    Tinjauan Filsafat Hukum Islam terhadap Pelaksanaan Remisi bagi Pelaku Tindak Pidana

    The paper aims to examine the perspective of Islamic legal philosophy on the implementation of Remission in terms of legal principles and justice. There are three conclusions from this article. Firstly, good behavior which is a requirement for a criminal to receive remission cannot be named as the concept of repentance in Islamic law. Secondly, the remission given to the perpetrator is not based on the principles of law and justice in Islam. Thirdly, it is suggested that Presidential Decree No. 174 of 1999 concerning Remission needs to be reviewed by distinguishing the types of crimes committed, so that justice, peace, and benefit for the community can be obtained. Even so, it should be noted that based on the philosophy of Islamic law, remission which is given to the criminals (convicts or child criminals) who have committed serious human rights crimes, corruption, drug dealers, murder, and transnational crimes, etc. is not following the principles of law, justice and benefit

    Abortion as a crime has a long story and many people do not realize that abortion is related to the public wellbeing issue. Within the Islamic's perspective, fetus removal is prohibited because it kills the fetus (human candidate) which is glorified by Allah SWT. Ironically, abortion is supported by some groups. The impact is that there are an estimated 2,000,000 cases of abortion that occur each year in Indonesia. This paper concludes that the punishment received by the perpetrators who are indirect actors comes below the term of ta'zir offense. Where the form, the amount, and the way of its sentence being carried out are under the judge's discretion. It is demanded that the authorities should be bolder and more resolute in punishing offenders so that the harsher the punishment is given, the more likely it would deter. The public is demanded to be cautious against any persuasion efforts, incitement, and other forms of influencing that made them a party in a crime

    Notary deed as an authentic deed is often used as a means of proof in a trial, because it is the most powerful and perfect. Considering the importance of a notarial deed as a means of proof, the making of a notary deed must be done properly and carefully. The phenomenon of notary that doubles the position as an advocate of course also affects the authentic deed that was made by the notary. A notary who concurrently serves as an advocate is considered to violate the provisions in the Act, so that the notary becomes unauthorized and no longer has power in making a notarial deed. That a deed which is due to the inability of the employee / official who made it or because of a defect in its form, then the deed cannot be treated as an authentic deed, and only has power as a deed under the hand if it is signed by the parties and is no longer has the power of proof that is perfect. For that, those who feel aggrieved can file a lawsuit and claim for compensation to the notary. And for violations of dual positions committed, if it is proven that the notary may also be subject to sanctions.   Akta notaris sebagai akta otentik seringkali dijadikan sebagai alat pembuktian di dalam persidangan, karena sifatnya yang paling kuat dan sempurna. Mengingat begitu penting akta notaris sebagai alat pembuktian, maka pembuatan akta notaris harus dilakukan dengan benar dan cermat. Adanya fenomena notaris yang merangkap jabatan sebagai advokat tentunya juga berpengaruh terhadap akta otentik yang telah dibuat notaris tersebut. Seorang notaris yang merangkap jabatan sebagai advokat dianggap melanggar ketentuan dalam Undang-Undang, sehingga notaris tersebut menjadi tidak berwenang dan tidak berkuasa lagi dalam membuat akta notaris. Bahwa suatu akta yang karena tidak berkuasanya pegawai/pejabat yang membuatnya atau karena suatu cacat dalam bentuknya, maka akta tersebut tidak dapat diperlakukan sebagai akta otentik, dan hanya mempunyai kekuatan sebagai akta dibawah tangan jika ditandatangani oleh para pihak dan bersifat tidak lagi mempunyai kekuatan pembuktian  yang sempurna. Atas hal itu, bagi pihak yang merasa dirugikan dapat mengajukan gugatan dan tuntutan ganti rugi  kepada notaris tersebut. Dan atas pelanggaran rangkap jabatan yang dilakukan, jika terbukti notaris tersebut juga dapat dijatuhi sanksi.Akta notaris sebagai akta otentik seringkali dijadikan sebagai alat pembuktian di dalam persidangan, karena sifatnya yang paling kuat dan sempurna. Mengingat begitu penting akta notaris sebagai alat pembuktian, maka pembuatan akta notaris harus dilakukan dengan benar dan cermat. Adanya fenomena notaris yang merangkap jabatan sebagai advokat tentunya juga berpengaruh terhadap akta otentik yang telah dibuat notaris tersebut. Seorang notaris yang merangkap jabatan sebagai advokat dianggap melanggar ketentuan dalam Undang-Undang, sehingga notaris tersebut menjadi tidak berwenang dan tidak berkuasa lagi dalam membuat akta notaris. Bahwa suatu akta yang karena tidak berkuasanya pegawai/pejabat yang membuatnya atau karena suatu cacat dalam bentuknya, maka akta tersebut tidak dapat diperlakukan sebagai akta otentik, dan hanya mempunyai kekuatan sebagai akta dibawah tangan jika ditandatangani oleh para pihak dan bersifat tidak lagi mempunyai kekuatan pembuktian  yang sempurna. Atas hal itu, bagi pihak yang merasa dirugikan dapat mengajukan gugatan dan tuntutan ganti rugi  kepada notaris tersebut. Dan atas pelanggaran rangkap jabatan yang dilakukan, jika terbukti notaris tersebut juga dapat dijatuhi sanks

    IMPLEMENTASI HAK POLITIK MANTAN NARAPIDANA KORUPSI DALAM PEMILIHAN UMUM DI JAWA TIMUR

    The right to be voted and to be elected is a human right guaranteed by the Constitution. However, there are limitations to implementation. Research on the implementation of the political rights of ex-convicts in the general election aims to address the problem; first, regulations on the rights of former corruption convicts to be elected in legislation. Second, Implementation of the rights of elected ex-convicts of corruption in the election after the decision of the Supreme Court in East Java. This research is empirical legal research or socio-legal research. The Data obtained through document studies and subsequently, the interviews analyzed with an existing legal theory with a statute approach and a case approach. Data analysis techniques are using inductive thinking patterns. The results of this study indicate that the political rights of ex-convicted corruption are guaranteed in article 28 letter D point 3 of the 1945 Constitution, and article 43 of Law No. 39 of 1999 concerning Human Rights and the Election Law, where everyone has the right to be elected and to vote in elections based on the principle of equality. However, in its implementation, there are several variants such as the General Election Commission which issued a regulation prohibiting ex-corruption convicts from running, even though the regulation was canceled by the Supreme Court. Likewise, some political parties consistently did not nominate members who have been exposed to corruption as a preventive measure in preventing corruption.   Hak untuk memilih dan dipilih merupakan hak asasi yang dijamin oleh Konstitusi. Namun demikian terdapat pembatasan-pembatasan dalam pelaksanaanya. Penelitian tentang implementasi hak politik mantan narapidana dalam pemilu bertujuan untuk menjawab permasalahan; 1. Pengaturan hak dipilih mantan narapidana korupsi dalam peraturan perundang-undangan; 2. Implementasi hak dipilih mantan narapidana korupsi dalam pemilu pasca putusan Mahkamah Agung di Jawa Timur. Penelitian ini merupakan peneltian yuridis empiris atau penelitian sosio legal research. Data diperoleh melalui studi dokumen dan wawancara selanjutnya dianalisis dengan teori hukum yang ada dengan pendekatan perundang-undangan (statute approach),dan pendekatan  kasus (cases approach). Teknik analisa data menggunakan pola fikir induktif. Hasil penelitian ini menunjukkan bahwa Hak politik mantan terpidana korupsi dijamin di dalam pasal  28 huruf  D poin 3 UUD 1945, dan pasal 43 Undang-undang No. 39 tahun 1999 tentang Hak Asasi Manusia dan Undang-undang Pemilu, dimana setiap orang mempunya hak untuk dipilih dan memilih dalam pemilihan umum berdasarkan asas persamaan hak. Namun demikian  dalam implementasinya terdapat beberapa varian misalnya Komisi Pemilihan Umum yang mengeluarkan peraturan yang melarang mantan narapidana korupsi untuk mencalonkan diri, meskipun peraturan itu dibatalkan oleh Mahkamah Agung. Demikian pula beberapa partai politik konsisten tidak mencalonkan anggotanya yang pernah terkena kasus korupsi sebagai upaya preventif dalam pencegahan tindak pidana korupsi

    NKRI Bersyariah: Praktik Spasial, Representasi Ruang, Ruang Representasional

    An alternative ideology by realizing “NKRI Bersyari’ah” which was introduced by the Islamic Defenders Front (FPI) by M. Rizieq Syihab did not come from space or emerge suddenly without a cause, but there is a historical continuation. researchers use triadic concepts such as spatial practice, representations of space, representational spaces assisted by Pierre Bourdieu's habitus, fields, and distinction as a theoretical analysis. Based on the focus of the explanation and description above, the research studied wants to operate the discussion by asking the question, Why is the Ideology of “NKRI Bersyari’ah” able to be formed and endured? The results of the analysis in this study are that the representational space of the “NKRI Bersyari’ah” departs from the history of the NKRI and was strengthened by the Presidential Decree of July 15, 1959, on the 5th Alenia, resulting in long debates from groups who fought for Indonesia as an Islamic state in the “constitutional jihad” node and the stronghold the representatives who fought for an agreement state, namely the Unitary State of the Republic of Indonesia (NKRI), were not present suddenly, but rather there was a long logic in the dialectics of the space debate. Ideologi alternatif dengan mewujudkan “NKRI Bersyariah” yang di perkenalkan oleh Front Pembela Islam (FPI) oleh M. Rizieq Syihab tidak hadir dari ruang yang kosong atau muncul tiba-tiba tanpa sebab, melainkan ada persambungan sejarah. Peneliti mencoba untuk mengambarkannya dengan menggunakan konsep triadik seperti; spasial practice, representations of space, representational spaces yang dibantu oleh habitus, field, dan distintion Pierre Bourdieu sebagai analisis teoretik. Berdasarkan fokus penjelasan dan uraian di atas, maka penelitian yang dikaji ingin mengoperasikan pembahasannya dengan mengajukan pertanyaan, Mengapa Ideologi “NKRI Bersyariah” dapat terbentuk dan bertahan ?. Hasil analisis dalam penelitian ini bahwa ruang representasional “NKRI Bersyariah” berangkat dari sejarah berdirinya NKRI dan diperkokoh oleh Dekrit Presiden 15 Juli 1959 pada alenia ke-5, sehingga perdebatan panjang dari kelompok yang memperjuangkan Indonesia sebagai negara Islam dalam simpul “jihad konstitusional” dan kubu perwakilan yang memperjuangkan negara kesepakatan yaitu Negara Kesatuan Republik Indonesia (NKRI) tidak hadir secara tiba-tiba, melainkan ada logika panjang dalam dialektika  perdebatan ruang

    This article is based on field research aims to answer the question of the influence of Islamic Law on prohibiting liquor (Tuak) towards community behavior of Boto Village in Semanding district of Tuban Regency.  It also strives to analyze the factors that contribute to mold people's behavior. The approach of this research is combining a quantitative survey and qualitative research methods, with data analysis techniques in the form of analytical descriptive. The results of the study conclude that Islamic law is incapable of fashioning the actual behavior of its adherents, especially in the village of Boto. The prohibitions of liquor (tuak) failed to stimulate the behavior of rural communities under Islamic legal norms. This is indicated by the lack of community response to Islamic legal norms. On the contrary, it is conclusively found that the behavior of the majority of people deviates from the Islamic provisions of legal norms about the prohibition of liquor (tuak)

    This article aims to find out: (1) how is witness protection in Law of the Republic of Indonesia Number 13 of 2006 and witness protection in Islamic law? The results of the study concluded that; firstly, the protection of a witness in the Law of the Republic of Indonesia Number 13 of 2006 (Article 5) explains that a witness has the right to obtain protection for his personal, family, and property security, and is free from threats relating to testimony which will, is, or has given. The meaning of protection here is the efforts to fulfill the rights and provide assistance in the sense of security to witnesses that must be carried out by LPSK (Witness and Victim Protection Agency) or other institutions per the provisions of this law. Secondly, even though the mechanism for protecting a witness is not regulated in detail, but Islam highly appreciates a witness who is willing to give testimony in the disclosure of a case, namely by forbidding killing the witness

    Analisis Mas}lah}ah al-Mursalah terhadap Hukum Pencatatan Perkawinan di Indonesia

    Marriage registration is not regulated in the provisions of Islamic law. Whereas in the present, marriage registration is an urgent need to protect the rights of a husband and wife. Then a further legal excavation was carried out taking into account the benefits in the sack. Legal excavation on the benefit of a case that is not supported by the text of the Koran and al-Hadith like this is then called mas}lah}ah al-mursalah. Marriage registration contains many benefits and can keep life between husband and wife from many difficulties. In addition, marriage registration has also been in line with the objectives of the Shari'a (maqa>s}id al-shari>’ah) which includes the maintenance of religion, life, descent, intellect and wealth. The benefit is the protection meant for the rights of the husband, wife and the status of the children they are born with. So that the application of the theory of mas} ah} al-mursalah in the recording of marriage is appropriate and fulfills the requirements. Because marriage registration is the result of extracting Islamic law through an appropriate method that meets the conditions of mas} lah} ah al-mursalah, the law of marriage registration based on a review of the theory of mas} lah} ah al-mursalah is mandatory for the people of Indonesia. The marriage registration contained in the statutory provisions must be interpreted as part of Islamic law itself

    This paper aims to find out how the legal review of remissions in murder cases, as stipulated in Presidential Decree No. 174 of 1999. Furthermore, it was concluded by the authors that: first, the crime of murder that gets remission has their respective criteria, in the sense of granting remission depending on where the sentence is, the sentence is classified as temporary or classified as a death sentence if the crime is temporary, then will get remission on condition - Certain conditions, if criminal with capital punishment, then it cannot be unless there are other provisions. Second, the procedures for implementing the remission of murder perpetrators must fulfill several conditions determined by the Presidential Decree and the Minister of Law. And third, if viewed from the Islamic criminal law the implementation of granting remissions for the perpetrators of murder is very good, because with the remission it can make someone to change their behavior and also provide an opportunity for the murderer to avoid the act again, with the aim and encouragement to back to the midst of society

    In Acehnese society, there is a tradition called hareuta peunulang, which is the practice of giving a number of assets to married girls in preparation for starting a new life with her husband. This practice is still often carried out until now, especially by people in the Pidie Regency, Aceh Besar District and parts of the West Aceh region. This practice seems to be gender-biased, which is more privileging girls and discriminating boys. This article wants to criticize the practice of hareuta peunulang grants using the theory of grants in Islamic law, with the aim of finding a contradiction between the two and offering several legal formulas to reconstruct these traditional institutions so that they are in line with the ideals of Islamic law
