    Cases of child sexual violence increased last year including recurrent sexual violence, so Indonesia Government provide chemical castration in accordance with Law Number 17 of 2016 concerning Child Protection in Article 81 paragraph (7). The Indonesian Doctors Association refuses to be the executor of the castration, because it considers it as a chemical castration not from health services and contrary to the Medical Code of Ethics. This research focus on the doctor's authorithy to executing castration. This article is normative research with statutes approach and conceptual aproach. Research result explain about chemistry catastration can not execute due to the absence of implementing regulations regarding castration execution. Execution of court decisions is the authority of the Prosecutor, but in the case of special competencies, doctors can have that authority over legal authority. It cannot replace as violation of medical code of ethics because doctor have justification reasons, otherwise castration implementation will give contribution for vulnerable children to prevent sexual violence compared to the negative effect on 1 person who disputes. Convicted (sexual violance) is person with psychological problems related to his desire to have sex with children. This needs psychological and medical intervention, so doctors intervention is not violate the medical ethics because they take appropriate precautions.   Kasus kekerasan seksual anak semakin tahun semakin bertambah termasuk kekerasan seksual berulang, sehingga negara mengambil langkah hukum dengan memberikan hukuman kebiri kimia sesuai dengan Undang-Undang Nomor 17 Tahun 2016 Tentang Perlindungan Anak pada Pasal 81 ayat (7). Ikatan Dokter Indonesia menolak menjadi eksekutor atas sanksi tindakan kebiri, karena menganggap bahwa kebiri kimia bukan dari pelayanan kesehatan dan justru bertentangan dengan Kode Etik Kedokteran. Penulis berfokus pada kewenangan dokter dalam melakukan eksekusi hukuman kebiri. Penulisan ini menggunakan metode penlitian hukum normatif dengan pendekatan perundang-undangan (statute approach), pendekatan konsep (conceptual approach). Penelitian menunjukkan bahwa eksekusi belum dapat terlaksana karena belum terbentuknya peraturan pelaksanaan tentang eksekusi kebiri. Eksekusi hukuman pidana merupakan kewenangan Jaksa, namun dalam hal komptensi khusus, dokter dapat memiliki kewenangan tersebut atas adanya perintah hukum (peraturan pelaksana eksekusi kebiri kimia). Hal tersebut tidak melanggar kode etik kedokteran karena yang dilakukan dokter memiliki alasan pembenar, selain itu penerapan hukuman kebiri memiliki kemanfaatan yang lebih besar pada sejumlah anak rawan kekerasan seksual dibandingkan dengan adanya dampak negative pada 1 orang pelaku. Selain itu pelaku kejahatan seksual berulang merupakan orang dengan kondisi psikologi yang terganggu karena keinginannya berhubungan seksual dengan anak.     The Indonesian economy is growing very rapidly. It is depicted by the emergence of numerous industries, including the print and electronic media industry or the press. At the same time, the reform period has given "freedom of the press" to its position. However, it is common for the press industry to inflict harm to the consumers. Subsequently, a legal remedy in the form of class action comes to be known. In this context, this paper is presented, which aims to find out the opinion of Islamic criminal law regarding class action against press companies according to Law Number 8 of 1999 concerning Consumer Protection. The results of the study concluded that the cause of occurrence of a class action against the press company is due to the failure which causes mass damages, including negligence of the rule of law (iqnorantia Juris), negligence of the function (iqnorantia function), negligence of information (iqnorantia infom), negligent of national philosophy (iqnorantia nation), and others. Class action against press companies occurs because of the disobedience of the laws and regulations in force

    The study aims to provide a constitutional analysis of judicial review (PK) in civil cases for more than once. The research-based is the decision of the Constitutional Court No. 108 / PUU-XIV / 2016 and No. 34 / PUU-XI / 2013 in which the two judgments provide a different classification between criminal and civil cases. The method used in this research is a normative juridical with a conceptual, legislation, and case approach. The results of the study assert that: first, the opportunity for judicial review (PK) more than once in a criminal case is an effort to uphold justice substantively by the Constitutional Court. Whereas the restriction of judicial review (PK) only once in civil cases is intended to guarantee legal certainty. Secondly, there is rational inconsistency in the arguments of the Constitutional Court which is indicated in Decision No. 108 / PUU-XIV / 2016 and No. 34 / PUU-XI / 2013. Both criminal and civil cases must seek to establish and maintain substantial justice, especially since there is a due process of law principle that requires that everyone can get the same opportunity before the law

    The Islamic world which was formerly strong and glorious has become one of the colonies of Western nations. This unquestionably impacts many countries that they are no longer want to use Islam as a form of their government, but prefer the concept of the nation (nation-state). Even among Muslims scholars, the concept of Islamic governance is still debatable and questionable. One of the Muslim scholars who concur with the idea of the Islamic government is Muhammad Yusuf Musa, a lecturer at Al-Azhar Egypt, a graduate on Philosophy at the Faculty of Humanities at the University of Paris. This paper aims to find out Muhammad Yusuf Musa's thoughts about the Islamic government. The research found that according to Muhammad Yusuf Musa, the objectives of the Islamic government are (1) maintaining God's message on earth, and (2) improving human welfare by maintaining the unity and integrity of the people, helping each other and protecting the country from aggression and tyranny. Furthermore, the administration of the Islamic government demands two things, namely justice and shura.     This study aims to determine the background and content of the District Regulation of Madiun No. 8 of 2006 concerning the Supervision and Control of Alcoholic Beverages, as well as the view of Islamic criminal law about the District Regulation. The results of the study concluded that the increasingly widespread circulation of liquor in the district of Madiun and the absence of regulations that prohibit the liquor became the reason for the enactment of Regional Regulation No. Madiun. 8 of 2006. It contains rules on prohibitions and legal sanctions against the consumption and distribution of alcoholic drinks, particularly of class B and C. Regarding the prohibitions contained in the Perda, it against Islamic criminal law due to government policies that still allow the circulation of alcoholic beverages even with very low levels. On the other hand, from the punishment aspect, the sanctions given are under the provisions of Islamic criminal law, because with the sanction it can provide lessons for deterrent and not repeat it

    This research has purpose to analyze the implementation of a simple lawsuit settlement to reduce the accumulation of civil cases in the Supreme Court. Also to analyze the constraints and obstacles in the application of simple claim resolution to reduce the buildup of civil cases and investigate the constraints and obstacles in the application of simple claim resolution to reduce the buildup of civil cases. This research is normative legal research that used the approach of statute approach and conceptual approach. The result of this research indicated that the implementation of simple lawsuit mechanismin court process could be quite helpful for citizen to settle the civil cases on state court with a quick process, simple system and low cost. In the context of implementing a simple lawsuit mechanism in court proceedings, there are several obstacles and have not maximally utilized in society, such as the minimum limit for the value of material claims is at most Rp. 200,000,000.00 (two hundred million rupiahs)

    This study aims to answer questions about the mechanism for determining penalties for late payment of Arrum Haji financing products at the Blauran Surabaya branch of Sharia Pawnshops and analysis of Islamic law both in fiqh and fatwa DSN MUI no. 43 of 2004. Sharia pawnshops are inseparable from the risk of loss, so that compensation (ta’wid) is enforced. In its implementation, Sharia Pawnshops include the amount of compensation in the contract agreement, while it is stated in the special provisions of Fatwa DSN MUI No. 43 of 2004 concerning Compensation (ta'wid) stating that the amount of compensation may not be included in the contract agreement. The results of this study indicate that the determination of the amount of compensation (ta'wid) is not fully in accordance with the legal requirements of ta'wid if the losses incurred are not due to real losses and only in the form of losses that are only estimated, as well as regarding penalties for late repayment of financing. or what is known as ta'wid (compensation) according to the fatwa DSN-MUI No. 43 of 2004, this practice is not appropriate because the fatwa is not allowed to state the amount of compensation/fines for losses or damages. customer negligence, but in practice Sharia Pawnshops include the amount of compensation in the contract

Data is obtained through questionnaire to respondents in the year 2015-2017 with non-probability sampling techniques, namely incidental sampling technique.     Studi konseptual ini fokus terhadap 2 (dua) permasalahan pokok. Pertama, kebijakan hukum tentang bantuan hukum di Indonesia. Kedua, kebijakan hukum tentang bantuan hukum untuk pemberantasan korupsi di Indonesia. Kini, kebijakan hukum tentang bantuan hukum di Indonesia dapat dijumpai dalam Undang-Undang Republik Indonesia Nomor 16 Tahun 2011 tentang Bantuan Hukum beserta aturan pelaksanaannya. Kebijakan hukum tersebut dipandang lebih konkrit dan menjamin aspek pemenuhan hak atas bantuan hukum bagi masyarakat yang tidak mampu. Kebijakan hukum tentang bantuan hukum di Indonesia memungkinkan untuk dilakukan oleh advokat, paralegal, dosen, dan mahasiswa. Pada perkembangannya kemudian, kebijakan hukum tentang bantuan hukum dapat dimaksimalkan untuk upaya-upaya pemberantasan korupsi di Indonesia. Kegiatan pemberian bantuan kepada masyarakat tidak mampu tidak hanya sebatas pendampingan atau penyelesaian perkara di pengadilan (litigasi), tetapi juga dapat diberikan secara nonlitigasi. Ambil contoh, misalnya, dosen dan mahasiswa yang tergabung dalam organisasi bantuan hukum yang terverifikasi dan terakreditasi oleh pemerintah dapat melakukan penelitian hukum sebagai bagian dari kegiatan pemberian bantuan hukum untuk masyarakat yang tidak mampu. Hasil penelitian hukum tersebut, paling tidak, memuat monitoring dan evaluasi terhadap kebijakan hukum pemberantasan korupsi di Indonesia. Berawal dari hasil penelitian hukum tersebut, selain masyarakat tidak mampu mendapatkan haknya untuk mendapatkan informasi hukum, pemegang dan pemutus kebijakan mendapatkan rekomendasi-rekomendasi pembaruan kebijakan hukum untuk lebih memaksimalkan upaya-upaya pemberantasan korupsi di Indonesia

    The understanding of crime in the Islamic economic perspective, in various dimensions both prevention, curative prevention and rehabilitation have differences with other economic systems. But there are still many similarities in the viewpoints of economic crime that exist such as the foundation, the purpose of evil. Prevention of crime is related to the awareness of the individual, the community, the source of the law applied, the readiness of the community in the application of the law. Implementation of the law as a whole is a state obligation with all legal instruments that exist in the country, such as apparatus, judiciary. Inherent inspiration, belief in the unseen is very instrumental in the implementation of the law in Islam. This is almost nonexistent in a secular legal system, especially in the economy. Supervision inherent in the Islamic economic system is very instrumental even has become a key element since the Islamic shari'ah triggered. Islam is the best solution for the prevention of economic crimes of society, nation and state with the existence of a well-documented prevention system. If implemented in earnest then will terbuki Islam can be used as a solution for various kinds of economic crimes.Pemahaman kejahatan dalam perspektif ekonomi Islam, dalam berbagai dimensi baik secara pencegahan, pencegahan kuratif dan rehabilitasi mempunyai perbedaan dengan sistim perekonomian lain. Akan tetapi masih banyak persamaan sudut pandang dalam tindak kejahatan ekonomi ada seperti landasan, tujuan kejahatan. Pencegahan kejahatan terkait dengan kesadaran individu, masyarakat, sumber hukum yang diterapkan, kesiapan masyarakat dalam penerapan hukum tersebut. Penerapan hukum secara keseluruhan merupakan kewajiban negara dengan seluruh perangkat hukum yang ada pada negara tersebut, seperti aparat, peradilan. Pengawassan melekat, kepercayaan kepada yang ghaib sangat berperan dalam pelaksanaan hukum tersebut dalam Islam. Hal ini hampir tidak ada sama  sekali dalam sebuah sistim hukum sekuler, terutama dalam perekonomian. Pengawasan melekat dalam sistim perekonomian Islam sangat berperan bahkan telah menjadi unsur utama sejak syari’at Islam dicetuskan. Islam adalah solusi terbaik bagi pencegahan kejahatan ekonomi masyarakat, bangsa dan negara dengan adanya sistim pencegahan yang tertatan rapi. Apabila dilaksanakan secara sungguh-sungguh maka akan terbukti Islam dapat dijadikan solusi bagi berbagai macam kejahatan ekonomi. Kata Kunci: Tinjauan Islam, Kejahatan, Ekonom
