    Analisis Maqasid Al-Shariah Terhadap Peran Pemerintah Kota Surabaya dalam Mewujudkan Kota Layak Anak

    The research entitled: "Maqasid al-Shari'ah Analysis of the Role of the Surabaya City Government in Realizing Child Friendly Cities" is a field research that aims to answer the question how the role of the Surabaya City Government in realizing Child Friendly Cities through established public policies from the perspective of the maq??id al-shar?'ah. Research data were collected using interview and documentation techniques and then analyzed using descriptive analysis techniques with a deductive mindset. The results of the study concluded that the Surabaya City Government was very active in realizing Child Friendly Cities through the protection and fulfillment of children's rights, which was clearly seen from the existence of various public policies that were established to support institutional strengthening and fulfillment of the five Child Friendly Cities clusters.The role of the Surabaya City Government is in accordance with the concept of maqasid al-shari'ah because the determination of public policy is based on the welfare of children. This is proven by the elements of hifz al-din and hifz al-nasl in the public policy regarding civil rights and freedom, family environment, and alternative protection. In addition, there are elements of hifz al-nafs and hifz al-aql in public policies regarding institutional strengthening and the five Child Friendly Cities clusters, although they are actually less than perfect due to the absence of the hifz al-mal elements in them

    Peluang dan Tantangan Kalender Islam Internasional Mohammad Ilyas

    Abstrak:         Keberadaan kalender Islam internasional sangat urgen, namun sampai saat ini belum ada metode dan kriteria yang mapan untuk dijadikan pedoman. Salah satu sarjana Muslim yang melakukan penelitian komprehensif untuk menemukan metode dan kriteria yang tepat adalah Mohammad Ilyas. Sistem kalender yang diusulkan Mohammad Ilyas memiliki dua unsur pokok yaitu: Pertama, hisab imkanu rukyat atau visibilitas hilal (crescent visibility); dan Kedua, Garis Tanggal Kamariah Antar Bangsa atau International Lunar Date Line (ILDL). Implementasi terwujudnya ILDL yang digagas oleh Mohammad Ilyas masih sangat sulit diterima oleh masyarakat. Hal ini dikarenakan permulaan garis-garis tanggal tersebut setiap bulannya berubah-ubah dengan menyesuaikan kedudukan atau posisi hilal di mana wilayah pertama kali terlihat (imkanu rukyat), sehingga tidak memberikan kepastian garis nol derajatnya. Masyarakat Islam juga belum mampu memisahkan pergantian hari dengan IDL yang digunakan pada kalender Masehi sehingga terjadi double standard perubahan hari. Bagi Mohammad Ilyas, tantangan dan hambatan menuju unifikasi kalender Islam internasional menjadi tanggung jawab ilmiah bagi kaum intelektual Islam, sehingga tidak mustahil jika Ilyas memberikan sebuah harapan pasti akan tercapai unifikasi kalender Islam internasional pada tahun 2020 M/ 1442 H. Kata Kunci:   Mohammad Ilyas, Kalender Islam Internasional, Peluang dan Tantangan   Abstract:        The existence of the international Islamic calendar is very urgent, but until now there is no established method and criteria to be used as guidelines. One of the Muslim scientists who conducted comprehensive research to find appropriate methods and criteria is Mohammad Ilyas. The calendar system proposed by Mohammad Ilyas has two main elements: First, imkanu rukyat or crescent visibility; and Second, the International Armed Date Line or the International Lunar Date Line (ILDL). Implementation of the realization of ILDL initiated by Mohammad Ilyas is still very difficult to be accepted by society. This is because the beginning of the date lines are changing each month by adjusting the position or position of the new hilal where the area first seen (imkanu rukyat), so as not to provide certainty zero degrees. The Islamic community also has not been able to separate the change of days with the IDL that is used on the Christian calendar so that there is a double standard day change. For Mohammad Ilyas the challenges and obstacles to the unification of the International Islamic Calendar became a scientific responsibility for Islamic intellectuals. So it is not impossible if Ilyas gave a hope would be achieved unification of International Islamic Calendar in 2020 M / 1442 H.     The opportunity to make a profit is the most important factor for investors who participate in capital market transactions. With the legal status of “PT”, this factor causes a violation of the principles of transparency and fairness in capital market transactions that have been potential to harm the rights of independent shareholders. In this study, the researcher will focus on the issue of how to identify the legal conflict of interest in the rights issue transaction conducted by PT CPRO and the implementation of the tender offer conducted by PT Philip Morris Indonesia for the remaining shares of PT HM Sampoerna Tbk. The type of research method that the researcher uses is a normative juridical study and by using a case approach. The results of this study are(1) Rights transactions carried out by CPRO, CPRO did not fully comply with existing regulations. (2) it can be seen that the acquisition that has occurred in PT. HM Sampoerna, Tbk did not cause much change, both in terms of marketing and for its employees. (3) the acquisition has made the rights of its employees more secure

    This article is a field research to answer the role of community leaders as mediators in the settlement of inheritance disputes in Wonosalam, Demak and how the legal power of resolving inheritance disputes through mediator community leaders in Wonosalam, Demak. Research data are collected through interviews and observations, then are analyzed with descriptive analytical techniques with inductive thought pattern. Wonosalam community leaders have an important role in the settlement of inheritance disputes, namely as a mediator, including: opening and leading the mediation process, explaining and determining the heirs' parts, providing the best advice and solutions, deciding and determining what has been agreed by the parties to the dispute, preventing the emergence of even bigger disputes, and still maintaining harmony and harmony in social life. The results of the settlement of inheritance disputes through mediators of community leaders in Wonosalam do not have an enforceable legal force, because they are not confirmed by making a peace certificate or a peace agreement letter, which is contained in: article 27 of the Supreme Court Regulation No. 1 of 2016 concerning Mediation Procedures and article 1851 Civil Code. Nevertheless, the determination of community leaders as mediators in the settlement of inheritance disputes is obeyed and implemented by the people of Wonosalam

    This article discusses the theory of mashlahah mursalah on the Multi Level Marketing Planning Generation Program (MLM Genre) of the Family Planning and Women's Empowerment Office in Pasuruan Regency. From the research on the MLM Genre program organized by the Family Planning and Women's Empowerment Office of Pasuruan Regency, it can be concluded: First, this program has not been implemented properly because the program should have been implemented in every sub-district in Pasuruan Regency, which amounted to twenty-four Districts, but for now it is still running in five districts only. Among the factors is the lack of awareness of the Pasuruan community to participate in running the program. Second, the Multi Level Marketing Planning Generation Program organized by the Family Planning and Women's Empowerment Office of Pasuruan Regency in terms of activities and material delivered by the Family Planning and Women's Empowerment Office of Pasuruan Regency provides benefits for adolescents and the surrounding community who will get married. In the perspective of the maslahah mursalah, it has fulfilled the requirements of the mashlahah, and does not contradict to the texts, real, general in nature, and has many benefits

    This paper discusses the implementation of marriage with two different contracts and trustees at the Office of Religious Affairs (KUA) in Wonokromo, Surabaya. The data in this article is collected by documentation and interview with the head of KUA of Wonokromo and witnesses to marriage and analyzed using descriptive analysis technique. In the case of this marriage, the first marriage contract uses a nasab guardian because the marriage officer (penghulu) knows his nasab guardian is Muslim. Then the second contract uses the judge guardian because in the bride’s family card, the guardian is Christian. Even though it has been married by a nasab guardian, the head of KUA of Wonokromo listed in the marriage certificate is the judge guardian that the supporting documents in the marriage require the use of a judge’s guardian. This implementation is included in the maslahah mulghah because the use of the contract with the judge guardian is rejected by the proposition that he knew that the nasab guardian was Muslim. This means that if there is a legal guardian who has the right to marry, then the judge guardian does not need to be used

    Peran Pemerintah Daerah Kabupaten/Kota Dalam Pengawasan Tenaga Kerja Asing di Indonesia

    Article 33 paragraph (3) of the 1945 Constitution of the Republic of Indonesia implies that the natural resources which belong to the State are used for the prosperity of the people of Indonesia. Thus, in carrying out the mandate of the Constitution to create justice for the community and national economic development of employment including foreign workers, the government should provide a good mechanism and supervision so that there will be no gap between the mandate of the constitution and the acceleration of economic development involving foreign workers. Labor inspection done by a separate working unit in the agency whose scope of duties and responsibilities is in the field of employment is in the central government, provincial government, and district/ city government. This study used a normative-empirical approach, where the researcher examined the law and its implementation regarding the roles of district/ city governments in the supervision of foreign workers. The purpose of this study was to examine the extent of the roles of district/ city governments in overseeing foreign workers in their regions. The results of the study showed that the roles of district/ city governments in carrying out the supervision of foreign workers in Indonesia were not regulated by laws of No. 23 of 2014 concerning regional government, PP No. 20 of 2018 concerning the use of foreign workers, and Minister of Manpower Regulation No.10 of 2018 concerning procedures for the use of foreign workers. Thus, its implementation made it difficult for district/ city governments to oversee the presence of foreign workers in their areas.Pasal 33 ayat (3) UUD 1945, mengisyaratkan bahwa kekayaan alam yang terkandung di dalam negara dipergunakan untuk kemakmuran rakyat, maka pemerintah dalam menjalankan amanah konstitusi. Agar terciptanya keadilan bagi masyarakat dan pembagunan ekonomi nasional lapangan kerja yang melibatkan tenaga kerja asing, haruslah ada mekanisme dan pengawasan yang baik agar tidak terjadinya kesenjangan antara amanat konstitusi dengan percepatan pembangunan ekonomi yang melibatkan tenaga kerja asing. Pengawasan ketenagakerjaan oleh unit kerja tersendiri pada instansi yang lingkup tugas dan tanggung jawabnya di bidang ketenagakerjaan pada pemerintah pusat, pemerintah provinsi, dan pemerintah kabupaten/kota. Metode penelitian ini adalah pendekatan normatif- empiris, di mana penelitian tersebut mengkaji undang-undang dan implementasinya terhadap peran pemerintah daerah kabupaten/kota dalam pengawasan tenaga kerja asing. Tujuan penelitian ini adalah untuk mengkaji sejauhmana peran pemerintah daerah kabupaten/kota dalam mengawasi tenaga kerja asing di daerahnya. Hasil penelitian menunjukkan bahwa peran pemerintah daerah kabupaten/kota dalam melaksanakan pengawasan tenaga kerja asing di Indonesia tidak diatur oleh UU. No. 23 Tahun 2014 tentang Pemerintahan Daerah, PP No. 20 Tahun 2018 Penggunaan Tenaga Kerja Asing dan Permen Ketenagakerjaan No.10 Tahun 2018 tentang Tata Cara Penggunaan Tenaga Kerja Asing.     Eco-Fiqh: Pendekatan Maslahat Terhadap Amdal dan Konservasi Lingkungan

    This study based on postulate that both maslahat and primary texts of Islam are never contaradicting essentially, where holy text is guidance for humankind for goodness of world and hereafter. Based on ‘maslahat approach’, appear idea of eco-fiqh to respond several envoronmental problems. This article aims to study about eco-fiqh which is based on maslahat approach (benefit) and analysis about environmental impact (amdal). To realize benefit of development, regulation of analysis about environmental impact must be obeyed, because it is supported by Islamic principle that “preventing the adverse effects is more prioritized than taking advantages”. Eco-fiqh guides a principle that prevention of environmental adverse effects for longer time than to take economic benefit for shorter time. Preserving the environment is prophetic doctrine and also a mainstream of Islamic doctrine which sometimes ignored. Preserving the environment is not only ‘tahsiniyat’ or ‘hajiyat’, or “dharuriyat’. Idea of eco-fiqh is an effort to put environmental conservation as mainstream of Islamic doctrine. Therefore, it brings about eco-piety beside spritual and social piety.Kajian ini berangkat dari sebuah postulat bahwa maslahat dan teks-teks primer Islam tidak pernah bertentangan secara hakiki sebab nas? suci adalah panduan bagi manusia untuk meraih maslahat di dunia dan di akhirat. Berangkat dari pendekatan maslahat, lahirlah gagasan dan konsep eco-fiqh, yaitu sebuah gagasan untuk merespons berbagai masalah lingkungan. Artikel ini merupakan studi tentang eco-fiqh yang bertumpu pada pendekatan maslahat dan analisis mengenai dampak lingkungan (Amdal) secara umum. Untuk merealisasi maslahat dalam pembangunan, aturan tentang Amdal mesti dipatuhi, karena hal itu sejalan dengan prinsip bahwa mencegah dampak buruk (mafsadah) lebih diprioritaskan daripada mengambil maslahatnya. Eco-fiqh ini memberi tuntunan prinsip pencegahan dampak lingkungan jangka panjang daripada sekadar obsesi meraih keuntungan ekonomi jangka pendek. Melestarikan lingkungan merupakan sunah dan doktrin us??l?y?t (mainstream) ajaran Islam yang sering diabaikan. Konservasi lingkungan tidak sekadar tah?s?niy?t atau h??jiy?t, melainkan dharuriyat d??ar?riy?t. Gagasan tentang eco-fiqh merupakan upaya menarik dokrin konservasi lingkungan masuk ke dalam mainstream ajaran Islam.     Menggagas Fiqh Realita Dalam Kehidupan Keagamaan di Indonesia

    This article aims to describe the significant of the sociological approach to formulate the fiqh (Islamic jurisprudence) of reality within the religious life of the Indonesian society. The study of reality is needed in the social and religious sciences, especially in the fiqh  studies because it is capable to be a natural activator of the transformation in formulating the Indonesian fiqh. The research approach used is a sociological approach. The results show that the fiqh of reality is a part of the Islamic jurisprudence that has relevance to the reality of society. In applying of this fiqh, there are needs to be an effort to contextualize of interpreting the text so that the understanding of it is not literally according to the sound of the text. In this context, the reality consists of two forms, namely: a fixed and changing reality. The fixed reality is the nature (sunnah) of Allah in this universe which has been pointed out in the Qur'an that this reality will not shift. The changing reality can be seen from the general and partial reality. The general reality is a different human tradition because of difference in the place and time, while the partial one is just for certain individual condition. The implementation of the such fiqh is necessary for the Indonesian Muslims, especially in building the harmonization of the national life.Artikel ini membahas tentang signifikansi pendekatan sosiologis untuk menemukan fiqh realita dalam menganalisis kehidupan keagamaan di Indonesia. Hal ini karena studi tentang realita sangat penting bagi ilmu sosial dan ilmu agama, terutama ilmu fiqh karena mampu menjadi penggerak transformasi yang alamiah menuju terbentuknya fiqh Indonesia. Pendekatan yang digunakan adalah dengan pendekatan sosiologis. Hasilnya menunjukkan bahwa fiqh realita merupakan fiqh yang mempunyai keterkaitan langsung dengan realita masyarakat. Dalam mengaplikasikan fiqh, perlu adanya upaya kontekstualisasi, agar pemahaman terhadap nash tidak secara harfiyah menurut bunyi teks. Dalam konteks ini, realita terdiri dari dua bentuk, yaitu: realita yang tetap dan realita yang berubah. Realita yang tetap adalah sunnah Allah di alam raya ini yang telah disinyalir dalam al-Qur’an bahwa realita ini tidak akan berganti dan berubah. Sedangkan realita yang berubah terbagi menjadi dua: ada realita yang general dan ada yang parsial. Realita yang general adalah tradisi manusia yang berbeda karena perbedaan tempat dan perbedaan masa, sedangkan realita yang parsial khusus bagi kondisi individu tertentu. Implementasi fiqh realita ini urgen bagi umat Islam Indonesia, terutama dalam membangun harmonisasi kehidupan keagamaan di Indonesia
