between 1947 to 1980. The article provides brief literature review of the books of seerah written before the creation of Pakistan and have also enlisted some books of different languages being spoken in Pakistan include Sindhi, Urdu, Punjabi, Seraiki, Pakhtun and Baluchi. However, the Urdu books translated from Arabic during the period of 1947 -1980 have been brought under a detailed research review in this research. This research has summed up results that make us well aware of many things. This research work reveals that scholars of subcontinent produced many writings about the seerah of beloved prophet Muhammad peace be upon him based on modern principles
نکاح مسیار کی شرعی حیثیت :ایک تقابلی جائزہ: THE ISLAMIC LEGAL STATUS OF NIKKAH-E-MISYAR: A COMPARATIVE STUDY
The term ‘‘Nikah Misyar’’ translated sometimes as ‘‘marriage of convenience’’ or ‘‘Traveller’s marriage’’. It is not found in Quran or Sunna or classical works of Islamic jurisprudence because it is introduced recently by some clerics. In Sunni Islamic law, Nikah Misyar is a type of sunny Nikah that is ostensibly carried out with the objective of allowing a couple to engage in intercourse in a permissible manner. The husband and wife thus joined abandon several marital rights, such as living together, the wife’s rights to housing and maintenance money (nafaqa) and the husband’s rights to housekeeping and access. There exit so much confusion in the society about this matter, is it halal or haram? Its answer simply depends upon the conditions in this Nikah, if the conditions are according to Shariah than it is halal, and on the other way if it does not fulfil the teachings of Islam then it is haram. This paper discusses the viewpoints of various religious scholars, regarding Nikah Misyar. Some forms of this marriage have more negative effects than others, such as a man staying in another country for some work and getting married for a period of time and then ending it. This form of Nikah-e-Misyar will have more negative effects on society, whereas on the contrary, if a man or a woman living in the same country or city, due to some of their own constraints, choose this easy form of marriage and also agree to it, then this form has positive effects
