Get PDFConsidering the warnings of the European Union for Spain to solve the normative dispersion on the taxation of waste, which undoubtedly influenced the enactment of the recent Tax on the Deposit of Waste in Landfills, Incineration and Co-incineration of Waste; the pressure from some Autonomous Communities to maintain their own taxes, as a condition for approving the Law on Waste and Polluted Soil for a Circular Economy, and the requirements of this Law for Local Entities to establish an economic instrument for waste generation, that will allow them to face the payment of the recent tax, the purpose of this paper is to detect and assess the challenges that arise from the application of the state tax at the community, autonomous, and local level.Considerando las advertencias de la Unión Europea para que España solucione la dispersión normativa sobre la imposición a los residuos, que sin dudas influyeron en el dictado del reciente Impuesto sobre el Depósito de Residuos en Vertederos, Incineración y Coincineración de Residuos; las presiones de algunas Comunidades Autónomas para mantener sus impuestos propios, como condición para aprobar la Ley de Residuos y Suelos Contaminados para una Economía Circular, y las exigencias de esta ley para que los Entes Locales establezcan un instrumento económico de pago por generación de residuos, que les permitirá afrontar el pago del reciente impuesto, el objetivo de este trabajo consiste en detectar y valorar los retos que se derivan de la aplicación del impuesto estatal en el ámbito comunitario, autonómico y local

El litigio climático estratégico y su impacto en la gobernanza de la migración climática
No full textThe legal framework governing the climate migration phenomenon has been defined as a “gaping legal hole”. Years of international negotiations have resulted in very little, mainly non-binding and vague statements or recommendations. This paper argues that while international negotiations on climate migration have been largely ineffective, some significant developments have been achieved through strategic climate litigation and the “gaping legal hole” has been narrowed, at least to a certain extent. This paper reviews several key cases and explains their relevance to, and importance for, the development of the regulation of climate migration.
El marco jurídico que rige el fenómeno de la migración climática se ha definido como un "vacío legal enorme". Años de negociaciones internacionales han dado como resultado muy poco, principalmente vagas declaraciones o recomendaciones no vinculantes. Este artículo argumenta que, si bien las negociaciones internacionales sobre la migración climática han sido en gran parte ineficaces, se han logrado avances significativos a través de litigios climáticos estratégicos y se ha reducido, al menos en cierta medida, el "vacío legal enorme". Este artículo revisa varios casos clave y explica su relevancia e importancia para el desarrollo de la regulación de la migración climática

Cooperative learning and pédagogies coopératives: two different conceptions of cooperative group work
Get PDFMoltes pedagogies i pràctiques educatives recomanen l’ús de la cooperació entre alumnes. Aquest article teòric intenta diferenciar dues de les pràctiques més utilitzades de dues concepcions de la cooperació escolar: el treball en grup cooperatiu de l’aprenentatge cooperatiu (cooperative learning, provinent del món anglosaxó) i el treball en grup (travail en groupe) de les pedagogies cooperatives (pédagogies coopératives, provinents del món francòfon). Mentre que l’aprenentatge cooperatiu prioritza més aviat el desenvolupament de les habilitats cooperatives (aprendre a cooperar) per a després cooperar per aprendre, les pédagogies coopératives es presenten de diverses formes a través de dispositius que majoritàriament busquen que els estudiants aprenguin cooperant. L’article consisteix a introduir el travail en groupe de les pédagogies coopératives, i a eliminar els possibles malentesos en referència al treball en grups cooperatius de l’aprenentatge cooperatiu. No es tracta de pràctiques cooperatives que xoquen o competeixen, són més aviat lògiques amb tradicions diferents, proposades per contribuir a l’aprenentatge i que presenten formes de complementarietat.Many pedagogies and educational practices recommend cooperation between students. This theoretical article tries to differentiate two of the most used practices from two conceptions of school cooperation: the "cooperative group work" of aprenentatge cooperatiu (cooperative learning, from the Anglo-Saxon world) and the "travail en groupe" (group work) of pédagogies coopératives (cooperative pedagogies, originating from the French world). While cooperative learning prioritizes the development of cooperative skills (learning to cooperate) and then cooperating to learn, cooperative pedagogies are presented in various forms through devices that mostly aim for students to learn cooperatively. The article introduces the “travail en groupe” of cooperative pedagogies, and tries to clear up any misunderstandings with reference to the "work in cooperative groups" of cooperative learning. These are not cooperative practices that clash or compete; rather they are logical practices from different traditions, which both contribute to learning and complement each other

Get PDFThis work notes the technical and legal implementation of the Riverbank Line legal institute (RL) in its function of delimiting the public water domain (PWD). Climate change has been affecting the behaviour of waters and the limits of the PWD, which warns about the possible outdatedness of the criteria for determining the RL and the consequent risk for people and property due to the effects of the waters. This study proposes: (i) present the theoretical bases and analysis of the RL functioning; (ii) confront the theoretical bases with a specific case through satellite images that allow evidence of the modifications to the PWD due to the effect of climate change; (iii) conclude with a series of inadequacies of the institute and reflections on the responsibility of the State for the lack of adaptation to the effects that climate change has on waters.El presente trabajo constata la implementación técnica y jurídica del instituto jurídico de Línea de Ribera (LR) en su función delimitante del dominio hídrico público (DHP). El cambio climático viene incidiendo en el comportamiento de las aguas y en los límites del DHP, lo cual alerta sobre la posible desactualización de los criterios para la determinación de la LR y el consecuente riesgo para personas y bienes por los efectos de las aguas. En este estudio se propone: (i) plantear las bases teóricas y el análisis del funcionamiento de la LR; (ii) confrontar las bases teóricas con un caso concreto mediante imágenes satelitales que permitan evidenciar las modificaciones al DHP por efecto del cambio climático; (iii) concluir con una serie de desaptabilidades del instituto y reflexiones sobre la responsabilidad del Estado por la falta de adaptación a los efectos que tiene el cambio climático sobre las aguas

Els vestits a les memòries de les missions de recerca de Palmira Jaquetti per a l’Obra del Cançoner Popular de Catalunya
Get PDFL’article se centra en la manera de vestir de la població catalana i les peces comunes que componen el vestit a partir de la informació continguda a les memòries de les missions de recerca de cançons que va fer Palmira Jaquetti (Barcelona, 21 de setembre de 1895 - Els Monjos, 8 de maig de 1963) per encàrrec de l’Obra del Cançoner Popular de Catalunya, en companyia de Maria Carbó, de Mercè Porta o d’Enric d’Aoust, entre el 1925 i el 1940. La informació es presenta agrupada en els apartats sobre els vestits de Palmira Jaquetti, els vestits dels homes, els vestits de les dones, els cabells, els vestits dels infants i la roba de la llar. Les memòries de les missions de recerca de Palmira Jaquetti constitueixen un testimoni rellevant de primera mà que documenta el canvi de manera de vestir entre 1926 i 1936, quan s’abandonen les peces d’ús habitual fins a finals del segle xix (calces, barretina, gec, gipó, etc.) i se substitueixen per altres que s’imposen (gorra, pantalons, brusa, etc.).This article focuses on the dressing style of the Catalan people and the common pieces of clothing described in the reports on the research missions for songs written by Palmira Jaquetti (Barcelona, 21st September 1895 - Els Monjos, 8th May 1963), commissioned by the ‘Obra del Cançoner Popular de Catalunya’, alongside Maria Carbó, Mercè Porta and Enric d’Aoust, between 1925 and 1940. The information is presented in various sections: Palmira Jaquetti’s clothes, men’s clothing, women’s clothing, hair, children’s clothing and household linen. The reports on Palmira Jaquetti’s research missions are a relevant first-hand testimony of the evolution of dressing style between 1926 and 1936, when the garments which had been standard up until the late nineteenth century (breeches, ‘barretina’, jacket, doublet, etc.) were replaced by others, which become more habitual (beret, trousers, blouse, etc.)
