KEBIJAKAN POLSEK TANDES SURABAYA BAGI KEHARMONISAN RUMAH TANGGA TAHANAN PERSPEKTIF MASLAHAH MURSALAH
This is a field research that aims to find out the policies of the district police of Tandes, Surabaya for the harmony of household prisoners and the analysis of maslahah mursalah on those policies. The result of the research concludes that the policies of the district police of Tandes, Surabaya allow prisoners to meet their families on terms that have been agreed by prisoners and police officers of Tandes, Surabaya. It is an effort to develop cases that are being experienced by prisoners as well as stabilizing emotional condition of the prisoners who have already married. Such policies are in line with maqasid al-shariah and maslahah mursalah concept. All that can be seen from the fulfillment of the five basic guarantees of life (salvation of religion, soul, mind, descendant, and possession) and fulfilled the conditions that exist in maslahah mursalah. It’s just that the government’s attention to the rights and obligations of prisoners who have already married is felt to be lack. Therefore, the government should pay more attention to the rights of the people in making policy. For the people, they should pay attention to the fate of their families who become prisoners, not to be ostracized because it is not impossible they want to be better than ever.Tulisan ini merupakan hasil dari penelitian lapangan yang bertujuan untuk mengetahui bagaimana kebijakan Polsek Tandes Surabaya bagi keharmonisan rumah tangga tahanan? dan bagaimana analisis maslahah mursalah atas kebijakan Polsek Tandes Surabaya tersebut? Hasil penelitian menyimpulkan bahwa Kebijakan Polsek Tandes Surabaya membolehkan tahanan bertemu dengan keluarganya dengan syarat yang telah disepakati oleh tahanan dan petugas Polsek Tandes Surabaya merupakan upaya pengembangan kasus yang sedang dialami tahanan serta menstabilkan emosional tahanan yang sudah berkeluarga. Adapun bentuk kebijakan Polsek Tandes Surabaya tersebut telah sejalan dengan maqashidus syari’ah dan konsep maslahah mursalah. Semua itu dapat dilihat dari terpenuhinya lima jaminan dasar kehidupan (keselamatan agama, jiwa, akal, keturunan dan harta) serta terpenuhi syarat-syarat yang ada dalam maslahah mursalah. Hanya saja perhatian pemerintah akan hak dan kewajiban tahanan yang sudah berkeluarga dirasakan masih kurang, sebab di satu sisi tahanan yang berkeluarga mempunyai kewajiban yang tidak bisa dikesampingkan. Oleh karena itu, pemerintah sepatutnya lebih memperhatikan hak masyarakat dalam membuat sebuah kebijakan dan bagi masyarakat, hendaknya memperhatikan nasib keluarganya yang menjadi tahanan, jangan sampai dikucilkan karena bukan tidak mungkin mereka ingin menjadi lebih baik dari sebelumnya.
Perkawinan Lansia di Kecamatan Socah Kabupaten Bangkalan Perspektif Maqasid Al-Shari’ah
This is a field research that analyzes the marriage suitability of elderly people in Socah, Bangkalan under the theory of maqasid shari'ah. The elderly marriage is officially conducted at KUA (Religious Affairs Office) of Socah for different reasons, namely: on the basis of coercion to the bride so that the family relationship does not break up, resulting in reluctance, on the basis of family compassion and encouragement. It is because the bride is an old maid and is his own niece on the basis of mutual love, avoid immorality and seek peace of life in old age. All couples can fulfill both material and non-material obligations, although not as perfect as a young couple. Some husbands do not want to have children for fear of not being able to support even though in this case the wife really wants it. Thus, the marriage of the elderly in Socah is sometimes appropriate and not in accordance with the maqasid shari'ah. The suitability in question is in terms of hifz al-din (protecting religion) and hifz al-mal (protecting wealth), while its inadequacies are in terms of hifz al-nasl (protecting offspring), because of their desires to have offspring and in terms of hifz al-nafs (protecting soul), and hifz al-'aql (protecting ratio), because of differences in descent have the negative effect on family disharmony that can interfere with the soul and mind. In this case, an intense dialogue and approach must be made to the couple to be more open and understand each other
Analisis Istihsan Atas Pertimbangan Hakim Terhadap Saksi Non Muslim Pada Perkara Perceraian
Verification in the Religion Court is important because the court upholds law and justice based on no other evidence, including in civil cases, such as divorce. One of the proofs is a witness testimony. The majority of Islamic law experts like Imam Malik, Imam al-Shafi'i or Imam Ahmad ibn Hanbal agreed that a witness must be a Muslim, so that in a case witnessed by someone who is not Muslim, his testimony is deemed invalid. This article wants to see a case of establishing non-Muslim witnesses in a divorce case in the Sidoarjo Religious Court by using descriptive analysis, which is systematically describing the facts and characteristics of the object studied by the later analysis and using the istihsan theory. Based on the analysis, the Sidoarjo Religious Court in Case No. 1889/Pdt.G/2017/PA.Sda. has received the status of a non-Muslim witness because it has fulfilled formal requirements in a civil procedure law. In line with istihsan theory, non-Muslim testimony is permissible because of the development of the present era and its greater difficulties so that it can be accepted in religious courts. If it is forced that witnesses to be Muslim, then justice seekers will be harmed and have difficulties
Peranan Koperasi Syariah dalam Mengatasi Kemiskinan di Kota Surabaya
This article discusses sharia cooperatives and their role in overcoming poverty in the city of Surabaya. The city of Surabaya is the capital of the province of East Java, the largest and most populous city in East Java. Poverty is a problem that the city government of Surabaya always looks for a solution to. Various programs have been made, including through training, improvement of cooperatives, including Sharia cooperatives. This article is the result of a literature review and is qualitative in nature. The data collected through the literature were analyzed descriptively. The results of the study concluded that the Surabaya government made programs to alleviate poverty, including developing sharia cooperatives. With the existence of Islamic cooperatives, people can manage their funds and develop their businesses through Islamic cooperatives. Even though poverty cannot be eradicated, this effort is one way that can help prosper the community and help overcome existing poverty
Perilaku Konsumsi Santri Al-Jihad Surabaya ditinjau dari Perspektif Ekonomi Islam
This article discusses the consumption behavior of students at Pondok al-Jihad Surabaya. Consumption is a human need that is vital for survival, without eating humans cannot move properly and socialize with others. The main purpose of consumption is to worship Allah SWT. Consumption must be based on the principles of the Qur'an and Hadith. This paper describes how many consumption characteristics the students have, who are also students of UIN Sunan Ampel. The data was conducted by interviewing 10 male and 10 female students. The data obtained were analyzed with the theory of consumer behavior in Islamic economics. The results of the study concluded that there were differences in consumption behavior between male and female students of Pondok al-Jihad Surabaya. The allowance for male students ranges from 500,000-1,000,000 rupiah, while the allowance for female students ranges from 900,000-1,700,000 rupiah. The money is used to meet basic needs, while the rest of the male students use it for coffee and cigarettes, while the female students use it for shopping, and if there is any leftover the money will be saved. Based on the Islamic economics, the consumption value of Pondok al-Jihad students is still reasonable, but for non-essential needs, the consumption should be reduced, such as the need for cigarettes, snacks, and shopping, so that they are not excessive because Islam prohibits excessive consumption
Gaji Guru Taman Pendidikan Al-Qur’an dalam Perspektif Ekonomi Syari’ah
Al-Qur'an Education Park (TPQ) is an educational institution that supports formal education in schools. The teacher as a component in teaching and learning activities has a very important role in determining the success of learning. The role of the TPQ teacher is not only to educate students so that they can read and write the Qur'an properly and correctly, but also so that students can live an Islamic life. The purpose of this journal is to find out more about the meaning of teachers and their role in education, and how Islamic economics views their welfare. This research was conducted through observation and interviews. The data obtained were analyzed using the Islamic economic approach. The results obtained from this study were that TPQ teachers received a monthly salary, the amount of which was adjusted to their respective TPQ. The salary received is still below the UMR standard. However, TPQ teachers are still enthusiastic about teaching because they teach TPQ because of their heart's calling and they simply want to practice their knowledge by ignoring the value of the material they will get. Based on Islamic economics, the TPQ salary is related to the concept of ujrah and ijarah. They are entitled to a salary, and it is better if the salary can be increased again so that it is equal to their profession and so that TPQ education will be of higher quality
Analisis Fiqh Jinâyah terhadap Sanksi Pengemis di Muka Umum di Kota Surabaya
Abstract: This article discusses the prohibition of public begging in Surabaya. According to article 504 of the Penal Code and Surabaya municipality by law no. 17/2009. In Surabaya, beggars who have been considered breaching the law operate in street intersections. This is considered breaching of public order. Thus, this is not a crime but a minor violation of the law. They are arrested for one day and brought to social department for briefings. The punishment is so lenient that it can be called as a pardon. In Islamic criminal law perspective, such a leniency is allowed as long as not erasing punishment altogether.

Abstrak: Artikel ini membahas tentang fikih jinâyah terhadap laragan mengemis di muka umum di kota Surabaya. Larangan engemis di muka umum diatur dalam Pasal 504 KUHP Junto Perda Tahun 2009 Juncto Perda No. 17 Tahun 2009 di Surabaya tentang pengemis di muka umum. Pengemis yang melanggar ketertiban umum adalah pengemis yang beroperasi dan mangkal di berbagai perempatan jalan, mereka akan dimasukkan ke dalam penjara untuk 1 hari saja dan setelah itu akan dikembalikan kembali ke dinas sosial untuk mendapatkan pembinaan. Dengan hukuman 1 hari tadi diharapkan dapat menjadikan efek jera kepada para pengemis sehingga di kemudian hari mereka tidak mengulangi kembali, kemudian melihat hukuman yang didapat dari pengemis yang mengemis di muka umum dengan melanggar ketertiban umum, maka hukuman tersebut masuk dalam katgegori pemaaf dikarenakan salah satu sebab hapusnya hukuman ta’zîr yakni para pengemis hanya mendapat hukuman selama 1 hari, tetapi tidak menghapuskan seluruhnya.

Fenomenologi Islamisme dan Terorisme
Abstract: There are three mainstream theories which elucidate the relationship between Islamic doctrine and political actions that lead to terrorism acts of its believers: Firstly: they who believe that justification of violence and terror acts is inherent products of religious doctrine. Secondly: those who view that terrorism is profane matters, unrelated to religious doctrine whatsoever. Thirdly, opinion that state that terrorism is syncretism as well as interrelative modification between politics and religion. Although the three theories differ in concluding the role of religion in terrorism, they share some analytical approach, which put religion as doctrine and politics as political drive in every terrorism act. To measure the more dominant motive of the two can be done using two perspectives of phenomenology. First perspective views islamist movement as a form of anti modernism which emerges as a cure for western-type of modernization. The west is the enemy. Second perspective concludes that the movement is phenomenon of manifestation as well as response to post-modern development. Islamism emerges as something different, echoing cultural autonomy, alternative political entity as well as moral ideological critique of secularism brought by modernism.
Key words: Islamism, terrorism, phenomenologyAbstrak: Terdapat tiga pendapat mainstream yang memberikan ulasan teoritis mengenai antara doktrin Islam atau faktor politik, yang melatarbelakangi aksi-aksi terorisme dari kelompok berlatar belakang muslim: Pertama, mereka yang percaya bahwa pembenaran terhadap aksi-aksi kekerasan hingga terorisme adalah produk inheren dari doktrin keagamaan. Kedua, mereka yang memandang bahwa terorisme adalah perkara yang profan, sama sekali tak ada hubungannya dengan agama. Ketiga, pendapat yang menyebutkan bahwa terorisme adalah sinkretisme serta modifikasi interrelatif antara politik dan agama. Meski berbeda dalam menyimpulkan peran agama dalam terorisme, tiga teori mainstream di atas mempunyai keidentikkan dalam pendekatan analisis, yaitu; dimensi agama sebagai doktrin dan dimensi politis yang inheren menyertai setiap aksi tindakan terorisme. Menakar motif mana yang paling dominan dalam setiap aksi Islamisme dapat berangkat dari tinjauan fenomenologis. Terdapat dua perspektif umum yang dipakai oleh para pengamat dalam melakukan pendekatan studi terhadap fenomena gerakan Islamisme ini. Menurut perspektif pertama, gerakan Islamisme adalah sebuah bentuk anti-modernitas yang muncul sebagai respon antidote terhadap pembaharuan yang dihasilkan oleh Barat. Berdasarkan perspektif ini, Islamisme muncul dengan langsung menempatkan dirinya sebagai musuh dari Barat yang menjadi pionir dari modernisasi. Perspektif kedua menyimpulkan bahwa gerakan tersebut adalah fenomena manifestasi dan sekaligus juga respon terhadap perkembangan post-modernitas. Menurut perspektif ini, Islamisme muncul sebagai sesuatu yang menjadi pembeda, menyuarakan otonomi kultural, entitas politis alternatif serta kritik moralitas idologis terhadap sekularisme modernitas.

Konsep Negara dan Relevansi terhadap NKRI Perspektif Emha Ainun Nadjib
State and power are two things that cannot be separated from one another. Substantially, both have the main purpose of creating prosperity for the people. In fact, the Indonesia's democratic system seems to be imperfect. Therefore, it needs to have reorientation and revitalization of the concept in its implementation. The thought of Muhammad Ainun Najib (Cak Nun), in this context, is an alternative offer, such as; first, there is a distinction between state institutions and government institutions, between the head of state and the head of government, for the sake of creating political stability and the administration of the good governance; second, the criteria of a leader need to have scientific quality that is not only knowing issues of the personal and group interests, but also understanding in detail about the life of the regions; third, Indonesia should have five national pillars such as people, Indonesian National Army (TNI), intellectuals, customs and culture, as well as spiritual powers. Those five pillars are supposed to support the upright and the solid state of the Republic of Indonesia.Negara dan kekuasaan merupakan dua hal yang tidak dapat dipisahkan satu sama lain, yang secara substansial mempunyai tujuan utama menciptakan kesejahteraan bagi rakyatnya. Sistem demokrasi Indonesia terbukti masih belum sempurna, perlu ada reorientasi, dan revitalisasi konsep dalam pelaksanaanya. Pemikiran Muhammad Ainun Najib (Cak Nun) dalam konteks ini menjadi alternatif yang dapat ditawarkan misalnya; pertama, adanya pembedaan antara lembaga negara dan lembaga pemerintah, antara kepala Negara dan kepala pemerintahan, demi terciptanya kestabilan politik dan penyelenggaraan pemerintahan yang baik dalam suatu negara; kedua, kriteria seorang pemimpin perlu memiliki kualitas keilmuan yang tidak hanya sekedar mengetahui persoalan yang bersifat kepentingan pribadi dan golongan, tapi wajib memahami secara rinci tentang kehidupan di wilayahnya; ketiga, Indonesia seharusnya memiliki lima pilar kebangsaan seperti rakyat, TNI, Intelektual, adat dan budaya, dan kekuatan spiritual yang menopang tegak dan kokohnya Negara Kesatuan Republik Indonesia yang tata tentren kerta raharja
Akibat Hukum Protokol Notaris yang Tidak Diserahkan oleh Ahli Waris kepada Notaris Lain
In the notary science known as the "Notary Protocol", is the State Archive which must be kept and maintained by a notary. Once the importance of the storage and security of the notarial protocol, to the notary who has died, there is an obligation of the heir to inform and submit notary protocol to the Regional Supervisory Board (Majelis Pengawas Daerah/MPD), then the Regional Supervisory Board (MPD) designates another notary as the notary receiver of the protocol to receive and store the notary protocol. Notary protocols which are not submitted to other notaries result in harm to the parties, especially if they are a problem and need to be verified in court by the parties or parties concerned. The authority of the Regional Supervisory Board (MPD) is to request a notary protocol to the heirs of a notary who has died.Dalam bidang kenotariatan dikenal istilah “Protokol Notarisâ€, yaitu Arsip Negara yang harus disimpan dan dipelihara oleh notaris. Begitu pentingnya penyimpanan dan keamanan protokol notaris, maka terhadap notaris yang meninggal dunia, terdapat kewajiban ahli waris untuk memberitahukan dan menyerahkan protokol notaris kepada Majelis Pengawas Daerah (MPD), selanjutnya Majelis Pengawas Daerah (MPD) menunjuk notaris lain sebagai notaris penerima protokol untuk menerima dan menyimpan protokol notaris tersebut. Protokol notaris yang tidak diserahkan kepada notaris lain berakibat kerugian pada para pihak terutama bila akta tersebut bermasalah dan diperlukan pembuktian di pengadilan oleh para pihak atau pihak-pihak yang terkait.
