    Kedudukan dan Kewenangan Dewan Pertimbangan Presiden dalam Tinjauan Fiqh Siyasah

    This paper aims to find out the perspective of Fiqh Siyasah on the position and authority of the Presidential Advisory Council (Watimpres) under Constitutional Law in Indonesia. From the results of this study, it can be concluded that the Presidential Advisory Council is domiciled in the office of the President because it is part of the power vested on the state government and is responsible to the President. Presidential Advisory Council is authorized to provide advice and consideration to the President, whether requested or not. Every member of the Presidential Advisory Council can give advice and consideration to the President. Watimpres is not permitted to provide information, statements, and/or disseminate the contents of advice and consideration to any party. In the QS. Ali Imran (3): 104 implicitly outlines the existence of an advisory body in the community. Ahl al-Halli wa al-’Aqdi is not under the caliphate and is accountable for the caliph. The responsibility to give advice and consideration to the President based on the Islamic notion of amar ma'ruf nahi munkar comes under the QS. Ali Imran (2): 104, 110, and 114. Besides, the Prophet Muhammad has ordered to convey the truth even though it was bitter for those who delivered it

    This paper aims to find out: (1) how is the application of financing products of mura>bah}ah BMT "Mandiri Ukhuwah Persada" East Java ?; and (2) how is the analysis of mura>bah}ah financing products in increasing customer income at the "Mandiri Ukhuwah Persada" BMT in East Java? At the end of this paper, the author concludes two things. First, in its application, the financing product of mura>bah}ah in BMT "Mandiri Ukhuwah Persada" is considered to be incompatible with the provisions in the fatwa DSN, because the product is mura>bah}ah in BMT "Mandiri Ukhuwah Persada" uses the contract mura>bah}ah bi al-kala>m, in which the BMT authorizes the customer to purchase the goods on behalf of the customer and the contract for>bah}ah bi al-kala>m is done verbally. YOUNG BMT only applies the principle of trust to customers and there is no supervision conducted by BMT. Second, mura>bah}ah financing products provided to the public, especially traders who lack capital, so they have no difficulty in finding loans. Because with the increase in capital, the business has also progressed, namely an increase in revenue, production and performance.Tulisan ini bertujuan untuk mengetahui: (1) bagaimana aplikasi produk pembiayaan mura>bah}ah pada BMT “Mandiri Ukhuwah Persada” Jawa Timur?; dan (2) bagaimana analisis produk pembiayaan mura>bah}ah dalam meningkatkan pendapatan nasabah pada BMT “Mandiri Ukhuwah Persada” Jawa Timur? Di akhir tulisan ini, penulisa menyimpulkan dua hal. Pertama, dalam aplikasinya, produk pembiayaan mura>bah}ah pada BMT “Mandiri Ukhuwah Persada” dianggap kurang sesuai dengan ketentuan-ketentuan dalam fatwa DSN,  disebabkan karena produk mura>bah}ah pada BMT “Mandiri Ukhuwah Persada” menggunakan akad mura>bah}ah bi al-kala>m, yang mana pihak BMT memberi kuasa kepada nasabah untuk membeli barang tersebut atas nama nasabah dan akad mura>bah}ah bi al-kala>m tersebut dilakukan secara lisan. BMT MUDA hanya menerapkan asas kepercayaan kepada nasabah dan tidak ada pengawasan yang dilakukan oleh pihak BMT. Kedua, Produk pembiayaan mura>bah}ah yang diberikan pada masyarakat khususnya para pedagang yang kekurangan modal, sehingga mereka tidak kesulitan untuk mencari pinjaman. Karena dengan bertambahnya modal, usaha pun telah mengalami kemajuan yakni adanya peningkatan dalam hal pendapatan, produksi dan kinerjanya

    Most of the Criminal Laws implemented in Indonesia come from the provisions contained in the Penal Code inherited from the Netherlands with some amendments. Although its coverage, several criminal laws are regulated outside the Penal Code. It was often heard that there are efforts to revise the Penal Code through the Criminal Code Bill, however, Indonesia has not yet succeeded in passing the Criminal Code Bill. One input in the reform of the Criminal Code Bill is its adaptation to the development of the community, its adjustment with the norms of community that is derived from religious teachings. In the Criminal Code Bill aside from being a codification of all rules related to crime, it is also expected to further strengthen the existence of Islamic criminal law through the values ??of justice, equality, and utility. These values ??are the essence of Islamic Criminal Law through understanding the concept of "qat'iy and dhanny". Even though the guidelines and references used are a positive legal system, the essence contained is in accord with the values ??of Islamic Criminal Law.   Abstrak: Sebagian besar Hukum Pidana yang berlaku di Indonesia berasal dari ketentuan yang ada di dalam KUHP yang merupakan hukum pidana warisan Belanda dengan beberapa perubahan ketentuannya, meskipun begitu ada beberapa ketentuan pidana yang berlaku di Indonesia yang diatur diluar KUHP. Sering terdengar bagi kita bahwa terdapat upaya untuk merevisi KUHP melalui RUU KUHP, Akan tetapi Indonesia sampai saat ini belum berhasil mengesahkan RUU KUHP tersebut. Salah satu masukan dalam penyempurnaan RUU KUHP tersebut adalah dengan menyesuaikannya terhadap perkembangan kondisi masyarakat serta memasukkan norma-norma yang berkembang dan berlaku dimasyarakat, dimana sebagian besar norma-norma tersebut berasal dari nilai ajaran agama. Dalam RUU KUHP disamping sebagai kodifikasi seluruh aturan terkait dengan pidana juga diharapkan semakin memperkuat eksistensi hukum pidana Islam melalui nilai-nilai keadilan, kesetaraan, persamaan serta kemaslahatan. Nilai-nilai tersebut merupakan esensi dari Hukum Pidana Islam melalui pemahaman konsep “qat’iy dan dhanny”. Sehingga meskipun pedoman/acuan yang dipakai dalam system hukum nasional di Indonesia merupakan hukum positif perundang-undangan, akan tetapi didalamnya terdapat esensi nilai-nilai Hukum Pidana Islam

    Abstract: Covid-19 pandemic outbreak is a new phenomenon for Indonesian Government. Although Indonesia already has regulations, The 2018 Health Quarantine Act Number 6. However, the law requires government regulations to be implemented. Based on this, President issued The 2020 Government Regulation Number 21, as a legal basis for the enactment of Large-Scale Social Restrictions. However, formally and materially, many problems on The 2020 Government Regulation Number 21. In addition, the material regulated in Government Regulations does not answer the questions contained on The 2018 Health Quarantine Act Number 6. Therefore, this article wants to answer questions related to how the juridical analysis of The 2020 Government Regulation Number 21 in the perspective of legislation. The method  of research in this article is normative juridical by analyzing a number of laws and regulations. The conclusion in this article is that The 2020 Government Regulation Number 21 does not meet the minimum requirements as a implementing regulation, it is necessary to make a new government regulation to replace it.   Abstrak: Wabah pandemi Covid-19 merupakan fenomena baru bagi Pemerintah Indonesia. Meskipun pada hakikatnya, Indonesia telah mempunyai regulasi yang mengatur hal tersebut yaitu Undang-Undang Nomor 6 Tahun 2018 tentang Kekarantinaan Kesehatan. Akan tetapi, Undang-Undang tersebut memerlukan peraturan pemerintah untuk dapat dilaksanakan. Berdasarkan hal tersebutlah, Presiden kemudian menerbitkan Peraturan Pemerintah Nomor 21 Tahun 2020 sebagai landasan hukum diberlakukannya Pembatasan Sosial Berskala Besar. Namun, secara formil maupun materiil, Peraturan Pemerintah Nomor 21 Tahun 2020 menyimpan banyak persoalan. Selain itu, materi yang diatur dalam Peraturan Pemerintah sama sekali belum menjawab pertanaan yang terdapat dalam Undang-Undang Nomor 6 Tahun 2018. Oleh karena itulah, artikel ini hendak menjawab pertanyaan terkait bagaimanakah analisis yuridis Peraturan Pemerintah Nomor 21 Tahun 2020 dalam perspektif ilmu perundang-undangan. Metode penelitian dalam artikel ini adalah yuridis normatif yaitu dengan menganalisis sejumlah peraturan perundang-undangan. Kesimpulan dalam artikel ini adalah Peraturan Pemerintah Nomor 21 Tahun 2020 belum memenuhi syarat minimal sebagai suatu peraturan pelaksana yang layak, oleh karena itulah perlu di buat peraturan pemerintah baru untuk menggantikannya

    This paper aims to obtain a comprehensive understanding of various legal instruments related to the environment through an understanding of environmental law from its historical aspects. The law evolves and progresses throughout the historical development of society and not legislated as a complete system of conduct from the first time it presented. This paper concludes several points; the first point is that the historical regulation of Environmental Law in Indonesia that can be classified into three periods; the Dutch East Indies period, the Japanese period, and the period after independence.     Human Rights are the basic rights of humans that inherent to them since they were born. As a constitutional state, Indonesia has legally recognized the existence of those regulations as mentioned in the 1945 Constitution of the Republic of Indonesia. On the other hand, as religion, Islam also has an expert theory or ahliyyah (the appropriateness of someone to act and take responsibility for his or her actions). The purpose of this paper is to find out the relevance of human rights to the expert theory or ahliyyah. By using descriptive normative analysis, it can be concluded that human rights and expert theory have relevance, where the theory of ahliyyah al-wujub had been given before someone was born and the theory of Ahliyyah al-ada’ has newly been given when they are capable or mature. In this case, human rights were given when he or she was born into the world. Of course, this connection is important because Indonesia makes Islamic law as one of the sources in the formation of legislation

    Hadith as the basis of Islamic law does not consist of all forms of hadith, even though its veracity has been shown by the Koran. The scholars' from among Muhaddithin, Usuliyyin, and Fuqaha', have formulated the basics of hadith hujjahan, namely al-hadith al-maqbulah (hadith accepted as a source of Islamic law) and al-hadith al-mardudah (a hadith that is rejected as a source of Islamic law). According to them, the hadith of al-Maqbul must be based on the principle of rejecting or accepting a hadith narration, that is, it must be narrated by a narrator who is 'adil and dabit, and in that hadith status there is no' illah al-qadihah (severe disability) and the narrator does not experience shudud (peculiar). Muhaddithi n takes the stance to accept all hadiths, both sahih, hasan and da'if to be practiced, except in a position that is not too weak (da'if). But that is not the attitude of Usuliyyin ', and Fuqaha', they took the basis of istinbat to the hadith that has the value of sahih or hasan which are both ma'mul bih (which can practice), although al-hadi th ghayr al-mutawatirah (a hadith not narrated by many narrators) and give benefits yaqin, and if ghayr ma'mul bih (cannot be practiced), then according to they are rejected as the basis of legal terms

The results showed that the public is currently still misusing social media to spread crime in cyberspace. Most of the perpetrators of cybercrime on social media will be caught by Law No.11 of 2008 concerning Electronic Information and Transactions (UU ITE), whether intentional or unintentional. The law should provide protection for internet users with good intentions, and provide firm action for perpetrators of cyber crime. However, the legal system has not solved all computer crimes over the Internet. Likewise in the investigation, there were many obstacles related to legal instruments, the ability of investigators, evidence, and computer forensic facilities.     Analisis Kritis Terhadap Fikih Perceraian Responsif Gender: Studi Penerapan Kaidah Maqasid al-Syari'ah

    This study discusses the application of maqasid al-shar'ah principles in the gender-responsive marriage Jurisprudence. The focus of this research is: how the principles of maqasid al-shar'ah could be used as a foundation and approach of Ijtihad? How is the application of maqasid al-shar'ah principles in the issue of gender-responsive marriage Jurisprudence? This research is a qualitative research, which is in the form of descriptive-analytical library research. The approach used is the philosophical approach. In this study it was found that there are four rules of maqasid al-shar'ah which are used as the basis for jihad. These norms was then applied in a gender-responsive divorce Jurisprudence. This research concludes, that the holder of divorce rights is male, but the divorce can be pronounced based on the court's decision so that the results are more objective. In addition, divorce must be done for certain reasons, such as the cause of a constant dispute that cannot be resolved. Therefore, divorce without cause and without dialogue with his wife, is prohibited because it gives the effect of harm especially to his wife and children
