    Pemberatan Pidana terdahap Residivis dalam Pandangan Hukum Pidana Islam

    In criminal law theory the term repetition of a criminal act (recidive) is known. In the Criminal Code of Indonesia, recidive is a reason to increase the punishment for criminal offenders, in addition to the criminal act, the position as a civil servant and the crime of using a state flag. The concept of criminal prosecution is inseparable from the purpose of punishment itself, in general. However, the regulation in the Criminal Code of Indonesia is considered to be too complicated to make improvements. Unfortunately the Criminal Code Bill is still in the process of maturation and certainly has not been promulgated. The concept of punishment is also known in Islamic criminal law as ‘aud. This paper aims to compare the recidive concept and the ‘aud. From this study, it was concluded that first, from the aspect of equality in principle, both of them have more or less the same principles, namely: (1) the perpetrators of criminal acts must be punished based on a court decision that has permanent legal force, (2) if the criminal offender repeats the criminal act then the sentence against it can be aggravated. Second, from the aspect of the difference, for criminal offenders who have become "accustomed" to committing crimes, there is no longer a feeling of guilt when committing crimes, according to Islamic Criminal Law, perpetrators must be eliminated from people's lives with two punishment options: death sentence or imprisonment lifetime. While in positive criminal law, the provisions that apply are not always the case. However, because the principle of punishment for the ‘aud basically uses the principle of Jarimah Ta’zir, then Ulil Amri can regulate differently, according to the principle of the goal of punishment itself.   Abstrak: Pengulangan tindak pidana atau recidive dalam KUHP merupakan alasan untuk memperberat hukuman bagi pelaku tindak pidana. Namun dalam pengaturannya di  dalam KUHP dianggap terlalu rumit hingga perlu diadakan penyempurnaan, sedangkan R-KUHP masih terus dalam proses pematangan. Konsep pemberatan hukuman ini juga dikenal dalam hukum pidana islam dengan istilah ‘aud. Tulisan ini bertujuan membandingkan antara konsep recidive dan ‘aud tersebut. Kesimpulan dari tulisan ini adalah bahwa pertama, dari aspek persamaan, keduanya memiliki prinsip yang hamper sama, yaitu: (1) pelaku tindak pidana harus dihukum berdasarkan putusan pengadilan, (2) apabila pelaku tindak pidana mengulangi perbuatannya maka hukumannya dapat diperberat. Kedua, dari aspek perbedaannya, untuk pelaku tindak pidana yang “telah menjadi terbiasa” berbuat pidana, menurut Hukum Pidana Islam, pelaku harus dieliminasi dari kehidupan masyarakat dengan dua opsi hukuman: hukuman mati atau penjara seumur hidup. Sedangkan dalam hukum pidana positif, ketentuan yang diberlakukan tidak selalu demikian. Namun demikian, karena prinsip pemidanaan atas ‘aud menggunakan prinsip jarimah ta’zir, maka ulil amri dapat mengatur berbeda sesuai dengan prinsip dari tujuan pemidanaan itu sendiri

    This paper aims to analyze the existence of political party intervention in legislative drafting on regulation No 1/1974 about marriage. Political party intervention is actually contrary to responsive legal theory that is applied in the formation of regulations in Indonesia. Political party intervention can change the legal content in the formulation of legislation because there are interests that are subjective. The implication, of course the resulting legal products will not solve problems in society that have been assessed as public issues. If examined from the perspective of public policy, Government intervention is likely to occur at the policy planning stage. This is due to the process, the party as an element of political power views the importance of the values ??of flow in order to be contained in the laws discussed. The result, the regulations that have been passed are far different from the proposed bills. One example is the Marriage regulation. Debate and rejection occur in the discussion of the article 2 (1) UUP 1974. The affiliation of Islamic parties considers marriage to be a matter of worship and religious values.     To give better protection to the prospective participant of the Islamic pilgrimage (‘umrah), the Minister of Religious Affairs has just added consideration to the Consumer Protection Law in enacting the Minister of Religious Affairs’ Regulation No. 8 of 2018. According to the Consumer Protection Law, this research studies the qualification of the Islamic Pilgrimage’s prospective participant and organizer. It also looks at the recourse obtained by the prospective participants from the perspective of the consumer protection law, after the enactment of the Minister of Religious Affairs’ Regulation No. 8 of 2018. This research is using a juridical-normative approach by specifying the study in a descriptive-analytical manner. The result shows that the Consumer Protection Law’s provision qualifies the prospective participant of Islamic pilgrimage (‘umrah) as a consumer, whereby its organizer as a business actor. From the perspective of the Consumer Protection Law, the enactment of the Minister of Religious Affairs’ Regulation No. 8 of 2018 has not yet fully safeguarded the prospective participant’s interests. In conclusion, after bearing into mind that their rights have not yet wholly fulfilled, particularly at the time of departure cancellation.   Pemberlakuan PMA No. 8 Tahun 2018 dengan mempertimbangan ketentuan Undang-Undang Perlindungan Konsumen merupakan hal baru diharapkan dapat lebih memberikan perlindungan  terhadap calon jemaah umrah. Penelitian ini mengkaji bagaimanakan kualifikasi calon jemaah umrah serta PPIU berdasarkan Undang-Undang Perlindungan Konsumen serta bagaimanakah perlindungan calon jemaah umrah dalam perspektif perlindungan konsumen pasca pemberlakuan PMA No. 8 Tahun 2018. Penelitian ini merupakan penelitian yurudis normatif dengan spesifikasi penelitian deskriptif analitis. Hasil penelitian menunjukkan bahwa calon jemaah umrah dapat dikualifikasikan sebagai konsumen dan PPIU juga dapat dikualifikasikan sebagai pelaku usaha berdasarkan Ketentuan Undang-Undang Perlindungan Konsumen. Perlindungan calon jemaah umrah dalam perspektif perlindungan konsumen pasca pemberlakuan PMA No. 8 Tahun 2018 belum sepenuhnya memberikan perlindungan bagi calon jemaah umrah, mengingat pemenuhan akan hak-hak para calon jemaah umrah tidak dapat terpenuhi terlebih dalam hal terjadinya  gagal berangkatnya calon jemaah umrah

    The criminal acts that often happen in people's lives are related to a violent crime, one of which occurred in Duduk Sampean Gresik, which has the court decision. This paper aims to analyze the decision of the Gresik district court regarding the violent crime that occurred in Duduk Sampean. This paper concludes three things in this research, namely: (1) the three individuals are Muslims and they are mukallaf who are responsible for their jari>mah (Illegal act or ommission), their action is classified as jari>mah tawa>fuq so that each one is only responsible for their owns actions; (2) the imprisonment imposed by the Gresik District Court is classified as a ta'zi>r sentence which falls under the authority of ulil amri or the government even though it has been freed from the qis}a>s punishment and diyah  for getting forgiveness; and (3) the restitution received by the victim constitutes the realization of the legal liability of the offender for obtaining forgiveness

    Changes in production technology, international trade systems, and consumer lifestyles have increased the risks of the health and safety of consumers. Therefore, the government has formed the Drug and Food Supervisory Agency (BPOM) that has the responsibility and accountability in consumer protection. This paper aims to find out the duties and authority of BPOM in the context of consumer protection. The results of the study stated that there are several tasks attached to the Food and Drug Supervisory Agency (BPOM) which are based on Presidential Decree 166 of 2000. The powers are that protecting public health from the risk of circulation of therapeutic products, traditional medicines, complementary products, and cosmetics that do not meet quality requirements, safety, and efficacy, as well as food products that are unsafe and unfit for consumption. It also protects the public from the misuse of drugs, narcotics, psychotropic products, and addictive substances as well as risks due to the use of hazardous products and substances. BPOM also has the authority to conduct control, draft regulation and standardization, authorize industrial licensing and certification, product evaluation before being allowed to circulate, sampling and laboratory testing, investigation, and law enforcement

    This article aims to find out what factors cause agrarian conflicts and how to know the efforts to resolve agrarian conflicts according to agrarian law No. 5 of 1960 and the laws and regulations relating to agrarian affairs. The results of the study concluded that: first, the existence of the support of the Village Government towards Exxon Mobil Cepu Limited, lacked support from the village community in the use of village treasury land and the lack of communication established between the EMCL, the Village Government and the Village Community. And Second, Law No. 5 of 1960 which imposed a resolution through a court process and outside the court could not resolve the conflict. The new conflict can be resolved by using Regional Regulation No. 23 of 2011 concerning the acceleration of the growth of exploration and exploitation and processing of oil and gas in Bojonegoro Regency, which regulates employment, land use and Corporate Social Responsibility (CSR) programs

Untuk itulah dalam Undang-Undang No. 7 tahun 2017 Pemilu dan Undang-Undang No. 2 tahun 2008 Partai Politik perlu direvisi untuk ketentuan-ketentuan masalah mahar politik serta bentuk pertanggungjawaban pidana praktik mahar politik yang dilakukan dalam pemilu. Penelitian ini bertujuan untuk menganalisis tentang pembaharuan hukum pidana dalam Undang-Undang No. 7 tahun 2017 tentang Pemilu dan Undang-Undang No. 2 tahun 2008 tentang Partai Politik terhadap praktik mahar politik. Jenis penelitian ini, merupakan penelitian kualitatif dengan pendekatan literatur dan peraturan perundang-undangan, dengan analisis data secara deduktif. Berdasarkan hasil penelitian pembahuruan hukum pidana harus segera dilakukan terhadap Undang-Undang No. 7 tahun 2017 Pemilu dan Undang-Undang No. 2 tahun 2008 tentang Partai Politik oleh pembuat kebijakan agar praktik mahar politik yang dilakukan oleh partai politik dan calonnya dalam pemilu tidak terulang kembali, karena akan mencederai dan merusak nilai-nilai demokrasi serta kehawatiran akan timbulnya praktik KKN

    Di era digital, semua orang bebas mengemukakan pendapat dengan adanya media sosial (medsos). Namun, media ekspresi tersebut memunculkan efek negatif dengan banyaknya kasus penyalahgunaan yang dilakukan oleh para pengguna. Mereka terjebak pada kasus tindak pidana, seperti pencemaran nama baik dan ujaran kebencian. Baru-baru ini di medsos (facebook, blog) muncul perdebatan antara komunitas flat earth dan Kepala LAPAN tentang bumi bulat vs bumi datar. Masing-masing mengemukakan argumentasi ilmiahnya yang berujung pada petisi yang dikeluarkan oleh komunitas flat earth kepada Kepala LAPAN. Pada dasarnya berpendapat merupakan kebabasan yang melekat pada individu. Namun, perlu keterampilan dan aturan (etika) tentang penyampaian argumentasi ilmiah di medsos. Argumen ilmiah berbeda dengan opini atau pendapat. Ia membutuhkan klaim, bukti dan alasan ilmiah. Dalam tulisan ilmiah, penulis hanya bertujuan untuk meyakinkan pembaca bahwa yang ditulis itu benar, tidak untuk mempengaruhi pembaca untuk mengukuti keinginan penulis. Islam memberikan kebabasan kepada masyarakat untuk menyampaikan argumen/pendapat baik di dunia nyata maupun di medsos. Namun, Islam memberikan batasan terkait substansi yang disampaikan. Secara global, batasan tersebut adalah: menyajikan informasi yang bermanfaat dan terbukti kebenarannya (ada klaim, bukti dan alasan ilmiah), sebagai sarana amar ma’ruf nahi munkar, tidak melanggar aturan agama dan aturan negara, menjalin silaturrahmi dan tidak mendatangkan permusuhan
