Analisis Kriminologis terhadap Korelasi Masa Pandemi Covid-19 dengan Kejahatan Harta Benda dan Kejahatan Properti di Wilayah Polrestabes Kota Surabaya
Penelitian ini bertujuan untuk mengetahui bagaimanakah analisis kriminologis terhadap korelasi masa pandemi Covid-19 dengan kejahatan harta benda dan kejahatan properti di wilayah Polrestabes Kota Surabaya” akhir dari tulisan ini menyimpulkan tiga hal. Pertama bahwa data statistic trend kejahatan selama masa pandemic covid-19 di Polrestabes Wilayah Surabaya mengalami peningkata, jika difokuskan pada nomor (1) Curat (pencurian dengan pemberatan), (2) Curas (pencurian dengan kekerasan), dan (3) Curanmor (pencurian kendaraan bermotor). Kedua, terdapat berbagai faktor yang melatar belakangi tren naiknya kejahatan di masa Pandemic Covid-19 di wilayah Polrestabes Surabaya, antara lain: (1) faktor ekonomi, (2) lingkungan sosial pelaku, (3) lokasi dilakukannya kejahatan, (4) faktor mitasi, dan (50 faktor korban, dikarenakan semisal korban yang memberikan peluang untuk terjadinya kejahatan, atau kelemahan biologis dan psikologis dari korban. Ketiga, peningkatan angka kejahatan di Surabaya pada masa pandemi Covid-19 dengan mendasarkan pada aspek ekonomi sebagai faktor utama adalah tidak bisa dibenarkan, karena masih adanya faktor-faktor lain yang bisa memicu peningkatan tersebut
Efektivitas Program Penanganan Covid-19 dan Pemulihan Ekonomi Nasional (PC-PEN) ditinjau dari Ekonomi Pancasila
Abstract: The COVID-19 Pandemic that has lasted for 2 years has resulted in a weakening of the economy in Indonesia. The formation of various policy strategies by the Government to overcome these conditions has been carried out based on the values espoused in the Pancasila Economic System. This system is expected to provide solutions in dealing with challenges and conditions during the pandemic. This solution is realized in extraordinary steps, one of which is the Economic Recovery and Structural Reform which is in line with the Covid Handling and National Economic Recovery (PC-PEN) program. The theme of the Government Work Plan (RKP) in 2022 is Economic Recovery and Structural Reform which is in line with the PC-PEN program which has been ongoing since 2020. Based on Law No. 2 of 2020 concerning Stipulation of Perppu No. 1 of 2020 concerning State Finance Policy and Financial System Stability for Handling the Covid19 Pandemic and/or in Facing Threats That Endanger the National Economy and/or Financial System Stability Becomes Law, with the focus on the budget for the PC-PEN program as a form of economic recovery, widening the APBN deficit above 3 percent of GDP is allowed until 2022. The government through the fiscal and monetary authorities prepares strategic steps for a soft landing and exit strategy in financing the national economic recovery based on people's welfare. This writing was made with a qualitative approach that aims to analyze the effectiveness of the Covid-19 Handling and National Economic Recovery (PC-PEN) program after the COVID-19 Pandemic by referring to the Pancasila values.

Abstrak: Pandemi COVID-19 yang telah berlangsung selama 2 tahun mengakibatkan melemahnya perekonomian di Indonesia. Pembentukan berbagai strategi kebijakan oleh Pemerintah guna menanggulangi kondisi tersebut telah dilakukan dengan berdasar pada nilai-nilai yang dianut dalam Sistem Ekonomi Pancasila. Sistem ini diharapkan dapat memberikan solusi dalam menghadapi tantangan dan kondisi pada masa pandemi. Solusi tersebut diwujudkan dalam langkah-langkah extraordinary, salah satunya adalah Pemulihan Ekonomi dan Reformasi Struktural yang sejalan dengan program Penanganan Covid dan Pemulihan Ekonomi Nasional (PC-PEN). Adapun tema Rencana Kerja Pemerintah (RKP) di tahun 2022 adalah Pemulihan Ekonomi dan Reformasi Struktural yang sejalan dengan program PC-PEN yang telah berlangsung sejak 2020. Berdasarkan Undang-Undang Nomor 2 Tahun 2020 tentang Penetapan Perppu Nomor 1 Tahun 2020 tentang Kebijakan Keuangan Negara dan Stabilitas Sistem Keuangan untuk Penanganan Pandemi Covid-19 dan/atau dalam Rangka Menghadapi Ancaman yang Membahayakan Perekonomian Nasional dan/atau Stabilitas Sistem Keuangan Menjadi Undang-Undang, dengan difokuskannya anggaran dana untuk program PCPEN sebagai bentuk pemulihan ekonomi, maka pelebaran defisit APBN diatas 3 persen PDB diizinkan hingga tahun 2022. Pemerintah melalui otoritas fiskal dan moneter menyusun langkahlangkah strategis untuk soft landing and exit strategy dalam pembiayaan pemulihan ekonomi nasional yang dilandaskan pada kesejahteraan masyarakat. Penulisan ini dibuat dengan pendekatan kualitatif yang bertujuan untuk menganalisis efektivitas program Penanganan Covid dan Pemulihan Ekonomi Nasional (PC-PEN) pasca Pandemi COVID-19 dengan mengacu pada tata nilai Pancasila.

Construction of Wife's Permit on Polygamy Practice of Tablig Pilgrim's Mayangan Jogoroto Jombang
The focus of this study is the construction of the wife's license to practice polygamy on Tablig Mayangan Jombang Pilgrims. The purpose of the study is to find out the practice of polygamy Of Tablig Mayangan Pilgrims and the model of the wife's license to practice polygamy Tablig Pilgrims Mayangan. This type of field research is qualitative, using the analysis of normative legal and sociological approaches, with inductive reasoning and Data collection techniques using observation, documentation, and interviews. The results showed that polygamous behavior carried out by Tablig pilgrims is based on rational and sharia-laden aspects because polygamous behavior arises due to consideration of the struggle of da'wah as Tablig pilgrims. Polygamy is also considered worship for the husband and wife of Tablig worshippers. Therefore, the practice of polygamy of the husbands and husbands of Tablig pilgrims strictly follows the provisions stipulated in Law No.1 of 1974, article 4 paragraph 2 about committing the cause of polygamous marriage by obtaining the wife's permission. The construction model of the wife's license to practice polygamy Tablig pilgrims is the model of Wira'i, which considers prudence over the property of the third wife as a rich man to avoid disputes over the seizure of Gono - Gini property and so on
Tathawwur al-Mar’ah al-Muslimah fi al-Mujtama’ al-Libyi
Abstract: This article discusses the development of Muslim women in Libya. Women in society play a role that surpasses the role of men in the growth and development of society, as women are half of society. Women in the pre-Islamic era were a commodity that men owned, and they did not have any rights. At the beginning of Islam's advent, women's status changed a lot, and women became entitled to many rights and status. In addition to obtaining all their rights recognized by the Islamic religion and accompanied by Libyan legislation, Libyan women have incited the inclusion of women's rights through the ratification of international conventions and women's participation in all fields. Women's rights are their right to education, their right to choose a husband, their right to litigation, to defend their financial rights and to remedy injustice against them, women's right to work and to hold public office, women's right to judicial and litigation functions, women's right to political participation and community development, and women's right to health care.

الملخص: إن هذه المقالة تبحث تطور المرأة المسلمة في ليبيا. المرأة في المجتمع تلعب دورًا يتفوق على دور الرجل في نماء المجتمع وتطوره، فالمرأة هي نصف المجتمع. كانت المرأة في الجاهلية عبارة عن سلعة تخضع لملكية الرجل ، ولم تكن لها أي من الحقوق. وبداية ظهور الاسلام تغير وضع المرأة كثيرا واصبحت المرأة لها كثيرا من الحقوق واصبحت لها مكانة. إن المرأة الليبية اضافة الي حصولها على جميع حقوقها التي اقرها الدين الاسلامي وواكبتها التشريعات الليبية التطور فحرضت على تضمين حقوق المرأة من خلال التصديق على المواثيق الدولية ومشاركة المرأة في كل المجالات. فحقوق المرأة هي حقّها في التربية والتعليم، حقّها في اختيار الزوج وحقها في التَّقاضي والدِّفاع عن حُقوقها الماليّة ورفع الظلم عنها، حق المرأة في العمل و تولي الوظائف العامة، حق المرأة في تولي الوظائف القضائية والتقاضي، حق المرأة في المشاركة السياسية و تنمية المجتمع، وحق المرأة والرعاية الصحية.

The Problem of Violating The Law on Information and Electronic Transactions in Democracy Country
Law Number 11 of 2008 concerning Information and Electronic Transactions as amended by Law Number 19 of 2016 (ITE Law) is a law that regulates all matters concerning information technology applicable in Indonesia. As a democratic country, Indonesia upholds and respects freedom. In reality, the ITE Law creates many problems in the midst of society, because it is often used as a tool to limit freedom of speech and opinion. The results of this study indicate that the presence and implementation of the ITE Law which is considered to silence freedom of opinion and expression which is one of the pillars of democracy for social media users, is actually not all true. The existence of the ITE Law actually presses all parties to be more careful in their attitudes and expressions on social media. So that the negative impact or violation of the rights of freedom of others and other violations in the cyber world can be avoided. Then the freedom of opinion and expression can run well.
Konsep Mahram Bagi Haji Wanita Perspektif Fikih Syafi’i dan Regulasi Pemerintah Arab Saudi
Abstract: This study explains the concept of Mahram for Muslim women who wish to perform the pilgrimage. This research method uses a qualitative description approach. Collection of data from the sources of the books of the Shafi'i school of thought by reading, interpreting, observing, analyzing to be used as data for research purposes on the concept of mahram for women who perform the pilgrimage in Saudi Arabia in terms of the Shafi'i school. This type of thesis research is descriptive analysis and literature research. The process in this research found that, First, the government of Saudi Arabia allows women to go on pilgrimage without a mahram if a trusted travel agent shades the trip. Second, the application of the concept of mahram for women who perform the pilgrimage according to the Shafi'iyyah school is mandatory.

Abstrak: Penelitian ini menejelaskan konsep Mahram bagi perempuan muslimah yang hendak menunaikan ibadah haji. Metode penelitian ini menggunakan pendekatan deskripsi kualitatif. Pengumpulan data-data dari sumber kitab-kitab mazhab Syafi’i dengan membaca, mengartikan, mencermati, menelaah untuk dijadikan data keperluan penelitian penerapan law bagi wanita yang menunaikan ibadah haji di Arab Saudi ditinjau dari mazhab Syafi’i. Jenis penelitian skripsi ini adalah deskriptif analisis dan penelitian pustaka. Proses dalam penelitian ini menemukan bahwa, Pertama, pemerintah Arab Saudi memperbolehkan haji perempuan tanpa mahram jika perjalanannya dinaungi oleh travel agent yang terpercaya. Kedua, penerapan konsep mahram bagi wanita yang menunaikan ibadah haji menurut mazhab Shāfi’iyyah adalah wajib adanya.

Konsep Miranda Rule dalam Hukum Pidana di Indonesia Perspektif Maqasid al-Shari’ah
This article examines the application of the Miranda rule concept in Criminal Procedure Law in Indonesia which is viewed from the perspective of maqa>s}id ash-syari>'ah. The research method used in this research is normative law which is described in an explorative-qualitative manner. The results of the study explain that the existence of The Miranda Rule concept in the Criminal Procedure Code in Indonesia is not entirely included. It is limited only to Article 52 of the Criminal Code which gives freedom to suspects or defendants in giving information. The right to remain silent is not justified in the Criminal Procedure Code as in Mirnada Right. This is because in some cases there was coercion by the authorities which then led to an inaccurate decision by the court. So maqa>s}id ash-syari>'ah views the concept of the miranda rule of benefit to be applied in criminal law in Indonesia, especially the Criminal Procedure Code as a form of safeguarding human dignity and human rights. Mistakes or harm should be minimized or even eliminated when dealing with human life or human dignity. So the author concludes that it is necessary for lawmakers or in this case the legislature and the government to carry out legal reforms to the existence of the rights of suspects or defendants in procedural law in accordance with the objectives or benefits of a law.
Urgensi Peran Majelis Adat Aceh dalam Pengawasan Hukum Adat Istiadat di Aceh Barat: Studi Implementasi Qanun Nomor 5 tahun 2021 tentang Majelis Adat Aceh Kabupaten Aceh Barat
Article 18B number [2] of the 1945 Constitution states that the State recognizes and respects customary law community units and their traditional rights as long as they are still alive and in accordance with community development and the principles of the Unitary State of the Republic of Indonesia, which are regulated by law. Article 18B, the Constitution provides the basis for the establishment of customary institutions as part of the policy for implementing regional autonomy in Aceh. Included in the Aceh autonomy policy is the establishment of customary institutions, including the Acehnese traditional assembly. the existence of the Aceh Customary Council, has been regulated in Chapter XIII of the Customary Institution Article 98 of Law Number 11 of 2006 concerning the Government of Aceh. In the process of monitoring the performance of the Aceh Customary Council, the Aceh Barat Regency has its own role in carrying out their duties and authorities as stipulated in Article 49 of the West Aceh Regency Qanun Number 5 of 2021 concerning the Aceh Customary Council, that the Aceh Regency Customary Council fosters and supervises the implementation of adat. based on Islam in the life of the people of West Aceh
Peran Perbankan Syari’ah Dalam Perkembangan Perekonomian Di Indonesia
Abstract: The existence of institutions and all the rules in which there are matters of money in the running of finance in the country, have become the most important foundation and guidance in accelerating the speed of development of a country, especially in terms of the economy[1]. Indonesia is a country with most people embracing Islam, certainly wants a mechanism as a financial regulator. while avoiding the interest system in banking. Islam embodies the basis of sharia trading. Islamic banks appear as an answer about the cons of usury and interest in banking.[2] So, therefore, Indonesian Muslims who want their financial operations in banks to avoid usury, do not need to worry anymore with the existence of Islamic banks or Islamic banks. The banking sector is important as a link between capital and the real results that are in the hands of capital owners. The first use of banking in a large economy must be aimed at what ways that money can be used properly as a ranking of the economy. The existence of Islamic banks cannot be separated from the plummet of the economy which was initially seen and called the monetary crisis.[3] Islamic Bank is a bank that in running its finances, leaving all the problems of usury. In this case, the interest that is considered as usury is a challenge in these times. Islamic finance exists, based on two reasons. Due to the prohibition of taking usury in it. And because of financial transactions that have it in it, is considered to have some shortcomings.[4]

Abstrak: Keberadaan lembaga dan segala aturan yang didalamnya terdapat urusan uang dalam berjalannya keuangan negara, telah menjadi landasan dan pedoman terpenting dalam mempercepat laju pembangunan suatu negara, khususnya dalam hal perekonomian. Indonesia sebagai negara yang sebagian besar penduduknya memeluk agama Islam, tentunya menginginkan suatu mekanisme sebagai pengatur keuangan. sekaligus menghindari sistem bunga dalam perbankan. Islam mewujudkan dasar perdagangan syariah. Bank syariah muncul sebagai jawaban atas kontra riba dan bunga perbankan. Maka dari itu, umat Islam Indonesia yang ingin operasional keuangannya di bank terhindar dari riba, tidak perlu khawatir lagi dengan keberadaan bank syariah atau bank syariah. Sektor perbankan penting sebagai penghubung antara modal dengan hasil riil yang berada di tangan pemilik modal. Penggunaan pertama perbankan dalam ekonomi besar harus diarahkan pada cara apa agar uang dapat digunakan dengan benar sebagai peringkat ekonomi. Keberadaan bank syariah tidak lepas dari anjloknya perekonomian yang awalnya terlihat dan disebut dengan krisis moneter. Bank syariah adalah bank yang dalam menjalankan keuangannya meninggalkan segala permasalahan riba. Dalam hal ini, bunga yang dianggap riba menjadi tantangan di masa sekarang. Keuangan Islam ada, berdasarkan dua alasan. Karena larangan mengambil riba di dalamnya. Dan karena transaksi keuangan yang ada di dalamnya, dianggap memiliki beberapa kekurangan.

Ragam Alasan Perilaku Hukum Dalam Pernikahan di Masa Covid-19 (Studi Kasus Desa Denanyar Kabupaten Jombang
Abstract:
This study discusses the various reasons for the legal behavior of the people of Denanyar Jombang when carrying out marriages during the Covid-19 period. Given that several policies regulate marriage during the Covid-19 period, such as Circulars, namely; P-006/DJ.III/Hk.00.7/06/2020,P-001/DJ.III/Hk.007/07/2021, and 700/415.10.1.3/2020. The problem that arises is that not all people can understand properly and completely the policies issued by the government, on the one hand, the desire to remain married cannot be rejected. By using the sociology of law approach by carrying out the grounded theory of social action initiated by Max Weber, we conclude that there are various reasons why the people of Denanyar Jombang continue to carry out marriages during the Covid-19 period, which is shown in the legal behavior taken by the community. Reading the theory of social action can be inferred and reduced to the presence of effectual action, traditional action, an act of value rationality, and an act of value rationality as the basic foundation of the Denanyar community in their action.

Abstrak: Kajian ini membahas mengenai ragam alasan perilaku hukum masyarakat Denanyar Jombang ketika melaksanakan pernikahan di masa Covid-19. Mengingat adanya beberapa kebijakan yang mengatur tentang pernikahan di masa Covid-19 seperti Surat Edaran yaitu; Surat Edaran Nomor:P-006/DJ.III/Hk.00.7/06/2020, Surat Edaran Nomor: P-001/DJ.III/Hk.007/07/2021, dan Surat Edaran Bupati Jombang Nomor: 700/415.10.1.3/2020. Problem yang muncul adalah tidak semua masyarakat mampu memahami secara baik dan utuh kebijakan yang dikeluarkan oleh pemerintah, pada satu sisi keinginan untuk tetap menikah tidak bisa ditolak. Dengan menggunakan pendekatan sosiologi hukum dengan menjalankan grounded theory of social action yang digagas oleh Max Weber sampai kepada kesimpulan bahwa terdapat berbagai ragam alasan masyarakat Denanyar Jombang tetap melaksanakan pernikahan di masa Covid-19 yang ditunjukan pada perilaku hukum yang diambil oleh masyarakat. Melalui pembacaan teori perilaku sosial dapat diinferensikan dan direduksi adanya affectual action, traditional action, an act of value rationality, dan an act of value rationality sebagai landasan pokok masyarakat Denanyar dalam berperilaku.
