Amicus curiae i interwencja podmiotów trzecich przed TSUE i ETPCz – zasady, praktyka i znaczenie przesłanki interesu w rozstrzygnięciu sprawy
The article examines the role and significance of the amicus curiae institution in proceedings before the Court of Justice of the European Union (CJEU) and the European Court of Human Rights (ECtHR). It provides a comparative analysis of the legal frameworks, judicial practice, and functions that third-party interventions serve in both systems. The article points out that before the CJEU, the possibility for amicus curiae participation is strictly limited by legal provisions and subject to stringent procedural requirements, particularly in preliminary ruling proceedings, where intervention is only permitted for parties already participating in the domestic proceedings. In direct actions before the CJEU, the circle of entities entitled to intervene is broader; however, admission requires demonstrating an interest in the outcome of the case, which must be both direct and current. By contrast, the ECtHR system is significantly more flexible: the President of the Court may authorize the participation of any interested person or organization, provided it serves the interests of justice, without requiring the intervener to prove victim status under the Convention. The article emphasizes that amicus curiae interventions contribute to the objectivity of the proceedings, ensure a comprehensive examination of the case, and enhance the quality of judicial reasoning. Their role—particularly before the ECtHR—is steadily expanding, thereby promoting stronger protection of human rights and the rule of law in Europe.
Artykuł analizuje rolę i znaczenie instytucji amicus curiae w postępowaniach przed Trybunałem Sprawiedliwości Unii Europejskiej (TSUE) oraz Europejskim Trybunałem Praw Człowieka (ETPCz). Przedstawia porównawczą charakterystykę regulacji prawnych, praktyki orzeczniczej oraz funkcji, jakie pełnią interwencje podmiotów trzecich w obu systemach. Wskazuje, że w TSUE możliwości udziału amicus curiae są ściśle ograniczone przepisami i wymagają spełnienia rygorystycznych przesłanek proceduralnych, zwłaszcza w postępowaniach prejudycjalnych, gdzie interwencja jest możliwa wyłącznie dla podmiotów już uczestniczących w postępowaniu krajowym. W postępowaniach bezpośrednich przed TSUE krąg podmiotów uprawnionych do interwencji jest szerszy, jednak wymaga wykazania interesu w rozstrzygnięciu sprawy, który musi być zarówno bezpośredni, jak i aktualny. Natomiast w ETPCz system jest znacznie bardziej elastyczny – Prezes Trybunału może dopuścić do udziału każdą zainteresowaną osobę lub organizację, jeśli leży to w interesie wymiaru sprawiedliwości, bez konieczności wykazywania statusu „ofiary” naruszenia praw konwencyjnych. Artykuł podkreśla, że interwencje amicus curiae przyczyniają się do obiektywizacji procesu, wszechstronnego rozpoznania sprawy oraz podniesienia jakości orzecznictwa, a ich rola – zwłaszcza w ETPCz – systematycznie rośnie, co sprzyja lepszej ochronie praw człowieka i praworządności w Europie.
 
Odpowiednie warunki techniczne i organizacyjne sądu jako podstawa do stosowania instytucji procesu cywilnego
This publication describes the role of specifying the court’s technical and organizational conditions in civil procedure law. The establishment of technical and organizational conditions for the court enables the filing of procedural documents via an electronic delivery system, the delivery of documents to an electronic delivery address or by posting the content of a document on an information portal, the preparation of minutes of a hearing (not exclusively written), and the organization of a remote hearing. These conditions therefore constitute a crucial element of the civil procedure. The absence of these conditions deprives a party of the above digital procedural rights, but does not eliminate the essence of procedural rights. A clause on technical and organizational conditions for the court provides a legally secure means of preventing the implementation of the IT solutions provided for in the law.
W publikacji opisano rolę wskazania w przepisach prawa postępowania cywilnego warunków technicznych i organizacyjnych sądu. Powstanie warunków technicznych i organizacyjnych sądu umożliwia wnoszenie pism procesowych za pośrednictwem systemu teleinformatycznego, dokonywanie doręczeń na adres do doręczeń elektronicznych lub poprzez umieszczenie treści pisma w portalu informacyjnym, sporządzenie protokołu posiedzenia niewyłącznie pisemnego, a także organizację posiedzenia zdalnego. Warunki te stanowią zatem istotny element przebiegu procesu cywilnego. Brak warunków pozbawia stronę postępowania powyższych cyfrowych uprawnień procesowych, ale nie unicestwia istoty praw procesowych. Klauzula warunków technicznych i organizacyjnych sądu stanowi bezpieczny prawnie sposób na niewdrożenie przewidzianych w prawie rozwiązań teleinformatycznych

The aim of this article is to summarize anti-corruption reforms in Ukraine from 2014 and conduct an attempt to examine their effectiveness using four international datasets: Corruption Perceptions Index, Control of Corruption indicator, Index of Public Integrity and Basel AML Index.

Identifying authorship of non-genuine writing by a forensic handwriting examiner
In this article, references to “writing” incorporate handwriting, numerals, initials, and signatures. Whilst the determination of the authenticity of writing, including signatures, is accepted as being within the typical skill set of forensic handwriting examiners (FHEs), the determination of authorship of any established non-genuine writing is less well accepted and can be viewed as contentious in a court of law in South Africa.
